1 TITLE Mental Health Law and Policy SI MODULE CODE N CREDITS 30 LEVEL 7 JACS CODE L500 SUBJECT GROUP Social work DEPARTMENT Social work, social care and community services MODULE LEADER Aileen Moore MODULE STUD HOURS (based on 10 hours per credit)* Scheduled Learning and Teaching Activities Placement (if applicable) Independent Guided Study MODULE DESCRIPTOR Total Number of Study Hours MODULE AIM This module aims to provide students with the knowledge of the legal and policy framework required to undertake statutory duties and roles specified in the Mental Health Act 1983 (amended 2007) and the skills to demonstrate competence in applying the law in supervised practice according to professional codes of practice and ethics. MODULE LEARNING OUTCOMES By engaging successfully with this module a student will be able to 1. Critically apply knowledge of mental health legislation, related codes of practice and national and local policy guidance to complex and high risk situations in the wider context of other relevant legislation, in particular the Children Act 1989, Children Act 2004, Human Rights 1998 and the Mental Capacity Act 2005 and DOLs taking account of values such as rights and choice and diversity; 2. Apply in-depth knowledge and understanding of the particular needs of children, young people, their families and communities to AMHP Specialist Mental Health practice in the context of those particular needs, taking into account risk and rights ; 3. Critically evaluate a range of research and evidence based practice to analyse local and national policy that informs AMHP specialist mental health practice. 4. Define the legal position and accountability of AMHPs in relation to the Acts, any employing organisation and the authority on whose behalf they are acting including safeguarding roles. National and local Codes of Practice Service users and carers perspectives Relevant case law

2 The AMHP role, powers, accountability and responsibilities The AMHP role - interpreting and applying legally defined threshold criteria in complex practice situations (risk, rights, judgements and dilemmas in decision making). Other statutory roles within the legislation that interface with the AMHP role The AMHP role in inter-professional practice LEARNING, TEACHING AND ASSESSMENT - STRATEG AND METHODS Students will be supported in their learning, to achieve the above outcomes, in the following ways Tutor led / directed learning Lectures and interactive workshops led by university tutors and expert practitioners from a variety of mental health settings will provide opportunities for students to explore the application of the law in practice. Tutorial support will be provided for the presentation and case study assessments.
