1 CONTEST RULES FOR 4 DICE ROLL 1. How to Enter the Contest: a. The contest will run for a one (1) day event. Actual Dice Roll to be held on February 18, 2012 at BMW of Santa Maria (hereinafter referred to as BMWSM ), located at 2150 S. College Drive, Santa Maria, CA b. To participate, register online at on February 5, A maximum of thirty (30) participants will be selected as finalists as further described in Rule #4 below. There will be a maximum one (1) Grand Prize winner. The odds of winning depend on the number of eligible entries received. c. Limit one (1) entry per person. Entrants may be disqualified at the sole discretion of BMWSM. d. The sponsors of this contest are KSBY COMMUNICATIONS (hereinafter referred to as KSBY ), 1772 Calle Joaquin, San Luis Obispo, CA and BMWSM, 2150 S. College Drive, Santa Maria, CA e. Winners will be posted on the site for 72 hours from the contest end. 2. Eligibility Restrictions: 3. Grand Prize: a. The contest is open to all contest participants who are eighteen (18) years of age or older and who are legal U.S. residents of one (1) of the following counties in KSBY s viewing area: SANTA BARBARA-SANTA MARIA-SAN LUIS OBISPO TV MARKET ACCORDING TO NIELSEN MEDIA RESEARCH. Employees, officers, and directors of Sponsors, KSBY, Odds On Promotions or Incentive Plus Network or their respective affiliated companies, subsidiaries, distributors, dealers, retailers, printers, advertising, and promotion agencies, any or all other companies associated with this contest, or the members of the immediate families or households of any of the above are not eligible for this contest. Immediate family shall include spouse, parents, children, siblings, grandparents, grandchildren and any other person residing within the same household. Must have a valid driver s license to be eligible. Players must provide their name, address, and valid address. Prize is non-transferable. Prize has no cash equivalent. Prize may not be exchanged. b. Only one (1) winner per household is permitted as a finalist. a. Grand Prize: A 2012 BMW vehicle selected by the Sponsors with a retail value of approximately forty-nine-thousand-five hundred dollars ($49,500). A 1

2 maximum of one (1) Grand Prize will be awarded. If the one (1) available Grand Prize is won in accordance with these Rules, the contest will officially end at the time the Grand Prize is won. If no finalist successfully rolls the (5) dice with the BMWSM logo face up in accordance with these Rules, no Grand Prize will be awarded. b. Grand Prize is provided courtesy of Odds On Promotions/IPN. c. The Grand Prize, if won, may not be exchanged or substituted by the winner. The Sponsors may substitute the Grand Prize for a prize of equal value. d. The Grand Prize winner, if there is one, will receive 1099 IRS Tax form for the value of the Grand Prize as stated in these Rules. e. The Grand Prize winner, if there is one, will be responsible for paying for taxes, tag and title, including but not limited to income taxes and sales, use or similar taxes. 4. Selection and Notification of Winners: a. Decisions of BMWSM with respect to the contest are final and binding. b. Register online at on February 5, 2012, from 3-7pm in order to participate in this contest. Thirty (30) winners will be randomly selected by Sponsor BMWSM during KSBY s telecast of Super Bowl XLVI on February 5, 2012, 3-7pm and will receive a $50 gas card. A potential finalist that cannot be reached or contacted later to confirm their selection, does not meet the eligibility requirements, or does not wish to participate in the Grand Prize event, will be disqualified. A maximum of thirty (30) finalists will be selected. c. The eligible finalists will receive $50 gas card and will be given the opportunity to attempt to win a Grand Prize by providing all requested information in the official registration binder and rolling a set of five (5) pre-printed dice after receiving instructions to do so from the contest administrator at the Grand Prize event located at BMWSM (time to be announced later at In order to be a valid attempt, each eligible contestant must: i. Print and sign their full name in the official registration binder on the next unoccupied line. Name must be printed clearly to be eligible. Valid Driver s license will also be required. ii. After completing this information, and upon direction of BMWSM, the finalist must then roll the provided set of five (5) dice in accordance with the requirements outlined herein. iii. The order of the finalists for the dice role attempts will be determined by BMWSM. 2

