1 HELSINKI COMMISSION HELCOM RESPONSE 13/2010 Response Group 13th Meeting St. Petersburg, Russia, October 2010 Agenda Item 11 Detection, investigation and prosecution of offenders of anti-pollution regulations 11.1 Aerial surveillance Document code: 11.1/1 Date: Submitted by: Secretariat MINUTES OF THE MEETING OF THE HELCOM INFORMAL WORKING GROUP ON AERIAL SURVEILLANCE (IWGAS), HAMBURG, GERMANY, 9-10 MARCH 2010 The Meeting is invited to take note of the attached outcome of the annual meeting of the Informal Working Group on Aerial Surveillance (IWGAS) held in Hamburg, Germany, on 9-10 March 2010, and more specifically: - to note that EMSA offered to deliver yearly statistics on satellite surveillance for table 2 of the report on illegal discharges on annual basis by 15 February (Para 3.13); - to endorse IWGAS decisions and conclusions regarding Super CEPCOs in the Baltic Sea (Paragraphs ), including that: Super CEPCOs are a good way forward for joint surveillance operations in the Baltic Sea; the frequency of Super CEPCOs in the Baltic Sea needs to take into account the organization of such operations in other regional agreements; they are to be organized on a voluntary basis, and that the regular CEPCOs will continue to be organized unless there is an offer by any of the HELCOM countries to conduct Super CEPCO; for each Super CEPCO a preparation team should be established, consisting of a country who organized Super CEPCO previously and the host country, with the aim of utilizing the existing experience and sharing the planning effort. The Bonn Agreement countries outside the Baltic Sea region could also be requested for assistance; - to consider the issue of having common understanding and harmonized legislation regarding certain aspects of operating in each other s waters (such as. dropping sample buoys and life rafts from aircrafts), to be possibly discussed with ENPRO (Paragraph 7.1). Additionally, Poland and Finland are invited to inform on their possibilities to organize Super CEPCO in 2011 (Paragraph 5.10). 3 MINUTES OF THE MEETING OF THE INFORMAL WORKING GROUP ON AERIAL SURVEILLANCE (HELCOM IWGAS) INTRODUCTION 0.1 The annual meeting of the Informal Working Group on Aerial Surveillance was held in Hamburg, Germany, on 9-10 March The Chairman, Mr. Dirk Reichenbach, Germany, opened the Meeting and welcomed the participants. 0.3 The Meeting was attended by Delegations from all the Contracting Parties to the Helsinki Convention except Latvia and Lithuania as well as by an invited guest from the Secretariat of the Black Sea Commission. The List of Participants is attached as Annex Ms. Monika Stankiewicz, Professional Secretary of HELCOM, acted as secretary of the Meeting. Agenda Item 1 Opening of the Meeting and Adoption of the Agenda Documents: 1/1 1.1 The Meeting adopted the Agenda as contained in Annex 2. Agenda Item 2 Matters arising from meetings of HELCOM Response Group and ongoing HELCOM work Documents: 2/1, 2/2 2.1 The Meeting took note of the decisions by the Eleventh Meeting of the HELCOM Response Group (HELCOM RESPONSE 11/2009) held in Stockholm, Sweden, September 2009 (document 2/1), and of the Minutes of the Twelfth Meeting of the HELCOM Response Group (HELCOM RESPONSE 12/2010) held in Helsinki, Finland, February 2010 (document 2/2), and decided to consider the specific topics of relevance to IWGAS under the relevant Agenda Items. 2.2 The Meeting referred to the request by KIMO International at HELCOM RESPONSE 11/2009 that IWGAS review the work undertaken in BONN on aerial surveillance guidance in relation to MARPOL Annex V infringements. The Meeting took note of the information by the Chairman that even though the BONN Aerial Surveillance Handbook includes a recommendation to report findings on pollution covered by Annex V, it does not give any specific guidance for dedicated missions to survey garbage discharges from ships. 2.3 The Meeting took note of the information by Sweden on the ongoing research project by the Gothenburg University to develop equipment to measure ship emissions to be installed on one of the Swedish aircrafts. 2.4 The Meeting took note of the information by EMSA on training on aerial surveillance and satellite monitoring to be organized by the Netherlands with support of EMSA during the next year. 2.5 The Meeting took note of the information by the Secretariat on the joint submission by the Baltic Sea countries to IMO to designate the Baltic Sea as a control area under Annex IV of MARPOL 73/78. Such a designation would impose a ban on sewage discharges from passenger ships in the Baltic Sea unless sewage has been treated to remove nutrients. Page 2 of 15

