ACTION ITEMS California: Business Climate and Economic Competitiveness 2014 Legislative Session and ballot measures in circulation: What state actions would have a positive impact? What actions by our state would have a negative impact? SV Caucus 14 members of the California Legislature who physically represent some portion of Silicon Valley: What would make you more likely to participate? We are considering a new tool to measure Silicon Valley's business climate against other top U.S. tech regions: What key economic indicators and regions do you think we should measure in such a study? What other steps should we consider to be more effective in the State Capitol? Accomplishments: Support AB 327 (Perea): Electricity/natural gas, rates, net energy metering, RPS Passed both Houses; waiting concurrence on amendments pending Support SB 209 (Lieu) / AB 1412 (Bocanegra, Gatto): Retroactive tax repeal Third reading on Assembly floor pending Partially Accomplished Temporary (8 year) Sales Tax Exemption for manufacturing, bio tech and R&D Passed signed by Governor Works in Progress Oppose AB 488 (Williams): Expansive and costly new recycling program allowing authorities to ban the sale of tech products if consumers are not recycling old batteries, costing manufacturers millions Did not pass off Suspense File; held in committee two year bill Support California Environmental Quality Act (CEQA) reform two year bill. Disappointment that we could not achieve meaningful CEQA reform Support SB 391 (DeSaulnier): California Homes and Jobs Act document fee to fund affordable housing, placed on suspense August 30 two year bill Early evaluation of 40 new freshman legislators: Fred Noteware shared perspective on the meaning of half of the assembly being freshman. He noted that these legislators have the opportunity to serve 12 years and he views that as a good thing. We have developed positive relationships with SV delegation, but we must repair the relationship with the President Pro Tem, and need to strengthen the relationship with the Governor who can serve as a backstop to bad legislation. Should we do a policy scorecard? What metrics should be considered? Discussion was encouraged. Bay Area Council Economic Institute has conducted analysis on the economic indicators compared to other regions in the U.S. Reviewed innovation regions: Nashville, Denver, Vancouver and Dallas California Competitiveness Discussion: 2014 Legislative Session and ballot measures in circulation. Privacy issues many bills need to be monitored because privacy issues have impact on new innovators. Silicon Valley Caucus 14 members of the California Legislature who physically represent some portion of Silicon Valley: Silicon Valley Caucus members were invited to attend meetings to facilitate the building of relationships between CEOS with the elected officials at the state level. Be careful not to send the wrong message that Silicon Valley is just fine. Companies may be here but the future of the employee base may not be here. Educare of Silicon Valley Dennis Cima reported A capital campaign is underway to create an Educare facility in Silicon Valley. This will be accomplished through large partnerships, both public and private. Educare provides a pipeline supporting early childhood education because if you don t invest in this, you ll never be able to remediate the issues that aren t addressed during this formative time. There is a $1 million challenge grant to the corporate sector from a national funder with ties to other Educare projects. We don't want to leave that on the table in $800,000 is the SVLG goal. Consideration of donations was requested. Staff will be following up with member companies over the next weeks. SF Baylands Restoration & Flood Mitigation Mike Mielke and Andy Ball, President, Suffolk Construction reported

5 The region is increasingly vulnerable to flooding and seismic activity. All nine Bay Area counties are affected. Infrastructure is vulnerable including airports, BART, transportation. Climate changes cause sea level to rise putting levees under pressure. And there has been an increase in severe storms. Levees need to be protected or there could be flooding. The current levee system was not built nor maintained to avoid flooding or a major seismic event. Businesses are at risk, but people are also living in those regions. The goal will be to get an initiative on the ballot with a clear message of what we can actually do to really make a difference. Does your business have a continuity plan? Staff will work to develop a task force to lead us forward, and are looking for volunteers from member companies. What is the best way for your company to engage? Communications Grassroots cooperation Task force development Insurance companies will need to be looped in. Money spent now could protect assets in the future. Billions of dollars can be saved, if we proactively address this problem now. There being no further business, the meeting adjourned at 10:10 a.m. Signed
