4 Mandate In March 2015 regional council s Executive Leadership Team approved development of this organisational Discovery Protocol to guide internal and external land disturbance/earthworks processes and operations to ensure: a) Regional Council demonstrates it recognised the importance of historic and cultural heritage when it is planning or undertaking land disturbance or earthworks activities b) Legislative responsibilities are clearly understood and integrated into Councils practices/processes for planning and implementing land disturbance and earthworks activities undertaken by staff and contractors c) Reputational risk in this area is minimised d) Regional Council operations recognise and provide for the relationships of Māori and their culture and traditions e) Works undertaken under bylaw demonstrate that best management practice is observed in the event of discovery of sites, koiwi and taonga tuturu f) Guidelines align with internal policies and practices to ensure consistency and compliance g) Guides are actionable for field staff. Te Kawa Tūhura MANDATE The Executive Leadership Team believed it timely that an organisation wide protocol is developed to ensure consistency: a) In implementation, regardless of activity status b) With legislative responsibilities under the Resource Management Act 1991, Heritage NZ Pouhere Taonga Act 2014, Protected Objects Act 1975, Marine and Coastal Area (Takutai Moana) Act 2011 and Treaty settlements c) With external protocols 1. Council staff and contractors shall give effect to Te Kawa Tūhura when planning and undertaking land disturbance and earthworks activities for regional council. Performance will be subject to appraisal. Training in the implementation of Te Kawa Tūhura will be arranged by Managers. Training by an archaeologist on recognising a potential site of historic heritage value will also be arranged by Managers. Contracts and environmental enhancement fund projects involving earthworks and land disturbance activities will recognise and provide for Te Kawa Tūhura. Te Kawa Tūhura was mandated by the Executive Leadership Team on Te Kawa Tūhura will be reviewed on a 3 yearly basis. 5 Executive Summary Bay of Plenty Regional Council carries out earthworks and land disturbance activities on a regular basis. These activities can affect recorded and unrecorded sites of historic and cultural heritage value as well as items like koiwi2 and taonga tuturu3 that might be found there. Planning to avoid recorded sites of significance and knowing what to do in the event of discovery of an unknown site and items is the focus of Te Kawa Tuhura operations guideline. Te Kawa Tūhura clarifies what to do in the event of discovery of a site of Māori origin, from the moment of discovery until decisions about the site and the interim custody of koiwi and taonga tuturu are made by Heritage New Zealand and the Ministry for Culture & Heritage. Te Kawa Tūhura can be used when Regional Council is planning and undertaking earthworks: as a consent applicant under bylaws or permitted baselines and when regional council is delegating or assigning earthworks to a contractor, consultant or associate4 Te Kawa Tūhura EXECUTIVE SUMMARY Te Kawa Tūhura includes a Practice Guide, Planning Flowcharts, Referral Flowcharts, a Discovery Protocol Template and handy cards with tips for first respondents at a discovery site. The Practice Guide offers guidance in the project planning phase and identifies steps to take in the event of discovery of a site of Māori origin. The Discovery Protocol Template is the planning tool for making a rapid response from the moment of discovery until decisions about the site and the interim custody of koiwi and taonga tuturu are reached by Heritage New Zealand and the Ministry for Culture & Heritage. Te Kawa Tūhura includes Planning Flowcharts5 that identify proactive steps to take to: o avoid disturbance of identified sites of historic heritage value and archaeological sites o seek pre-authority advice from Heritage New Zealand and/or an archaeologist (where necessary or appropriate) o be ready to act appropriately in the event of discovery of koiwi, taonga tuturu and the find site of Māori origin that may have been disturbed during regional council earthworks Te Kawa Tūhura Handy Cards can be amended to include relevant telephone numbers, printed, laminated and displayed in vehicles used by earth-workers and site managers. 