1 City Council Information Letter September 27, 2013 Grant Award from the Atlanta Regional Commission for Pedestrian Bridge Improvement Project Both the Office of the City Manager and the Department of Engineering were recently notified by leadership of the Atlanta Regional Commission that our community is being awarded $200,000 from its allocation from the United States Department of Transportation Moving Ahead for Progress in the 21 st Century (MAP) Program. As referenced in the attached memorandum from City Engineer Jackson Myers, commitments to this effect include funding for design and applicable environmental site assessments necessary to begin pedestrian bridge improvements located at the Georgia International Convention Center, crossing Camp Creek Parkway and Napoleon Avenue. Once design activities have been completed as noted, the City of College Park will then become eligible for shovel ready construction grant funds for actual project implementation. As a funding agreement is currently being processed, recommendations for authorization will be presented for your review and consideration. Such is therefore anticipated in the coming weeks. Meanwhile, a well deserved congratulations to both City Council and staff members that were effective in offering leadership and guidance in helping the City of College Park with this achievement.
2 City Council Information Letter September 27, 2013 Page 2 Implementation of Night Court Pursuant to direction recently offered to both support and sponsor a night court initiative in our community to help reduce existing heavy case load and future opportunities respectively, my office hosted a meeting with leadership of the College Park Police Department and the College Park Municipal Court to discuss pertinent details and arrangements. As referenced in the attached electronic mail message from both Police Chief Ron Fears and Master Police Sergeant Ralph Atkins, direction is being offered to begin night court operations every first and fourth Tuesday of each month, effective January ih. Meanwhile, applicable staff training and case load management is being achieved so as to engage a smooth transition respectively. Consideration to Revise Occupational Tax Ordinance After hosting various deliberations with staff from the Office of the City Clerk, the Department of Finance and Accounting, and legal counsel concerning administration of the City of College Park's occupational tax ordinance and its applicability to additional revenue collection resulting from the 1969 Agreement outcome, recommendations to offer various revisions respectively became appropriate. As referenced in the attached executive summary as compiled by City Clerk Melissa Brooks, these include updated business classifications, so as to effectively recognize establishments operating at Hartsfield Jackson Atlanta International Airport (HJAIA) now obligated to the City of College Park to this effect. Additionally, the ability for taxes and fees to be set by resolution as opposed to ordinance, flexibility relative to fee structure and/or other related opportunities resulting from additional anticipated revenues from HJAIA, and other related economic development activity, supports direction to this effect. Other notable considerations respectively include new uniform due dates, as well as earlier bill distribution.
3 City Council Information Letter September 27, 2013 Page 3 Arrangements are therefore being made to host a presentation to this effect during your October ih workshop meeting, to include an opportunity for you to offer direction as well. Recognition of International Building Code In response to a question raised by Councilman Clay during last week's regu lar meeting relative to the State of Georgia's recognition of the International Building Code (IBC) and our community's involvement, please be advised that the City of College Park also supports the same requirements in terms of the application of building codes and other related affairs. As referenced in the attached memorandum from Building Inspector Skip Barlow, the Uniform Codes Act, the state law that supports the IBC in Georgia, took effect in Since then, cities and counties throughout the State were subject to the same requirements, in effect, being required to follow provisions of the IBC. Interestingly however, the City of College Park first began administration of building and construction codes to this effect in 1988, well in advance of the aforementioned State of Georgia Uniform Codes Act directive. As additional modifications to, the existing IBC are to take effect statewide in January, the City of College Park will therefore be required to enforce respectively. Likewise, direction is being offered to both the Department of Inspections and The Collaborative Firm to begin applicable education and notification processes in the coming weeks. Calendar of Activities, Meetings, Tasks, and Functions As city administration will soon be in position to finalize recommendations relative to a revised lease agreement with both the United States General Services Administration and the Federal Aviation Administration, various meeting and discussions were offered to this effect during the past few days. Additionally, me and a number of department directors hosted a presentation program

