3 Introduction Perth and Kinross Council s Adults with Learning Disability service, is registered by the Care Commission to provide a Care at Home and a Housing Support Service. The service is provided by Perth and Kinross Council s Social Work Department to adults with learning disabilities requiring care and housing support services in their own home. The service aims to: develop and encourage tenants decision-making skills and involvement in the planning for all aspects of their lives. Basis of Report Before the Inspection The Annual Return The service submitted a completed Annual Return as requested by the Care Commission. The Self-Evaluation Form The service submitted / failed to submit a self-evaluation form as requested by the Care Commission. Regulation Support Assessment This service was inspected after a Regulation Support Assessment (RSA) was carried out to determine the intensity of inspection necessary. The RSA is an assessment undertaken by the Care Commission Officer (CCO) which considers: complaints activity, changes in the provision of the service, nature of notifications made to the Care Commission by the service (such as absence of a manager) and action taken upon requirements. The CCO will also have considered how the service responded to situations and issues as part of the RSA. This assessment resulted in this service receiving a low RSA score and so a low intensity inspection was required as a result. The inspection was then based upon the relevant inspection focus area(s) and follow up on any recommendations and requirements from previous inspections, complaints or other regulatory activity. During the inspection process During the visit which took place on 25th March 2008, the Care Commission Officer spoke with the Manager, Senior Social Care Officer and 2 Social Care Officers. 20 staff questionnaires were distributed to a random selection of staff within the registered service. A total of 16 questionnaires were completed and returned. Evidence was gathered from a number of sources including: Service users' personal plans Policies & Procedures Essential records The Care Commission Officer reported on the inspection focus areas of: Restraint Adult protection The inspection also took into account the Regulation of Care Act (Scotland) 2001 and the 3/8

4 Regulation of Care (Requirements as to Care Services) (Scotland) Regulations 2002, Scottish Statutory Instrument 114, referred to below as SSI 2002/114. Fire Safety Issues The Fire (Scotland) Act 2005 introduced new regulatory arrangements in respect of fire safety, on 1 October In terms of those arrangements, responsibility for enforcing the statutory provisions in relation to fire safety now lies with the Fire and Rescue service for the area in which a care service is located. Accordingly, the Care Commission will no longer report on matters of fire safety as part of its regulatory function, but, where significant fire safety issues become apparent, will alert the relevant Fire and Rescue service to their existence in order that it may act as it considers appropriate. Further advice on your responsibilities is available at Action taken on requirements in last Inspection Report The three requirements and two recommendations made in relation to safe recruitment have been satisfactorily addressed. Comments on Self-Evaluation The service completed a self evaluation document, which identified how it was meeting specific National Care Standards and Themes. View of Service Users A Lay Assessor and Lay Assessor Coordinator participated in the inspection on 25th March and visited 4 service users. (Lay Assessors are volunteers working with the Care Commission with experience of using care services and authorised to take part in inspections). 5 Regulations / Principles National Care Standards National Care Standard Number 4: Care at Home - Management and Staffing Strengths The focus areas of adult protection, child protection in adult care services, Scottish Social Services Council, staff training and restraint will be reported on within this standard. The service had copies of the following guidance: 'Rights, Risks and Limits to Freedom', the principles and good practice guidance, Mental Welfare Commission 'Safe to Wander', Mental Welfare Commission The service had a policy and procedure regarding restraint and maintaining appropriate records. This document made reference to best practice guidance such as: 'Rights, Risks and Limits to Freedom', the principles and good practice guidance, Mental Welfare Commission At the time of inspection there were no incidents of restraint recorded. Personal plans observed by the Care Commission Officer all contained relevant risk assessments in relation to issues of restraint. There was evidence that staff had received specific CALM training. A permanent trainer was employed by the local authority. The Manager was aware of the qualifications required for staff to register with the Scottish Social Services Council. There was evidence of appropriate manager's award and S.V.Q training having been obtained. The service was supported by a separate training department, which had undertaken a training needs assessment on the staff group, and from this a staff training programme had been developed for The Manager confirmed that they work in conjunction with the training department to ensure that training development is relevant to specific service delivery. Evidence of training plans were available during the inspection. Through discussion with staff, it was evidenced that vulnerable adults training had been provided. The Manager, and staff who spoke with the Care Commission Officer were aware of the service's adult abuse procedure and area inter - agency adult protection procedures. Areas for Development A system to directly observe and monitor staff practice was not in operation. (See recommendation 1). 6 Not all elements of this standard were inspected. The service operated a quality assurance system which was built into their team development plan. The service provided opportunities for service users to comment on the service they received. Formal reviews were recorded within service users plans. In addition, information gathered by an independent advocacy agency had been collated. Relatives and representatives of service users had the opportunity to meet staff and provide direct feedback regarding service delivery - during six monthly reviews and open days. During team meetings and daily meetings, staff were given the opportunity to make comment on service delivery. Areas for Development None identified within this inspection 6/8

