11 BACKGROUND The proposed resolution for this item is in direct response to the Brown Act. According to District Counsel, "The Board may meet in Closed (Executive) Session prior to or during negotiations to give instructions to its negotiator regarding the price and terms of payment for the purchase or the lease of the property only after it has identified the parcels of concern, and has identified the people with whom this negotiator may negotiate in open session." ALTERNATIVES No alternatives are recommended. 10

Approval of Out-of-State Travel for Directors Beverly Lane, Doug Siden and John Sutter, and General Manager Robert E. Doyle to Attend the 2013 NRPA National Legislative Forum on March 19-21, 2013 in Washington, D.C. (Pulido) It is recommended that the Board of Directors approve out-of-state travel for Directors Beverly Lane, Doug Siden and John Sutter and General Manager Robert E. Doyle to attend the National Recreation and Park Association s (NRPA) National Legislative Forum to be held on March 19 21, 2013 in Washington, D.C. REVENUE/COST Funding for this travel is available in existing departmental budgets. BACKGROUND The 2013 NRPA National Legislative Forum is scheduled for March 19 21, 2013 in Washington, D.C. This conference is an important informational gathering of park and recreation agencies. In addition, meetings will be held with the District s Washington legislative advocate and Congressional representatives to discuss various issues of interest to the District. ALTERNATIVES No alternatives are recommended. 13

15 EAST BAY REGIONAL PARK DISTRICT RESOLUTION NO.: March 5, 2013 APPROVAL OF OUT-OF-STATE TRAVEL FOR DIRECTORS BEVERLY LANE, DOUG SIDEN AND JOHN SUTTER AND GENERAL MANAGER ROBERT E. DOYLE TO ATTEND THE 2013 NRPA NATIONAL LEGISLATIVE FORUM ON MARCH 19 21, 2013 IN WASHINGTON, D.C. WHEREAS, the National Recreation and Park Association s (NRPA) National Legislative Forum Is being held on March 19 21, 2013 in Washington, D.C.; and WHEREAS, representation at this conference is an important opportunity for the District to keep updated on national issues and policy briefings that affect park agencies throughout the nation; and WHEREAS, as an additional benefit to the District, meetings are also held with the District s Washington legislative advocate and various members of Congress to discuss issues of interest to the Park District; NOW, THEREFORE, BE IT RESOLVED that the Board of Directors of the East Bay Regional Park District hereby approve out-of-state travel for Directors Beverly Lane, Doug Siden and John Sutter and General Manager Robert E. Doyle to attend the NRPA Legislative Forum in Washington, D.C.; and BE IT FURTHER RESOLVED that the General Manager is hereby authorized and directed, on behalf of the District and in its name, to execute and deliver such documents and to do such acts as may be deemed necessary or appropriate to accomplish the intentions of this resolution. 16 C. BUSINESS BEFORE THE BOARD 1. CONSENT CALENDAR RECOMMENDATION AGENDA REGULAR MEETING BOARD OF DIRECTORS EAST BAY REGIONAL PARK DISTRICT Tuesday, March 5, 2013 d. Authorization to Enter Into a Contract for Services Agreement with CPS HR Consulting (Gonzales/Doyle) The General Manager recommends that the Board of Directors authorize entering into a Contract for Services Agreement with CPS HR Consulting for the following recruitments: Chief of Interpretive and Recreation Services and Chief of Stewardship. REVENUE/COST The total cost of this Contract for Services Agreement will not exceed $41,000; funding is available in the Human Resources Division s Professional Services budget BACKGROUND The District currently has two key positions that need to be filled: Chief of Interpretive and Recreation Services and Chief of Stewardship. These recruitments require time, attentiveness and an aggressive recruitment strategy, which includes a nationwide search. The District has used CPS HR Consulting in the past for a number of critical positions, including the AGM of Land and the AGM of Operations. Staff recommends that the District utilize the services of CPS HR Consulting to again assist in providing qualified candidates for the Chief of Interpretive and Recreation Services and Chief of Stewardship positions. ALTERNATIVES None are recommended. 15

