3 RADIOLOGICAL HEALTH PROGRAM ORGANIZATION Radiation Machines Registration, Certification and Inspection Division - regulates over 5,000 facilities Radioactive Materials Licensing and Compliance Division - regulates over 600 facilities Regulations Development and Enforcement Coordination - responsible for fee collection, regulations promulgation, preventive maintenance and enforcement. Authorized 33; assigned 30 (three contractual)
4 The Dental Issue Radiation Machine Safety & Performance Requirements Significantly low compliance rates Initial Compliance rate in 2000 = 22% Initial Compliance rate a decade later = 48% Lowest of ANY facility group regulated by the Department No significant improvement in sight
5 Enforcement Cases Dental Enforcement Cases Fiscal Year
6 Work in Progress Unique identification number given to all radiation machines for tracking purposes. Processing of revamping database which houses all registrant information. Field Inspection Reporting System will communicate with main database allowing inspectors to update information from field. Online registration capability-accepting forms and payment Improving service registration provider requirements In-depth training audits
7 RADIATION MACHINE PREVENTIVE MAINTENANCE Established regulations and program to require preventive maintenance of most radiation machines on manufacturer s recommended schedule Established procedures, acquired staff, established database module Publicized regulations
8 RADIATION MACHINE PREVENTIVE MAINTENANCE Began sending Notices of Violation to facilities failing to supply preventive maintenance service reports 5300 (of 14,500) machines at 2100 (of 5100) facilities were not in compliance one year after regulations effective By March 2014, sent Notices of Violation to over 800 facilities compliance rate nearly 100% after Notice
9 ENFORCEMENT OF REGULATIONS As of March 2014, over 40 enforcement actions have been taken for violation of radiation control regulations in Fiscal Year 2013 Actions range from settlement offers to Stop Work Orders Penalties are assessed in Fiscal Year 2014, ranged from $250 to $20,000

RESOURCE MANAGEMENT CHALLENGES TO COMPLETE SAFEGUARD AND INCREASED CONTROL INSPECTIONS IN THE REQUIRED TIME FRAME. IMPLEMENTATION OF CHANGING (NRC 10 CFR 31.5(C)(13)(i) CLASSIFIED GENERAL LICENSES TO SPECIFIC LICENSES.
