6 EXECUTIVE SUMMARY Greater Daka is one of te fastest growing mega-cities in te world. An estimated 300,000 to 400,000 migrants, mostly poor from rural areas, arrive in te metropolitan area annually. In te last 10 years, its population as more tan doubled and is projected to grow from te current 12 million to 20 million in 2020, making it one of te world's largest cities. Te Gazipur City Corporation (GCC) area is a garment ub wit 272 garment factories in te immediate vicinity of te corridors, employing approximately 1 million workers, adding to te floating population. So te government request, te project preparatory tecnical assistance (PPTA) consultants analyzed 6 main corridors in Greater Daka s fringes and recommended te nort corridor as te one wit te best potential to organize urban development and support a mass-transit infrastructure. Te Bus Rapid Transit (BRT) was also recommended as te best mass-transit mode for te selected corridor, wit 20% of its lengt located witin Daka City Corporation (DCC), and 80% located witin te Gazipur City Corporation (GCC). Te Greater Daka Sustainable Urban Transport Project (GDSUTP) - BRT corridor covers a 20 km stretc located in te nortern fringe of Daka connecting Gazipur, Tongi and Uttara areas. Te roadway is a major entry into Daka and is caracterized by severe traffic congestion. Te corridor is caracterized by a dense strip of mixed use commercial, industrial, and institutional land uses wic include informal (non-titled) vendors/awkers operating witin te rigt of way (ROW) as well as formal (titled) commercial enterprises, institutions, and industrial properties. Te Government of te People s Republic of Banglades received loans from Asian Development Bank (ADB), Frenc Development Agency (FDA) and a grant from Global Environmental Fund (GEF). Te project will require maximizing te ROW to accommodate te BRT system. Te resettlement impacts include but are not limited to (i) permanent relocation of vendors/ awkers, (ii) temporary disturbance of income and liveliood, (iii) partial loss of structures, and (iv) permanent land acquisition (strip takings). A video-grapy was carried out along te corridor by te RHD wit support from te feasibility team in February A census survey was conducted from February to Marc Feasibility level design and census survey conducted during project preparation revealed tat a total of 1,962 ouseolds will be impacted due to te proposed project. Te resettlement impacts include: (i) relocation of 1,409 awkers conducting businesses witin te proposed ROW along te corridor; (ii) relocation of 46 non-titled informal settlers and teir residential structures along te nortern banks of te Turag River; (iii) impacts to 497 commercial establisments operating along te corridor, of wic 435 sall experience partial loss of structures, and 62 establisments sall experience loss of storage space witin te ROW; (iv) partial impacts on 6 industrial units along te corridor wic includes (a) 2 industries wose compound walls and vacant lands for a widt of about 1m witin te compound wall are impacted, (b) relocation of a private transformer witin one industrial compound and (c) 3 units were te semi-permanent structures in te front of te industries are impacted. In none of tese 6 industries, te main building of te industry is impacted, and (v) strip taking of land in front of 3 religious properties (including 2 mosques and 1 temple) will be acquired. In addition, temporary income impacts to te 435 permanent commercial establisments and 966 workers impacted in 240 of te 497 commercial structures will result for a period of one mont wen te pre-construction activities contractor Page-1

7 sall carry out te demolition of te portion of te structure and carry out te repairs/restoration of te façade of te structures. Wile te proposed improvements along te corridor are planned witin te available ROW, land acquisition along certain stretces in unavoidable. At present, a total of acres (approximately) of lands will be acquired. Tis includes (approx.) acres of lands under Daka District and (approx.) acres of lands under Gazipur District. A Resettlement Plan (RP) was prepared in accordance wit ADB s Safeguard Policy Statement (2009) and Acquisition and Requisition of Immovable Property Ordinance 1982 (ARIPO), during te feasibility study based on preliminary