4 Agenda Item 3 National activities and aerial and satellite surveillance reports Documents: 3/1, 3/2, 3/2/Rev The Meeting took note of the information by Sweden on their national surveillance activities, including that: - there is a positive trend in the number of detected spills by Sweden, - Sweden attended an oil on water exercise in Norway, - due to a mission outside the region, Sweden will operate with decreased resources until late June Denmark presented the results of their surveillance flights. 10% less observations of spills from ships have been made comparing to The Meeting took note of the information by Germany on their surveillance activities in 2009 (Presentation 1), including some difficulties with the engine of one of the German aircrafts and maintenance of another aircraft. Germany participated in an oil on water exercise in the Dutch Exclusive Economic Zone (EEZ). 257 flights were carried out in the Baltic Sea in There were 15 pollution detections in German waters and EEZ, amounting to approximately 1.9 m 3 of oil, and only one polluter has been identified (in Danish EEZ). Pollution per Flight Hour (PF) index is decreasing. 3.4 The Meeting further took note that Germany will renew their fleet. The refit of cockpit and propeller of the aircraft will start during summer this year in connection with general maintenance. This will result in reduced availability of German aircraft in the second half of 2010, meaning also limitation of participation at any international flight events. Germany also made a call for tender for replacement of the aircraft. 3.5 The Meeting took note of the information by EMSA on the ongoing pilot project to integrate SeaTrackWeb (STW) to CleanSeaNet (CSN), to be launched in April The aim of the project is to simplify model set up for backtracking and forecasting to give possibility for a quick overview for operators. STW in national systems still needs to be run to have more detailed information. 3.6 The Meeting took note of the information by Finland about their surveillance activities, including modification of surveillance equipment in two Dornier aircrafts finalized in July and November last year (Presentation 2). Some further renewal of equipment is planned for The number of detections is going down. The number of flight hours decreased due to renewal of aircraft and a mission abroad. Three polluters have been identified, including one case in the Estonian waters. 3.7 Estonia presented their surveillance activities (Presentation 3) and informed that the number of flights had decreased from four to two times per week from June 2009 due to financial constraints. Out of 18 satellite detections, two oil spills have been confirmed. Cooperation with Finland has been strengthened. Estonian aircraft overhaul is planned. In 2010 the merging process of Border Guard with Police forces has been finalized. 3.8 Poland reported more flight hours and detected spills (Presentation 4). One polluter was caught red-handed. Upgrade of MSS on Polish aircraft to the new version MSS 6000 is on the way. The contract with Swedish Space Corporation is expected to be finalized in mid The Meeting took note of the information by Russia that the national programme of the HELCOM Baltic Sea Action Plan implementation in Russia is being developed for presentation at the HELCOM Ministerial Meeting on 20 May 2010, Moscow. The draft programme includes provisions on actions to start up surveillance for spills in Russia, including training of personnel. Some equipment to detect spills is available in Russia and has been flight-tested. Page 3 of 15

5 3.10 The Meeting concluded that surveillance activities in the Baltic Sea bring the result and less and less spills are detected The Meeting took note of the annual 2008 HELCOM report on illegal discharges observed during aerial surveillance (document 3/1) The Meeting took note of the presentation of the draft annual 2009 report on illegal discharges observed during aerial and satellite surveillance (document 3/2 and 3/2/Rev.1, Presentation 5) and noted with satisfaction the increased surveillance activities by the countries as well as the decreased overall number of oil spills in the Baltic Sea The Meeting noted the discrepancy between the satellite statistics reported by the European Maritime Safety Agency (EMSA) and those reported by the countries via the HELCOM web reporting system and welcomed the offer by EMSA to deliver yearly statistics for table 2 of the report on illegal discharges on annual basis by 15 February. The Meeting requested EMSA to provide the satellite statistics for the 2009 report to the Secretariat by 19 March The Meeting requested the Secretariat to make the following corrections to the draft report: Finland is to be listed among the countries who reported fewer flight hours in 2009 comparing to 2008, German spill 8 instead of 9 should be removed from the report, as it is an observation made during a