Establishment of Community Gain & Community Gain Fund A Community Gain and a Community Gain Fund were established for the catchment area of Irishtown, Ringsend, and Sandymount, in accordance with Planning Permission, reference 29S.EF2022 and Industrial Emissions Directive Licence, reference W , granted by An Bord Pleanala and the Environmental Protection Agency respectively, for the Dublin Waste to Energy Project. The relevant conditions are reproduced below: Planning Condition No. 2 A community liaison committee shall be established to liaise between Dublin City Council and the local community. The membership of this committee shall reflect the membership of the community gain administration board proposed by Dublin City Council in its submission at the Oral Hearing. The committee shall comprise 10 members having an independent chairperson, 3 local community representatives, 3 elected members of Dublin City Council, 2 officials of Dublin City Council and I representative from the operators of the waste to energy facility. The Community shall have responsibility for the administration of the community gain fund account to be set up in accordance with condition No.3 of the planning permission and for decisions on projects to be supported by the fund in addition to acting as a liaison committee with the local community in relation to ongoing monitoring of the operation of the facility. Planning Condition No. 3 A Community Gain Fund shall be established to support facilities and services which would be of benefit to the community in the general catchment area. This fund shall include a once-off capital contribution equivalent to 3% of the capital cost of the facility and an annual contribution per tonne of waste accepted for thermal treatment at the plant. The annual contribution shall be 1 per tonne in the first year following commissioning of the plant and thereafter shall be updated in accordance with the consumer price index. Details of the management and operation of the fund which shall be lodged in a special community fund account shall be agreed between DCC and the Community referred to in Condition No.2 of Planning Permission. Licence Condition (c) Establish a Community Gain Liaison committee and facilitate regular meetings of that Committee at a frequency to be agreed with the Committee. 5 1.1 Community Gain In line with Planning Condition No. 2, a Community Gain was established. Dublin City Council sought applications for nominations for the three community representatives. The South East Area Committee was asked to nominate three elected representatives. The Chief Executive, Dublin City Council appointed an independent chair. Chief Executive Orders ET/CE/28/2015 and ET/CE/38/2015 refer. The Terms of Reference of the Committee were agreed at the first meeting of the Community Gain which was held on the 17 th September 2015 in Dublin City Council offices, Wood Quay. The Role and Responsibility of the Community Gain is as follows: 1. To have responsibility for the management of the Community Gain Fund. 2. To decide on projects to be supported by the Fund which will provide environmental, recreational and community facilities which will benefit the local communities in the catchment area. 3. To liaise between Dublin City Council and the local community on the construction phase of the Waste to Energy facility. 4. To liaise between Dublin City Council and the local community in relation to ongoing monitoring of the operation of the facility post commissioning. 6 1.2 Community Gain Fund In line with Planning Condition No. 3, a Community Gain Fund was established and to date 9,013, has been credited by the developer of the Waste to Energy Project, Dublin Waste to Energy Limited (DWtEL), to a dedicated Waste to Energy Community Gain Fund cost centre. A total of 10,380, will be lodged during the construction phase of the project with the last payment being made in January In accordance with its Terms of Reference, the Committee developed a Community Gain Projects Grant Scheme which provided the mechanism for assessing and funding proposals from local community and voluntary organisations, for the development of environmental, community and educational projects in the catchment area as indicated on the map below and coloured yellow. The disbursement of the Community Gain Funds, on behalf of the Committee, is being facilitated by Dublin City Council. Community Gain Projects Grants Scheme 2016 The Community Gain Projects Grant Scheme 2016 opened for applications between the 1 st February 2016 and the 31 st March million was available for disbursement. 2.1 Overview of Applications Received 56 grant applications were received from the Irishtown, Ringsend and Sandymount Catchment Area. The applicant organisations were representative of a broad range of sectors within the Irishtown, Ringsend and Sandymount community. 9 2.2 Overview of Applications Approved The Community Gain convened on six occasions throughout Four of these meetings were dedicated to assessing each of the 56 grant applications submitted, against the 2016 Projects Grant Scheme s general conditions and criteria. The Committee began the assessment process by considering applications requesting amounts less than 20,000. Following this, applications requesting amounts of between 20,000 and 100,000 were evaluated and finally, applications requesting amounts in excess of 100,000 were examined. Following detailed consideration 32 grant applications were approved in principle. Each applicant organisation was notified of the outcome by way of letter. Where funding was approved in principle the successful applicant organisation was informed of the amount approved and advised of the specific conditions that must be met in order to access the grant in each case. 12 2.3 Drawdown Timeframe & Stages of Payment The grant approval letter issued to successful applicants advised that requests for drawdown from the Community Gain Fund must be submitted to the Community Gain by a specified date. In the majority of cases this was 12 months from the date of issue of the grant approval letter. Successful grant applicants were also informed that payment would be made in full on completion of the project and subject to invoices for expenditure incurred being submitted. Beneficiaries were advised that if they required an extension to the drawdown date or variation to the stages in which the grant payment will be made, then they must submit a formal written request to the Community Gain at the earliest possible date, disclosing full details as to why the variation is sought. The Community Gain received four requests from grant applicants to vary both the stages in which payment will be made and the extension date for drawdown of the fund. To date there has been six requests for drawdown from the community Gain Fund totalling 43, Legal Agreement/Deed of Charge As per condition 2.3b of the Projects Grant Scheme 2016 successful applicants approved for funding of between 20,000 and 100,000 must sign a legal agreement. In this regard, eight applications were approved in principle for funding from the Community Gain Fund of amounts between 20,000 and 100,000. Similarly, as per condition 2.3b of the Projects Grant Scheme 2016 successful applicants approved for funding in excess of 100,000 must sign a Deed of Charge. In this regard, ten applications were approved in principle for funding from the Community Gain Fund of amounts greater than 100,000. Dublin City Council s Law Department will liaise with these applicant organisations in relation to Legal Agreements and Deeds of Charge and provide the Committee with regular updates and progress reports. 13 2.5 Internal Assessor Dublin City Council will endeavour to make an internal assessor available to the Community Gain. The internal assessor will report on the progress and value of the projects as they occur and confirm that works have been carried out in accordance with the applicants proposed project. In this regard, it is estimated that 16 of the proposed projects will require monitoring and reviewing by the internal assessor. CGLC Projects Grant Scheme 2016 Annual Report Page 12 of 14

14 3. Finance The disbursement of the Community Gain Funds, on behalf of the Committee, is being facilitated by Dublin City Council. Payments from the developer of the Waste to Energy Project, DWtEL, are credited to the dedicated Waste to Energy Community Gain Fund cost centre. To date 9,013, has been credited to this cost centre. Communications 4.1 Newsletter The Community Gain produced their first newsletter in January 2016 which was distributed throughout the South East Area. 4.2 Website The website is regularly updated with the latest Community Gain announcements including minutes of the Committee s meetings and Dublin Waste to Energy project reports. In addition, a list of successful applicant organisations in the 2016 Projects Grant Scheme was published. There were 1,110 website visits in The average duration of a session was 2 minutes and 13 seconds. The bounce rate was 42.16% The address cglc@dublincity.ie is the primary method of communication between the Community Gain and applicant organisations.