Many in attendance appear to have appreciated our presence at the meeting, as I therefore consider this engagement to have been a successful community outreach function. GA / Date: September 26, 2013 TO: FROM : SUBJECT: Terrence, Moore, City Manager Jackson Myers, City Engineer Atlanta Regional Commission committed $200,000 to the City of College Park Pedestrian Bridge project. In February 2012, The Fergu son Group (TFG) arranged a high-level meeting with officials in the U.S. Department of Transportation (DOT) to discuss funding opportunities for the City's major infrastructure needs. After highlighting the strategic importance of College Park to the North Georgia economy and the key assets already in place, DOT officials strongly encouraged the City to apply for the TIGER program. Transportation Investment Generating Economic Recovery {TIGER) is a supplementary discretionary grant program included in the American Recovery and Reinvestment Act of The legislation provides $1.5 billion for a National Surface Transportation System through September 30, 2011, "to be awarded on a competitive basis for capital investments in surface transportation projects. " TFG's recommended strategy was to pursue the funding, knowing that College Park's strategic position would elicit further interest in the City beyond the TIGER program. After a st aff review of the project that best met the TIGER program goals and requirements, the City submitted an application for the pedestrian bridge project over Camp Creek, linking Gateway Center to Downtown and the MARTA st op via non-vehicular roadways. This project is the final phase in a co mprehensive approach to transportation and livability for South Fulton County. This will provide a new bike and pedestrian bridge connecting the GICC, MARTA, the downtown business district, and additional walking paths along Roosevelt Highway into one 1 Qualified projects should result in "desirable, long-term outcomes" for the United States, a state within, or a regional or metropolitan area. According to Title 23 of the United States Code, eligible projects could include improvements to interstate highways, reworking of interchanges, bridge replacement s, earthquake-related improvement s, relocating roads, upgrading rural collector roads, certain transit projects, passenger and freight rail transportation projects, and PQ!! infrastructu re. Selected projects might improve the economy of the entire country, transportation safety, and quality of life for communities.
6 seamless system. It will take pedestrian and cylists off of major arterials (Old National Highway, Roosevelt Highway, and Camp Creek Road) by providing them with dedicated and restricted access. It builds upon the current Quiet Crossings project that is enhancing safety around the CSX railroad tracks that abut the MARTA station. Existing transportation assets heavily favor mobility and safety needs of vehicular traffic. This project will provide mobility and safety in equal parts to bicycle, pedestrian, and vehicular transportation modes around the key assets of Downtown College Park, the GICC, and the MARTA station. As the gateway to Hartsfield Jackson Atlanta International Airport, this project has regional and national significance. The strategy is already reaping benefits. The initial project description included addressing safety concerns around the CSX rail lines. Casting a broad net using the larger footprint of citywide bike-ped plans, the U.S. Economic Development Administration was approached and was able to fund the Quiet Zones program with $300,000 in year-end available funding. These funds needed to be obligated quickly or face forfeiture and College Park presented a shovelready project that met this need. As part of the strategy to consider re-submitting the 2012 TIGER application again in 2013, TFG worked with City Planning Staff to host a stakeholders meeting and secure support for the overall approach. Through this meeting, attended by over 40 representatives, funds available from the Atlanta Regional Commission (ARC) were identified. In late September, the ARC committed $200,000 to the Pedestrian Bridge project. These will help expand ARC investment proposed under the Livable Communities Initiative (LCI). In a year's time, the strategy has produced over $500,000 in funds to advance College Park's infrastructure need s. Plans are underway to secure at least that much from tourism authorities and from federal, state, and regional sources over the next 12 months. CC: Mayor and City Council City Staff

8 COLLEGE PARK OCCUPATION TAX UPDATE EXECUTIVE SUMMARY A number of changes are being proposed to be made to Chapter ll Article I of the City Code of College Park, Occupational Licenses, Taxes and Regulations, however many of the proposed changes are not material as they either are being proposed to either correct typographical errors or rewording provisions to add clarity to the Article. A summary of the proposed changes to Chapter ll Article I is as follows: New Business Classifications The current occupation tax code uses the Standard Industrial Classification code (SIC); however this code is no longer used or updated by the Federal govemment. To reflect this change, the new occupation tax code would use the North American Industry Classification System (NAICS) as such code system has been in use by the City of College Park Occupation Tax Clerk to classify business operations since the change in the code system. Taxes and Fees Set by Resolution Rather Than Ordinance Tax schedules and enumerated fees would be removed from the body of the code of ordinances. Under the proposed occupation tax code, the Mayor and Council would set tax schedules and fees through the passage of resolutions. This change would make it easier for the Mayor and Council to adjust tax rates and fees in the future.
9 Adjustment in Annual Returns The updated code would require that registrants account for any difference in the prior year tax amount when registering for the cunent year as an additional tax amount due or as a credit to apply to the current year amount due. Registrants would also have the option of applying for a refund of any overpayment. New Sections The updated occupation tax code also proposes to add two new sections to Chapter 11, Article I. Section 28 would establish the requirement to file a "final return", the fee for processing a final return and the procedures related to filing a refund request. Section 29 affirmatively states that any occupation tax liabilities that are outstanding when any new ordinance is passed shall remain in force until paid in full.

Therefore, the plumbing requirements of the International Plumbing Code, the electrical requirements of the National Electrical Code, and the energy requirements of the International Energy Conservation Code must be used for one- and two-family dwelling construction.