clean-up operation The Meeting requested Sweden to confirm whether the spills reported by Sweden include also all the spills detected during Super CEPCO 2009 and to inform the Secretariat accordingly by 15 March Taking into account the above changes to be made, the Meeting approved in principle the 2009 report on illegal discharges observed during aerial and satellite surveillance with the view of submitting it for the final approval to the contacts of HELCOM RESPONSE and HELCOM MARITIME The Meeting discussed the spills coding and how to distinguish, based on unique spill IDs, between the own observations and those made by another country in a given country s EEZ, and concluded that this could be solved by adding an additional column in the report to flag detections made by other countries. This addition to the annual reporting format would also be in line with the change made by the Bonn Agreement (cf. document 8/1). The Meeting requested the Secretariat to implement the change to the HELCOM web reporting. Agenda Item 4 Outcome of Super CEPCO Baltic Sea 2009 Documents: 4/1 4.1 The Meeting took note of the outcome of the HELCOM Super CEPCO 2009 conducted in Visby, Sweden, September 2009 and of the feedback received from the participating countries (document 4/1), including that: - having a debriefing day with the invited experts and observers would be of added value; - Super CEPCO is more convenient than normal CEPCO from an operational point of view; - route length should always be considered; - satellite communication should be a standard; - presence of experts / observers could be utilized to a greater extent. 4.2 The Meeting discussed the lessons learnt from the operation and thanked Sweden for hosting it and Finland for assisting in the planning process. 6 Agenda Item 5 CEPCO operations 2010 Documents: None 5.1 The Meeting welcomed the information by Estonia on their readiness to host the CEPCO North in the latter part of 2010 and by Finland on the arrangement of a mini CEPCO between Finland and Sweden during week 27 of The Meeting also welcomed the organization of a mini CEPCO by Denmark in The Meeting regretted that there are no plans for conducting a CEPCO in the southern Baltic Sea in 2010 and noted that this is due to aircrafts temporary non-availability and financial constrains. 5.4 The Meeting discussed how Super CEPCOs could be organized in future, and in principle agreed that Super CEPCOs are a good way forward for joint surveillance operations in the Baltic Sea. 5.5 The Meeting noted that in addition to the Bonn Agreement also REMPEC has become active in this field and concluded that the frequency of Super CEPCOs in the Baltic Sea needs to take into account the organization of such operations in other regional agreements, and especially in the Bonn Agreement, to ensure that there are no overlapping events. 5.6 The Meeting considered the idea of hosting Super CEPCOs by countries in an alphabetical order according to a fixed frequency. While some benefits of such a solution could be seen, the Meeting did not find the idea useful due to economic and operational reasons. 5.7 The Meeting decided not to come up, for the time being, with any fixed time schedule for Super CEPCOs in the Baltic Sea and agreed that they are to be organized on a voluntary basis. The regular CEPCOs will continue to be organized unless there is an offer by any of the HELCOM countries to conduct Super CEPCO. 5.8 The Meeting agreed that for each Super CEPCO a preparation team should be established, consisting of a country who organized Super CEPCO previously and the host country, with the aim of utilizing the existing experience and sharing the planning effort. The Bonn Agreement countries outside the Baltic Sea region could also be requested for assistance. 5.9 The Meeting discussed the issue of sharing the costs of Super CEPCOs and concluded that those costs should be dealt with in a similar way as during CEPCOs The Meeting welcomed the offer by Poland and Finland to investigate their possibilities, in cooperation with other countries, to organize Super CEPCO in 2011 and requested Poland and Finland to inform the Secretariat accordingly as soon as possible, by HELCOM RESPONSE 13/2010 at the latest The Meeting also took note of the information that Denmark will consider organizing Super CEPCO in The Meeting noted that the three HELCOM countries being also the Bonn Agreement parties have so far ensured sufficient information exchange on the aerial surveillance operations planned in both seas, and invited these countries to continue to function as the information channel. Additionally, the Meeting requested the Secretariat to be in contact with the BONN Secretariat regarding plans for surveillance operations. Agenda Item 6 Use of satellite images Documents: 6/1 6.1 The Meeting took note of the information by the Chairman on the recent meetings of the European Group of Experts on satellite Monitoring and assessment of sea-based oil Page 5 of 15

