2 Terms and Conditions Checkbox [Required] Georgetown University Law Center Student Group Fundraising Policy The Student Group fundraising policy was developed to clarify existing practices associated with student group fundraising and ensure a consistent process. This policy will allow student groups to host special events that require funding beyond what is available through Law Center resources and minimize conflicts with other fundraising efforts at the Law Center and within Georgetown University. In the context of this policy, student groups are defined as student organizations, journals, Barristers Council, and the Pro Bono Board. Fundraising for the Equal Justice Foundation summer public interest funding program and Home Court are excluded from this policy. All fundraising proposals must be submitted to the appropriate administrative office before the recommended deadline. Fundraising proposals must be approved by the Executive Director of Development and the appropriate administrative office, which together will present ideas, answer questions and develop strategies. I. Donations and Sponsorships 1. There is a difference between sponsorships and donations. Sponsorships are a business transaction where funding or other resources are given to a student group in return for a measurable benefit, such as advertising, event participation, or signage. Donations are gifts given to a student group with no expectation of a measurable benefit to the donor. In both donation and sponsorship, the appropriate administrative office, along with the Development Office, will review and must approve the details of the gifts or funding. 2. Sponsorships generally are not tax deductible because the sponsor receives a benefit from the transaction. A donation may be tax deductible because the donor is giving a gift. In some cases, a portion of a sponsorship may be tax deductible if the dollar amount of the sponsorship is significantly higher than the market value of the benefit that the sponsor receives. This would be handled on a case-by-case basis with the sponsor with the Development Office in accordance with its sponsorship policy. III. Fundraising from Internal Sources to Benefit Official Georgetown Law Student Groups 1. Fundraising from internal sources by student groups will be approved by the appropriate administrative office on a case-by-case basis. Student Life (for student organizations), Journal Administration (for journals),dean of Students (for Barristers Council), and the Office of Public Interest & Community Service for the Pro Bono Board must approve all logistics for the fundraiser, including location, duration, and purpose of the fundraising. 2. Students must submit the Student Group Fundraising Application form on OrgSync at least two weeks before the proposed date of the fundraiser. The appropriate administrative office will be given the form for approval. 3. Student groups will be permitted to host one student group fundraiser per semester. No more than eight student group fundraisers will be allowed in a semester, and no more than two in one month. Fundraisers will be approved on a first come, first served basis. 4. Students groups may not charge admission to student group-sponsored events. 5. There is no limit on the amount of funds a student group may raise through the proposed fundraiser. IV. Fundraising from External Sources to Benefit Official Georgetown Law Student Groups 1. Student groups are not permitted to directly solicit funding, including in-kind gifts, from outside sources (including law firms, corporations, individual alumni, alumni groups, foundations, other businesses and other individuals affiliated with the Law Center, University and its students) without first receiving approval from the Development Office and appropriate administrative office. 2. The Development Office and appropriate administrative office will consider proposals for external funding for special events and programs (workshops, symposia, speakers, etc.). Proposals for other purposes, such as general use funds and travel, will not be considered or approved. Travel requests should be submitted to the Student Travel Committee, chaired by the Dean of Students and the Assistant Dean for the Office of Public Interest and Community Service. 3. Student groups may submit proposals requesting $1,000 to $5,000 per event or program. In cases of an event jointly sponsored by more than one student group, only one request up to $5,000 will be considered. Requests for funding less than $1,000 will not be considered. Requests for funding more than $5,000 will be considered only under exceptional circumstances. 4. Student groups are required to complete and submit a student groups fundraising application (available on OrgSync) at least eight weeks prior to the proposed event, although it is recommended to submit the application as soon as possible to increase the probability of being funded. If the request is approved, the student group will be notified regarding next steps. Approved requests do not guarantee funding for an event. 5. The fundraising application will include the following information: event title, date, venue and audience; amount requested and anticipated use of funds; names of firm(s) to be approached and proposed contact names; list of proposed benefits provided to firms; name of student(s) who will be responsible for coordinating the fundraising effort, and any other relevant information. General criteria for approving a proposal requires confirmation of the following: _ Requested funding is not already available from the student group s budget or other internal Law Center resources. _ Project and fundraising goals are consistent with the mission and policies of the Law Center. _ Envisioned project is fundable through charitable gifts. _ Implementation of the project will require minimal Law Center resources. _ Solicitation of the individual(s) or organization(s) is consistent with other solicitations of those individual(s) or organization(s) by the Law Center and/or University. 7. Student groups may not automatically accept unsolicited donations from external sources, including in-kind donations or offers of reimbursement for student group expenses. Student groups who are approached by law firm recruiting officers with proposals to provide funding for events or programs are not barred from discussing such offers, provided that the student group indicates to the recruiting officers that any proposal is subject to approval by the relevant administrative contact at Georgetown as well as the Development Office. Any student request for approval of such an offer must occur no later than six weeks prior to the event(s) to which the funds would be applied. Law firm recruiting office offers can be less than $1000, but other monetary limits in section II, 3 apply. V. Student Group Fundraising to Benefit an External Organization 1. Fundraising by student groups or individual students to benefit an outside organization will be approved by the Office of Student Life on a case-by-case basis. When appropriate, OSL will consult with the Office of Public Interest and Community Service. OSL must approve all of the logistics for the fundraiser, including the location, duration, and purpose of the fundraising. 2. Students must submit a written request to the Director of Student Life at least 4 weeks before the proposed date of the fundraiser. 3. Fundraising is limited to the internal Law Center community members. 4. Gifts made to a fundraiser to benefit an external organization are not considered charitable gifts to the Law Center or the University, and therefore donors will not receive any type of receipt recognized by the IRS from the Law Center or University. 5. The funds raised for an external organization must be for the purpose of providing direct services to or on behalf of underprivileged or disenfranchised individuals or organizations. Fundraising to promote particular causes is not permitted. 6. Student groups will be permitted to host one fundraiser to benefit an outside organization per semester. No more than six fundraisers benefitting outside groups will be allowed in a semester except in extraordinary circumstances, such as the occurrence of a natural disaster. In such circumstances, a student may petition the Office of Student Life for a waiver of this policy. 7. Fundraisers benefiting outside organizations will be approved on a first-come, first-served bases if they meet the criteria stated in section V, A collection of goods (i.e., clothing, books, toys, food) for outside organizations will not be considered a fundraiser. 9. Students generally may not use Law Center facilities or resources to raise funds to benefit an individual. VI. Student Organization Fundraising Policy Violations If a student group violates the fundraising policy, the Law Center reserves the right to take appropriate administrative action up to and including loss of student group privileges at the Law Center.
