Background of the assignment Within the framework of the UNODC Regional Programme for Eastern Africa ( ) and its respective mandates, UNODC, through its Regional Office for Eastern Africa (ROEA) and in close coordination with its headquarter, aims, among others, to promote and support effective responses by Member States in Eastern Africa to transnational organized crime, illicit trafficking and illicit drug trafficking at the legal, technical and policy level; and to promote and strengthen a functional criminal justice regime against terrorism that is effective and is implemented by States in accordance with the rule of law. UNODC does so primarily through its regional programmes on Transnational Organized Crime and Illicit Trafficking as well as Terrorism Prevention. Accordingly, the UNODC ROEA Transnational Organized Crime, Illicit Trafficking and Terrorism Prevention Programmes are pivotal to UNODC s mandate to assist Member States in preventing, suppressing and prosecuting transnational organized crime, terrorism and related offences in Eastern Africa. In turn, the latter programmes are implemented through various outputs and activities, including technical and legal advice, capacity building through training activities and procurement, and facilitation of national coordination and international cooperation. These activities include hosting meetings, workshops and conferences, but also procurement of equipment and resource material in support of programme outcomes. 2 investigations and intelligence capacities of Member States to counter terrorism in Eastern Africa. These activities include organizing 3 national training workshops for 60 criminal justice practitioners in 3 Eastern Africa Member States; organize 1 regional workshop for 30 criminal justice practitioners from 13 Eastern Africa Member States; provide ongoing advice and mentoring to Eastern Africa Member States as requested; and disseminate UNODC resource material. These activities will be delivered in coordination and collaboration with INTERPOL Regional Bureau Nairobi and UNODC's Terrorism Prevention Branch (TPB) at UNODC Headquarters. Accordingly, and as part of these programme activities, UNODC aims to strengthen investigations and intelligence capacities of Member States to counter terrorism in Eastern Africa by: Conducting 3 national training workshops for 20 criminal justice practitioners per workshop (3 days) in each of Kenya, Tanzania and Uganda, using UNODC resource material and aimed at enhancing basic and specialized investigative techniques, including digital evidence collection, to investigate acts of terrorism and related activities; Provide ongoing advice and mentoring by UNODC experts aimed at improving protocols for tasking, collection, analysis and dissemination of operational and court-directed intelligence, especially in relation presenting intelligence in court without compromising methods, sources or tradecraft; and Provide UNODC resource materials to relevant criminal justice training institutions in 13 Eastern Africa Member States. 2. Purpose of the assignment Within the framework of the UNODC Regional Programme for Eastern Africa ( ) and its sub-programme on Terrorism Prevention, the consultant will: Develop a training curriculum on basic and specialised investigation techniques aimed at enhancing the capacity of law enforcement officials of Eastern Africa Member States to effectively investigate acts or attempted acts of terrorism; Deliver three 3-day national training workshop for 20 law enforcement officials per workshop on basic and specialised investigations techniques related to terrorism investigations (Kenya, Tanzania and Uganda), utilising the training curriculum developed; Assist in delivering one 3-day regional training workshop to 30 law enforcement officials from 13 Eastern Africa Member States on basic and specialised investigations techniques related to terrorism investigations in Kenya. 3. Specific tasks to be performed by the consultant Relying on experience and using the UNODC Handbook on Criminal Justice Responses to Terrorism, UNODC Preventing Terrorist Acts: A Criminal Justice Strategy Integrating Rule of Law Standards in Implementation of United Nations Anti-Terrorism Instruments, UNODC Criminal Intelligence Manual for Managers, UNODC Criminal Intelligence Manual for Front-line Law Enforcement, UNODC Criminal Intelligence Manual for Analysts and other relevant resource materials as a guideline, the Consultant shall: Page 2 of 6
3 a. Develop a training curriculum i. Develop a training curriculum on basic and specialised investigation techniques aimed at enhancing the capacity and ability of respective national police service to prevent and investigate acts of terrorism and related activities, and to develop and disseminate (both intra-agency and inter- agency) intelligence related to terrorism and violent extremism, especially in relation to court directed intelligence to be presented as evidence in court. Accordingly, the training curriculum must, in principle adhere to the following requirements: - subscribe to the provisions of the applicable international conventions on terrorism and human rights, UN Security Council resolutions and UN General Assembly resolutions; - be structured as a 3-day training; - cover the thematic topics of i) reactive investigations, ii) proactive investigations including intelligence-led policing, and iii) disruptive techniques; - provide for a combination of theoretical training, practical exercises and case studies; - identify relevant UNODC and other resource materials