7 Pollution (EGEMP 11 (3-4 June 2009) and EGEMP 12 (24 November 2009)), including the publishing of a JRC paper on confidence levels and discussions on the future of EGEMP to be decided in June 2010 at the next EGEMP Meeting. 6.2 The Meeting took note of the information by the Black Sea Commission on the three-year MONINFO Project aiming at, e.g., extending the use of CleanSeaNet to all Black Sea countries. 6.3 The Meeting took note of the presentation by EMSA on the Agency s satellite surveillance activities, including the CleanSeaNet 2 nd generation (Presentation 6). 6.4 The Meeting noted with satisfaction the high rate (58%) of verifications of satellite detections in the Baltic Sea area. 6.5 The Meeting took note that the training on the new functionalities and structure of CSN2 can only take place after the CSN Data Centre is fully tested and running. The training for three persons per coastal state has tentatively been scheduled for 1 st /2 nd week of November The Meeting took note of the EMSA interest to receive from the CSN users more information and feedback on administrative or judicial follow-up, figures on Port State Control (PSC) inspections and/or prosecution of identified polluters as a result of CleanSeaNet alerts. 6.7 The Meeting noted that such information is difficult to obtain, as prosecution of polluters is usually dealt with by other authorities than those carrying surveillance activities and no feedback on legal proceedings is received on regular basis. Moreover, as long as the case is in court, no information on the spill can be disclosed. Additionally, the Meeting pointed out that the number of Port State Control inspections as follow-up of the detected spills is not indicative of surveillance system efficiency as, e.g., in some cases PSC need not to be initiated due to sufficiency of the collected evidence. 6.8 The Meeting took note of the information by EMSA: - on the high level of cancellations in October 2009 / February 2010 due to an issue with the ESA notification system that failed to inform EMSA of conflicts beforehand, preventing the re-planning of images. This problem is now being solved. - that on the 22 October 2010 ENVISAT will suffer an orbit change which will result in at least 2-3 weeks of expected down time and re-calibration. CSN will only rely on RS1 and RS2 for this period, and the ability to meet current coverage requirements for this period will most likely be affected. 6.9 The Meeting positively responded to the EMSA request to plan satellite images more in advance and to have longer planning periods starting from 2011 and onwards. The aim is to reduce the conflicting orders and make the planning process easier to manage. The Meeting pointed out, however, that the system should be flexible enough to accommodate additional needs and make cancelations, e.g., related to the CEPCO operations, emergency operations or aircraft non-availability The Meeting welcomed the information that CSN2 will have an automated notification function in case the image has not been ordered or has been cancelled The Meeting recalled the request by IWGAS 2009 to EMSA to consider a delivery on a monthly basis of an overview of satellite statistics for the whole Baltic Sea, including the feedback on a follow up action taken. EMSA informed that for the time being there is no possibility for having monthly statistics, and that CSN2 will make them available The Meeting suggested EMSA to make sure that the CSN technical reports and maps are always accompanied with the sufficient description explaining the nature of statistics in order to ensure correct interpretation of the information The Meeting noted that EMSA has been recently requested to produce a satellite coverage density map to show which areas are covered by more intensive monitoring and that this request is being dealt with within a separate EMSA project. 8 6.14 The Meeting discussed future operational needs for satellite surveillance coverage in the Baltic Sea on the basis of the agreed revised operational satellite coverage requirements (document 6/1) and agreed that there is no need for any changes The Meeting took note of the information by EMSA that in October and November 2010 there might be some problems in delivering the agreed number of images due to ENVISAT orbit change (cf. Paragraph 6.8) The Meeting referred to the proposal by the BRISK Project related to subregional agreements as contained in document HELCOM RESPONSE 12/2010 5/1, which included the suggestion to consult IWGAS regarding sub-regional cooperation on aerial surveillance and took note of the information