design. Te RP will be updated by te EPCM as per current census/socio Economic Survey. Te census/socio economic survey as been started by te Resettlement Plan Implementation NGO (CCDB) as per indicated Limit of Work (LOW). CCDB as submitted te cainage wise completed census/socio economic survey forms to te RHD for te entry and updating RP by EPCM. Government of Banglades agreed to implement Te ADB Safeguard Policy to avoid involuntary resettlement werever possible; to minimize involuntary resettlement by exploring project and design alternatives; to enance, or at least restore, te livelioods of all displaced persons in real terms relative to pre-project levels; and to improve te standards of living of te displaced poor and oter vulnerable groups. Roads and Higways Department engaged Cristian Commission for Development in Banglades (CCDB) troug te Asian Development Bank (ADB) for Implementation of Resettlement Plan. Accordingly, CCDB commenced te activities as per given Terms of Reference (TOR) and oter Land Acquisition assistances as per request of Project autority wit te necessary cooperation from Asian Development Bank and Greater Daka Sustainable Urban Transport Project (BRT, Gazipur-Airport) Officials. Te Progress up to te mont of November 2015 (consolidated) along wit issues is furnised in details. Page-2

8 PROGRESS REPORT Greater Daka Sustainable Urban Transport Project (BRT, Gazipur-Airport) 1. INTRODUCTION Tis report presents te progress on te activities carried out by te Cristian Commission for Development in Banglades (CCDB) pertaining to implementation of Land Acquisition and Resettlement Plan (RP) of Greater Daka Sustainable Urban transport Project (GDSUTP) BRT Gazipur- Airport. GDSUTP is a sustainable Urban Transport System (SUTS), witin te Gazipur City Corporation (GCC) and Daka Nort City Corporation (DNCC), wic forms part of Nort Greater Daka, troug te delivery of a 20-kilometer Bus Rapid Transit (BRT) corridor, starting from Hazarat Sajalal International Airport to Gazipur Terminal. Once BRT project is in operation, it will carry, 20 tousands passenger/our/direction and travelling time will be alf of te present. Tis project provides a olistic solution for integrated urban mobility, bearing a demonstration effect as no modern mass-transit system exist in Banglades yet. Te Government of te People s Republic of Banglades wit te major financial assistance from te Asian Development Bank (ADB) as undertaken te Greater Daka Sustainable Urban transport Project (GDSUTP) BRT, Gazipur-Airport. 2. APPOINTMENT OF CCDB Te Roads and Higways Department engaged CCDB troug Asian Development Bank (ADB) for Implementation of Resettlement Plan. An Agreement was signed between te Roads and Higway Department (RHD) and te Cristian Commission for Development in Banglades (CCDB) on June 17, Te Project Director (ACE, RHD), GDSUTP (BRT, Gazipur-Airport) issued CCDB Notice to proceed vide Memo No. 35.RHD BRT (PD) , dated 23/06/2015 in connection wit commencement of te Implementation of Resettlement Plan. Accordingly, CCDB activated te work since June 25, 2015 vide Memo No.CCDB/RU/1212/15 dated 28 June PROJECT LOCATION AND COMPONENT Te major components of te Project are (i) construction of 20 km dedicated bus lane (corridor), out of wic 4.5 km will be elevated 4-lane bus lane, (ii) reconstruction of 8-lane Tongi bridge, (iii) supply of 50 articulated bus, (iv) construction of 7 flyovers, (v) construction of one bus depot at Gazipur, (vi) improvement of 141 access road (out of wic 61 are in Gazipur), (vii) construction of ig capacity drain, starting from Joydebpur intersection to Turag river, (viii) improvement of 6 markets in Gazipur, setting of close circuit T. V. Camera, and (ix) construction of 20 km footpat along te total route. Page-3