7 PRACTICE GUIDE Responsibility for actions undertaken upon discovery of a site, artefacts or koiwi during regional earthworks is with the relevant Manager, while overall responsibility is with the relevant Group Manager. Council Staff and Contractors Initial Desktop Assessment In your initial desktop assessment use the steps in Te Kawa Tūhura Planning Flowchart when planning the proposed earthworks project to check whether the project: location and design is on or close to an identified site of historic heritage value or an archaeological site needs a specialist assessment report by a suitably qualified and experienced archaeologist needs pre-authority advice from Heritage New Zealand is likely to require cultural advice or a cultural impacts assessment from tangata whenua with relationships with the subject area Te Kawa Tūhura PRACTICE GUIDE If identified sites are present or close by then it s possible that other unidentified sites will also be present. Seek Advice from An Archaeologist When planning a project that may affect sites of historic heritage value seek the specialist advice of a fully qualified and experienced archaeologist before finalising your project plan. An archaeologist can provide specialist archaeological advice (including reports) about: avoiding or mitigating adverse effects at identified sites of historic heritage value (including archaeological sites that are subject to an authority from Heritage New Zealand) identifying potential sites of historic heritage value when to seek pre-authority advice from Heritage New Zealand training for staff and contractors in the recognition of potential sites of historic heritage value interim site management at a discovered site appropriate cordon distances discovery, recovery and interpretation of the surviving evidence from archaeological sites including: o interpretation of taonga tuturu o interpretation of koiwi and, in conjunction with NZ Police, an assessment of whether the site is a crime scene Archaeological advice is also important to informing the cultural impact assessments and kaitiakitanga decisions of tangata whenua. Archaeological advice significantly assists tangata whenua when: an archaeological report is made available to tangata whenua to inform their cultural impacts assessments in a resource consent process tangata whenua are gathered at a discovered find site of Māori origin alongside the archaeologist and other parties like New Zealand Policy, council officials and Heritage New Zealand surviving evidence from an archaeological site of Māori origin has been discovered Send archaeological reports to tangata whenua when seeking their assessment. 6

8 Is a Cultural Monitor Needed? A cultural monitor is a person that monitors the impacts of activities on places and values of significance to tangata whenua. In an earthworks consents process, cultural monitors are being identified by iwi (or several iwi) who recommend a cultural monitor be commissioned to carry out specified cultural monitoring activities. This can include activities outlined in this guideline. Having a cultural monitor available can be very helpful where: large scale earthworks operations are proposed, there is a likelihood of discovery of sites of Māori origin there are several iwi with relationships with the subject land area Advice from Tangata Whenua Identify Tangata Whenua and their Contact Details In the early stages of planning for earthworks activities use your contacts list or Councils Contacts Database or its Māori Contacts Database to identify tangata whenua with relationships with the subject area. Te Kawa Tūhura PRACTICE GUIDE You should check this information with the relevant Māori Policy Advisor6 or ensure the accuracy of the data by testing the contact details. When you are confident contact details are accurate, insert them into the Discovery Protocol Template you are adapting and add them to the Handy Cards issued to the Site Manager and earth-workers. Where tangata whenua advice includes a Discovery Protocol, use the information provided to further inform your actions in response to discovery of a site. Seeking Advice from Tangata Whenua in Cultural Impacts Assessments in a Consents Process Where Council is an applicant for resource consent, tangata whenua may be identified as parties from whom a cultural impacts assessment is required to inform a Council consent decision. Preparation of a cultural impacts assessment can take time and incurs costs that should be factored into your project plan. Where there are multiple tangata whenua groups with relationships with the subject area, you will need a cultural impacts assessment from each group. When seeking a cultural impacts assessment provide a copy of any archaeological report as this will inform tangata whenua as they prepare their cultural impacts assessment/s. When to call Tangata Whenua to attend a Site Discovery Before calling tangata whenua to the scene, ensure the archaeologist has had time to assess whether the site: is of historic heritage value is of Māori origin contains taonga tuturu or koiwi and if so, whether they are found together or not 6 There is a Māori Policy Advisor in each of the constituency areas of Kōhī, Mauao and Ōkurei constituencies. 7

