1 Submitted by: Prepared by: For reading: Chair of the Assembly at the Request of the Mayor Depts. of Law and Community Development ANCHORAGE, ALASKA AO No AN ORDINANCE OF THE ANCHORAGE ASSEMBLY AMENDING ANCHORAGE MUNICIPAL CODE TITLE, LAND USE PLANNING (NEW CODE EFFECTIVE JANUARY, 0), TO REPEAL THE GROUP LIVING USES SEVERE ALCOHOL DEPENDENT HOUSING AND TRANSITIONAL LIVING FACILITY ; ADD A NEW GROUP LIVING USE SUPPORTIVE HOUSING FACILITY ; AMEND THE DEFINITIONS OF GROUP LIVING USES ASSISTED LIVING FACILITY AND HABILITATIVE CARE FACILITY ; AMEND TABLES OF ALLOWED USES; AMEND OFF-STREET PARKING REQUIREMENTS; AND AMENDING ANCHORAGE MUNICIPAL CODE TITLE, LAND USE PLANNING (OLD CODE EXPIRES DECEMBER, 0), TO REPEAL THE USES SEVERE ALCOHOL DEPENDENT HOUSING AND TRANSITIONAL LIVING FACILITY ; ADD A NEW USE SUPPORTIVE HOUSING FACILITY ; AND AMEND OTHER SECTIONS OF CODE TO EFFECTUATE THE ADDITION AND DELETION OF USES. THE ANCHORAGE ASSEMBLY ORDAINS: Section. Anchorage Municipal Code (new code) section.0.00b.. entitled Severe Alcohol Dependent Housing is hereby repealed and a new section is added as follows:. Supportive Housing Facility a. Definition A residential facility, other than an assisted living facility, correctional community residential center, or habilitative care facility, that provides housing twenty-four () hours a day, and that also provides on-site programs designed to assist residents with connecting to community services, improving daily living skills, securing employment, or obtaining permanent housing. b. Use-Specific Standards i. A small supportive housing facility shall provide housing for no more than six residents, including any support staff living at the facility. A medium supportive housing facility shall provide housing for seven to residents, including any support staff living at the facility. A large supportive housing facility shall provide housing for or more residents, including any support staff living at the facility. ii. On-site programs shall be for residents of the facility only. iii. In residential districts, the design standards for multi- AO 0-

The operator shall submit a management plan for the facility and a floor plan showing all uses and services, including sleeping areas/rooms, residential dwellings or units, emergency exits, and bathrooms Section. Anchorage Municipal Code (new code) subsection.0.00b.. entitled Transitional Living Facility is hereby repealed. Section. Anchorage Municipal Code (new code) section.0.00b. is hereby amended to read as follows (the remaining portions of subsections.-. are not affected and are not included): B. Group Living. Assisted Living Facility a. Definition A facility meeting the definition of an assisted living home under Alaska Statute Chapter., which [THAT] provides housing and ancillary services on a residential basis to three or more adults, and adolescents in appropriate cases as allowed by exception.. Habilitative Care Facility a. Definition A residential facility, other than a correctional community residential center, assisted living facility, or supportive housing facility [OR TRANSITIONAL LIVING FACILITY], the principal use or goal of which is to serve as a place for persons seeking rehabilitation or recovery from any physical, mental, or emotional infirmity, or any combination thereof [IN A FAMILY SETTING] as part of a [GROUP] rehabilitation and/or recovery program utilizing counseling, self-help, or other treatment [OR ASSISTANCE], including but not limited to substance abuse rehabilitation. Such care for persons age and under, who are under the jurisdiction of the state division of juvenile justice, shall be considered habilitative care, and not a correctional community residential center. Section. Table.0-: Table of Allowed Uses-Residential, Commercial, Industrial and Other Districts (new code) is amended as provided in the Attachment A. Section. Anchorage Municipal Code (old code) Section..00 is amended to read as follows (the remaining portions of section..00 are not affected and are not included): Habilitative care facility means a residential facility, other than a correctional community residential center, assisted living facility, or supportive housing facility [OR TRANSITIONAL LIVING FACILITY], the principal use or goal of which is to serve as a place for persons seeking rehabilitation or recovery from any physical, mental, or emotional infirmity, or any combination thereof, [IN A FAMILY SETTING] as part of a [GROUP] rehabilitation and/or recovery program utilizing counseling, self-help or other treatment [OR ASSISTANCE], including, but not limited to, substance abuse rehabilitation. Such care for persons age and under, who are under the jurisdiction of the State Division of Juvenile Justice, shall be considered habilitative care, and not a correctional community residential center. The term "habilitative care facility" replaces the "quasi-institutional house" previously used in this title. A small habilitative care facility shall provide housing for no more than six residents, including any support staff living at the facility. A medium habilitative care facility shall provide housing for seven to residents, including any support staff living at the facility. A large habilitative care facility shall provide housing for or more residents, including any support staff living at the facility. [SEVERE ALCOHOL DEPENDENT HOUSING MEANS A FACILITY THAT PROVIDES HOUSING HOURS PER DAY, OTHER THAN ON A TEMPORARY BASIS, TO SEVEN OR MORE PERSONS WHO ARE SEVERELY ALCOHOL DEPENDENT. PERSONS UNDER THE JURISDICTION OF THE COURTS MAY RESIDE IN AN SEVERE ALCOHOL DEPENDENT HOUSING FACILITY. IT DOES NOT INCLUDE ANY FACILITY WHICH IS A CORRECTIONAL COMMUNITY RESIDENTIAL CENTER, RESIDENTIAL CARE FACILITY, OR HABILITATIVE CARE FACILITY. THE FACILITY MAY PROVIDE SERVICES ACCESSORY TO THE HOUSING SUCH AS AN ON-SITE RESIDENT MANAGER RESPONSIBLE FOR SAFETY MONITORING, PROPERTY MAINTENANCE AND MONITORING, AND HOUSE RULES MANAGEMENT, AS WELL AS RESIDENTIAL SUPPORT STAFF TASKED TO PROVIDE ASSISTANCE WITH DAILY/INDEPENDENT LIVING SKILLS TRAINING AND TO PROVIDE REFERRALS FOR SERVICES SUCH AS MENTAL HEALTH, REHABILITATION, MEDICAL, AND OTHER SIMILAR SERVICES. FOOD SERVICE, LAUNDRY, COMMUNITY RECREATION ROOM, AND OTHER SUCH RESIDENTIAL-RELATED SERVICES AND FACILITIES MAY BE PROVIDED ON-SITE TO RESIDENTS OF THE FACILITY ONLY. GROUP REHABILITATION SHALL NOT BE PROVIDED WITHIN THE FACILITY AS A PRIMARY USE, BUT MAY BE PROVIDED ON AN OCCASIONAL BASIS, ONLY TO RESIDENTS OF THE FACILITY, IF IT IS NOT A REQUIREMENT OF RESIDING IN THE FACILITY.
