1 Terms of Reference Provision of consultancy services for Design of Water & Sanitation infrastructures for most deprived (IDPs & Cholera affected) population Background Decades of wars and embargos have severely damaged Iraq s water supply and sanitation infrastructure and weakened the Government s capacity at all levels to manage WASH services, moreover the increased demand on water due to fast population growth combined with Climate Change puts a lot of stress on Iraq s development. As a consequence of Ramadi ongoing operations, Anbar has experienced a surge of massive internal population displacement from Ramadi and surrounding villages towards other more secure areas, the situation is particularly serious for newly displaced populations,. Following the launch of military operations in the area in April 2015, approximately 300,000 people have recently been displaced from Ramadi District and Khalidiya, Habbaniya and Karmah sub-districts, and have sought refuge within Anbar and Baghdad, whereas the municipal services could not cover the needs of host community rather than the IDPs, WASH needs remain overwhelming in both camp and non-camp situations. With poor sanitation, lack of water and diminishing waste collection services, these combined factors pose significant public and environmental health risks through the contraction of water-borne and communicable diseases as well as a rise in vector transmitted diseases. Women and children are at particular risk of disease, violence and loss of dignity in a context of inadequate, inappropriate, unsafe, and non-segregated sanitation facilities, as well as lack of hygiene and sanitary items, and there is a need to ensure that they have dignified access to WASH in displaced and return contexts. Although about 89% of Iraqi population had access to a drinking water supply network in 2011 (MICS 4), only 60% of households had access to chlorinated water at the same period, leaving 2 household in 5 at risk of evitable water borne diseases, only 26% of collected waste water is treated, while the rest is disposed mainly into water bodies. Solid waste management remains inadequate. Cholera, typhoid, polio, hepatitis, and childhood diarrhea remain threats to public health across the country. The Ministry of Health has announced Vibro Cholera (VC) positive cases (serotype Inaba) tested since 8 September, 2015, so far, more than 3000 cholera cases had been confirmed 1 of 9

2 and two death were reported (females) by the Iraqi ministry of health, the four governorates showed largest figures of confirmed cases according to WHO reports are Babel, Dewaniyah, Muthana and Baghdad; whereas, illegal disposal of sewage in Euphrates, high rate of turbidity and contamination due to significant decline in water level have negatively affected the quality of water. To address the urgent water and sanitation needs for the affected population and to maintain public health standards, UNICEF has committed to improve WASH services to IDPs within their settlement and to urgently stop the illegal disposal of waste water, in this regards UNICEF plan to implement water and sanitation networks within the largest IDPs camps in Baghdad and Anbar and connect with the public infrastructure and to implement low cost sewage projects where no public sewage system is available.. Purpose The purpose of this agreement is to prepare the water and sanitation system designs with detailed drawings for IDPs settlements in Baghdad and Anbar and Cholera affected locations in Southern governorates. Major tasks The consultant firm to prepare site plans along with topographic surveys and design Water and sanitation systems with detailed drawings and bill of quantities and demonstrate proper technologies to enhance the efficiency of water and sanitation projects, the task includes flow rates calculation, pipe sizing, feeding source, storage tanks, control valves and meters for water system and pipe sizes, fittings, manholes size, grease traps, septic tanks, cesspools for black and grey water sewerage systems for the following activities: 1. Sewerage network, pumping station and delivery sewer pipeline for Takia camp in Baghdad- AL-Saydiyah. 2. Sewerage network, delivery sewer line with low Cost Sewerage treatment project for Abo Ghriab camp in Baghdad. 3. Pilot project on solar desalination unit for reuse of high salinity raw water. 4. Pilot project on Pre-filtration for raw water in Southern governorates water treatment plant. 3 3 Delivering the endorsed documents by the concerned directorate in the targeted governorates. 18 th Feb th Feb 2016 Frame summarized below: The Consulting Firms offering proposal shall include in their proposals a comprehensive time schedule for the aforementioned milestones of the required services. RFPS RESPONSE FORMAT The Proposer must submit one sealed Plain envelope containing two separate sealed envelopes A and B to UNICEF's Country office located in the Green Zone Area, Diwan School, Baghdad, Iraq. Envelope-A will be for the Technical Proposal containing all information requested in the following paragraph named as (Technical Proposal) and envelope-b will be for the Financial Proposal containing all information requested in the following paragraph named (Financial Proposal) In case the proposer opted electronic submission; two separate s should be submitted one Technical and one Financial Proposal to the following address: iraqsupply@unicef.org. The Technical Proposal MUST include the following but is not limited to: (a) (b) (c) (d) A confirmation letter that the Provider is registered with professional government bodies (Registration Documents with concerned authorities to be provided) Completed Provider s Profile forms. {For those Providers who have already submitted their forms in the last one year, there is no need for re-submission, though it is in their interest to send an updated Profile form ORGANIZATION: General information about the Provider s background, year of establishment, Organizational structure, Number & type of staff (whether part time or full time with CVs), assets (equipment, training facilities, etc.); Names of companies your organization is affiliated with. 5 Appendix I Financial Proposal 1. This Financial Proposal must be submitted by the Provider in a separate envelope-b than that used for the Technical Proposal. Failure to follow this instruction will result in your proposal being rejected! 2. The Financial proposal will be opened only for the technically qualified proposal after the technical evaluation is completed. For those Providers who do not qualify, the envelope containing the financial proposal will be returned un-opened. 3. Costing - UNICEF will cover costs related to the workshops. UNICEF will ensure that office space and use of office equipment is provided to the Experts. 4. Please provide the cost break down of all the items included in the below table and submit this page in a separate envelope-b. All price offers shall be made in US Dollars only. 6 Evaluation of Proposals As soon as receiving the offers, the proposals will be technically evaluated considering the following criteria: Criteria Maximum Points Overall Response Proposal Documentation 5 Company and Key Personnel Organizational Background, year of establishment, organization structure 10 Work Experience 25 Key personnel proposed 25 Financial Status 10 Proposed Methodology, Approach and System Methodology on Providers approach 25 Total Technical Evaluation 100 The minimum technical score required to qualify is 70 points OVERALL EVALUATION GRID Each Proposal will be evaluated against a weight allocation of [70%] for the technical proposals and [30%] for the fee proposal. The total maximum obtainable points is 100. Technical Proposal Financial Proposal [70%] [30%] The UNICEF evaluation team will select the Proposal which is of high quality, clear and meets the stated requirements and offers the best combination of technical and price score. TECHNICAL PASS CRITERIA The minimum technical score required to qualify is 70 points, financial proposal will not opened unless technical score > or = to 70 points COMMERCIAL EVALUATION The formula for determining the financial scores is the following: SF = 100 x FM/F Where SF is the financial score, FM is the lowest price from the bidders achieving the minimum technical score and F is the price of the proposal under consideration. The weights given to the technical and financial proposals are: T = 0.7 and F = 0.3 Payment terms and conditions 6 of 9

