1 Date of Meeting: July 3, 2018 # 5 BOARD OF SUPERVISORS BUSINESS MEETING ACTION ITEM SUBJECT: ELECTION DISTRICT(S): Smart Scale Project Selection for the Commonwealth Transportation Board Six Year Improvement Program (FY FY 2025) Countywide CRITICAL ACTION DATE: July 3, 2018 STAFF CONTACT(S): Bob Brown, Transportation and Capital Infrastructure Penny Newquist, Transportation and Capital Infrastructure Joe Kroboth, III, Transportation and Capital Infrastructure PURPOSE: To obtain Board of Supervisors (Board) endorsement and priorities for up to ten candidate projects for submission to the Virginia Department of Transportation (VDOT), and the Department of Rail and Public Transportation (DRPT) for Smart Scale funding in the Commonwealth Transportation Board s (CTB) Six Year Improvement Program (SYIP) for FY FY 2025, and the Board s endorsement of a resolution of support for submission with the applications. Furthermore, DTCI is seeking endorsement of a letter of support from the Board for a Smart Scale Application being submitted by Fairfax County for the Rock Hill Road Bridge (Davis Drive Extension and Dulles Toll Road: Rock Hill Overpass). 2 Item 5, Smart Scale Project Selection for the CTB Six Year Improvement Program (FY FY 2025) Board of Supervisors Business Meeting July 3, 2018 Page 2 TRANSIT APPLICATION: Americans with Disabilities Act (ADA) Transition Plan - Construct ADA compliant bus stops throughout Loudoun County BACKGROUND: On March 1, 2018, the CTB began accepting Pre-Applications for Round 3 of Smart Scale funding for the period FY FY The pre-application period (Phase 1) ended on May 31, There were no limits on the number of pre-applications submitted. At the May 1, 2018 Board Meeting, DTCI presented Item #7 1 in preparation for the FY SYIP Smart Scale Program. Item # 7 included a staff review of all projects listed in the Board Adopted FY Capital Improvement Program (CIP) and recent planning studies completed by DTCI. Staff developed an extensive list of potential projects for both the Roadway and Transit Programs in Loudoun County. At the May 1, 2018 Business Meeting, the Board voted (9-0) to add Northstar Boulevard, between Shreveport Drive and Route 50, to change the Route 15 Improvements project limits to extend from Montresor Road to the Point of Rocks Bridge, and requested that staff bring a follow-up action item to a July 2018 Business Meeting to present recommendations and suggested priorities for up to 10 highway and 10 transit projects to be submitted to Smart Scale prior to the August 1, 2018 deadline (Attachment 1). Subsequent to the Board s action, DTCI learned from DRPT that the relocation of a canopy from the Dulles North Transit Parking Lot would not be eligible under Smart Scale. The list of Transit projects now includes one project, the ADA Compliance Transition Plan for Bus Stops. ISSUES: The Smart Scale application and resolution deadline is August 1, The 18 highway projects listed in Table 1 will need to be reduced to 10 in order to fully complete detailed Applications by August 1, Completed Applications will be considered for Smart Scale funding in the CTB FY SYIP. Northern Virginia Transportation Authority (NVTA) Funding: On June 14, 2018, the NVTA approved funding of $304,947,000 for eight of the nine Loudoun County projects that were submitted in December of Of the eight Loudoun County projects recommended for inclusion in the NVTA Six Year Plan (SYP), seven of these projects were part of the 18 preapplication applications supported by the Board. Therefore, DTCI staff is recommending six of these projects be removed from consideration. With the adopted SYP by NVTA and the $25 million TIGER Grant award, these projects will be funded at a level equal to the County s adopted CIP.