9 Also ensure the archaeologist is able to be present to inform tangata whenua when they attend the scene. If it is suspected the site may be of interest to NZ Police, ensure the archaeologist and NZ Police have sufficient time to assess the scene. Once it is clear the site is of historic heritage value, a site of Māori origin and is not a crime scene it is important to observe the appropriate cultural behaviours as such sites can become a tapu place of great significance to tangata whenua. The relevant Māori Policy Advisor can provide you with advice for when you convene tangata whenua parties, the archaeologist, Heritage New Zealand staff and NZ Police at a meeting at the discovery site. Plan how you (or a commissioned cultural monitor) will: usher tangata whenua and other parties to the find site ask for the offering of appropriate karakia by tangata whenua ask tangata whenua if they will include workers, the find site, machinery and the wider work area in karakia ask tangata whenua whether they have any advice to offer in respect to: o the appropriate treatment of any koiwi discovered at the site including their re-interment or availability for archaeological study o suggestions for treatment of koiwi and taonga tuturu found together o suggestions for interim custodianship of taonga tuturu noting that an interim custodian must be a registered artefact collector and approved by the appropriate representative of the Ministry for Culture and Heritage noting that many iwi are registered artefact collectors and/or hold Protocols with the Ministry for Culture and Heritage o any other advice they wish to offer those present Te Kawa Tūhura PRACTICE GUIDE Kai Te Whakanoa Before leaving the work site, invite people to move to a separate area where they can have a cup of tea or coffee and a bite to eat. This is an important act of whakanoa that releases people from the state of tapu surrounding the find site. Vigilance A Cultural Monitor can provide vigilance at the cordoned find site until parties gather can be included in a contract. The site manager and council official shall ensure the safety and reasonable comfort of the cultural monitor at the find site. This may include a need to stay at the find site overnight if koiwi and taonga tuturu cannot be assessed by an archaeologist or uplifted for safe-keeping until an interim custodianship decision is made by the Ministry for Culture and Heritage. 8

12 Te Kawa Tūhura Discovery Protocol Template Template for Adaptation TE KAWA TŪHURA DISCOVERY PROTOCOL Providing for Protection of Sites of Historic Heritage Value, Koiwi (Human Skeletal Remains) and Taonga Tuturu (Artefacts) If sites of historic heritage value, archaeological sites, koiwi or taonga tuturu are uncovered or suspected during any ground disturbance or earthworks the following process will be followed by all persons. Procedure: 1. All work shall cease immediately at the site of discovery. 2. Cordon the area to prevent further damage. DO NOT remove any material from the site. Advise the site manager and. (Council official) (insert phone number). Te Kawa Tūhura DISCOVERY PROTOCOL 3. The.(Council official) will notify the Archaeologist (phone ). Depending on the archaeologist s advice, the (Council official7) will notify Heritage NZ s Regional Archaeologist ( ). If clearly identifiable human remains are uncovered the archaeologist will advise the staff member to contact the NZ Police Area Investigation Manager ( ) (this is a legal requirement following the discovery of any human skeletal material). 4. The archaeologist will advise whether the site is of Maori origin. If so, the Council official will contact the appropriate tangata whenua representative/s to meet on site with staff and the archaeologist to discuss what further actions are appropriate to safeguard the site and found objects. Contact: <insert appropriate tangata whenua contacts by referring to the Māori Contacts Database and checking this list with the Māori Policy Advisor>8. 5. Found objects (taonga tuturu) must be placed into the custody of a registered artefact collector that may be nominated by tangata whenua and archaeologists and decided by the Senior Advisor Heritage Operations (Māori) or the appropriate representative at the Ministry for Culture & Heritage. 6. Works affecting the site shall not resume until Heritage NZ, NZ Police (if skeletal remains are involved) and tangata whenua groups have given approval for work to continue. 7. 13 Archaeology in the Bay of Plenty There are very many unidentified places of historic heritage value of Māori origin in the Bay of Plenty region and New Zealand. There are over 8000 recorded archaeological sites in the Bay of Plenty region, the majority of which relate to Māori occupation. Since 1957 the NZ Archaeological Association (NZAA) has maintained a national inventory of archaeological sites called the Site Recording Scheme. The Scheme is used in planning and statutory processes as an initial site identification and assessment tool for site management and historic heritage protection purposes. The scheme contributes to the New Zealand Heritage List/Rārangi Kōrero administered by Heritage New Zealand and establishes the most comprehensive database of historic and archaeological sites in New Zealand. Te Kawa Tūhura ARCHAEOLOGY Accurate to within +/-100m, data from the New Zealand Heritage List is available in cultural layers within regional councils Geoview 2 Database. Sites of local significance can also be identified in schedules in district plans and these should also be considered in the planning process. 12

