4 1. INTRODUCTION 1.1 The Commissioning Safeguarding Children Policy outlines the responsibilities of the IOW CCG and the services it commissions to ensure compliance with statutory duties (Children Act 2004 s.11) which places a duty on NHS bodies to make arrangements to ensure that their functions are discharged with regard to the need to safeguard and promote the welfare of children. 1.2 This policy will be reviewed in accordance with revisions of statutory guidance and associated national policy. 2. GOVERNANCE 2.1 The A lead director within IOW CCG will have safeguarding within their portfolio. The IOW CCG will employ or have service level agreements to have a designated nurse and a designated doctor for safeguarding children. In addition to these posts, a designated doctor and nurse with Looked after Children expertise will need to be commissioned, and a paediatrician for child death. It may be decided that these posts could be commissioned under the collaborative commissioning arrangements. 2.2 The designated professionals will support IOW CCG personnel and provide expert advice to the IOW CCG and to named professionals within the services they commission. 2.3 Safeguarding children and young people will be supported by the IOW CCG governance structure with regular reporting to the Quality and Patient Safety Committee and the Board. 2.4 The NHS Commissioning Board (NHSCB) and its regional and local offices will have a safeguarding lead to ensure safeguarding is embedded within its structures. 2.5 A Named GP will be appointed to support Primary Care. The Named GP will be supported by the NHSCB Local Area Team. 2.6 The IOW CCG will also be a statutory partner (Children Act 2004, s.13) of the IOW Local Safeguarding Children Board (IOW LSCB). 3. SAFE GUARDING TRAINING 3.1 The personnel within the IOW CCG will be trained at the appropriate level for their contact with children (as per statutory 1 and professional guidance 2 ). They will also be encouraged to access the training provided by the IOW LSCB. 4. QUALITY MONITORING 5.1 Contracts with providers will outline the requirements under legislation to safeguard children and young people, as per NHS Commissioning Contract Schedule 2, Part L. It will be the responsibility of the contract team to produce a service specification for safeguarding children to be included in the 1 HM Government (2010) Working Together to Safeguard Children: a guide to inter-agency working to safeguard and promote the welfare of children London: Department for Children, Schools and Families. 2 Royal College Paediatrics and Child Health, Royal College of Midwives, Royal College of Nursing, Royal College of General Practitioners, Community Practitioner and Health Visitor Association (2010) Safeguarding Children and Young People: Roles and Competences for Health Care Staff London: RCPCH. 5 contracts that reflect legislative and current requirements. Support will be given by the designated leads. 4.2 The procurement procedure for providers will include safeguarding children as a requirement in their bids. The designated professionals will provide the expertise to review the safeguarding requirements of the bidders. 4.3 The contracts team will be responsible for monitoring contracts for compliance, with support from the designated professionals for the safeguarding children requirements, where necessary. 4.4 Designated professionals will supervise named professionals from provider organisations or have a monitoring arrangement in place with providers to support them in their safeguarding practice. The designated professionals can therefore inform the contracts team of the quality of provision of safeguarding within providers and escalate any risks identified. 4.5 In the event of a Serious Incident Requiring Investigation (SIRI) or other risks identified with any provider which relate to potential safeguarding children concerns, the designated professionals will assist in reviewing safeguarding standards and advising the IOW CCG of the necessary action required. 4.6 The Director responsible for safeguarding and the designated professionals will be members of the IOW LSCB (and ensure appropriate sub-committee representation). The LSCB has a responsibility for quality assuring inter-agency work. 4.7 The CCG will have regular reviews of risks and monitor any trends in safeguarding children. Quality improvement activities (e.g. audit) will be supported as part of a programme of continuous improvement. 5. PARTNERSHIP WORKING 5.1 The IOW CCG will be represented on the IOW LSCB; the key statutory body for inter-agency working. Where safeguarding is under a collaborative commissioning arrangement with two or more CCGs a robust framework will need to be demonstrated to allow effective commissioning, governance and assurances. 5.2 The IOW CCG will work in partnership with the IOW LSCB when undertaking serious case reviews or other reviews where there are multi-agency learning outcomes. 5.3 In regard to Multi Agency Public Protection Arrangements (MAPPA) the IOW CCG will work together with the MAPPA arrangements where requested to manage the risk to the public. The IOW CCG will also provide support to other risk assessment processes e.g. MARACs SAFE WORKING PRACTICES 6.1 The IOW CCG will have in place safe working practices which include: Whistle-blowing policy Safe recruitment practices, to include appropriately trained interviewers, CRB checks Induction training in safeguarding Management of allegations against members of staff NHS Isle of Wight Clinical Commissioning Group 5
