Summary of Public Participation Process 1. A list of identified authorities and interested and affected parties was compiled (E2). 2. A notification was sent to all identified I&APs that included the required information as per the EIA Regulations 2010 on 25 March 2013 (E2). 3. An advertisement was placed in the local newspapers The Star and Roodepoort Record on 28 March 2013 and 29 March 2013 respectively (E3). 4. An authority screening site visit was conducted on 7 February Meetings on the site where held on 7 February 2013 (CoJ, JRA, DWA) and 20 June 2013 (GDAERD) (E5). 5. The Gauteng Department of Water Affairs (DWA), Johannesburg Roads Agency (JRA) and the City of Johannesburg were sent the notification and BID on 25 March 2013 (E4) 6. Three site signs were placed at the entrance to the SANBS Constantia Kloof Campus, at the fence adjacent to Constantia Boulevard and the CADAC facility across the watercourse and across next to the park area in Florida Park, on 28 March 2013 (E1). 7. Comments received on the notice and BID to date are included in E4. 8. The DRAFT Basic Assessment documentation was made available to all identified I&APs for a specified 40-day commenting period, as well as placed in the Florida Library. JRA would normally fix the embankment, but based on Andre s observations on-site, the embankment would not rank as a priority, and considering the long list of items on JRA s to fix list, the embankment would only be fixed in about 6 years from now. Therefore, JRA is also happy with SANBS getting it done. Notwithstanding the above, CoJ and JRA would have to give final approval on the designs of the embankment stabilisation and related environmental management measures prior to construction. CoJ also require that a sustainable urban drainage systems (SUDS) approach be incorporated into the embankment stabilisation. It was discussed with DWA that the necessary Section 21c and i WUL applications be submitted with CoJ as the applicant, but with SANBS as the implementation agency. In this regard, an agreement and letter of appointment will be required from CoJ and SANBS which must also be clear about who the responsible party will be with regard to future maintenance of the stabilisation (this should be CoJ/JRA). SANBS and CoJ/JRA must sort this issue out. A Section 21a WULA will be required for the borehole. This however will fall under SANBS as the applicant. SANBS will also need to make application to CoJ for the borehole in terms of bylaws and registration processes. Minutes: 1. Purpose of the meeting to focus on the embankment collapse issue. Background to SANBS and importance of the site presented by JK. 2. There is evidence of embankment movement and the embankment has been studied and is currently deemed unstable. 3. There is a critical threat that if the embankment collapsed suddenly there would be a significant negative impact to SANBS operations and facilities, especially to the national blood plasma supply which is stored close to the collapsing embankment. 4. This issue has previously been rectified by CoJ by placing gabions in This issue was raised with GDARD in June 2012, and SANBS advised to submit applications. This was done, yet 6 month delay on the part of GDARD in getting application acceptance letter issued. 6. The situation can be rectified, yet the timeframe to conduct the legislated BAR process is a concern, given the critical nature of the stability of the embankment. 7. DWA has been to site and is supportive, yet WULA still needs to be dealt with. 8. CoJ cannot help immediately and only in 8 years time, since it is strictly their responsibility. 9. Situation is critical especially in rain season, which is coming up. 10. JK asks if embankment issue can be separated out of the BAR process and expedited through issuing a NEMA Directive? 11. CoJ is not desilting area above the bridge on Constantia Boulevard, and this causes the culverts under the bridge to block and be flooded debilitating SANBS operations due to access constraints. 12. The solution proposed is the gabion structure which is more economical and will be effective; similar to the existing gabions in place along a section of the embankment. 13. SANBS is a secure facility and collapse may destroy their fence and compromise security. 14. CS states that a directive from GDARD may not be possible and states that the embankment be separated out into a separate BAR process and expedited as much as possible. 15. If any dramatic change occurs, then SANBS can make the decision to go ahead and then the approval can be dealt with i.t.o. the S24G application process. 16. AF to send floodline and related information within 2 weeks. 17. JK to send EIA/presentation information, EIA schedules and scope variation to GS by Friday 28 June. 18. 35 Response to Comments received on registration and distribution of BID The issues raised by I&Aps are more focussed on the embankment collapse issue, and thus are not directly relevant to this Waste Licence Application. The issues are however included below and form a basis for the background of the Waste License Application. Issue I&AP Response 1. Issue: Embankment Collapse 1.1 Rehabilitation of embankment is supported City of Johannesburg Dept. of Water Affairs Given the critical nature of the situation, the in-principle support is noted. Regulatory timeframes however limit the expedient processing of the required documentation. 1.2 Flood line and wetland demarcation required 1.3 The critical nature of the situation is not being taken up by authorities 2. Issue: Land ownership 2.1 The land on the downstream section along the western boundary of SANBS is not municipal owned. 