3 GENESEE COUNTY METROPOLITAN PLANNING COMMISSION Tuesday, October 4, 2016, 8:00 a.m. MINUTES The Genesee County Metropolitan Planning Commission met at 8:00 a.m. on Tuesday, October 4, 2016, in the Conference Room of the Genesee County Metropolitan Planning Commission (GCMPC), 1101 Beach Street, Room 223, Flint, Michigan. I. CALL TO ORDER Chairperson Himelhoch called the meeting to order at 8:00 a.m. II. ROLL CALL Present: Alan Himelhoch, Alexander Isaac, Cheryl Sclater, Gloria Nealy, Janice Karcher, Jeffrey M. Derek Bradshaw added that staff will be meeting later today with Genesee County Habitat for Humanity regarding a grant opportunity offered by the state for homeowner rehabilitation projects. GCMPC is not eligible to apply, but can partner with a local non-profit agency. If awarded, the grant will require match funding. 8 November 1, 2016 MEMORANDUM TO: FROM: SUBJECT: Members of the Genesee County Metropolitan Planning Commission Damon Fortney, Planner II FOS ; Montrose Township Edward Polzin Application For Farmland Agreement I. LEGISLATIVE BASIS FOR GCMPC REVIEW Part 361 of the Natural Resources and Environmental Protection Act, 1994 Act 451 as amended, more commonly known as P.A. 116, enacted in 1974, establishes the right of a landowner, if all qualifications are met, to enter into a temporary restrictive agreement where the owner and the state agree to jointly hold the right to develop a parcel of farmland. This covenant is an agreement to not develop the property except as specifically stated within the agreement. The covenant runs with the land and is for a jointly agreed upon length of time (at least 10 years). Upon receipt of an application, the local governing body has 45 days to approve or reject the application. Within this 45-day period, the local governing body must seek comment from a number of bodies including the county or regional planning commission. Any comment received is strictly advisory as these reviewing agencies do not have an approval or rejection power over the application. II. STAFF ANALYSIS The request for comment from the Genesee County Metropolitan Planning Commission was received within the required 45-day period starting at the onset of application. The parcel in question is located in Montrose Township at R-5E, T-9N, Section 11, with a total size of 36 acres (30 acres of which are used for cultivation). The parcel is located on the south side of Lake Road, just east of Marshall Road. This parcel appears to be eligible for the Farmland and Open Space Preservation Program because it is between 5 and 40 acres in size, with at least 51% of the land being agriculturally active. Income from the sale of agricultural products on this parcel totals $500 per tillable acre annually, exceeding the income requirement of at least $200 per acre required to be eligible for the program. 9 According to the Montrose Charter Township Master Plan, the current zoning for this parcel is Agricultural, with all surrounding parcels zoned as either Agricultural or Residential Farm. The future land use map of Montrose Township also shows the property remaining as Agricultural. Therefore, preserving this parcel as farmland and open space is consistent with the township s goals. There are two other parcels located adjacent to the parcel in question already protected under the Farmland and Open Space Preservation Program, and many other parcels throughout Montrose Township. The Master Plan explains that based on community input, existing agricultural lands are important to the residents of Montrose Township. The future land use map shows agricultural land uses predominantly in the northeast, far west, and southeast portions of the township. The plan sets a goal that prime agricultural lands and related agricultural activities and resources should be maintained and encouraged to ensure Montrose Township s unique rural character. The Farmland and Open Space Preservation Act is cited as one tool that can be used for maintaining agriculture as an environmental asset. III. STAFF RECOMMENDATION Pursuant to the provisions of Public Act 116, staff recommends that the Genesee County Metropolitan Planning Commission, submit the following comments to Montrose Township, in regards to FOS : 1. Review of the Application for Farmland Agreement indicates the parcel in question meets the requirement of PA 116, being between 5 and 40 acres in size, with 51% of the land being agriculturally active and producing a gross annual income in excess of $200 per tillable acre. 2. Preserving this area strictly for agricultural and open space uses addresses the County s call for special attention to local farmland and other open spaces as described in GCMPC s, A Changing Landscape: 2006 Land Use Analysis and Trends. 3. The enrollment of this parcel in P.A. 116 is consistent with local planning. The parcel under consideration is designated as Agricultural in both current zoning and future land use maps. Preserving this parcel for agricultural use is consistent with the goals and objectives listed in the Montrose Charter Township Master Plan. IV. The three (3) adjacent parcels listed in Vienna Township at T-9N, R-6E, Section 7 measure a cumulative acres. The landowners are submitting one application, rather than an application for each identified parcel. The parcels are located between Elms Road to the west, Farrand Road to the south, Webster Road to the east, and Lake Road to the north. Each individual parcel meets the criteria of being a minimum of 40 acres and appear to meet the 51% threshold of land agriculturally active, set by the State of Michigan. 12 The Vienna Township Zoning Districts Map, approved in 2005, designates the parcels as Agricultural Residential District (AR). Neighboring parcels immediately south are identified as One Family Residential District (RSA); with all other parcels zoned as AR. The Future Land Use Map of Vienna Township intends for these parcels to continue use as Agriculture. The Master Plan states the northern and southwestern portions of the Township contain the best soils for farming and the intent of the Master Plan is to limit the change of these areas to urban development as much as possible. There are two other known parcels in Vienna Township which are protected under P.A. 116; however, none are directly adjacent to the property currently being reviewed. III. STAFF RECOMMENDATION Pursuant to the provisions of Public Act 116, staff recommends that the Genesee County Metropolitan Planning Commission, submit the following comments to Vienna Township, in regards to FOS : 1. Based off initial review, this application for Farmland Agreement is eligible for the Farmland and Open Space Preservation Program. The parcels meet the minimum 40 acres or larger requirement and appear to meet the 51% threshold of land agriculturally active. 