3 Preliminary remarks III-V Materials are used by European industries in strategic electronic components manufacturing Certain substances are today being evaluated within the framework of the CLP/REACH legal process. European industry federations are currently acting to raise awareness of the European Commission and of the relevant institutions on the strategic nature of these substances. This presentation aims to present the strategic importance of III-V materials for European innovation, and raise awareness on the key issue of their assessment under CLP and REACH Regulations. 3

5 What are III-V materials? III-V materials stem from columns III and V of the periodic table of elements. 3 main elements constitute this «family»: o o o GaAs & alliages : AlGaAs, GaInAs, GaInP, GaAlAsP, InP & alliages : GaInAs, AlInAs, GaInAsP, AlInAsP, GaN & alliages (substracts SiC, saphir, Si, ) : GaAlN, GaInN, AlInN, III-V materials posses specific properties: o o o o High electronic speeds (performant electronic components) High breakdown voltages (high performance power components) «Direct gaps» band structure (LED & lasers) Complex multilayer structures (photonic & electronic brand new nano-components) 5

Regulatory risks : Example of today s situation for GaAs and InP substances Indium Phosphide (InP) Under CLP Regulation : Officially classified as CMR :

Gallium Arsenide (GaAs) Under CLP Regulation : Classification expected for the 2 nd semester 2012, as CMR : carcinogenic 1B and reprotoxic 1B Classification

14 Regulatory risks : Example of today s situation for GaAs and InP substances Indium Phosphide (InP) Under CLP Regulation : Officially classified as CMR : carcinogenic 1B and reprotoxic 2 under Annex VI of CLP Regulation (JOUE July 22th, 2012). Gallium Arsenide (GaAs) Under CLP Regulation : Classification expected for the 2 nd semester 2012, as CMR : carcinogenic 1B and reprotoxic 1B Classification of these substances as CMR under CLP makes them eligible to further REACH procedures. InP & GaAs are among the first III-V materials to be assessed under CLP & REACH Regulations : soon, all III-V substances could be concerned 14

15 Today s interrogations No alternatives are today available to replace these materials III-V materials strategic importance is recognized by the EU through Key Enabling Technologies (KETs) initiatives European innovation and growth are largely dependent on these materials Limitation of European Competitiveness; Competition distortion for European SMEs The right Risk management options are in place, monitored. Quantities are small and exposure to workers is below any EOL. Recent Reach regulation on III-V put an uncertainty on our innovation Economic and societal consequences of a too strict regulation over III-V materials shall be of direct effect on innovation and competitiveness Contradiction between the European Union 2020 Strategy targets and restrictions on key high-tech components, critical to EU innovation 15
