1 OFFICIAL CONTEST RULES: Port City Photos Instagram Contest 1. ELIGIBILITY 1.1 The Port City Photos Instagram Contest (the Contest ) is open to all legal residents of Canada, (except residents of Quebec), who have reached the age of majority in their province or territory of residence at the time of entry (the Entrant ). Directors, employees, representatives or agents (including those with whom such persons are domiciled) of the Contest sponsor, Port Metro Vancouver (the Sponsor ) and its affiliates and representatives, including the contest administrator, Edelman (the Administrator ), are exempt from entering the Contest. 1.2 The Sponsor shall have the right at any time to require proof of identity and/or eligibility of the Entrant to participate in the Contest. Failure to provide such proof may result in disqualification. All personal and other information requested by and supplied to the Sponsor for the purpose of the Contest must be truthful, complete, accurate and in no way misleading. The Sponsor reserves the right, in its sole discretion, to disqualify any Entrant should an Entrant at any stage supply untruthful, incomplete, inaccurate or misleading personal details and/or information. 1.3 Participation in the Contest constitutes an Entrant s full and unconditional agreement and acceptance of these Rules, which are final on all matters relating to the Contest. Chances of winning depend on the total number of qualified Entrants. 1.4 The Contest is in no way sponsored, endorsed or administered by, or associated with Instagram. Any questions, comments or complaints regarding the Contest should be directed to the Sponsor and not Instagram. 2. CONTEST DETAILS 2.1 The Contest will consist of four (4) Weekly Contests, with a Grand Prize awarded upon Contest close. Each Weekly Contest will be Four to Seven (4-7) days in length beginning on the Monday or Friday of each week throughout the duration of the Contest Period. The Grand Prize will be awarded based on all valid entries received during the Contest Period. The Contest Period is July 9, 2015 to August 7,

2 3. CONTEST PERIOD 3.1 Each Weekly Contest will have a unique Entry Period as outlined below. The Sponsor reserves the right to adjust dates for any of the timeframes outlined in these rules per their discretion. Week 1 Contest: The week 1 Contest Period begins on Thursday, July 9, :00:00 a.m. Pacific Daylight Savings Time (PDT) and ends on Thursday, July 16, 2015 at 11:59:59 p.m. PDT, after which time no further entries shall be accepted. Week 2 Contest: The week 2 Contest Period begins on Friday, July 17, :00:00 a.m. PDT and ends on Thursday, July 23, 2015 at 11:59:59 p.m. PDT, after which time no further entries shall be accepted. Week 3 Contest: The week 3 Contest Period begins on Friday, July 24, :00:00 a.m. PDT and ends on Thursday, July 30, 2015 at 11:59:59 p.m. PDT, after which time no further entries shall be accepted. Week 4 Contest: The week 4 Contest Period begins on Friday, July 31, :00:00 a.m. PDT and ends on Thursday, August 6, 2015 at 11:59:59 p.m. PDT, after which time no further entries shall be accepted. Month Contest: Grand Prize The Month Contest Period begins on Thursday, July 9, :00:00 a.m. PDT and ends on Friday, August 7, 2015 at 11:59:59 p.m. PDT, after which time no further entries shall be accepted. 4. CONTEST ENTRY 4.1 To participate in the Contest, Entrants must have a valid Instagram account. To register a valid Instagram account, visit and follow the instructions. As at the commencement of the Contest, there are no fees associated with the creation of an Instagram account. 4.2 No purchase necessary to enter the Contest. 2

3 4.3 To submit a valid entry: (a) post a photo of What my port city means to me to a valid personal Instagram account using the hashtag #myportcity during the Contest period; 4.4 Entries will not be included if: (a) the hashtag #myportcity is not included with the post 4.5 There is no limit to the number of valid entries per Entrant per Weekly Contest during each Weekly Contest Period (weeks 1-4). 4.6 There is no limit of valid entries per Entrant for the Grand Prize during the Month Contest Period. If the Entrant was identified as the Winner during one of the Weekly Contests in weeks 1 4, they are still eligible to win the Grand Prize. 4.7 In the event of a dispute, entries received online shall be deemed to be submitted by the authorized account holder of an Instagram account associated with the entry. For the purpose of the Contest Rules, authorized account holder of an Instagram account is defined as the natural person who is assigned to a Instagram account by an Internet access provider, on-line service provider, or other organization responsible for assigning Instagram Accounts. Each selected entrant may be required to provide the Sponsor with proof that the selected entrant is the authorized account holder of the Instagram account, as well as a government issued, legal proof of identification, for all details associated with the winning entry. 4.8 Without limitation, the Sponsor is not responsible for entries that are not received due to technical difficulties or declared invalid if they are late, illegible, incomplete, damaged, irregular, mutilated, forged, robotically or electronically reproduced or exceed the maximum number of entries per Entrant per Entry Period. 4.9 No communication or correspondence will be exchanged with entrants except with those selected as a Winner (as defined in Section 5) All entries become the sole property of the Sponsor and none will be returned for any reason. By entering this Contest, each Entrant expressly consents to the Sponsor storing, sharing and using the personal information submitted with his/her Entry only for the purpose of administering the Contest unless the entrant otherwise agrees. 3