14 Māori Historical and Cultural Heritage Māori historical and cultural heritage are taonga for all New Zealand. They are what make New Zealand distinct from every other country in the world. It s here in New Zealand that Māori exclusively occupied space for many generations as the indigenous peoples of Aotearoa. While now occupied by many more people of many different cultures and traditions, the historic and archaeological evidence of the lives of the indigenous peoples of New Zealand remain evident in the landscape, and important to the people of New Zealand. For Māori, as with all other peoples of the world, places of historic and cultural heritage are important linkages to a people s history, origins, culture and traditions. In the case of Māori in New Zealand, they also underpin the fact of indigeneity and this establishes the context for Māori people and their relationships with all other people that now share this physical space. For Māori people it is natural that these special places of historic heritage value bring with them the wairua (spirit) of their Māoritanga, a sense of belonging and being of a place, as well as the opportunity to rekindle memory and create new ones, to learn about and empathise with the lives of tipuna (ancestors) from whom Māori descend, and for all New Zealanders to achieve greater knowledge and understanding of how Maori lived and what they endured in their lifetime. Māori people inherit a duty of kaitiakitanga that compels their engagement in managing and protecting sites of historic and cultural heritage of Māori origin. There can be several tangata whenua groups with relationships with areas that are subject to earthworks each of which may practice kaitiakitanga in different ways at different places throughout the Bay of Plenty. Each of them is to be recognised and provided for as the Bay of Plenty Regional Policy Statement policy IW2B (b) recognises that: only tangata whenua can identify and evidentially substantiate their relationship and that of their culture and traditions with their ancestral lands, water, sites, waahi tapu and other taonga. Te Kawa Tūhura MĀORI HISTORICAL & CULTURAL HERITAGE Tangata whenua cultural heritage advice greatly informs the management and protection of identified sites of historic heritage value and the pragmatic advice they can contribute in the event of discovery of a previously unidentified site of Māori origin. Tangata whenua advice helps to identify: cultural impacts to be avoided where an identified site of historic heritage value may be affected by earthworks culturally appropriate steps for managing a newly discovered site of Māori origin and koiwi discovered there and culturally appropriate interim custodianship arrangements to recommend to the Ministry for Culture & Heritage, Heritage New Zealand and the Māori Land Court Archaeological advice is critical to informing the kaitiakitanga advice provided by tangata whenua. 13

15 Compliance with the Heritage NZ Pouhere Taonga Act 2014 Te Kawa Tūhura supports Council compliance with the requirements of the Heritage New Zealand Pouhere Taonga Act 2014, the Protected Objects Taonga Tuturu Act 1975, the Resource Management Act 1991, Treaty settlement statutes and Protocols and regional policy. The Heritage New Zealand Pouhere Taonga Act 2014 makes it unlawful for anyone to modify or destroy, (or cause to modify or destroy), the whole or any part of an archaeological site without prior authority from Heritage NZ. Bay of Plenty Regional Council promotes actions consistent with important principles in the Heritage New Zealand Pouhere Taonga Act An application for an authority to undertake any activity that will or may modify or destroy the whole or any part of any archaeological site or sites within a specified area of land, whether or not a site is a recorded archaeological site or is entered in the NZ Heritage List/Rārangi Kōrero or on the Landmarks list 10, is required from Heritage NZ before works are undertaken. Te Kawa Tūhura COMPLIANCE There are many types of sites of historic heritage value11 provided for in the Heritage New Zealand Pouhere Taonga Act This guideline promotes a precautionary approach where, at the time of discovery, any site of historic heritage value (whether recorded or not) shall be treated as though it is a potential archaeological site, historic area or place, site of interest to Māori, wāhi tapu, wāhi tapu area or wāhi tūpuna. This is because it cannot be known at the time of a discovery whether the site is an archaeological site or a wāhi tapu, a wāhi tūpuna, a site of interest to Māori, an historic place, or a site of historic heritage value until an archaeologist is able to assess and advise the type of site discovered. Council staff and contractors are encouraged to seek early pre-authority advice from Heritage New Zealand to determine whether an authority from Heritage New Zealand will be required. 