CML (125) RECOMMENDATION Report on bids and award of contract for the Jackson Avenue Bicycle and Pedestrian Improvements (Between McKee Road and Alum Rock Avenue) Federal Project No. CML (125) to the sole bidder, Golden Bay Construction, Inc., in the amount of $1,290,376 and approval of contingency in the amount of $129,038. OUTCOME Award of the construction contract to Golden Bay Construction, Inc. will enable the Jackson Avenue Bicycle and Pedestrian Improvements (Between McKee Road and Alum Rock Avenue) Federal Project No. CML (125) to proceed on schedule with the installation of two traffic signals and a modification of one traffic signal. Approval of a ten percent contingency will provide funding for any unanticipated work necessary for the proper completion of the project. BACKGROUND On June 6, 2013, the Metropolitan Transportation Commission (MTC) approved the City's grant request for the Jackson Complete Streets Project in the amount of $1,500,000 through the One Bay Area Grant (OBAG). MTC's OBAG Program is a new funding approach that better integrates the region's transportation funding program with Senate Bill 375. The OBAG program rewards jurisdictions that focus housing growth in Priority Development Areas (PDAs) through their planning and zoning policies, and production of housing units. The OBAG program allows flexibility to invest in a community's transportation infrastructure by providing funding for
2 Page 2 Transportation for Livable Communities, bicycle and pedestrian improvements, local streets and roads preservation, and planning activities, while providing opportunities for Safe Routes to Schools (SRTS) projects and Priority Conservation Areas. This grant-funded project which was designed by URS Corporation, will enhance pedestrian, bicyclist, and transit safety and access along Jackson Avenue. Improvements will include the installation of new traffic signals at Luz Avenue and the offset intersections of Jackson Avenue and Madden Avenue and Jackson Avenue and Alexian Drive. A fourth crosswalk will be part of the modification at the existing traffic signal at Mather Drive. This project will also include sidewalk repairs and curb/gutter improvements along with installing new pedestrian curb ramps. City staff are coordinating with VTA to relocate and improve bus stops. Construction is scheduled to begin in August 2016 with completion in February ANALYSIS Bids were opened on March 17, 2016, with the following results: Variance Over/ (Under) Contractor Total Bid Amount Percent Engineer's Estimate $1,100,000 Golden Bay Construction, Inc. $1,290,376 $190, (Hayward) The sole bid received was 17 percent over the Engineer's Estimate. Potential reasons for the higher bid include the requirements of Federal-Grant Regulations, the increase cost of materials and labor to construct traffic signals, the increase in construction activity in the South Bay, or a combination of these causes. The bid is considered acceptable for the work involved in the project. Golden Bay Construction, Inc. is an experienced contractor in installing and managing roadway improvements projects which include roadway pavement, sidewalk restoration, curb and gutter, and traffic signal and street lighting installations. This contractor has been involved with the installation of numerous capital improvement projects for roadway improvement projects within the City. In accordance with Federal Regulations, 49 CFR Part 26, a Disadvantage Business Enterprise (DBE) goal of 15% was established for this project. Golden Bay Construction, Inc. met the 15% DBE goal and committed to $181, DBE participation.
3 Page 3 Council Policy provides for a standard contingency of ten percent on Public Works projects involving traffic signal systems. The standard contingency is appropriate for this project. EVALUATION AND FOLLOW-UP This project is currently within budget and expected to be completed by February No additional follow up action with the Council is expected at this time. PUBLIC OUTREACH The public outreach for this project was coordinated with Council District 5 and residents and businesses adjacent to the intersections. Additionally to solicit contractors, this project was listed on BidSync and advertised in the San Jose Post Record and San Jose Mercury News. This memo will be posted on the City's website for the June 7, 2016, Council Agenda. COORDINATION This project and memorandum was coordinated with the Departments of Transportation, Planning, Building and Code Enforcement, the City Manager's Budget Office and the City Attorney's Office. COST IMPLICATIONS 1.