by the Secretariat that HELCOM RESPONSE 12/2010 did not put any requests to IWGAS Agenda Item 7 Proposals for HELCOM Response Group Documents: None 7.1 The Meeting decided to bring to the attention of the HELCOM Response Group the issue of operating in each other s waters and legislation to drop sample buoys and life rafts from aircrafts. For practical reasons it would be beneficial to have common understanding and harmonized legislation in this regard. The Meeting suggested that this issue could be discussed with the Network of the Prosecutors on Environmental Crime (ENPRO). Agenda Item 8 Other business Documents: 8/1, 8/2, 8/3, 8/4 8.1 The Meeting took note of the information on some changes to the Annual reporting format for aerial surveillance proposed by OTSOPA 2009 Meeting (26-28 May 2009, Rotterdam, Netherlands) (document 8/1), and agreed on introducing those changes to the HELCOM web reporting (cf. Paragraph 3.17). 8.2 The Meeting considered the proposal by Denmark for a Diplomatic Clearance Matrix Annex in the Bonn Agreement Aerial Surveillance Handbook (document 8/3). The idea behind the proposal is to include in the Handbook information on what information needs to be submitted to obtain diplomatic clearance for oil pollution flights, where to send it and what is the diplomatic clearance content for each country of the Bonn Agreement and HELCOM. 8.3 The Meeting encouraged all countries to be able to give annual diplomatic clearance for environmental surveillance. 8.4 The Meeting concluded that it would be of added value to have information beforehand describing what actions crews can take when a slick is detected in another country s EEZ. The Meeting noted that the content of diplomatic clearance is different between the countries and could be different depending on which nation applies for it. 8.5 The Meeting requested the Contracting Parties to submit to the Secretariat information on 1) how to apply for diplomatic clearance for oil surveillance in their country by the end of May 2010 and 2) operational conditions from a granting country towards aircraft crews by 31 December The Meeting requested Denmark in cooperation with the Secretariat to prepare a document based on the information received for consideration by the next meeting of IWGAS. 8.6 The Meeting stressed that the information under point 1 should contain a copy of the format to request for diplomatic clearance if such exists, what information needs to be filled in and guideline how to do this, and if general or specialized (environmental surveillance, SAR, transport) diplomatic clearance is granted. 8.7 The Meeting agreed that pending the discussion by IWGAS 2011, the information on diplomatic clearance would be included in the HELCOM Response Manual. 9 8.8 The Meeting took note of the presentation by Germany on the RG-mod Code which is a description system for merchant ships (document 8/4, Presentation 7). Germany is planning to bring it into use. Merchant ships differ very much in their individual appearance, and the use of RG-mod Code can facilitate identification of ships. The code now contains 5 designators: I. Ship type designator, II. Ship sub-type designator, III. Cargo handling designator, IV. Superstructure designator, and V. Funnel designator. 8.9 The Meeting requested the Contracting Parties to provide feedback on the RGmod Code to Germany ( addresses are indicated in the document), including on its usefulness and any modification needed The Meeting took note of the information by Denmark on optimization of environmental flights in Danish waters based on aircraft ability to detect oil and presumed number of spillages (Presentation 8). From now on Denmark will fly only in day light through the whole year round, and especially in spring and summer time, and will reduce flight hours from 500 to 450 hours per year due to increased flight speed. New flight schemes will be tested in The Meeting took note of the information by Finland that the pollution observation log has been integrated into the surveillance system and invited Denmark to lead the updating of the log from now own The Meeting took note of the list of contact persons for IWGAS (document 8/2) and updated the list (Annex 3). Agenda Item 9 Next chairing country Documents: 9/1 9.1 The Meeting welcomed the nomination of Mr. Juris Skrube, Latvia, as a Chairman of IWGAS for the next two years ( ) (document 9/1). Agenda Item 10 Next Meeting Documents: None 10.1 The Meeting invited Latvia to come up with the dates for the next meeting of IWGAS to be agreed with the Contracting Parties via correspondence. Agenda Item 11 Outcome of the Meeting Documents: None 11.1 The Meeting adopted the draft Minutes of the Meeting. The final Minutes will be prepared by the Secretariat in consultation with the Chairman.