4 5. CONTEST WINNER SELECTION 5.1 A Weekly Contest Winner (the Winner ) will be selected for each Weekly Contest Period. Selection of each Winner will take place according to the following: (a) the Winner will be selected based on pre-determined criteria by the Sponsor from the pool of qualified entries received during the Weekly Contest period; (b) the Winner will be notified via comment to their Instagram photo entry; (c) the Sponsor will feature the winning photo on the Port Metro Vancouver Facebook page until the next winner is selected for the following Weekly Contest Period. 5.2 In the event that the Sponsor or Administrator cannot reach the Winner, the Sponsor reserves the right to post the winning weekly photo on the Port Metro Vancouver Facebook page regardless. 5.3 A Month Contest Winner (the Grand Prize Winner ) will be selected for the Month Contest Period. Selection of the Grand Prize Winner will take place according to the following: (d) the Winner will be selected based on pre-determined criteria by the Sponsor from the pool of qualified entries received during the Month Contest period; (e) the Winner will be notified via comment on their Instagram photo entry; (f) the Sponsor will feature the winning photo on the Port Metro Vancouver Facebook page throughout the month of August 2015, and they will be awarded the official Grand Prize. 5.4 In the event that the Sponsor or Administrator cannot reach the Winner after multiple failed attempts within five (5) business days, an alternative winner will be chosen. 6. CONTEST PRIZE 6.1 Official Weekly Contest prizing will be announced during the corresponding Weekly Contest Period on the Port Metro Vancouver Facebook page ( 6.2 Each Weekly Contest will consist of the same Prize of equal value; the winning photo featured on Port Metro Vancouver s Facebook page for a seven (7) day period. 6.3 Any given Weekly Contest Prize must be accepted as awarded. Prizes are not transferable and cannot be redeemed for cash. 4

5 6.4 The Grand Prize will be announced, following Contest close and winner notification, on the Port Metro Vancouver Facebook page ( 6.5 The Grand Prize will consist of eight (8) tickets to a Harbour Patrol Tour in Vancouver, courtesy of Port Metro Vancouver. 6.6 The Grand Prize must be accepted as awarded. Prizes are not transferable and cannot be redeemed for cash. 6.7 The Grand Prize will be locally based in the Lower Mainland in British Columbia. 6.8 The Sponsor is not required to subsidize any travel or hotel fees associated with claiming the Prize. 7. GENERAL CONDITIONS 7.1 By entering the Contest, each Entrant grants the Sponsor and its affiliates, subsidiaries, related companies, agents, successors and assigns the unrestricted right for any purpose to produce, reproduce, publish, broadcast, communicate by telecommunication, exhibit, distribute the Entrant s name, address, voice, Entry, statements about the Contest and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by the Sponsor in any manner whatsoever, including print, broadcast or the Internet and expressly waives, to the fullest extent permitted by law, any moral rights which may now or may hereafter be recognized by legislative enactment or otherwise at law or in equity with respect to the Entry. 7.2 The Sponsor will not be liable for: (a) any failure of the Website during the Contest; (b) any electrical or technical malfunction or other problems relating to the telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software; (c) the failure of any Entry to be received by the Sponsor for any reason including, but not limited to, technical problems or traffic congestion on the Internet or at any website. 7.3 Further, the Sponsor will not be liable for any damage to an Entrant s or any other person s computer related to or resulting from participating or downloading any material in the Contest. 7.4 The Sponsor reserves the right to withdraw, suspend or amend the Contest in any way at any time, in the event of any accident, error, technical problem, computer virus, tampering, unauthorized 5

6 intervention, fraud, technical failure or any other cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of the Contest as contemplated by these Rules. 7.5 Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law. 7.6 The Contest shall be governed in all respects, including validity, interpretation and effect, by all applicable laws and in cases where federal and provincial laws conflict, the federal law shall prevail. 7.7 The decisions of the Sponsor with respect to all aspects of this Contest are final and binding on all Entrants without right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of entries. 8. INTELLECTURAL PROPERTY 8.1 All intellectual property, including, without limitation, all trade-marks, trade names, logos, designs, promotional materials, web pages, source code, drawings, illustrations, slogans and representations are owned or licensed by the Sponsor. All rights are reserved. Unauthorized copying or use of any copyrighted material or intellectual property without the express written consent of its owner is strictly prohibited. 9. LANGUAGE DISCREPANCY 9.1 In the event of any discrepancy or inconsistency between the terms and conditions of these Rules and disclosures or other statements contained in any Contest-related materials, including, but not limited to, the Contest registration form, print or on-line advertising, the terms and conditions of these Rules shall prevail, govern and control. 6
