3 Introduction Catalina House was registered with the Care Commission on 1 April Catalina House was situated on the shores of the Cromarty Firth, near the town of Alness, in Ross Shire. The accommodation, a former hotel on two floors, had been adapted for use as a care home and was registered to provide a care service to a maximum of 25 adults with mental health problems, of which a maximum of 4 places may be used for respite care. Basis of Report This service was inspected after a Regulation Support Assessment (RSA) was carried out to determine the intensity of inspection necessary. The RSA is an assessment undertaken by the Care Commission Officer (CCO) which considers: complaints activity, changes in the provision of the service, nature of notifications made to the Care Commission by the service (such as absence of a manager) and action taken upon requirements. The CCO will also have considered how the service responded to situations and issues as part of the RSA. The inspection was based upon follow up on any recommendations and requirements from previous inspection, complaints or other regulatory activity. During the inspection which took place on 25th January 2008, the Care Commission Officer met with the service manager and staff and service users. The Care Commission Officer examined the premises, and the range of policies, procedures and records relating to the follow-up of previous recommendations and requirements, complaints or other regulatory activity. This report is based on consideration of the service s compliance with the regulations associated with the Regulation of Care (Requirements as to Care Services) (Scotland) Regulations 2002 (SSI 2002/114) as well as taking account of the following National Care Standards : Care homes for people with mental health problems: Standard 5- Management and staffing arrangements The Regulation of Care (Requirements as to Care Services) (Scotland) Regulations SSI 2002/114 - Regulation 4 (1) (a) - Welfare of Service Users Action taken on requirements in last Inspection Report No requirements were made in the previous inspection report. 5 Regulations / Principles Regulation 4: SSI 114 Regulation 4 (1) Welfare of Users Strengths It had been recommended that service users were risk assessed on admission to the service with regard to their capacity to manage their finances, and the appropriate mechanisms were in place to safeguard them. The service provider had reviewed their policies and a new policy was in place "Adults Lacking Capacity" was in place which incorporated the principles contained within the Adults With Incapacity (Scotland) Act This positive response was noted. Areas for Development Regulation 13: SSI 114 Regulation 13 Staffing Strengths Staff had undertaken some basic training on restraint, but this stopped short of actual training on physical restraint. The manager indicated that the training previously received was felt to be sufficient to safely meet the service user's needs Areas for Development In light of the service user group's needs it is important that the service provider continues to risk assess staff training needs with regard to the need for training in physical restraint. 6 Enforcement There has been no enforcement action against this service since the last inspection. Other Information Fire Safety Issues The Fire (Scotland) Act 2005 introduced new regulatory arrangements in respect of fire safety, on 1 October In terms of those arrangements, responsibility for enforcing the statutory provisions in relation to fire safety now lies with the Fire and Rescue service for the area in which a care service is located. Accordingly, the Care Commission will no longer report on matters of fire safety as part of its regulatory function, but, where significant fire safety issues become apparent, will alert the relevant Fire and Rescue service to their existence in order that it may act as it considers appropriate. Further advice on your responsibilities is available at During the inspection visit it was noted that the home had undergone refurbishment and upgrade and these positive developments were noted.
