Encorp Return-It to Win-It EMPLOYEE CONTEST OFFICIAL RULES The "Return-It to Win-It Employee Contest (the "Employee Contest") is offered by Encorp Pacific (Canada) (the Employee Contest Sponsor ) and is administered by WSP International Limited (the Employee Contest Administrator ). NO PURCHASE NECESSARY TO PLAY. General Employee Contest Information: The Employee Contest is being played at approximately one-hundred and sixty-four (164) Return-It Depots ( Participating Locations ) in the Canadian province of British Columbia. This is a trade contest and is only available to employees of Participating Locations, who are in good standing as of June 12, (See Rule 2 below, Who Can Play ). There is also a Return-It-to-Win-It consumer contest which is integral to this Employee Contest. Eligible employees must go online to ( Employee Contest Website ) to register and create an account ( Account ) by providing their first name, last name, address, telephone number and the name of the Participating Location where they are employed, in order to play or win prizes in the Employee Contest. See Rule 10 for a list of Participating Locations. Any questions, concerns or comments regarding the Employee Contest can be forwarded to gamemaster@returnitemployeecontest.ca or send your questions, concerns or comments and a selfaddressed, stamped envelope to Return-It Employee Contest, c/o P.O. Box 3009, M.I.P. Markham, ON, L3R 6G4. To create your Account, you must have a web browser that is compatible with Microsoft Internet Explorer 5.5x, Netscape 7.2 or AOL 8.0. Mac system requirements: Mac OS X Jaguar 10.2 or Panther 10.3, running Safari. In the event of a dispute as to who submitted an online registration or entry, the registration or entry will be deemed to be submitted by the Authorized Account Holder of the address by an Internet access provider, online service provider or other organization (i.e. business, educational institution) that is responsible for assigning addresses for the domain associated with the submitted address. 1) CONTEST DATES: The Contest begins at 12:00:00 AM, Pacific Time ( PT ) on June 12, 2017 (the "Contest Start Date") and is scheduled to end at 11:59:59 PM PT on September 10, 2017 (the "Scheduled Contest End Date"). The period between the Contest Start Date and the Scheduled Contest End Date is known as the "Contest Period". Weekly draw eligibility ends on different dates, as indicated elsewhere in these rules ( Official Rules ). 2) WHO CAN PLAY: The Employee Contest is open to all legal residents of the Canadian province of British Columbia, who are employees in good standing of any of the Participating Locations as of Contest Start Date and through each draw date. In these Official Rules, to be in good standing the employee must be gainfully employed as a full-time or part time employee at any of the Participating Locations throughout the Contest Period. Employee Contest Sponsor reserves the right to make any final determination as to the eligibility of any person. 2 promotional agencies, and any entity involved in the production, implementation, administration or fulfillment of the Employee Contest are not eligible to play in the Employee Contest or win prizes. 3) HOW TO PLAY: Once employees have registered on the Employee Contest Website (see General Employee Contest Information, above) they will be able to view questions related to the Return-It-to-Win-It consumer contest. There will be a new question posted on the Employee Contest Website every Monday during the Contest Period at 12:00:01 AM, PT, starting Monday, June 12, Employees have until 11:59:59 PM, PT on the Sunday following to correctly enter their answer. Employees can attempt to correctly answer the question once per day. Each correct answer generates an automatic one (1) ballot entry per week in our Employee Online Sweepstakes. 4) WEEKLY ONLINE SWEEPSTAKES DRAWS AND PRIZES: There will be a total of sixty-five (65) draws held, each to award a fifty dollar ($50.00) Amazon.ca Gift Certificate and a total of twenty six (26) draws held, each to award a one hundred dollar ($100.00) Amazon.ca Gift Certificate, following the schedule detailed in Table 1 below. Prizes will be awarded by way of random draws conducted to select seven (7) entries each Monday starting on Monday, June 19, 2017 and ending on Monday, September 11, Weekly Online Sweepstakes winners will be randomly selected per draw from among all eligible online entries received by 11:59:59 PM on the day prior to the date of each draw. For greater clarity, the deadline to enter and be eligible for any weekly draw during the Contest Period is Sunday at 11:59:59 PM, from June 12 through September 10 inclusive). All entries (except those selected in any previous draw) will automatically rollover into any subsequent draw(s). Odds of winning any Weekly Online Sweepstake prize are dependent upon the number of eligible entries received prior to the deadline for each weekly draw. The number of Gift Certificate prizes available to be won will decline during the Contest Period. Employee Contest Administrators will conduct random drawings at