Conroy, Attorney, Office of the Staff Judge Advocate, MDW As you leave work late on a Friday night, you notice a heavy-set man sitting in the car next to yours in the darkened parking lot. You recognize him as a Soldier. He simply stares at you as you drive away, and you recall he is the same man you saw in past weeks sitting in his car outside your house leering at you while you did lawn work. As the weeks pass, he seems to be following you. As a young female soldier, you are scared. Can anything be done to stop and/or punish his behavior? Yes. Under the military s new Stalking law, the person can be court-martialed under Article 120a of the Uniform Code of Military Justice (UCMJ). The new law makes stalking a crime if the offender engages in a course of conduct directed at a specific person, if such conduct would cause a reasonable person to fear bodily harm or sexual assault. Such course of conduct includes repeated maintenance of visual or physical proximity to the victim. Even if the offender merely causes himself/herself to be in the proximity of the victim on two or more occasions, he/she can potentially be charged with stalking. The key elements are met if the offender has knowledge that his/her actions will cause fear in the victim, a reasonable person would be afraid, and if the particular victim is truly afraid. Why the new law? This updated UCMJ offense brings the military in line with civilian stalking laws. In recent years, many celebrities have been stalked, including Sharon Stone, Meg Ryan, Brad Pitt, Catherine Zeta-Jones, Steven Spielberg, Gwyneth Paltrow, Richard Gere, and Katie Holmes. Military members are also at risk. Recent Department of Justice studies show that 1 out of 12 women will be stalked during their lifetime. Statistics indicate that 78% of past stalking victims were women, and 77% of them knew their stalkers. Most classes are open to all Service members, their family members, and DoD civilians. Inside this issue: New Stalking Law: UCMJ Article 120 Parenting Home, Marriage & Money Management Employment Readiness Pentagon (JMAC) Support Groups Army Family Team Building (AFTB) Along with the new stalking law, UCMJ Article 120 has been completely overhauled, with numerous sexual offenses now falling under Article 120, which used to deal only with rape and carnal knowledge. For example starting on October 1, 2007, there will be a new crime of Wrongful Sexual Contact, which will punish those who intentionally touch, either directly or indirectly through the clothing, the genitalia, groin, breast, inner thigh or buttocks of another. Such touching is a crime if it is done with the intent to abuse, humiliate, degrade, or to arouse sexual desire. Additionally, starting on October 1, 2007, the crime of Rape will include not only acts done by force, but also acts facilitated by administering a drug substance impairing the victim s ability to control his/her conduct. Such a substance includes the commonly known date-rape drug. For information on any new laws or existing sexual offense laws, contact the Military Justice Division of your base or post legal office.