3. Issue: Waste management 3.1 CoJ supports proposal, requesting registration with local waste management initiatives. Anvil Properties SEFSA SANBS City of Johannesburg City of Johannesburg It is agreed that such critical information must be factored into the proposed design, construction and maintenance of the most effective solution. Geotechnical and hydrological issues dominate this situation. GDARD and DWA have been urged to expedite the decision making on this critical situation. Erf 317/202 is privately owned by Anvil Properties (Pty) Ltd. SANBS has the clear intention to obtain all necessary and relevant approvals and authorizations, and following all necessary requirements by the City of Johannesburg i.t.o. waste management. 35

Background Information Document Environmental Impact Assessment by Basic Assessment (BA) Process South African National Blood Service (SANBS), Constantia Kloof, Roodepoort, Gauteng Department of Environmental Affairs Ref No.: 12/9/11/L1065/3 Gauteng Department of Agriculture and Rural Development Ref No.: 002/12-13/E0144 Introduction The South African National Blood Service (SANBS) has commissioned EcoAfrica Environmental Consultants (EcoAfrica) to conduct a Basic Assessment (BA) Process in support of a proposed upgrade of its existing Constantia Kloof Campus. Established in 2000, the SANBS Constantia Kloof campus receives blood from donor clinics in the Egoli zone, tests and processes the blood and dispatches the blood to blood banks. The proposed upgrade consists of the establishment of a liquid nitrogen storage facility and associated infrastructure, the drilling of a water supply borehole, the licensing and relocation of the existing heath care temporary waste storage activities, and the stabilisation of a compromised section of embankment along a tributary of the Kleinjukskei River. Property Location The SANBS Constantia Kloof Campus is located at No.1 Constantia Boulevard, Roodepoort, Gauteng or GPS co-ordinates 26 9'17.56"S and 27 55'30.06"E. The campus is situated on Erf 921, Constantia Kloof, which is owned by SANBS. The proposed embankment stabilisation of the Kleinjukskei tributary is situated directly adjacent to the Campus on Erven 98 and 924 (see page 2). The boundaries of the Campus are Constantia Boulevard to the north, Hendrik Potgieter Road and the N1 Highway to the east, and the public open space to the south and west. Neighbouring areas surrounding the Campus include residential and commercial areas of Constantia Kloof and Florida Hill suburban areas. Authorising of Listed Activities Application is being made to the Gauteng Department of Agriculture and Rural Development (GDARD) in Johannesburg for the authorising of activities related to the upgrade of the Campus and the embankment stabilisation. In terms of the National Environmental Management Act (Act No. 107 of 1998) (NEMA) and Environmental Impact Assessment Regulations, 2010, as corrected by GN No. R.660 and R.1159 (EIA Regulations, 2010), environmental authorisation is required through a Basic Assessment (BA) Process for Listed Activities 11(x) and (xi), 18(i), 24 and 40(iii) and (iv) of Regulation 544 of 18 June 2010, as well as 4(b)(vi) of Regulation 546 of 18 June Licensing of Waste Management Activities Application is being made to the Department of Environmental Affairs (DEA) in Pretoria for the licensing of the relocation of the existing temporary health care hazardous waste storage facility (in excess of 35 cubic meters), used for bio-hazardous and chemical waste storage. In terms of the National Environmental Management: Waste Act (Act No 59 of 2008) and Government Notice No. 718 Category A, Listed Activities 2 and 18, a waste license is required through a Basic Assessment (BA) Process. 45

46 Licensing of Water Uses Application to the Department of Water Affairs (DWA) may be required for the stabilisation of the river embankment and the proposed borehole. In terms of the National Water Act (Act No 36 of 1998), water use registration is required and licensing may be required in terms of Section 21 a, c and i water uses. 47 BA Process and Public Participation Process (PPP) The BA Process provides for a Public Participation Process (PPP) and the registration of Interested and Affected Parties (I&APs), as well as the opportunity for registered I&APs to comment on BA documentation. All registered I&APs will be notified of the availability of further BA documentation placed for comment. Advertisements and site notices have been placed, and neighbouring properties have been notified of the BA Process. The relevant authorities, parastatal organisation and local organisations identified to comment on this application include City of Johannesburg Municipality (CoJ), the Johannesburg Roads Agency (JRA), Department of Water Affairs (DWA), South African National Roads Agency Limited (SANRAL). Notification has been sent to all these authorities and organisations. Registration Period: Any person may register as an interested and affected party (I&AP) and submit initial comments within a 30-day registration period. Disclosure of any direct business, financial, personal or other interest which the person or organisation may have in the approval or refusal of the application, is required. Registration will close on 30 April You may register and/or submit initial comment by completing and submitting the attached Registration/Initial Comment Sheet, or similar, to EcoAfrica Environmental Consultants.