its offices in Markham, ON to award prizes on the stated dates, as per the schedule outlined below. A minimum of three (3) attempts will be made to contact the each selected entrant to arrange for redemption of the prize. Prizes that are not claimed after the third attempt to be contacted will be deemed forfeited and a new entry will be drawn. As a condition of awarding any Online Sweepstakes prize, selected entrant must sign and return, within seven (7) days of receipt, the Employee Contest Sponsor s Release Form confirming his/her compliance with these Official Rules and releasing the Employee Contest Sponsor, any Prize suppliers, their respective administrators, affiliates, subsidiaries, advertising and promotional agencies, and the directors, officers, partners, dealers, employees and agents of each of the foregoing, from and against any and all liability arising from or in connection with participation in the Employee Contest or the acceptance, possession or use/misuse of any prize. Before being declared winners, all selected entrants will be required to correctly answer, unaided, a mathematical skill-testing question administered by the Employee Contest Sponsor or Employee Contest Administrator. If a potential winner fails to return the required documents in accordance with these Official Rules, or is found to have violated the rules of the Employee Contest in any way, or if any prize or prize notification from Employee Contest Sponsor is returned as undeliverable, the potential winner will be disqualified and will be deemed to have forfeited the prize in question and Employee Contest Sponsor will conduct a random draw to select an alternate prize winner. This Employee Contest is void outside the jurisdictions specified in these Official Rules and where prohibited by law and is subject to all applicable federal, provincial, local, and municipal laws and regulations. By participating in the Employee Contest, and as a condition of acceptance of any Prize, each entrant, his/her heirs, executors, administrators, and assigns, RELEASES AND FOREVER DISCHARGES AND HOLDS HARMLESS the Employee Contest Entities, their parent companies, direct and indirect affiliates, subsidiaries, successors, assigns, advertising, promotion and fulfillment agencies and legal and other advisors, agents and representatives and each of their employees, officers, directors, partners, representatives and agents (collectively, the Released Parties ), from and against any and all losses, damages, rights, claims, actions, causes of action, personal injury, property damage or death (including without limitation all costs and liabilities of any kind (including solicitor fees), ( Claims ) AND INCLUDING WITHOUT LIMITATION ANY SUCH CLAIMS ARISING FROM ANY ACT OF NEGLIGENCE OR GROSS NEGLIGENCE OF THE RELEASED PARTIES, that the entrant now has, or may hereafter have against the Released Parties directly or indirectly resulting or arising from: (i) participation in the Employee Contest, or the awarding, acceptance, use, or misuse or enjoyment of any Prize, or traveling to, preparing for, or participating in any Employee Contest-related or Prize-related activity; or (ii) the publicity rights granted to the Employee Contest Sponsor and its direct and indirect affiliates as referred to above. It is understood that there may be serious risks of bodily injury, death, or property damage associated with the use or misuse of any Prize, and any prize winner voluntarily assumes these risks. The entrant may be required to pay any taxes associated with the awarding of any Prize. Any claim or dispute with respect to the Employee Contest, any Prize, or this Agreement shall be governed by the laws of the Province of British Columbia and any proceedings in relation to any such claim or dispute shall be resolved exclusively by the British Columbia courts. If any portion of this document is determined to be unenforceable by a court of law, all other parts of this document shall remain in full force and effect, and that the conditions and covenants herein shall be binding on the entrant and the entrant s heirs, successors, administrators, executors and assigns. PRIZES SHALL BE ACCEPTED AS IS. IT IS UNDERSTOOD THAT THE EMPLOYEE CONTEST ENTITIES HAVE NOT MADE ANY WARRANTY, REPRESENTATION, OR GUARANTEE, EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, REGARDING ANY PRIZE, OR ANY SUBSTITUTE PRIZE. ALL ENTRIES AND PRIZE CLAIMS RECEIVED BECOME THE PROPERTY OF EMPLOYEE CONTEST SPONSOR AND WILL NOT BE RETURNED. 8 The Released Parties are not responsible for any website, technical, hardware, software or telephone failures or damages of any kind, lost or unavailable network connections, or failed, incomplete, garbled or deleted computer or network transmissions, or for entry requests, or prize claims that are stolen, illegible, incomplete, misdirected, lost, late, postagedue, damaged, or ineligible. CAUTION: ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE OR OTHERWISE CORRUPT THE EMPLOYEE CONTEST OR TO UNDERMINE THE LEGITIMATE OPERATION OF THE EMPLOYEE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS.
