33 Tw Degrees: c-l g-slw cst us $37m; will hit 40% target CHRIS KEALLMONDAY JUNE 15, Respnding t unusually pinted Cmmerce Cmmissin criticism, the third mbile peratr says it has been hurt by c-lcatin delays mre than anyne and that it can still hit its target fr installing its wn gear n Telecm, Vdafne and Wsh twers at 40% f its cell sites. "We share the cmmissin's disappintment," Tw Degrees' chief executive Mike Reynlds says. "The premise that we wuld try t d fewer c-lcatins rather than mre is ridiculus. It s faster and cheaper s fr anybdy t suggest we have purpsely tried t d less is iditic." Last week, a June 2 letter frm the cmmissin t Tw Degrees wasmade public. The letter, frm cmmissiner Anita Mazzleni t Tw Degrees chief executive Mike Reynlds, uses unusually blunt language by the standards f her rganisatin. In it, Ms Mazzleni expresses her annyance that the cmmissin spent tw years fighting fr Tw Degrees right t install its gear n rivals cell twers nly t see the budding third mbile peratr largely ignre the cst-saving pprtunity affrded by its c-lcatin ruling, issued in December. Of its netwrk f 400 r s cell twers in Auckland, Wellingtn and Christchurch, Tw Degrees has nly c-lcated n fur sites (all twers wned by Telecm, NBR understands). In all ther instances, it has built its wn twers. Telecm and Vdafne insiders als expressed their bafflement that they had spent millins preparing fr sites fr c-lcatin with Tw Degrees, at the behest f the cmmissin, nly t see the telc fail t turn up at the c-l party. 34 S why didn t Tw Degrees take the ptin t c-lcate? Chief executive Mike Reynlds says by the time the cmmissin s determinatin n c-l came thrugh, in December, it was t late. His cmpany was already well int its build acrss Auckland, Wellingtn and Christchurch. Separate frm the cmmissin's regulatry effrt, Tw Degrees als tried t reach a clcatin deal directly with Telecm and Vdafne thrugh the Telecmmunicatins Carriers Frum, Mr Reynlds says, but talks brke dwn in March Last week, Tw Degrees resigned frm the self-regulatry bdy, which anther manager dubbed the Telecmmunicatins Cartel Frum. Mr Reynlds als reiterated his cmpanies frequent criticism f the Resurce Management Act. Tw Degrees riginal business plan called fr 39% f its cell twers t use the cheaper clcatin ptin. But the RMA keeps cell twers in New Zealand arund 10m shrter than twers in Eurpe (where c-lcatin is cmmnplace). At many sites, there simply isn t rm fr Tw Degrees gear. Cmbined with the timing f the cmmissin s ruling, this meant Tw Degrees simply culd nt c-lcate at mre than fur sites. What's new? But haven t the limitatins f the RMA, and ur dwarf twers, always been a knwn factr? Yes, says Mr Reynlds. The bit everyne is nt getting, he says, is that Tw Degrees business plan calls fr it t cllcate in 39% t 40% f instances natinwide. After the telc s August launch, its custmers will use Tw Degrees wn netwrk in Auckland, Wellingtn and Christchurch but ram (invisibly, t them) n Vdafne elsewhere. But Tw Degrees has always planned t have build its wn netwrk everywhere, Mr Reynlds says, and frm August nward it will incrementally expand its cell twer rll-ut.

In many mre instances, Tw Degrees will be able t c-lcate with Telecm, Vdafne r Wsh. And nce it has built its netwrk New Zealand-wide (n target date is public), it will have hit its 40% c-l target. N big deal In her June 2 letter t Mr Reynlds, the Cmmerce Cmmissin s Ms Mazzleni als cmplained that Tw Degrees was behind n regulatry filings, including a database f its cell sites. T underline the gravity f the situatin, Ms Mazzleni wrte that - althugh the cmmissin did nt plan it - High Curt actin wuld be an ptin if the telc did nt fulfil its bligatins by June 5.
