REFERENCE: UPDATE: REFERENCE: UPDATE: Page 16, Attachment A-1, Section VI., A., Invoice Properly prepared invoices shall be submitted for each detention center directly to the Department s Contract Manager within fifteen (15) business days following the end of the month for which services were rendered or five (5) business days after receipt of the ADP report. Payment of the invoices shall be pursuant to section , Florida Statutes and any interest due shall be paid pursuant to section 55.03(1), Florida Statutes. A Vendor Ombudsman, established within the Department of Financial Services, may be contacted if a Respondent is experiencing problems in obtaining timely payment(s) from a State of Florida agency. The Vendor Ombudsman may be contacted at (850) The Respondent shall provide, with each monthly invoice, an accepted and signed monthly ADP report for the previous month, which will be provided by the Department by the tenth (10th) of each month. The report is produced by the first Monday of the month following the reporting month and will be received by the Respondent no later than the tenth (10th) of the invoicing month. The Per diem will be determined as follows: Yearly contract amount in Attachment H by total number of days in the contract term by the total Average Daily Population (ADP) for all Regional Juvenile Detention Centers in the Central Region. The ADP for fiscal year (FY) 2015/16 is three hundred and fifty-six (356) youth as determined by the Department s Bureau of Research and Data s and available in the Comprehensive Accountability Report, (See page 65 of this ITN, IV. Statement of Purpose). This per diem will remain the same for the term of the resulting contract from this ITN. The Respondent must use the following formula to determine monthly invoice amount: # of days in a month x # of youth in the monthly ADP report x per diem = total amount of invoice. Provides both mental health and substance abuse services. *Psychiatrist - Five (5) hours per week Note: Staffing above sought for this ninety-three (93) bed facility. Return of this Addendum is not mandatory; however, the Provider is responsible for its contents and is requested to sign and submit this Addendum with its response to the ITN. Protests must be filed with the General Counsel s Office, Department of Juvenile Justice, 2737 Centerview Drive, Tallahassee, Florida , within the time prescribed in section (3), Florida Statutes, and chapter , Florida Administrative Code. Notices delivered by hand delivery or delivery service shall be to the Agency Clerk, Office of the General Counsel, Florida Department of Juvenile Justice, 2737 Centerview Drive, Tallahassee, Florida , with a copy to the Department s Procurement Manager responsible for this solicitation. Failure to file a protest within the time prescribed in section (3), Florida Statutes, or failure to post the bond or other security required by law within the time allowed for filing a bond, shall constitute a waiver of proceedings under chapter 120, Florida Statutes. Written notices, formal requests and proceedings must conform to the requirements set forth in chapter , Florida Administrative Code. Any person who files an action protesting a decision or intended decision pertaining to contracts administered by the department or agency pursuant to section (3), Florida Statutes, shall post with the department or the agency at the time of filing the formal written protest a bond payable to the department or agency in an amount equal to 1 percent (1%) of the estimated contract amount. The estimated contract amount shall be based upon the contract price submitted by the protestor or, if no contract price was submitted, the department or agency shall estimate the contract amount based on factors including, but not Page 7 of 15

8 limited to, the price of previous or existing contracts for similar commodities or contractual services, the amount appropriated by the Legislature for the contract, or the fair market value of similar commodities or contractual services. The agency shall provide the estimated contract amount to the Provider within seventy-two (72) hours, excluding Saturdays, Sundays, and state holidays, after the filing of the notice of protest by the Provider. The estimated contract amount is not subject to protest pursuant to section (3), Florida Statutes. The bond shall be conditioned upon the payment of all costs and charges that are adjudged against the protestor in the administrative hearing in which the action is brought and in any subsequent appellate court proceeding. In lieu of a bond, the department or agency may, in either case, accept a cashier's check, official bank check, or money order in the amount of the bond. If, after completion of the administrative hearing process and any appellate court proceedings, the department or agency prevails, it shall recover all costs and charges which shall be included in the final order or judgment, excluding attorney's fees. This section shall not apply to protests filed by the Office of Supplier Diversity. Upon payment of such costs and charges by the protestor, the bond, cashier's check, official bank check, or money order shall be returned to the protestor. Is this to be determined by the provider or will specific topics assigned by OHS? The respondent may determine the most effective type of training to meet this requirement as long as the curriculum is evidence-based. Please see, 63M and 63M-2.010, Florida Administrative Code (F.A.C.). Pages 86 91: In Exhibits 1 and 2 of the ITN, The schedule calls for twenty-four (24) hours per year for the DHA to perform their duties on-site. In 63M-2, it states that the DHA must be on-site a minimum of once per week. Can you clarify the minimum requirements for the schedule the DHA needs to be onsite for Exhibits 1 and 2? The requirement of the Designated Health Authority (DHA) in each of the respective tables in Exhibit 1 is being corrected, in this Addendum to read, DHA - On site in the clinic at least weekly with no more than nine days between visits and on-call 7 days a week, 24 hours a day. Exhibit 2 does not include any requirements related to the DHA. Page 89 of the ITN lists psychiatric hours in The Hillsborough RJDC as 5 hours per week. The current contract in place calls for 3 hours per week at this facility, as well as 3 hours at Orange and Pinellas facilities (both larger than Hillsborough). Please clarify if DJJ is requiring an increase in services for this facility. Yes. As stated on Page 89 of the ITN, the Department is requiring (5) hours per week of services to be provided by the Psychiatrist at Hillsborough RJDC. Page 90 of the ITN lists mental health services for The Manatee RJDC as 40 hours for DMHCA, 20 hours of a licensed clinician and 20 of a non-licensed clinician. The current contract in place requires 40 hours for the DMHCA and 20 hours for an un-licensed clinician. Please clarify if DJJ is requiring an increase in services for this facility. Yes. As stated on page 90 of the ITN, the Department is requiring mental health services be provided at Manatee RJDC for the following amount of hours for the positions indicated: 40 hours by the DMHCA, 20 hours by a licensed clinician and 20 hours by a non-licensed clinician. Page 90 of the ITN lists psychiatric services in The Manatee RJDC requiring 3 hours per week. The current contract requires 2 hours per week. Please clarify if DJJ is requiring an increase in services for this facility. Yes. As stated on page 90 of the ITN, the Department is requiring psychiatric services be provided at Manatee RJDC for 3 hours per week. What is the state s annual budget for the Central region? The projected annual amount for the resulting contract shall not exceed $4.2 million. What timeframe does DJJ anticipate for transition?