Land acquisition along certain stretces is unavoidable. A total acres (approximately) of Land are to be acquired wic includes 3.681(approx.) acres of land under Daka District and (approx.) acres of land under Gazipur District. Tis includes bot of Government and private lands. Te Land Acquisition Plan as been finalizing by EPCM as per finalization of engineering design. 6. LAND ACQUISITION PROCESS IN BANGLADESH Te present legislation (L.A Ordinance, 1982) enables transfer of properties from private ownersip to public ownersip permanently. Te Deputy Commissioner of te District being te Acquiring Body as te legal rigt to assess compensation for loss of property and pay compensation (CCL) to te persons entitled as prescribed under law and and over te land to te Requiring Body (GDSUTP). Te land acquisition is a lengty process and takes muc time. 7. RESETTLEMENT PLAN IMPLEMENTATION (RPI) Were population displacement by te acquisition of land is unavoidable, a detailed updated Resettlement Plan be Prepared wit te development strategy and package aim for improving or at least restoring te economic base of tose affected persons. In tis project, a Page-4

10 resettlement plan as been prepared in accordance wit Asian Development Bank Involuntary Resettlement guidelines. Te RP will be updated and to be included: All Census/Socio Economic Survey Data; Entitlement Matrix; Indicative LA and Resettlement Budget and To assist vulnerable PAPs togeter wit general sections to address issue suc as legal framework troug wic resettlement takes place. Te compensation due under law (CCL) for acquisition and requisition of immovable property will be paid to te eligible Entitled Persons (EPs) troug Deputy Commissioner s Office. RHD will provide additional Compensation and assistance to te Entitled Persons (EPs) bot titled and non-titled complying wit te principles of te ADB guidelines as per a Compensation and Resettlement Policy to be framed in tis connection. Te RPI NGO will assist RHD for smoot implementation of resettlement activities and documentation. 8. KEY ACTIVITIES PERFORMED a. Consultation wit te Roads and Higway Department (RHD), te Deputy Commissioner s Office (DC). 1. Te CCDB ad series of formal and informal meetings wit te RHD and Office of te Deputy Commissioner Gazipur and Daka regard te design of Land Acquisition and Implementation of Resettlement Plan. 2. Te Roads and Higways Department (RHD) is te Executing Agency (EA) and will be responsible for te overall coordination, supervision and execution of te project. A project management unit (PMU) is establised, eaded by a Project Director, and supported by a few RHD Officials. 3. Te project will be implemented by tree governmental agencies: i) Te Roads and Higways Department (RHD) will implement te main corridor restructuring, excluding te elevated section, and will prepare te PPP sceme to finance te BRT terminal near te airport; ii) Te Banglades Bridges Autority (BBA) will implement te 4.5 km elevated section, integrating te new Tongi bridge and te Abdullapur intersection flyover; and iii) Te Local Government Engineering Division (LGED) will implement te BRT terminal in Gazipur and small improvements on feeder roads, local markets. CCDB participated in different meetings wit PMU (RHD), EPCM on te issue of demarcation of limit of work and Land Acquisition of te project. CCDB met wit te LAO of Gazipur and Additional Lao, Daka regarding te LA process and current mouza including utilization of latest land survey and parca/katians. Page-5

11 b. Reconnaissance Visit RHD, CCDB and sub consultant of EPCM (Globe Survey Co.) jointly visited te project side as per Limit of Work. Demarcation/ Marking Activities CCDB as started te Demarcation/Marking activities of Limit of Work (LOW) wit te Globe Survey Company from July 12, CCDB as continued te work wole days in a week as per request of Project Manager-1 (EE), RHD. And also ave completed te Demarcation/ Marking Activities of te project as per design of LOW on August 29, However, it sould be re-demarcated as per final Land Acquisition Plan (LAP) and Limit of Work (LOW) wit te Deputy Commissioners (DCs) Daka and Gazipur. Orientation of Staff Orientation courses were arranged on June 28, 2015 and July 09, 2015 for te staffs at CCDB s ead offices on te principle of resettlement, Census/Socio-economic Survey, Market Survey, Information campaign, local people participation in te implementation process, Tey also acquire idea of about Grievance Redress mecanism and oter allied subjects in te resettlement aspects followed by anoter one day s practical training at field level. Te Training Specialist and respective Area Managers conducted te field level training. Te training was conducted in te ligt for verification of baseline data and field level survey for ascertaining quantum of losses and determining market value of land and oter assets. g. Social Mobilization