3 Item 5, Smart Scale Project Selection for the CTB Six Year Improvement Program (FY FY 2025) Board of Supervisors Business Meeting July 3, 2018 Page 3 Staff recommends that the Shellhorn Road project continues to be considered for Smart Scale funding. This project is funded in the Adopted FY 2019 FY 2024 CIP with $86,787,000 in General Obligation Bonds. This project should score well under the Smart Scale criteria, especially under congestion relief. Staff is proposing a Smart Scale request of $44 million which, if awarded, would reduce the currently planned $86,787,000 in General Obligation funding to $43,393,500 thus increasing bond capacity for other projects in the County s CIP. With the NVTA approval of the SYP, and staff recommendation to not submit Smart Scale application for six of the eight projects in the approved SYP, the original list of 18 highway projects was reduced to 12 projects. Ryan Road and Proffers: The widening of Ryan Road between Northstar Boulevard and Evergreen Mills Road has a proffer from one of the Brambleton Applications. Brambleton Land Bays 1, 3 and 5 proffered to construct Ryan Road prior to issuance of the 5,500th zoning permit. Currently Brambleton has received 5,041 zoning permits, leaving approximately 450 zoning permits to go before they are required to have their portion of Ryan Road constructed. There is also an active application (Ryan Assemblage ZMAP ) that has a draft proffer to complete the widening for Ryan Road that is not part of the Brambleton proffer. The latest Smart Scale Guidelines has set a new policy with respect to how proffers will be treated in evaluating a project: For a project phase or element that is expected to be funded or accomplished through proffers, the costs and benefits associated with that project element will be excluded from consideration in evaluating and rating the project for Smart Scale. If the applicant desires to submit a project with proffered conditions and seeks to obtain Smart Scale funding for, or in lieu of the proffer, the proffer must have been legally rescinded or terminated before the applicant may submit an application for the project. A proffered improvement cannot be funded through Smart Scale even if it is based on a future trigger. Therefore, DTCI staff recommends that the Ryan Road widening project be removed from consideration for this Smart Scale round of applications, reducing the list of potential applications to 11. Route 50 at Everfield Drive: The Willowsford Group is a by-right development that has agreed to pay for a traffic signal when warranted. Although not a Proffer, VDOT may consider this project to be fully funded. Therefore, DTCI staff proposes to eliminate the Roundabout on Route 50 at Everfield Drive from consideration for Smart Scale funding. Also, if this project were selected for Smart Scale funding, it would become federalized, requiring costly changes to the design. For these reasons, DTCI staff recommend that this project be eliminated from further consideration. Project Ranking: To address the question of ranking, DTCI staff prepared its own matrix based on the six factors used by the CTB s Smart Scale evaluation process. Listed below are the six measures and weights assigned by the CTB to develop a score for each project:

Congestion Mitigation (45%) 3. Accessibility (15%) 4. Environmental Quality (10%) 5. Economic Development (5%) 6. Land Use Coordination (20%) DTCI staff assigned a score between 1 (lowest) and 5 (highest) for each project under each measure. The score (1 to 5) was then multiplied by the percent (points) that the measure is given. For example, congestion mitigation is 45% of the 100 points, and a score of 2 would result in a factor score of 0.9 (derived from 0.45 times 2 equals 0.9). The scores derived by this process can only be considered staff scoring, and may not reflect final scores after review by CTB. The CTB uses a sophisticated computer model to evaluate the scores for each measure, whereas the staff is using intuitive decision making to identify the score. Other qualitative factors that staff considered in ranking project readiness, and public input from the on line survey. Based on the staff ranking process described above, the remaining 10 highway projects endorsed by the Board at the May 1, 2018 Business Meeting ranked as follows: Table 1. On May 23, 2018, the Public Affairs and