16 Handy Cards for First Respondents at a Possible Site of Māori Origin The Finders Handy Card If the finder suspects an archaeological site has been disturbed or discovered during works the finder will: STOP all machinery Call the Site Manager and Cultural Monitor (if there is one) to the scene Contact No: Finder Calls Site Manager & Cultural Monitor to the scene Leave items in place, as when they were first discovered at the site. Be available to speak with the Council Official and archaeologist when they visit the scene. Be ready to attend karakia with tangata whenua. Te Kawa Tūhura HANDY CARDS The Site Managers Handy Card The Site Manager will: Call the Council official and notify them of the find Contact No: Site Manager Calls Council Official and Cultural Monitor to the Scene Where a Cultural Monitor is appointed to monitor earthworks the Site Manager will call the Cultural Monitor to the scene and arrange for their vigilance and security at the scene. Place temporary Pink Flags in a 10m diameter around the find site until the archaeologist and Council Official advise the appropriate cordon distance to establish using cordon tape. Upon the advice of the archaeologist and Council Official the Site Manager will: Cordon the area using cordon tape Arrange to carefully move machinery away from the find site The Council Officials Handy Card The Council Official will call the archaeologist to the scene. Contact No: Council Official Calls Archaeologist to the Scene The archaeologist will inspect the scene and advise the Council Official about archaeological matters such as: Appropriate cordon tape distances Whether it is necessary to notify Heritage New Zealand and NZ Police Whether the site is of Māori origin Archaeological requirements, recommendations and suggestions for recovery and recording the find Key messages to assist onsite discussion and decision-making NZ Police and tangata whenua 15

18 APPENDIX 1 Sections and Principles of the Heritage New Zealand Act 2014 S6 Heritage New Zealand Pouhere Taonga Act 2014 Definitions Archaeological site means, subject to section 42(3) a) any place in New Zealand, including any building or structure (or part of a building or structure), that_ i. was associated with human activity that occurred before 1900 or is the site of the wreck of any vessel where the wreck occurred before 1900; and ii. provides or may provide, through investigation by archaeological methods, evidence relating to the history of New Zealand; and b) includes a site for which a declaration is made under section 43(1) Te Kawa Tūhura APPENDIX 1 Historic area means an area of land that a) contains an inter-related group of historic places; and b) forms part of the historical and cultural heritage of New Zealand; and c) lies within the territorial limits of New Zealand Historic place a) means any of the following that form a part of the historical and cultural heritage of New Zealand and that lies within the territorial limits of New Zealand: i. land, including an archaeological site of part of an archaeological site: ii. a building or structure (or part of a building or structure): iii. any combination of land, buildings, structures, or associated buildings or structures (or parts of buildings, structures, or associated buildings or structures); and b) includes any thing that is in or fixed to land described in paragraph (a) Site of interest to Māori means an archaeological site or other place I which an iwi or a hapū has, or at any time has had, an interest Tangata whenua means, in relation to an particular place or area, the iwi or hapū that holds, or at any time has held, mana whenua in relation to that place or area Wāhi tapu means a place sacred to Māori in the traditional, spiritual, religious, ritual, or mythological sense Wāhi tapu area means land that contains 1 or more wāhi tapu Wāhi tūpuna means a place important to Māori for its ancestral significance and associated cultural and traditional values, and a reference to wāhi tūpuna includes a reference, as the context requires, to a) wāhi tīpuna: b) wāhi tupuna: c) wāhi tipuna 17

19 Principles of the Heritage New Zealand Pouhere Taonga Act 2014 All persons performing functions and exercising powers under this Act must recognise (a) The principle that historic places have lasting value in their own right and provide evidence of the origins of NZ s distinct society; and (b) The principle that the identification, protection, preservation, and conservation of NZ s historical and cultural heritage should i. take account of all relevant cultural values, knowledge, and disciplines; and ii. take account of material of cultural heritage value and involve the least possible alteration or loss of it; and iii. safeguard the options of present and future generations; and iv. be fully researched, documented, and recorded, where culturally appropriate; and (c) the principle that there is value in central government agencies, local authorities, corporations, societies, tangata whenua, and individuals working collaboratively in respect of NZ s historical can cultural heritage; and (d) the relationship of Māori and their culture and traditions with their ancestral lands, water, sites, waahi tupuna, waahi tapu, and other taonga.