In order for a Grand Prize to be awarded, the five (5) dice rolled by the finalist must come to rest a minimum of six (6) feet with BMWSM logo face up in accordance with these Rules, and the finalist must be the first finalist to have achieved this result. If a finalist is awarded the Grand Prize, the contest ends and no additional Grand Prizes will be awarded. e. The dice roll attempt must occur in the presence of the contest administrator, and must be recorded on videotape in its entirety. Any dice roll attempt not in the presence of the contest administrator, or that is not videotaped in its entirety, for any reason will be disqualified and is not eligible for a Grand Prize, regardless of the outcome. f. Finalists are not permitted to take any practice or warm-up rolls prior to their attempt. Once any one (1) die has been rolled, his/her attempt is considered to be started. g. Each eligible finalist must roll/throw each oversized dice all at once. Finalists may not attempt to change the outcome of any rolled die by hitting the die with a subsequent roll attempt. h. Each die must be tossed in a way that does not allow the finalist to set the dice, alter or influence the random outcome of the roll. i. Each die must be rolled a minimum of six (6) feet in distance from the finalist. The contest administrator will designate the demarcation line that each die must cross during the roll attempt, as well as the line behind which the contestant must be positioned to take his/her attempt. j. Each dice must make a minimum of two (2) complete rotations while in the air. k. All dice must come to rest lying individually and completely flat. l. All dice must land on and remain on the designated dice rolling surface. m. No rolled die may come in contact with any person or object other than the designated rolling surfaces or walls. n. If any die comes in contact with another person or object (other than the dice roll surface or designated walls or backstop, or other dice) for any reason, or if any person or object in any way interferes, alters, changes, influences or affects the random outcome of the roll, then the entire attempt is disqualified and the finalist may not receive another attempt. o. The following will result in the finalist being required to re-roll their entire dice roll attempt: 3

4 i. If any of the following outcomes occur, that dice roll attempt is disqualified and the finalist will be granted a maximum of one (1) re-roll attempt (the finalist must re-roll all (5) dice): 1. If the contest administrator deems that any die has failed to cross the dice roll demarcation line. 2. If any die is leaning in any manner. 3. If any die leaves the designated dice roll playing surface. 4. If any contestant inadvertently drops a die as they are preparing to roll, and the dropped die does not meet the eligible dice roll requirements as stated in the contest rules. 5. In circumstances listed in 1-4 above, an eligible contestant may have a maximum of one (1) re-roll attempt. In the event of a second ineligible dice roll, their entire dice roll attempt will be disqualified and the finalist will not be eligible to win the Grand Prize. 5. Conditions: a. Payment of all federal, state and local taxes are the sole responsibility of the finalists for the gas card and Grand Prize winner, if there is one, for the Grand Prize. The Grand Prize winner, if there is one, will be required to sign an IRS Form W-9 or the equivalent. All finalists will be required to sign a release and affidavit of eligibility in a form (or forms) provided by BMWSM. Driver s license and social security number of the Grand Prize winner, if there is one, will also be required in order to collect the prize. b. The finalists agree to have their name, voice, or likeness used in any advertising or broadcasting material relating to this contest without additional financial or other compensation, and to sign a publicity release upon request. c. A maximum (1) Grand Prize(s) will be awarded. Grand Prize winner, if there is one, must pick up the prize at BMWSM. All other costs related to prize delivery and acceptance is the responsibility of the Grand Prize winner, including but not limited to all federal state and local taxes. The gift card the finalists receive may not be transferred or substituted by the finalists; Sponsors however may substitute an item of equal value. d. Grand Prize winner, if there is one, will be required to complete and return a W- 9 form, affidavit of eligibility, and liability/publicity release, and present a valid driver s license and social security card before prize will be awarded. Pursuant to the liability release, the finalists will agree to release and hold Incentive Plus/Odds On Promotions, Sponsors, and the affiliated companies and the officers, shareholders, directors, employees, agents and representatives of each of them, harmless against any and all claims or liability arising directly or indirectly from the prize or participation in the contest. Winners of prizes and 4