17 EAST BAY REGIONAL PARK DISTRICT RESOLUTION NO.: March 5, 2013 AUTHORIZATION TO ENTER INTO A CONTRACT FOR SERVICES AGREEMENT WITH CPS HR CONSULTING WHEREAS, the District is interested in recruiting for two key management positions: Chief of Interpretive and Recreation Services and Chief of Stewardship; and WHEREAS, CPS HR Consulting is qualified to offer these services and has provided recruitment services to the District for AGM of Land and AGM of Operations; WHEREAS, the Board Operating Guidelines require Board authorization for any vendor contract which exceeds $25,000; NOW, THEREFORE, BE IT RESOLVED, that the Board of Directors of the East Bay Regional Park District hereby authorize entering into a Contract for Services Agreement in an amount not to exceed $41,000 with CPS HR Consulting, with funding to be provided from the Human Resources Division s Professional Services account ; and BE IT FURTHER RESOLVED that the General Manager is hereby authorized and directed, on behalf of the District and its name, to execute and deliver such documents and do such acts as may be deemed necessary or appropriate to accomplish the intentions of this resolution. 18 C. BUSINESS BEFORE THE BOARD 1. CONSENT CALENDAR RECOMMENDATION AGENDA REGULAR MEETING BOARD OF DIRECTORS EAST BAY REGIONAL PARK DISTRICT Tuesday, March 5, 2013 e. Authorization to Enter Into a Contract for Services Agreement with Wesley and Associates (Gonzales/Doyle) The General Manager recommends that the Board of Directors authorize entering into a Contract for Services Agreement with Wesley and Associates for training and consultation work in the areas of leadership and management development. REVENUE/COST The total cost of this Contract for Services Agreement will not exceed $55,000. Funding for this contract must be available in the 2013 Budgets of the departments who will use the services of Wesley and Associates. Human Resources will set up one contract and purchase order and track usage from other departments using the services of Wesley and Associates. This will allow Human Resources to track the total costs spent from the contract. BACKGROUND The District provides in-house opportunities for staff to participate in soft-skills training such as leadership/management development, team-building, communications, presentation skills and diversity. Jill Wesley, principal of Wesley and Associates, has been a well-received facilitator at the District since Wesley and Associates is qualified to provide these services and is familiar with employees and the culture of the District as well. For 2013, staff has identified the following projects that will require the services of Wesley and Associates: communication and team-building courses, presentation skills training, and succession planning facilitation. ALTERNATIVES The Board could direct the General Manager and Human Resources Division to seek other firms who could perform this work. Because of the caliber of this facilitator, this alternative is not recommended. 17

