LONG On April 1, 2017 at 0257 hours I was traveling westbound on SR 101. I observed the above listed vehicle travel over the fog line of the roadway. I stopped the vehicle and made contact with the driver/owner of the vehicle, Jami Long. I advised her of my reason for stopping her. Jami admitted to traveling over the fog line of the roadway and advised she was distracted. While speaking with Jami, I could smell the odor of burnt marijuana coming from the inside of the vehicle. When looking inside of the vehicle I noticed a green leafy substance on Jami's pants. Jami denied there being any drug's inside of the vehicle. At this time I asked Jami to exit the vehicle. I asked Jami once again if there was anything inside of the vehicle, to which she stated no. Jami was placed in the rear of cruiser #348 unsecured. I went back up and made contact with the front seat passenger of the vehicle, later identified as Jonsay Hayes. Jonsay also denied there being any drugs inside of the vehicle. I asked Jonsay to exit the vehicle. While doing so, I noticed a "Cigarello" fall from Jonsay's lap. When I picked the item up, I noticed it was freshly rolled and contained suspected marijuana. Jonsay immediately denied the item being his and accused me of "planting" it there. Jonsay was detained in handcuffed and his person was searched. Jonsay was also secured in the rear of cruiser #348. A probable cause search was conducted on the vehicle. During the search I located an open bottle of "Hennessy" liquor on the passenger side floor board. Also found was an open bottle of "Bombay Sapphire" Gin, located behind the front passenger seat. Also found behind the front passenger seat was a wooden box containing a pipe, which is commonly used to smoke marijuana, but did not have any residue on it. Jami stated the open container's of liquor belonged to Jonsay. Upon speaking with Jonsay, he admitted they belonged to him. It should be noted, when speaking with Jonsay, I could smell a slight odor of an intoxicating beverage coming from his person. I issued Jonsay a summons for the above listed offenses and he was advised of his court date and time. Jami was given a verbal warning for the marked lanes violation.

7 The marijuana cigar was later logged into evidence locker #9 at the Erie County Sheriff's Office. The two open bottles of liqour were properly disposed of.
