The statement must be updated every two years. A current No. 8 card was not on file for staff as noted on the attached Supplement. Secure a medical statement for any one listed and retain on file. 3 Sec (k) All areas of the facility must be kept clean, safe, sanitary, and in good repair. Areas of the facility were found to not be clean, sanitary or well maintained. Develop a system for ongoing cleaning and maintenance. Areas of the facility in need of cleaning and/or repair were discussed with the owner, operator, and maintenance crew. All light bulbs/light fixtures need covers/sleeves. They are needed in the bathrooms and over the front desk. All vents and ceiling fans need to be dusted regularly. There is an accumulation of dust on these fixtures which must be removed. Replace/Repair all broken door thresholds that present trip hazards especially the dorway to the playground. Replace/Repair all window frams and/or door frames that are broken, have cracked or peeling parts or flaking paint. Repair/ Replace tile around toilets, sinks, shower floors etc. so that tripping hazards are not presented and so there are no broken chunks of tile, grout, caulking, or putty. Repair/Replace all holes in walls including behind toilets and around window frames. Repair/Replace broken glass in window of the infant room. Replace/Repair rusted hinges on upper cabinet door of the girl's bathroom or remove the door. Repair/Replace toilet paper holders in the bathrooms so the tiolet paper is accessible to a child on the toilet and isn't going to fall onto the floor or into the toilet. It should be noted that this visit encompassed 2 days and that the facility made significant improvements overnight , Toxins/Hazardous Materials , Facility Storage , Inside Temperature/Ventilation , Drinking Fountains/Water Coolers Sec (m) Drinking fountains must be accessible and sufficient to meet the children's needs. The drinking fountain was in need of repair. Make repairs so that the drinking fountain is useable. The outside water fountain is broken but is in the process of being repaired and , Phone/Emergency Numbers Posted Page 3 of 7

4 Sec (o) Emergency telephone numbers must be posted on or near all telephones. Emergency telephone numbers, for ambulance, fire, police, poison control center, child abuse registry, and the Broward County Health Department, and directions to the facility were not posted on or near all telephones. Post all required information on or near all telephones. The facility just needs to add the missing phone numbers to the current posted sheets , Shoes Worn By Personnel/Children , Minimum Number of Staff Members INDOOR/OUTDOOR SPACE , Indoor Usable Play Space , Equipment and Furnishings Sec (f)(1) Toys, equipment, and furnishings must be in a sanitary condition. Toys and materials are not maintained in a sanitary condition. Toys should be washed and sanitized. Please go through each classroom and have all of the dirty toys cleaned. Sec (f)(2) A sufficient amount of play equipment and materials must be available to allow each child to be involved in activities. Play equipment and materials are not sufficient in number for the licensed capacity of the facility for the following age group(s): [ 2 year olds ]. Obtain additional equipment and materials. It appears that the facility has sufficient toys on the premises but not accessible to the children as the rom is currently organized. TA regarding sufficient and appropriate equipment was provided , Activity Plan , Napping Space , Crib Requirements/Bedding , Outdoor Play Space Page 4 of 7

5 Sec (d) A safe and adequate fence or wall at a minimum of four (4) feet in height, unless a greater height is required, must be maintained for the outdoor play space. Fencing, including gates, must be continuous and shall not have gaps that would allow children to exit the outdoor play area. The outdoor play space was not adequately enclosed. Fencing is missing, broken or not safely secured. Make repairs as needed. The playground is currently under construction. The original plans would have had the project completed this week but there have been several unavoidable delays. Because of the current condition of the playground, outside play-time has been suspended until completion which is expected to happen by the end of this month. All classrooms now have Inclement Activity schedules which will insure that all children have gross motor activities everyday until the playground is complete. It should be noted that the facility is working on the playground during the days and after hours so as to complete the project by the deadline and that significant progress is being made. Sec (e) Concrete, asphalt, gravel and other similar non-yielding substances are prohibited beneath any piece of permanently installed play equipment. The playground lacked the required minimum of six (6) inches of resilient, impact resistant material under the equipment. Provide an adequate protective surface. Although this area previously failed to comply, a delivery of mulch was made today and is already being spread. Deadline - Complete Sec (g) The outdoor play space must have adequate shade. There is an inadequate area of shade for the playground. Provide the means for additional shaded area. Shade is part of the plan for the new playground , Outdoor Equipment Sec (i) All equipment must be installed safely and maintained in a safe condition. All play equipment shall be of substantial construction and free from rough edges, sharp corners, pinch and crush points, splinters, and exposed bolts. Ladders on slides must have a handrail. Equipment in the outdoor space is broken and needs to be repaired. Complete repairs and monitor equipment for safety. New equipment has been purchased and broken equipment is in the process of being repaired , Swimming Pool TOILET/BATH FACILITY , Toilet/Bath Facilities , Potty Chairs and Seats , Diaper Changing Procedures , Handwashing Facilities and Use Page 5 of 7

6 HEALTH PROGRAM , Written Instructions , Parent Notification , First Aid Supplies Sec (e) First Aid supplies must include band-aids, disposable gloves, cotton balls, sterile gauze squares and rolls, adhesive tape, thermometer, tweezers, scissors, pre-moistened wipes, soap, and a first aid manual. The facility s kits did not include all items but the missing items may be on site elsewhere in the building. Please inventory your kits and add missing items(s). All requirements of a regular license must be complete by [ ] , Nighttime Child Care , Fire Inspection Posted Expiration and , Records of Fire Drill , Insurance Expiration FACILITY'S RIGHT TO APPEAL UPON RECEIPT OF A NOTICE OF VIOLATION Section (g) of the Child Care Ordinance provides that upon receipt of a Notice of Violation, the facility may make a written request to the local licensing agency within fifteen (15) days from receipt of the Notice of Violation for a hearing to be scheduled before a county-appointed hearing officer to contest the issuance of the Notice of Violation. If the local licensing agency does not receive a written request for a hearing within the prescribed fifteen (15) days time frame, due to either the facility electing not to contest the Notice of Violation or the request not being timely made, the violation(s) set forth in the Notice of Violation shall be deemed to have existed and the owner or director of the facility waives the right to contest the substantive issues contained in the Notice of Violation at a later date. Additionally, the local licensing agency may issue an Administrative Fine in accordance with the Ordinance and/or take whatever action is deemed appropriate under the circumstances, including scheduling a hearing before a county-appointed hearing officer seeking suspension or revocation of the facility's license. Notwithstanding the above, if the local licensing agency elects to impose an Administrative Fine based upon the issuance of the Notice of Violation, the facility may contest the amount of any Administrative Fine imposed by the local licensing agency. If a request for a hearing on the Notice of Violation is made to the County, the local licensing agency may, in its discretion, elect to hold one hearing to address the Notice of Violation and the imposition of any Administrative Fine.