Meanwile, CCDB ad formal meeting in eac area attended by: Project Affected Persons (PAPs); Teacers, Religious Leader, Social allied personnel, extension workers, NGO members, etc. During tis period, te field staffs made quick reconnaissance visit at te road sites to acquaint wit local people and local condition. During teir visit, tey sougt support and cooperation of te PAPs and oter stakeolders and assuring tem to assist in all possible ways.. Consultation wit te Land Acquisition Officers (LAO) of Deputy Commissioner CCDB discussed wit te Deputy Commissioner s of Gazipur and Daka in respect of te Land acquisition process of te projects. All Deputy Commissioners office assured CCDB all kind of cooperation in planning and implementation of te project. CCDB briefed tat on bealf of RHD CCDB as submitted Land Acquisition Plan to Gazipur DC office on August 20, 2015 and Daka DC office on August 24, CCDB is continuing te liaison wit te LA sections of Gazipur and Daka. i. Baseline Socio-economic Survey Baseline Socio-economic Survey (SES) is an essential component of te Planning process. Te main objective of te SES of te PAPs is to acquire an adequate and reliable database for developing a well-designed Resettlement Plan (RP). Te Socio-economic Survey conducted during feasibility study of te project and all information as been incorporated in te prepared RP. Te SES as been completed by CCDB as per given format (Questionnaires) for te updated RP by EPCM and all completed forms ave been submitted to RHD. Page-9

15 j. Census Survey 1. EPCM developed a Census Survey Form for te preparation of updated RP. CCDB as started te Census/Socio-Economic survey wit te following form on August 04, CCDB as completed census survey on October 2015 and submitted te filled Census/ Socio-Economic Survey forms to te project autority for updated RP. Te Summary of filled Census/ Socio-Economic Survey forms as per cainage wic ave been submitted to RHD by CCDB are as follows: 1. Te Census Survey will cover Affected Houseolds including structures; Land to be acquired and category of Land; Affected trees under private land; Affected Commercial and Business Enterprises (CBEs); Affected Crops/Fis cultivation on private land; Affected Wage Labor; Affected Common Properties; and Vulnerabilities. Te team will use several tecniques of data collection to assess impact of land acquisition and displacement of PAPs. Te Tecniques include: One set of structured questionnaire for collecting requisite information fromi. Heads of ouseold units, and ii Owners/operators of business establisments on te ROW. k. Status of Land Acquisition (LA) Plan Te EPCM Consultant as prepared te Land Acquisition Plan and proposal as per engineering design. And on te basis of Engineering design Land Acquisition (LA) Proposal ave been submitted by RHD to te respective Deputy Commissioners Office. CCDB assisted RHD during submission of LAPs to te DCs. After submission of LAPs, CCDB is continuing liaison wit te LA section including Land Acquisition Officer (LAO) of Gazipur and Daka and rendered few logistic supports to te LA sections as per request of RHD. Te LAP as been scrutinized by DC, Gazipur and tey advised tat te LAP sould be submitted correctly as per LA Manual 1997 (20.1). PD RHD again issued a letter to Gazipur DC on Sept 22, 2015 wit to km August 20, 2015 request to deliver Land Katians and Previous acquired documents. Te LAP will be approved by te CLAC. CCDB as submitted of all latest parcas including plot wise analysis to RHD for revise te LAP as per RHD s request. After computerization of survey data CCDB will be able to assess te individual Entitle Person (EP) and quantum of losses including EP, EC and EP s payment. p. Information Campaign Te Asian Development Bank establises tat te affected people sould be informed and consulted on resettlement and compensation options. Organizing Focus Group of APs will foster consultation. Formation of Focus Group and olding of Fortnigtly Focus Group meeting ave been found very useful for way of raising consciousness of APs/EPs and formulating action to be followed at a later stage of te program implementation. In tis regard, CCDB will organize Focus Groups APs comprising 30 members based on neigborood and etno-cultural affinity. On top of tat an information Brocure written in Bangla wit detail