2 Overview The need and desire for utilities, load-serving entities (LSE s) and retail electric providers (REPs) to provide their customers with renewable energy is driving greater competition for renewable energy procurement. Renewable portfolio standards (RPS), environmental requirements to reduce carbon emissions, government incentives to promote the development of renewable energy generation resources, public opinion and other measures are turning the procurement process in some parts of the country into a dead scramble. A common and critical element of the renewable energy resource procurement is competitive bidding. In an effort to comply with these multiple public policy drivers and diversify overall energy portfolios, utilities, LSE s and REP s are customarily issuing requests for proposals (RFPs) for the purchase of renewable energy, renewable energy certificates (RECs) and related generating assets. The RFP (and its related instruments) process is, for the most part, tried and true. Yet, many participants in the RFP process on both the buy side and the sell side indicate that procurement RFPs could benefit from better planning and administration. How the RFPs are constructed and drafted are key elements in yielding optimum results. This symposium will be a timely opportunity for utility and power professionals, as well as service providers involved in the RFP procurement process, to network with their peers and related renewable energy service providers to address the key issues involved in preparing, administering, and responding to RFPs for the procurement whether through simple energy transactions or more complex construction and sale of renewable energy generating facilities of renewable energy power supplies. 5 Symposium instructors Dan Bradley / Director Energy Practice / Navigant Dan Bradley is a Director in the Energy Practice specializing in procurement and resource planning with a recent focus on Renewable Energy Credits (RECs) to help meet state RPS targets, renewable generation (solar, wind), energy efficiency and demand response. Over the past 10 years, Dan has assisted clients in procuring over 2,000 MW of generation including solar and renewable resources, over 2 million RECs, 1,000 MW of HVDC transmission, energy efficiency programs/initiatives, peak/demand response programs, generation biddings service. Dan s experience also includes participation in PJM/NYISO stakeholder processes, resource planning, electric/energy plans and resource decision making. Ben Foster / Senior Vice President / Optony Inc Ben Foster is Senior Vice President for Optony Inc. He has over 20 years of management experience and is responsible for the US operations of Optony. He is responsible for driving positive change for the environment while enabling the solar energy market, system owners and investors to achieve long-term value while lowering project risk. Mr. Foster has participated in and led collaborative efforts to improve best practices and deploy them across the United States and in China including federally-funded projects, industry whitepapers, and best practice guides. Previously, he was in the global business information industry working at the VP level for a diversified software and content company based in San Mateo, CA and at McGraw-Hill s Business Information Group, the number one worldwide B2B resource for the Construction, Energy and Aviation industries. There he was responsible for driving growth and operational improvement, building customer retention programs, and establishing business operations in Manila, Belfast, Delhi and Coimbatore. He is currently on the Board of Directors for Joint Venture: Silicon Valley Network (Chair of the Federal Outreach Committee), and Clean Cities Coalition of Silicon Valley. He is also on the California Schools of the Future task force for renewable energy, sponsored by the State Superintendent of Public Education. Ben previously served on the elected Board of Directors for the University of Colorado, Boulder Alumni Association. Caroline Judy / Assistant Director General Services Agency / County of Alameda Caroline Judy is the Assistant Director for the County of Alameda General Services Agency. She has administrative and strategic leadership responsibilities for GSA s 436 employees and department budgets totaling $135 million. Her areas of focus include developing performance metrics, improving disaster preparedness, and managing the procurement outreach program for small, emerging and local businesses. She is also actively engaged in large design/ build construction projects and sustainability, energy efficiency and renewable energy initiatives. She helped initiate the Silicon Valley Renewable Energy Procurement, and is currently working on an expanded initiative referred to as the Regional Renewable Energy Procurement, encompassing four Bay Area Counties. 5

6 Symposium instructors (continued) Bob Kendall / Managing Director - Energy / Navigant Robert (Bob) Kendall leads the Procurement Services group in Navigant s Energy Practice. His national and international work has supported clients in the areas of: procurement of new fossil-fuel and renewable generation and undersea transmission projects; negotiations of complex power purchase, interconnection, and transmission rights agreements; litigation support and expert witnessing; electric market design; and economic and financial analysis. As an electrical engineer, business man, and lawyer with more than 45 years experience in the electric power industry, Mr. Kendall brings deep and unique insights to solving complex issues involving procurement of generation and transmission resources and the resulting contracts. With a broad representation of representing investor-owned utilities, municipal entities and independent developers, he has played key roles in the development of new electric generation and transmission projects; served as an expert and policy witness in numerous regulatory and court proceedings involving contract interpretation, damage assessment, and fuel and purchase power costs; negotiated new contracts for the purchase and sale of electric power and transmission services; managed the operations of electric generation facilities; managed an independent generation development and operating company; managed regulatory and rate proceedings before federal and state regulatory commissions including fuel and purchase power cost proceedings; and managed the administration of contracts having payments of in excess of $3 billion per year. Mark Safty / Partner and Chair of the Energy & Infrastructure Group / Holland & Hart, LLP Mark Safty is a partner and Chair of the Energy and Infrastructure Group at Holland & Hart, LLP, where for more than 25 years he has represented companies operating on five continents in virtually every type of infrastructure development and financing transaction. He has extensive experience developing and financing projects in the renewable energy, healthcare, water, wastewater, and transportation sectors. He also teaches Renewable Energy Law and Policy courses at the Denver University and University of Colorado Law Schools. Mr. Safty was appointed as the Wirth Chair in Sustainability at the University of Colorado in The Wirth Chair is housed within the School of Public Affairs at the University of Colorado-Denver and honors the environmental and sustainable development achievements of former U.S. Senator, and Undersecretary of State and President of the United Nations Foundation, Tim Wirth.
