2 TCDLA Executive Committee MINUTES Saturday, December 5, 2015 Wyndham Hotel Austin, Texas Introduction Sam Bassett, President calls the meeting to order at 9:26 am. A quorum was present. Roll Call: P Sam Bassett, President PJohn Convery, President-Elect P David Moore PMark Snodgrass PKerri Anderson-Donica PGrant Scheiner PMichael Gross PSusan Kelly PDanny Easterling PTim Evans Key: P = Present; E = Excused Absence; A = Unexcused Absence Staff: Joseph Martinez, Melissa Schank, Rick Wardroup, Mari Flores MOTION: September 12, 2015, Minutes Approve minutes from September 12, 2015, Executive Committee Meeting in Dallas. Motion made by Mark Snodgrass, seconded by Kerri Anderson-Donica motion carries. President s Report, Sam Bassett General Counsel Position General Counsel interviews have been conducted. All candidates are well qualified. Sam has talked to Mark Daniel and Allen Place. Sam also suggests some of the other candidates as contract lobbyists for TCDLA if a position opens. The committee would like to have a civil lawyer review the grant guidelines regarding a portion of time charged to the grant. The committee would like to have a process prior to hiring anyone in place - office, integrated with staff, outline if there will be a downtown or in house office and if what grant will pay, longevity and continuity.sam would like to move forward and be expeditious with the issues. He would like to come up with answers by January or February. Executive committee members will come to Austin to meet with lead candidate December or January. TCDLA Membership Status While Serving as a Prosecutor Adam Kobs has reviewed and the Bylaws do not address. Discussion was had, a suggestion was just to recuse them from voting or have them self-recuse on any issues as a potential conflict, list serves etc. Discussion was held about possibility of suspending memberships. Executive Committee
3 Consensus was board members trust everyone s good judgment and suggest self-recuse and deal with them on a case-by-case basis as needed. Trial College Issue Emmanuel Obdi would like TCDLA to assist with his litigation regarding racial discrimination during the 2015 Trial College at Sam Houston State University. TCDLA has asked SHSU for its version of the events and the recording. Since Emmanuel has filed suit, SHSU is not releasing any information. Sam has exchanged s and phone messages and suggests we remain neutral until the litigation is complete. Forensics Advisory Board Commission TCDLA has submitted four names and resumes as requested. Names submitted were Mark Daniel, Deandra Grant, Keith Hampton and Mark Thiessen. Executive Director Report, Joseph Martinez DWI CLE Schedule A conference call was held resulting in keeping schedule as is for FY16 for DWI seminars. Grant gave a verbal report, emphasizing the need to try to keep TCDLA s seminars away from one another on the calendar, as well as geographically within the state report. Exploring options to move Top Gun DWI from August to September. Changes will be made to FY17. A suggestion was made to have a board meeting in conjunction with a DWI seminar. The committee discussed DWI competing organizations and the impact. Meeting with HCCLA Joseph will meet with HCCLA to see how TCDLA can coordinate and cosponsor with HCCLA. Grant has sent an to HCCLA leadership to coordinate moving forward in the future. Profit Sharing with Affiliates Joseph will have a call in the upcoming few weeks. Joseph gave credit to John Convery for coming up with this idea. Code Books Update We have identified there are some sections that have not been updated in the Code Books. The Code Books have been updated by an intern overseen by Cynthia Orr. We have been trying to contact Cynthia Orr who may have the corrected file on her laptop; her father has just passed. We have notified all who have purchased that we will send corrections. Rick has identified 80% of errors. Rick can make the updates if needed to have this corrected immediately. The cost of the book printing was $5600. MOTION: Motion made to start corrections now and eat cost of the book reprint made by John Convery, seconded by Kerri Anderson-Donica motion carries. Long Range Committee, Ed Mallett Ed has a new committee which includes Sam Bassett, Stephanie Patton, Bill Harris, Grant Scheiner and Marjorie Bachman. The committee is to update the last Long Range Plan and come Executive Committee
4 up with new ideas. Sam reported TCDLEI is taking a new direction for fundraising. Sam would like David Guinn to be a part of the committee. Ed will have a full report at the next Board meeting. Voice for the Defense Name The Pennsylvania Criminal Defense Lawyers Association has submitted a legal agreement requesting use of the name For the Defense. We will have a copyright lawyer review the agreement and give us a legal opinion. If approved we may ask for a minimal contribution from the PCDLA. Old Business No old business at this time. MOTION: Adjourn Meeting Motion to adjourn meeting at 10:11am was made by Mark Snodgrass, seconded by Susan Kelly - motion carries. 33 TCDLA Death Penalty Committee Report by Katherine Scardino & Kathryn Kase January 25, The Year in Review Texas tried only eight death penalty cases in 2015, which is down significantly from prior years. Prosecutors obtained only three new death sentences and one death re-sentence for a penalty retrial in 2015; four cases ended in life-without-parole sentences. Technically, one of the cases ending in death that of Mark Anthony Gonzalez (Bexar County) was not complete because the defense team raised a competency claim that the trial judge delayed deciding until January 2016, but allowed the punishment phase to go forward. Texas also had four life-without-parole sentences at trial. This is down from 11 new death sentences in 2014 and is the lowest number of death sentences since 1999, when Texas sent a historic high (post-furman) of 48 people to death row. Significantly, Harris County, the state s most prolific user of the death penalty, sent no new prisoners to death row. The one death penalty trial in Harris County involving a new defendant, Johnathan Sanchez, ended with jurors returning a life-without-parole sentence. A punishment retrial for Billy Mason in Harris County ended in a re-sentence to death, which accords with the 99 percent re-death-sentence rate for capital retrial cases that go to juries. Texas executed 13 prisoners in 2015, up from 11 in 2014, and for a total of 531 executions post- Furman. Also, the Court of Criminal Appeals and the federal courts issued 14 stays or modifications of the execution date Trials The year began with a finding in Bexar County that Mark Anthony Gonzalez had been fit to proceed to the punishment phase of his death penalty trial in Fall Accordingly, Gonzalez was formally sentenced to death by Bexar County District Court Judge Mary Roman. Jury selection also began for the death penalty trial of Charles Brownlow in Kauffman County. Seven more death penalty trials are scheduled for the first quarter of Executions There are 251 men and women on Texas death row. The first execution of 2016 was carried out on January 20 with the lethal injection of Richard Masterson, bringing Texas to a total of 532 executions post-furman.

36 CORRECTIONS AND PAROLE COMMITTEE REPORT TCDLA s Corrections Committee is assisting the State Bar of Texas Legal Services to the Poor in Criminal Matters Committee in conducting an investigation into the operations of State Counsel for Offenders. The goal of the investigation is to determine if State Counsel complies with the ABA s Ten Principles of a Public Defense Delivery System and if reforms to the system of defending indigent prisoners accused of crimes are warranted. A report and recommendations are scheduled to come out in March. The Corrections Committee has assisted in developing a survey instrument for current and former State Counsel staff and others who are familiar with State Counsel s operations and is gathering information about State Counsel s operations.
