1 1 A regular meeting of the Malone Town Board was held Wednesday July 13 th 2011, at the Malone Town Offices, 27 Airport Rd., Malone, NY, commencing at 6:00pm. PRESENT: Supervisor Howard Maneely Deputy Supervisor Paul Walbridge Councilor Louise Taylor Councilor John Sullivan Councilor Mary Scharf ALSO PRESENT: Susan Hafter, Town Clerk Andrea Stewart, Budget Officer/Bookkeeper Lillian-Anderson Duffy, Town Attorney Mark Besio, Highway Clerk Hugh Hill, Malone (C of C) Brooks Washburn, AIA, Potsdam Dan Clark, Malone Joy Brody, Malone Sam Brody, Malone Tricia Livernois, Malone Telegram CALL TO ORDER: At 6:00 pm, Supervisor Maneely called the meeting to order with a Pledge to the Flag. The Supervisor welcomed Telegram reporter, Trisha Livernois, who will now be covering town meetings. PLANNING BOARD RECOMMENDATION: Cerebral Palsy of the North Country has developed plans for a building at the town I.D.A. Park. Plans have been reviewed by Planning and IDA boards. Resolved (# ): that the Malone Town Board approves plans, as presented by Cerebral Palsy of the North Country, for a building to be constructed at the Malone IDA Park, with access/egress to be built to both Valco Drive and Creighton Road, as approved by the Town IDA Board and recommended by the Malone Town Planning Board. PRESENTATION TO BOARD: Hugh Hill and Dan Clark reported to the board regarding some activities and projects currently underway through Community Renewal/Revolution ( Re-greening Malone is one effort underway and involves working with local nurseries to make trees available at affordable prices. Malone business owners and residents are challenged to plant and care for 500 trees over the next two years, with the assistance of the growers. Another topic of concern is removal of blighted buildings from the community. The biggest costs are in dealing with asbestos and disposal of demolition debris. The Community Renewal group is working to find solutions for both problems, hopefully with assistance from Franklin County as well as town and village governments. Along with the Complete Streets Committee, the community renewal group looking for solutions to pedestrian danger and traffic congestion in the village center; based on relatively easy to achieve changes such as narrowing of traffic lanes, inclusion of bike lanes, better road marking and sineage. An effort to ease the tax burden on property owners who are improving their properties is also under discussion. Related to these efforts are community events designed to restore and promote community pride, such as an Arts Festival to be held this summer at Arsenal Green. Mr. Hill asked for Town Board support of all these initiatives and in the case of removal of blight, asked for a resolution similar to the one passed by the Village Board. * Motion Deputy Supervisor Walbridge Second Councilor Scharf Resolution # Removal of Blight WHEREAS, there are many residential and commercial buildings in and around the Town of Malone that are dilapidated to the point where they cannot be salvaged and pose a threat to the safety of the community; and WHEREAS, these structures are considered to be substandard, hazards, and are visual blight to the Town of Malone; and WHEREAS, the Town of Malone is the Franklin County Seat and as such we are desirous of presenting a brighter more prosperous image for all to see; and

2 2 WHEREAS, the community has taken strong interest and initiative in having this blight removed to improve aesthetics, reduce costs, and improve property values in the Town of Malone; and WHEREAS, the Town Board has determined that, in order to protect and promote the health, safety and general welfare of the people, these structures should be eliminated through the utilization of all means appropriate for those purposes; and WHEREAS, any assistance which may be given by the County of Franklin is for public use and purpose, for which public money may be expended; NOW THEREFORE BE IT RESOLVED, the Town Board of the Town of Malone hereby determines the optimal method to dispose of demolition debris caused by the removal of blight, is that the County of Franklin enter into an agreement with the Town of Malone to absorb the cost of the dumping fees for municipal take-downs. MINUTES & REPORTS: * Motion Councilor Sullivan Second Deputy Supervisor Walbridge Resolved (# ): to accept the following reports as presented and place on file: Supervisor 6/2011 Code Officer 6/2011 Supt. of Highways 6/2011 Airport Manager 6/2011 Clerk/Registrar 6/2011 Justice Court 6/2011 Councilor Taylor - Aye Councilor Sullivan - Aye Councilor Scharf Motion Deputy Supervisor Walbridge Second Councilor Taylor Resolved (# ): to accept the minutes of the 6/22/11 regular meeting as presented and place on file. OLD BUSINESS: SEQR Sewer/Loan application Attorney Anderson-Duffy reported that the DEC has not yet sent their approval of the Town taking lead status under SEQR for this project. Water Issues - - Master Meters installation update (meters purchased 5/10) Supervisor Maneely is looking for a quote for someone to install the meters. - Rusted bolts -West Side Water District Resolved (# ): that the Town Board authorizes Supervisor Maneely to bring to a head (discuss/negotiate) with the responsible engineers and contractors, the issue of rusted bolts which have caused leaks and damage, in the 10-year old West Side Water District infrastructure. -Tank Inspection -East Side Water District * Motion Councilor Taylor Second Deputy Supervisor Walbridge Resolved (# ): that the Malone Town Board authorize the expenditure of $ , as quoted by Statewide, for the cleaning of the East Side Water tank ($ ) and testing of the cathodic protection system ($400.00)