7 Payment will be made only upon UNICEF s acceptance of the work performed in accordance with the contractual milestones. The terms of payment are payment of the uncontested part of any invoice Net 30 days, after receipt of invoice and proof of delivery. Payment will be effected by bank transfer in US dollars. Proposers may offer early payment discounts, i.e. payment within a specified period of time faster than UNICEF s standard payment term of Net 30 days as per below payment schedule: 50% as soon as delivering the documents (detailed drawings and BOQs certified / approved by UNICEF supervisor). 50% as soon as delivering the endorsed documents by the concerned directorate in the targeted governorates. RIGHTS OF UNICEF UNICEF reserves the right to accept any Proposal, in whole or in part; or, to reject any or all Proposals. UNICEF reserves the right to invalidate any Proposal received from a Proposer which, in the opinion of UNICEF, has previously failed to perform satisfactorily or properly or to complete a contract on time, or any Proposal received from a Proposer which, in the opinion of UNICEF, is not in a position to perform the contract to be awarded as a result of this procurement action. UNICEF shall not be held responsible for any cost incurred by any Proposer in connection with this RFPS. The Proposer agrees to be bound by the decision of UNICEF as to whether its Proposal meets the requirements stated in this RFPS. Without limiting the generality of the rights set out above, UNICEF expressly reserves the right to, and by submitting its Proposal the Proposer expressly accepts UNICEF s right to: - contact any or all references supplied by the Proposer(s); - request additional supporting or supplementary data (from the Proposer(s)); - arrange interviews with any, some, or all of the Proposer(s), individually or collectively; - reject any or all Proposals; - accept any Proposal in whole or in part; - negotiate with the Proposer or Proposers which has or have, as the case may be, attained the best rating/ranking in the evaluation of Proposals; - award contracts to such number of Proposers as, in UNICEF s opinion, is required to achieve the overall objectives of this RFPS. By submitting a Proposal, the Proposer agrees to accept the decision of UNICEF as to whether the Proposal meets the requirements stated in this RFPS. PROPERTY OF UNICEF 7 of 9

8 This RFPS, along with any responses thereto, shall be considered the property of UNICEF and the Proposals will not be returned to the Proposers. GENERAL CONTRACTUAL TERMS AND CONDITIONS The UNICEF Generic General Terms and Conditions for Institutional Contracts for Services are attached [Annex X]. The relevant provisions of these Generic General Terms and Conditions, together with any designated Special Terms and Conditions [Annex X], will form part of any contract resulting from this RFPS. FULL RIGHT TO USE The Proposer warrants that it has not and shall not enter into any agreement or arrangement that restrains or restricts UNICEF s or any implementing partner s rights to use, dispose of or, otherwise, deal with any of the goods that are the subject of this RFPS. VERIFICATION PROCESS It is expected that during the evaluation, UNICEF will be requesting clarifications from Proposers. UNICEF will not divulge nor discuss the Proposals and merits except with the Proposer who made the Proposal. To ensure fairness towards all Proposers, the established technical evaluation criteria will be the basis for the evaluation; however, it is envisioned that the final evaluation may contain conclusions not only deriving from the method grid. 8 of 9