19 EAST BAY REGIONAL PARK DISTRICT RESOLUTION NO.: March 5, 2013 AUTHORIZATION TO ENTER INTO A CONTRACT FOR SERVICES AGREEMENT WITH WESLEY AND ASSOCIATES WHEREAS, the District desires and encourages employee participation in group trainings on topics such as leadership/management development, team-building, diversity training and presentation skills; and WHEREAS, Wesley and Associates is qualified to offer these trainings and has provided these trainings to District employees since 2007; and WHEREAS, the Board Operating Guidelines require Board authorization for any vendor contract which exceeds $25,000; NOW, THEREFORE, BE IT RESOLVED, that the Board of Directors of the East Bay Regional Park District hereby authorize entering into a Contract for Services Agreement in an annual amount not to exceed $55,000 with Wesley and Associates; and BE IT FURTHER RESOLVED that the General Manager is hereby authorized and directed, on behalf of the District and its name, to execute and deliver such documents and do such acts as may be deemed necessary or appropriate to accomplish the intentions of this resolution. 20 C. BUSINESS BEFORE THE BOARD 1. CONSENT CALENDAR RECOMMENDATION AGENDA REGULAR MEETING BOARD OF DIRECTORS EAST BAY REGIONAL PARK DISTRICT Tuesday, March 5, 2013 f. Authorization to Apply to the Environmental Protection Agency for Federal Grant Funds from the San Francisco Bay Water Quality Improvement Fund for the Breuner Marsh Restoration and Public Access: Point Pinole Regional Shoreline (Olson/Rasmussen/Collins) The General Manager recommends that the Board of Directors authorize a grant application to the Environmental Protection Agency for federal grant funds from the San Francisco Bay Water Quality Improvement Fund for the Breuner Marsh Restoration and Public Access at Point Pinole Regional Shoreline. REVENUE/COST This action proposes submission of a grant application up to $1,500,000. This project will increase the long term operational cost of the District. BACKGROUND The EPA is soliciting proposals under San Francisco Bay Area Water Quality Improvement Fund to protect and restore the water quality of the San Francisco Bay and its watersheds through comprehensive watershed management. The program seeks to fund projects to achieve significant improvement in water quality and attainment of beneficial uses. The proposed project is located on the former Breuner Property in the City of Richmond. The property is located at the north end of Goodrick Avenue on the west side of the Richmond Parkway. The project area is bounded by Point Pinole Regional Shoreline to the north, Union Pacific Railroad tracks to the east, the Murray property and Richmond Rod and Gun Club to the south and San Francisco Bay to the west. Habitat improvements include restoration of tidal saltmarsh and coastal scrub habitats. Recreation improvements include a small staging area, a new bridge over Rheem Creek, a picnic area, and improvements to shoreline trails. ALTERNATIVES No alternatives are recommended. 19

21 EAST BAY REGIONAL PARK DISTRICT RESOLUTION NO.: March 5, 2013 AUTHORIZATION TO APPLY TO THE ENVIRONMENTAL PROTECTION AGENCY FOR FEDERAL GRANT FUNDS FROM THE SAN FRANCISCO BAY WATER QUALITY IMPROVEMENT FUND FOR THE BREUNER MARSH RESTORATION AND PUBLIC ACCESS: POINT PINOLE REGIONAL SHORELINE WHEREAS, the U.S. Environmental Protection Agency (EPA) is soliciting proposals under the San Francisco Bay Area Water Quality Improvement Fund to protect and restore the water quality of the San Francisco Bay; and WHEREAS, the Breuner Marsh Restoration and Public Access project includes restoration of tidal saltmarsh and coastal scrub habitats and recreation improvements including a small staging area, a new bridge over Rheem Creek, a picnic area, and improvements to shoreline trails; NOW, THEREFORE, BE IT RESOLVED, that the Board of Directors of the East Bay Regional Park District hereby: 1. Approves the filing of an application for federal fund of up to $1,500,000 with the EPA; and 2. Appoints the General Manager or Assistant General Manager of Finance and Management Services as agent of the East Bay Regional Park District to conduct all negotiations, execute and submit all documents, including, but not limited to applications, agreements, amendment, payment requests and perform such acts, which may be necessary for the completion of the aforementioned project; and 3. Authorizes the Chief Financial Officer or Budget Manager to amend the current year s budget, without further Board action, upon receipt of the executed grant contract from the Grants Manager. The budget amendment will include an increase in budgeted revenue and a corresponding increase in appropriation for the amount stipulated in the grant contract. BACKGROUND DBW grants are awarded on a competitive basis. Grants are made to qualifying public agencies to fund facilities such as boat launching ramps, boarding floats, and associated parking areas, restrooms, and lighting for motorized and non-motorized boaters. The District is seeking funds to replace the boat dock and ramp, repave the parking lot and install new restrooms in compliance with ADA standards at the boat launch on Doolittle Drive. Resolution Approving the Application for Grant Funds for the Urban Greening Grant Program under the Safe Drinking Water, Water Quality and Supply, Flood Control, River and Coastal Protection Bod Act of 2006 (Proposition 84) for the Albany Beach Restoration and Public Access: Eastshore State Park (Olson/Rasmussen/Collins) The General Manager recommends that the Board of Directors authorize grant applications for grant funds from the California Strategic Growth Council from the Prop 84 Urban Greening Grant Program for the Albany Beach Restoration and Public Access project at Eastshore State Park. REVENUE/COST This action proposes submission of a grant application up to $1,000,000. This project has the potential to increase the long term operational cost of the District. BACKGROUND The Strategic Growth Council is a cabinet-level committee that is tasked with coordinating the activities of member state agencies to assist state and local entities in the planning of sustainable communities. The Urban Greening for Sustainable Communities Program provides funds to preserve, enhance, increase or establish community green areas such as urban forests, open spaces, wetlands and community spaces. The Eastshore State Park General Plan identifies a number of habitat restoration and public access improvements for Albany Beach. Restoration would include enhancement of the existing beach and sand dunes. Debris would be removed from the beach and native dune vegetation would be planted to stabilize the upper beach and dunes. Public access to the beach and water would be provided by installation of new ADA-compliant walkways and fencing that would provide access to the beach while minimizing impacts to the dunes. Interpretive exhibits, picnic facilities, restrooms and a staging area could also be provided. This project could be implemented in phases as funds are provided. 23