to be used during training workshops; and - include, as a minimum, the following practical topics: command structure; decision logs; generic rules of investigation; timelines and link analysis; initial crime scene preservation; crime scene cordons and control; Golden Hour principle; forensic examination (including digital forensics); introduction to explosive devises; introduction to ballistics; exhibit collection; hospitals and mortuary continuity and forensic capture; chain of custody and continuity of evidence; house to house enquiries; witnesses; suspects; statement taking; family liaison officer; CCTV retrieval and viewing; phones-cell site analysis; CDR and SIM cards; international enquiries-mla/comrog; evidential standards; briefing formats; search strategy; arrest strategycontamination strategy; custody procedures-incommunicado; medical examination; interviewing techniques-contemporaneous note taking; audio/visual recording; media strategies; case file compositioncomponents of a case file, structure, indices with cross reference to documents and exhibits; proactive intelligence-led operations. ii. Present draft training curriculum to UNODC for approval. b. Deliver three 3-day national training workshops for 20 law enforcement officials per training i. Deliver three 3-day national training workshop for 20 law enforcement officials per workshop on basic and specialised investigations techniques related to terrorism investigations in Kenya, Tanzania and Uganda, utilising the training curriculum developed; ii. Draft and present a workshop report to UNODC covering country-specific observations, conclusions and recommendations following conclusion of the respective workshops. The reports can be presented as a single report with separate reporting on each workshop. Page 3 of 6
4 c. Assist in delivering one 3-day regional training workshop to 30 law enforcement officials from 13 Eastern Africa Member States i. Assist UNODC and Interpol in delivering one 3-day regional training workshop to 30 law enforcement officials from 13 Eastern Africa Member States on basic and specialised investigations techniques related to terrorism investigations in Kenya; ii. Draft and present a workshop report to UNODC covering observations, conclusions and recommendations following conclusion of the respective workshop. 4. Expected tangible and measurable output(s)/deliverable(s): a. Comprehensive and high quality training curriculum based on experience, relevant UNODC material, relevant international conventions and UN resolutions and other credible resource material, delivered; b. Three 3-day national training workshops one each in Kenya, Tanzania and Uganda, utilising the training curriculum developed, delivered; c. Comprehensive report on national workshop outcomes delivered. d. Assistance in presenting one 3-day regional training workshop to 30 law enforcement officials from 13 Eastern Africa Member States delivered; and e. Comprehensive report on regional workshop outcomes delivered. 5. Dates and details of deliverables/payments: Deliverable Output Working Days To be accomplished by (date) a. Comprehensive and high quality training curriculum based on experience, relevant UNODC material, relevant international conventions and UN resolutions and 8 20 October 2017 other credible resource material, delivered. b. 5 workshop outcomes delivered. 22 days Payments will be made upon satisfactory completion and/or submission of outputs/deliverables. Indicative level of remuneration 410 USD 500 USD (C as per ST/AI/2013/4 (Annex III) (international)) 1 st payment following approval of training curriculum as per outcome (a) of the table in paragraph 5 (8 days); 2 nd payment following achieving outcome (b) and (c) of the table in paragraph 5 (18 days); 3 rd and 4 th payment following achieving outcome (d) and (e) of the table in paragraph 5 (22 days). 6. Indicators to evaluate the consultant s performance All the outputs should be submitted in English and meet the satisfaction of UNODC according to the following indicators: Quality of the reports produced; Quality of training curricula produced; Technical competence; and Timeliness of the delivery. The evaluation of the consultant s performance (the quality of the reports and products, the technical competence shown and the timeliness of the reports) will be determined by the Regional Representative, United Nations Office on Drugs and Crime (UNODC), Regional Office for Eastern Africa (ROEA) in Kenya, in close coordination and consultation with UNODC HQ. If the consultant does not meet the requirements, he/she will be provided with an opportunity to redraft in terms of the guidance provided by the assessors. If after redrafting the requirements are not met, the UNODC reserve the right to non-payment and/or suspension of the consultancy contract. 7. Qualifications/expertise sought (required educational background, years of relevant work experience, other special skills or knowledge required) i. A university degree in criminology, law, political sciences, sociology or related discipline or relevant work experience in a law enforcement force and/or security service; ii. At least 10 years of relevant professional experience in and extensive knowledge of the intelligence cycle, or investigation and prosecution of terrorism cases; iii. Proven experience in the development of training curricula and materials; iv. Proven experience in providing technical advice and mentoring; v. Ability to interact with governmental agencies, good interpersonal skills and organizational proficiency; Page 5 of 6