5 Item 5, Smart Scale Project Selection for the CTB Six Year Improvement Program (FY FY 2025) Board of Supervisors Business Meeting July 3, 2018 Page 5 Communications Division with the Office of the County Administrator issued a news release indicating the County was seeking public feedback on the 18 highway projects endorsed by the Board of Supervisors for funding from the Virginia Department of Transportation s Smart Scale program. The announcement provided a link to an interactive online survey map as part of the County s Geohub that illustrates where each proposed project is located in the county. By clicking on the names of projects, survey respondents read brief descriptions of the projects. Survey respondents were able to leave comments about the proposed projects. The opportunity for comments began on May 23, 2018, and ended on June 15, The survey map and final tally is posted at Attachment 3 provides a summary of the input from the online survey. Rock Hill Road Bridge (Davis Drive Extension and Dulles Toll Road: Rock Hill Overpass): Fairfax County has estimated the cost of this project at $100 million dollars. To date Loudoun County and Fairfax County each contributed $500,000 for a feasibility study. NVTA, as part of their adopted SYP, approved $20,000,000 for the project for Fairfax County. Fairfax County is now applying for $30 million in Smart Scale funds, using the $20 million from NVTA and $1 million from the feasibility study as a local contribution. DTCI staff is seeking Board endorsement for a letter of support for the Fairfax County Smart Scale Application. Resolution: A resolution of support from the Board (Attachment 4), approved in a public forum with adequate public notice, is required at the time of application. The resolution of support will be uploaded in the SMART Portal as part of the project documentation. DISCUSSION: Once the Competitive Application Phase closes on August 1, 2018, VDOT and DRPT will complete the scoring process with the State Office of Intermodal Planning and Investment (OIPI). This action is scheduled to be completed in January If a project is disqualified ( screened out ) by not meeting any of the minimum requirement(s) for funding under the Smart Scale program, the Applicant will be notified by January The list of qualified projects will be provided to the CTB to inform their funding decisions for project inclusion in the FY FY 2025 Statewide SYIP. The CTB is not required to fund the highest scoring projects; but it is expected to provide a rationale if a project with a lower score is funded over projects with higher scores. SYIP is expected to be adopted by the CTB in June The next opportunity for the County to submit new Smart Scale applications (Round 4) will begin in 2021 and completed in June FISCAL IMPACT: DTCI is utilizing contractual services to assist in the development of these applications. Preliminary cost estimates for these services are approximately $40,000 and are available in DTCI s FY 2019 operating budget. ALTERNATIVES: 1. The Board can recommend the 10 Roadway and one Transit projects as shown in Table 1, as Loudoun County s submission for Smart Scale Applications for the SYIP for FY FY

The Board can approve a letter supporting Fairfax County s Smart Scale application for the Rock Hill Road Bridge project and inclusion of that support in the Resolution (Attachment 5). OR 3. The Board can propose alternatives to the staff recommendation of projects. DRAFT MOTIONS: 1. I move that the Board of Supervisors endorse the projects in Table 1, as shown in the July 3, 2018, Board of Supervisors Business Meeting Action Item, and request the Department of Transportation and Capital Infrastructure staff to submit a grant application for each of these projects under the Smart Scale Round 3 program. I further move that the Board approve the Resolution of Support for Smart Scale Projects in Loudoun and the Rock Hill Road Bridge (Davis Drive Extension and Dulles Toll Road: Rock Hill Overpass) located in Loudoun County and Fairfax County for the Commonwealth Transportation Board s Six Year Improvement Program (SYIP) for the period FY FY 2025, included as Attachment 4 to the July 3, 2018, Board of Supervisors Business Meeting Action Item. I further move that the County Administrator transmit a letter of the Board s support for the Rock Hill Road Bridge (Davis Drive Extension and Dulles Toll Road: Rock Hill Overpass) located in Loudoun County and Fairfax County for Smart Scale Funding, included as Attachment 5 to the July 3, 2018, Board of Supervisors Business Meeting Action Item, to be sent to the Virginia Secretary of Transportation and the Commonwealth of Virginia. 10 A RESOLUTION OF THE BOARD OF SUPERVISORS OF LOUDOUN COUNTY, VIRGINIA AS AN ENDORSEMENT OF THE SMART SCALE GRANT APPLICATIONS WHEREAS the Commonwealth Transportation Board (CTB) requires a resolution of support from the governing body of any eligible organization submitting a SMART SCALE project application; AND WHEREAS the Loudoun County Board of Supervisors met on July 3, 2018, to review projects for selection as the County s SMART SCALE project applications; AND WHEREAS the Loudoun County Board of Supervisors recognizes that Fairfax County will be submitting a Smart Scale Application for construction of the Rock Hill Road Bridge (Davis Drive Extension), and that a portion of the bridge is located in Loudoun County, and that the Counties of Loudoun and Fairfax have equally contributed $500,000 for a $1,000,000 feasibility study for this project. As you are aware, the Smart Scale project prioritization process requires localities submit documentation for projects with funding other than the Smart Scale request, to demonstrate the applicant's intention to fund the remainder of the projects using funding other than Smart Scale.