26 EAST BAY REGIONAL PARK DISTRICT RESOLUTION NO.: March 5, 2013 RESOLUTION APPROVING THE APPLICATION FOR GRANT FUNDS FOR THE URBAN GREENING GRANT PROGRAM UNDER THE SAFE DRINKING WATER, WATERQUALITY AND SUPPLY, FLOOD CONTROL, RIVER AND COASTAL PROTECTION BOND ACT OF 2006 (PROPOSITION 84) FOR THE ALBANY BEACH RESTORATION AND PUBLIC ACCESS: EASTSHORE STATE PARK WHEREAS, the Legislature and Governor of the State of California have provided funds for the program shown above; and WHEREAS, the Strategic Growth Council has been delegated the responsibility for the administration of this grant program, establishing necessary procedures; and WHEREAS, said procedures established by the Strategic Growth Council require a resolution certifying the approval of application(s) by the Applicants governing board before submission of said application(s) to the State; and WHEREAS, the applicant, if selected, will enter into an agreement with the State of California to carry out the Project(s); NOW, THEREFORE, BE IT RESOLVED that the Board of Directors of the East Bay Regional Park District hereby: 1. Approves the filing of applications for the Albany Beach Restoration and Public Access Project; 2. Certifies that applicant understands the assurances and certification in the application, and 3. Application for approximately $1,000,000 for construction of the San Francisco Bay Trail between Gilman Street and Buchanan Street at Eastshore State Park; 2. Application for approximately $1,200,000 for construction of the Shadow Cliffs to Del Valle Regional Trail between Isabel Avenue and Vallecitos Road; 3. Application for approximately $75,000 for a feasibility study of the Niles Canyon Regional Trail, and the appropriation of $75,000 in Consolidated South Metro Measure AA development bond funds as required match. If the grant is not awarded, the appropriated AA funds would be returned to the South Metro Measure AA bond fund. If constructed, these projects would increase the long term operational cost of the District. BACKGROUND The Alameda County Transportation Commission (Alameda CTC) is responsible for planning, funding and delivering transportation projects and programs within Alameda County. The Alameda CTC is responsible for programming Federal, State and Local transportation funds. These projects represent high priority projects in the Regional Trails network that close gaps and connect with transportation hubs, jobs and activity centers. 27

Authorization to Correct the 2013 Operating Budget and Appropriate General Fund Unassigned Fund Balance (Rubaloff/Collins) The General Manager recommends that the Board of Directors authorize corrections to the East Bay Regional Park District s 2013 Operating Budget, which will require an increase in General Fund appropriations and revenue, as well as increase in 2002 Limited Obligation Debt Service Fund revenue and appropriations. REVENUE/COST The net impact of the correction to the 2013 operating budget is the use of $114,400 General Fund unassigned fund balance. BACKGROUND The Board of Directors adopted the 2013 Operating and Projects Budgets on December 18 th, 2012 with resolution The resolution included the intent to revise some items in the proposed budget that were known at that time. Subsequent to the posting of the adopted budget, three items were identified as needing correction: 1. Increase in General Fund supplies and services appropriations for the Regional Trails Unit Manager Department in the Operations Division: $213,120 increase in operating appropriations for Pacheco Corporation Yard supplies and services. o This budget amount was described in the narrative of the proposed budget document, but the adopted appropriations inadvertently did not include this amount. o This correction to the 2013 budget is a base budget change. 2. Increase in General Fund budgeted revenue and interagency agreement appropriations for the Public Safety Admin Department in the Public Safety Division: 33