3 3 LWRP - NYS Dept of State has provided information and instructions pertaining to the completion, approval, and adoption process for the Town & Village in regard to Local Waterfront Revitalization Program (LWRP). Clerk Hafter reported that Andy Labruzzo from the Department of State will come to Malone to present a refresher/q & A session on the LWRP for the public and the Town and Village Boards. Date, place and time are pending. Bid Opening - held 6/21/11 for Partial Parallel Taxiway B Phase 2. Supervisor Maneely said the funding has not yet been allotted. He added that Passero Associates is to meet with the local pilots group tomorrow. Airport Master Plan Two quotes were received for an Independent Fee Estimate related to the Master Plan: C & $ ; and McFarland & $2, * Motion Deputy Supervisor Walbridge Second Councilor Sullivan Resolved (# ): to authorize Supervisor Maneely to sign into agreement with C & S, at a cost of $2, for an Independent Fee Estimate related to the Malone-Dufort Airport Master Plan. SUPERVISOR REPORTS: Alice Hyde Medical Center Auxiliary 100 th anniversary * Motion Deputy Supervisor Walbridge Second Councilor Sullivan Resolution # PROCLAMATION In honor of the 100 th Anniversary of the Alice Hyde Medical Center Auxiliary WHEREAS, in July of 1911 an enterprising group of women formed an organization known as the Women s Hospital Club of Malone, and WHEREAS, this club was established to do good for the hospital, with an initial membership of 1000 women with dues of $1 per year, and WHEREAS, one hundred years later, the organization, now known as the Alice Hyde Medical Center Auxiliary, now numbers about 450 in membership, is open to men and women, with dues set at $5, and WHEREAS, through the years the Auxiliary has been a tremendous resource for the Medical Center, with volunteers working at the facility, and with tens of thousands of dollars in donated equipment, and WHEREAS, in 2010 alone, the accomplishments of the Auxiliary reflect that $42,500 was donated to the Medical Center; Scholarships awarded totaled $10,800; all babies born at the AHMC were provided with first photo and a handmade birth announcement card, along with WHALE (We Have A Little Emergency) packets for all new moms; Sponsorship of Mr. Yuk Poison Prevention Magic Shows; and provided personal items to all new Hemodialysis patients; and WHEREAS, the Alice Hyde Medical Center Auxiliary received the Now, therefore, be it RESOLVED: that the Town Board of the Town of Malone hereby congratulates and commends the Alice Hyde Auxiliary for its many achievements over the past one hundred years, and appreciates the positive impact they have had on the AHMC and the greater Malone community. BOA Reminder, Public Forum 6:30-8:00pm at NCCC regarding Town &Village Brownfields Opportunity Area (BOA)

4 4 Planning Board Recommendation Resolved (# ): that the Malone Town Board approves the recommendation from the Town Planning Board to allow for the construction of a 9 hole mini-putt golf course on Rt. 37, as approved by Code Officer Crossman. SUPERINTENDENT OF HIGHWAYS REPORT: Superintendent of Highways Shanty reported that the Town- owned paver is obsolete and parts are unavailable. Franklin County has a paver that is older, but better for the Town s purposes, and has more value. The Superintendents have worked out a trade/purchase agreement; that the Town of Malone will trade the old paver plus pay $15,000.00, in exchange for the County paver. Resolved (# ): that the Malone Town Board authorizes Town Highway Superintendent Shanty to complete, as presented, a trade/purchase transaction with Franklin County Highway Superintendent Hutchins for acquisition of a paver. Discussion Budget Officer Stewart asked where the cash was going to come from, as this item was not budgeted. She recommended the Board use some of the money that was earmarked for Equipment Reserve in the 2011 budget, rather than adding it to the reserve. Vote With the recommendation of Budget Officer Stewart included, Carried 5-0. Supervisor Maneely - Aye Deputy Supervisor Walbridge Aye Superintendent Shanty reported that River Road is complete with the exception of some patching. An application to FEMA for disaster assistance has been filed. Superintendent Shanty calculates that $82, has been spent to repair damage to River Road caused by flooding. Currently the crew is working on Pigeon Road and Travers Road; also culverts, dust control, mowing roadsides and sprucing up the garage. Supervisor Maneely asked the Superintendent to have Bill King Park mowed and cleaned up. CORRESPONDENCE: From Pizza Hut, notice of intent to renew liquor license. From Amvets, notice of intent to renew liquor license. Resolved (# ): that the Malone Town Board acknowledge and accept liquor license renewal notices from Pizza Hut and Amvets. From - Latremore s Insurance new partnership with NBT Bancorp s insurance subsidiary: Mang Insurance Agency LLC From - YMCA asking for letter of support request to relocate the DMV Testing area to a new location Resolved (# ): that the Malone Town Board supports the relocation of the DMV Testing area to a location away from the Armory/YMCA, and will send a letter to the Franklin County Legislature in regard to this issue. BILLS FOR AUDIT & PAYMENT: Motion Deputy Supervisor Walbridge Second Councilor Taylor Resolved (# ): that the following bills, having been audited, vouchers # General Fund- Abstract #13 $12, Part Town General Fund- Abstract #11 4, Trust & Agency- Abstract #28 2, West Side Water - Abstract #2 4, East Side Water- Abstract #10 4, Chips (DB230.3) Abstract # Airport Cap. Proj. Abstract #8 22, Landfill Cap. Proj. Abstract #1 3, Highway DA- Abstract # Highway DB- Abstract #11 36, Grand Total $90, Budget Inquiry Budget Officer Stewart asked what to do about the 2012 Fire Protection budget, as with the change in law, fire protection charges are supposed to be according to individual assessment and appear on town tax bills in January. However, the final tax roll for 2012 has already been filed, and the charges will not show on the tax bills for Supervisor Maneely said the Fire Department has attorneys who will take care of it.