7 Enforcement There has been no enforcement action against this service since the last inspection. Other Information This part of the report was written by a Lay Assessor. On arrival, we were made very welcome by the staff of the service. After chatting about the service over a cup of tea, we then organised a timetable to allow us time to visit 4 service users in their own homes. I told the service users about the Lay Assessor Scheme, explained about the new grading system and talked about service users participation - I also asked the following questions: Do you like your home and the service? Do you feel safe and secure? Is Person Centred Planning in place? Do you get choices? Are you involved in the interviewing of staff? The first service users said that they: were very happy in their home felt safe and secure enjoyed going to the Isla Road Day Centre. went out for walks, went shopping and enjoyed writing The local pub was a favourite place and the lager was good Going out for meals was lovely Planned their meals for the whole week - mince & tatties, fish and chips, tuna, banana s and weetabix were some of their favourite foods. He helped with the household chores by hoovering and helping to do the dishes he always brought his dirty washing through to the kitchen to put it in the washing machine! I enjoy my holidays - here are some photo s that were taken in Blackpool! We hope to go away again this year- in the summertime My brother and sister-in-law come to visit We are moving to a new flat - I ve picked a new blue carpet for my bedroom and I m really looking forward to moving I don t get involved in any interviewing The next service user said: Oh! I love my house - I feel very safe here! I go to Gleneagles - it s great I m going shopping this afternoon I need to buy some things! My flatmate helps with the chores I help to change the bed My brother and nephews come to see me We went away on holiday last year wasn t very nice, so I m not fussy as to whether I go away this year I like being at home I enjoy Coronation Street and East Enders We plan all our meals for the week I like a nice casserole and enjoy my tea and toast in the morning at breakfast time. Never been involved in the interviewing of staff I m going to the Fiddlers Rally at the Concert Hall, Perth. The fourth and final service user that I spoke to, made the following comments: 7/8

8 I enjoy living here with my flat-mate I m very, very happy here We are going to decorate soon and I ve picked the colours of the paint already I like watching Coronation Street on the telly I got an Easter egg last week My sister comes to see me here! I go to college on a Wednesday and my Drama group on a Friday I go to stay with my aunt every fortnight I go to Can able and Perth ARC Elvis Presley - (thumbs up and a big smile) - I have a guitar This morning we went to the bank, then to Tesco for the shopping and we then got a taxi home! I pick what I want to eat - I love spaghetti bolognaise and garlic bread and my care assistant makes a great curry and rice - its delicious! - My favourite treat is Irn Bru! I m having quiche and coleslaw- when you leave! I hope to go to Blackpool this year for my holidays - We will take a few cars and drive down. I went to the Royal Highland Show ground in Edinburgh with my drama group to perform One staff member said: We were encouraged to meet with service users before we were employed we had a get-together for this Requirements Recommendations Recommendation 1.