5 item(s) totaling $ or more from BMWSM contest(s) during a one year period will be issued a 1099 form reflecting the value of the prize(s) and item(s) and are responsible for paying all income taxes on prize(s). e. BMWSM reserves the right in its sole discretion to modify these Rules and dates at any time for any reason. Material modifications shall be announced online at when practical. By participating in this contest, you agree to be bound by these Rules, any modifications thereof, and by all other rules imposed by the BMWSM. f. No purchase is necessary. Purchase does not increase chances of winning. The contest is void where prohibited. g. Failure to comply with these Rules may result in a participant's disqualification, at the sole discretion of the BMWSM. h. KSBY and BMWSM is not responsible for typographical or other errors in the printing, the offering or the administration of the contest. i. A copy of the written contest rules and the name of the Grand Prize winner, if there is one, are available during regular business hours of BMWSM, located at 2150 S. College Drive, Santa Maria, CA j. Entries must be filled out completely and legibly in order to qualify, and will be void if they are, in whole or in part, incomplete, illegible, damaged, irregular, counterfeit, altered, or obtained through theft or fraud. No mechanically reproduced, software-generated or other automated multiple entries are permitted. Sponsors are not responsible for lost, late, illegible, misdirected or mutilated entries, including due to transmission, technical, and/or network failures of any kind, including, without limitation, malfunctioning of any hardware or software (whether originating with sender or Sponsors), telephonic failures, human error, or any other error or malfunction. For online entries, the authorized account holder of the address submitted at time of entry will be considered the entrant. An authorized account holder shall mean the natural person assigned to such account by the Internet access provider, online service provider, or other organization responsible for assigning addresses for the domain associated with such account. A potential finalist may be requested to provide proof that he or she is the authorized account holder of the address associated with a winning entry. k. Entrants agree not to upload, post or transmit any materials which contain any computer viruses, Easter eggs, worms, Trojan Horses or other harmful component or programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information. Any attempt to deliberately damage any website or undermine the operation of this contest is a violation of criminal and civil laws, 5

6 and Sponsors reserve the right to seek damages from any person who makes such attempt(s). l. Entry materials that have been tampered with or altered are void. Any questions regarding the number of entries submitted by an individual or the authorized account holder of an address shall be determined by BMWSM in its sole discretion, and BMWSM reserves the right to disqualify any entries by persons determined to be tampering with or abusing any aspect of this contest. m. By entering this contest, entrant agrees that BMWSM and the other sponsor of this contest may provide entrant with promotional materials and that BMWSM may release entrant s personally identifiable registration information to the other sponsor for that purpose. BMWSM is not responsible for the use of entrant s personally identifiable information by the other sponsor. n. BMWSM further reserves the right, in its sole discretion, to cancel or terminate this contest if, for any reason, it is not capable of completion as planned (including, but not limited to, for the following reasons: infection by computer virus, technical corruption, force majeure, or non-authorized human intervention that compromises or affects the administration, fairness, integrity, security, or proper conduct of this contest). o. BMWSM shall indemnify and save harmless KSBY, its affiliates, and their respective officers, directors, employees and agents against all demands, claims, actions, liabilities, losses, costs, damages or expenses whatsoever (including reasonable attorneys fees) resulting from or arising out of the use of, or direction to the BMWSM s website, or any portion thereof. p. By acceptance of prize, winner assumes full responsibility for all applicable income taxes, sales taxes, license, and other fees that may apply. q. KSBY, its parent, subsidiary, related and affiliated companies and their respective officers, directors employees and agents shall be released and discharged from any and all legal claims, losses injuries, demands, damages, actions, and /or causes of actions which arise out of and/or in any way related to the prize, the receipt, use and/or enjoyment of the prize and/or the Promotion. r. By entering, participants agree to be bound by these official rules and the decisions of the Sponsors, which shall be final in all matters pertaining to the contest. The Sponsors may deem an entrant ineligible to participate in a contest if the entrant disregards the rules. s. Any claims must be resolved in the state of California. Winner certifies he or she has read, understands and will abide by all contest rules. 6