of updated Compensation policy wic will constitute te main education material for public awareness. Tis will be distributed among te EPs and oter stakeolders after finalization of Land Acquisition and Resettlement Plan. q. Interaction wit te PAPs CCDB recognizes te importance in developing a close working relationsip wit te projectaffected persons (PAPs) based on participatory values at all levels. Tis relation will be establis troug day-to-day and face-to-face communication by te CCDB management team field staffs at site excanging views and ideas wit te PAPs. At Project inception, CCDB s team visited te project areas and met PAPs on a reconnaissance visit. During excange visits, te PAPs are encouraged to discuss future actions for ensuring teir active participation in project works. Te details of Group Discussion meetings are stating below: Unemployed people will get employment during construction work; Peoples will get actual compensation for affected properties; Vulnerable APs will get grant/skill training. r. FORMATION OF (i) PROPERTY ASSESSMENT AND VALUATION COMMITTEE (ii) GRIEVANCE REDRESS COMMITTEE (GRC) As per Resettlement Plan a committee for affected property assessment, valuation, and oter for Grievance Redress mecanism to be formed troug Ministry of Road Transport Page-16

22 and Bridges. After finalization of tose committees joint verification of affected properties including teir valuation, market survey, disposal of grievances will be start. s. Discussion Meetings: A series of discussion meeting, review meetings were eld wit Project Director (ACE), RHD, (GDSUTP) BRT Gazipur- Airport, Project Manager 1 & Project Manager 1 of GDSUTP, ADB-BRM, EPCM Consultant, Deputy Commissioners Offices bot Daka and Gazipur. Te major issues discussed are: Revision of LAP, Plot Index, Design Proposals wit DC office bot Daka and Gazipur and census/ses. Meeting wit RHD, CCDB, Glob Survey Company and EPCM Consultant (SMEC) at RHD conference all on te issue of Land Acquisition Plan (LAP) After troug discussion on te above topics te PD gave some suggestions for effective implementation of te project. 9. DETAILED WORK PROGRAMME CCDB as been maintaining close liaison wit te Project Director, RHD, (BRT Gazipur- Airport), Project Managers (EE), & Sub-divisional Engineer, RHD, (BRT Gazipur-Airport), EPCM Consultant for ensuring te Work Program for its own activities. Tis is in consistent wit te overall program for te social/ resettlement component, particularly in respect of te timings and duration of activities. Te work program will be reviewed and detailed tat te period of Contract will be 26 monts including mobilization. 27 12. MONITORING AND SUPERVISION Te Project Director (PD), Project Manager-I and Project Manager-II of GDSUTP, RHD are monitoring te Land Acquisition and Resettlement activities as regular basis. In addition to tat PD and PMs visits te alignment. Regular coordination and review meetings are olding wit te PD, PMs, Engineering Consultant, Implementing NGO and oter field level RHD staff members. Te Project Managers along wit Implementing NGO (CCDB) are closely maintaining liaison wit Deputy Commissioner Daka and Gazipur for different issue of Land Acquisition including minimize te impact of proposed LA. INGO is rendering supports to revise te Land Acquisition and assistance to te LA section of Deputy Commissioners Daka and Gazipur as per discussion wit PD, PMs of GDSUTP, RHD. Te Resettlement Specialist of Engineering Consultant (EPCP) is preparing te updated RP as per Census survey of INGO as per continued discussion wit te Project Director and Project Managers of GDSUTP. Te Property Assessment and Valuation Committee (PAVC) including Grievance Redress Committee for 02 Districts will be formed after getting approval of Resettlement Plan. Montly and Periodical progress report were also reviewed and finalized by te Project Director and submitted to te ADB, BRM. 13. CONCLUSION: Wit te dynamic leadersip of te Project Director, GDSUTP (BRT, Gazipur-Airport), GDSUTP Officials and ADB te image of te Resettlement implementation of GDSUTP will be a presentable position. CCDB is rendering in all sorts of documentary and logistic support for Land Acquisition as per request of RHD. CCDB is trying to acieve te work programmed witin te stipulated time by enancing additional inputs. Page-22