2. 15 November 1, 2016 MEMORANDUM TO: FROM: SUBJECT: Members of the Genesee County Metropolitan Planning Commission Jason Nordberg, Principal Planner Genesee County Metropolitan Planning Commission 3-C Transportation Planning October 2016 Status Report FY 2017 Transportation Improvement Program (TIP) Local Road Agencies Meetings Staff met with all local road agencies that have projects in the 2017 fiscal year of the Transportation Improvement Program (TIP). Staff reviewed the Michigan Department of Transportation (MDOT) project development schedule with the local road agencies to make sure they are aware and following the deadlines identified for project milestone. The Technical Advisory Committee (TAC) and the Genesee County Metropolitan Alliance (METRO) also approved a TIP amendment schedule that identifies 6 months during the year that major changes to projects (amendments) can be made. Rideshare Program During the month of October, staff promoted the Rideshare Program by providing referrals to MTA, V-Ride, and Enterprise Holdings. On October 12 th, staff attended the quarterly Local Rideshare Office meeting in Detroit. The purpose of the meeting was to discuss quarterly report requirements, the transition and merger of V-Ride into Enterprise Holdings, and to discuss ways to positively integrate both Uber and Lytf into the overall Rideshare Program. On October 25 th, staff met with New Paths Incorporated, a regional probationary residential agency located in Flint. The purpose of the meeting was to discuss ways in which the Rideshare Program could assist residents in meeting their transportation needs for job opportunities throughout Genesee and Lapeer Counties. 16 November 1, 2016 MEMORANDUM TO: FROM: SUBJECT: Members of the Genesee County Metropolitan Planning Commission Sheila Taylor, Principal Planner Environmental Program Environmental Program Update October 2016 Status Report Solid Waste Program Recycle Day was held on October 22, 2016 in Mt. Morris Township and 635 residents came through the site to recycle materials. Staff will report final waste amounts collected as soon as possible. Staff received totals from the Recycle Day event held in August at Lake Fenton High School, where 747 residents participated. Approximately 50,605 pounds of hazardous waste, 32,326 pounds of electronics and 2,880 pounds of appliances were collected. Staff has sent out 302 Solid Waste Permits to companies collecting waste within Genesee County. Staff is currently receiving and reviewing the 4 th Quarter Solid Waste Reports. Staff continues to work with the City of Flint and local service providers to encourage the recycling of water bottles and filters by residents of the City. 17 November 1, 2016 MEMORANDUM TO: FROM: SUBJECT: Members of the Genesee County Metropolitan Planning Commission Sheila Taylor, Principal Planner Community Development Program Community Development Program October 2016 Status Report Community Development Block Grant Program (CDBG) During October, staff continued to work with the local units in Group 3 to ensure PY 2015 projects are moving forward and will be finished by the contract expiration dates. After signing PY 2016 contracts in September, staff started working with Group 1 local units to help get projects started. GCMPC staff also worked with Group 2 applicants to make sure the application process was going smoothly. Staff has been conducting property management reviews at various locations throughout the county to inventory all items purchased with CDBG funds. Inventory should be complete in November. HOME Investment Partnerships Program (HOME) The HOME and Community Housing Development Organization (CHDO) applications are due November 18 th for 2017 funding. Staff is expecting multiple applications for funding. Habitat for Humanity continues to work on the 2015 funded project (six new construction homes). The homes are in various stages of completion, except the home to be built in the City of Mt. Morris where construction has not yet started. 18 Neighborhood Stabilization Program In October, rehabilitation was completed on one home in Flint Township, it was listed and has multiple offers which are being reviewed. Rehabilitation is underway at one property in the City of Mt. Morris and another in Genesee Township is expected to begin early November. Demolition of eight homes will begin in early November, after the contract is approved at the County Board meeting and the State has been notified. Staff continues to administer the NSP funds and to work with partners to acquire, rehab, sell and demolish homes in target areas of the County.

19 November 1, 2016 MEMORANDUM TO: FROM: SUBJECT: Members of the Genesee County Metropolitan Planning Commission Derek Bradshaw, Director-Coordinator Report of the Director-Coordinator October 2016 Status Report GLS Region V Regional Prosperity During October, the Regional Prosperity Initiative 2017 application for funding was released. The application is due to the state December 1 st. Staff will be sending out a request for letters of support from all I-69 Thumb Region partners. Several opportunities are being finalized and will take place in the next several months: Incremental Development Alliance (IDA) sessions related to small scale real estate development December 5 th 8 th. These sessions will primarily revolve around the principles and implementation mechanisms behind neighborhood based development projects. Recast City will be in town in early February to look at local producers and maker industries as a growing asset and a key sector to strengthen local economic resilience. Tourism First Impressions (TFI) applications have been disbursed to local units of government throughout the Region. This provides communities an opportunity to have an assessment completed that will report strengths and weaknesses of the community as seen through the eyes of first time visitors. The first Tourism Subcommittee meeting was held late September. Several project ideas were discussed and the group will be gathering again in early November to determine a project to receive funding. An additional I-69 Thumb Region Steering Committee meeting is scheduled for November 10 th at 10:30 a.m., at the Lapeer County Health Department.
