Commodity or Service Required (commodity class and group, manufacturer, model, and description, as appropriate): ENVIRONMENTAL CLEANUP AND RESTORATION SERVICES Quantity or Term (as appropriate): July 1, 2014 through June 30, 2019 Requestor (division, bureau, office, individual, as appropriate): Tom Lubozynski, Central District Performance and/or Design Requirements (intended use, function or application, compatibility etc. requirements; reference to policy, rule, statute or other act of the Legislature, etc., as appropriate): The Florida Department of Environmental Protection ("Department") discovered the presence of trichloroethylene ("TCE") and perchloroethylene ("PCE") in groundwater monitoring wells located within an area known as the Northern Downtown Orlando Site ("NDOS"), located in Sections 23, 24, 25 and 26, Township 22 South, Range 29 East in north-central Orange County. The Site generally is described as and includes the area bordered by Marks Street to the north, East Amelia Street to the south, Magnolia Avenue to the east and North Garland Avenue to the west. The Site includes Lake Concord and the land between North Garland Avenue and Lake Concord. The Site contains "Plumes A, B, and C" as described in the Department s draft report of June 7, The "NDOS Project" consists of the study, design, construction, operation and maintenance of a groundwater extraction and treatment system, as well as, special treatments (such as injection to enhance degradation of the contaminants) for Plumes A and B, including, without limitation, all necessary permits, approvals, insurance, pipes, pumps, wells, improvements, activities, maintenance, repair and replacement, reconstruction, traffic control, property access, sampling, reporting, closure and removal of the equipment and related systems, as set forth in this Contract. The "Common Facilities" shall be those portions of the Project which are designed and constructed to serve the entire groundwater remediation system and/or both Plume A and B, as opposed to a particular Plume. a. The Orlando Sentinel Communications Company (Sentinel), while denying that it is liable for any of the contamination within the Site, has agreed to perform certain Work (as defined by the Consent Decree Civil Action No ) for the alleged Plume A. b. The Department has voluntarily agreed to provide for the cleanup of Plume B so as to prevent the spread of contamination and to protect property values. The Department shall utilize the Sentinel as its contractor for purposes of completing the Project. c. Previously, the Project included Plume C because that Plume threatened Lake Concord. The Plume C portions of the Project had been the responsibility of the City of Orlando. Since Plume C is no longer threatening Lake Concord, Orlando is no longer participating in the Project. The Sentinel has always taken the lead role in the NDOS Project, with consultation and funding from the City of Orlando and the Department. The Sentinel has already implemented the Project, with consultation and funding from the City of Orlando and the Department. The Sentinel has continued to retain the same environmental engineering firms who built and operated the cleanup system and who know the characteristics of the contamination plumes. Therefore, it is cost effective to continue using the Sentinel as the lead for the NDOS Project. The Sentinel shall act as the Department's contractor in issuing decisions, orders, approvals, payments and notices with respect to that portion of the Project that relates to Plume B. 2 Scope of Services: The objective is for the Department to contract its responsibilities for Plume B of the NDOS Project to the Sentinel. The Sentinel will continue to manage the entire NDOS Project. This will ensure continuity of effort and the cost effectiveness of using the treatment system that was installed specifically for the entire NDOS Project. The Sentinel would ensure the following is accomplished: study, design, construction, operation and maintenance of the groundwater extraction and treatment system, as well as, special treatments (such as injection to enhance degradation of the contaminants) for Plumes A and B, including, without limitation, all necessary permits, approvals, insurance, pipes, pumps, wells, improvements, activities, maintenance, repair and replacement, reconstruction, traffic control, property access, sampling, reporting, closure and removal of the equipment and related systems, as set forth in this Contract. The "Common Facilities" shall be those portions of the Project which are designed and constructed to serve the entire groundwater remediation system and/or both Plume A and B, as opposed to a particular Plume. The Department will pay all costs authorized in the estimated operating costs up to the amount authorized in each annual task assignment (up to the amount authorized in its budget) associated with continuing the Plume B and Common Facilities portions of the NDOS Project The maximum amount of all task assignments under the proposed Contract shall not exceed $349, The specific actions with regard to the Plume B portion of the Project shall be agreed upon in advance by Sentinel and Department. The Sentinel shall act as the Department's contractor in issuing decisions, orders, approvals, payments and notices with respect to that portion of the Project that relates to Plume B and Common Facilities. Duration of Contract: The contract will need to continue until Plume B is remediated, no more funds are authorized, or the Department decides to no longer be responsible for Plume B. Intended source (vendor, contractor): Orlando Sentinel Communications Company Estimated Dollar Amount: $349,705 Justification for single source acquisition (what is necessary and unique about the product, service or source; steps taken to confirm unavailability of competition, as appropriate): From 1996 through 2009, The Orlando Sentinel Communications Company (Sentinel), City of Orlando, and the Department have worked as a partnership to implement a project addressing all three plumes at once. All three entities have provided oversight, decision-making, and funding. Until June 30, 2010, the Department was able to use the City of Orlando as its contractor. The City of Orlando had the contract (agreement) with the Sentinel. Now that the City of Orlando is no longer participating, that contracting method has not been available since July 1, A sole source contract, SP687, was awarded to the Sentinel from July 1, 2010 through June 30, The Sentinel contractor support is still necessary to continue to address the contamination from Plume B. The groundwater extraction and treatment system is built. The piping to bring the groundwater from Plumes A and B to the treatment system are interconnected. Many wells and pipes have been installed underground in right-of-ways and on private property. It would be cost prohibitive for the Department to separate from the system in order to build and operate its own groundwater extraction and treatment system. The Sentinel has always taken the lead role in the Project, with consultation and funding from the City of Orlando and the Department. The Sentinel has continued to retain the same environmental engineering firms who built and operated the cleanup system and who know the characteristics of the contamination plumes. It is cost effective to continue using the Sentinel as the lead for the NDOS Project. A sole source contract with the Sentinel would ensure that continues. 3 Prospective vendors are requested to provide information regarding their ability to supply the commodities or contractual services described. If it is determined in writing by the agency, after reviewing any information received from prospective vendors, that the commodities or contractual services are available only from a single source, the agency shall: 1. Provide notice of its intended decision to enter a single-source purchase contract in the manner specified in s (3) FS, if the amount of the contract does not exceed the threshold amount provided in s for CATEGORY FOUR. 2. Request approval from the Department of Management Services for the single-source purchase, if the amount of the contract exceeds the threshold amount provided in s for CATEGORY FOUR. If the Department of Management Services approves the agency s request, the agency shall provide notice of its intended decision to enter a single-source contract in the manner specified in s (3), FS.