35 $32,000 increase in interagency appropriations related to parking citation, which will be offset with $32,000 increase in parking citation revenue. There is no impact on fund balance. o The District is required by state statute to remit to the relevant counties $12.50 for each District parking citation issued. Previously this statutory fee was combined with the revenue, thus reducing revenue to a net amount. Improved transparency is achieved by accounting for the revenue and associated cost separately. The 2013 budget, as approved by the Board, continued the net reporting treatment. This budget correction will enable staff to modify the reporting of parking citation revenue and related expenditures, eliminating the netting of fees against the revenue. o This is a base budget change. 3. Increase in General Fund transfers out, and increase in 2002 Limited Obligation Debt Service Fund transfers in and services appropriations: $122,060 increase in General Fund transfers-out in combination with $122,060 increase in 2002 Debt Service Fund transfer in. Increase of $1,000 for services in 2002 Limited Obligation Debt Service o The General Fund has funded all the debt service payments for the 2002 Limited Obligation bonds. The final debt service payment (March 2013) is to be paid with amounts deposited into the reserve fund managed by the trustee. It has been determined the reserve fund balance is less than the final payment amount. Thus the General Fund is required to partially fund the final debt service payment in the amount of $146,660. The 2002 fund has current fund balance of $25,600, thus $121,060 is needed to supplement resources in 2002 debt service fund to cover the final debt service payment. o Additionally a final arbitrage calculation and an unexpected significant event disclosure are required but not fully budgeted in 2013, which results in the increase in services appropriation of $1,000. o This is a one-time budget change. The District s General Fund 2013 Adopted Operating Budget has total appropriations of $108,435,520 (including transfers out). This correction will increase appropriations by $367,180 to a revised total of $108,802,700. The District s General Fund 2013 Adopted Operating Budget has total budgeted revenue of $108,656,300 (including transfers in). This correction will increase revenue by $32,000. This amount combined with adopted budget excess revenue over expenditures of $220,780 totals $252,780, leaving a $114,400 resource shortage. The resource shortage will be funded through General Fund unassigned fund balance. Each of these budget adjustments is outlined in the attached budget change form. ALTERNATIVES The Board could elect not to fund these corrections. This is not recommended. 34

Approval of 2013 Risk-Based Internal Audit Plan and Acceptance of the Confirmation of the Organizational Independence with Qualification of the Internal Audit Function (Sumner/Rubaloff) The General Manager and the Board Finance Committee (by unanimous vote at the January 22, 2013 committee meeting) recommend that the Board of Directors approve the 2013 Internal Audit Plan. Additionally, in compliance with the Institute of Internal Auditors (IIA) International Standards for the Professional Practice of Internal Auditing (Standard) # 1110, Organizational Independence, at this meeting and annually hereafter, the Board is requested to accept the confirmation of the organizational independence of the internal audit function. REVENUE/COST There is no cost associated with this action. BACKGROUND Internal Audit Plan The internal audit function provides an independent and objective assurance and consulting activity that is guided by a philosophy of adding value to improve the operations of the District. It assists the District in accomplishing its objective by bringing a systematic and disciplined approach to evaluate and improve the effectiveness of the organization s risk management, control and governance processes. Each year the annual internal audit plan is presented to the Board for approval. The 2013 internal audit plan is comprised of projects prioritized by level of financial risk, which is defined as a set of circumstances that hinder achievement of objectives. A risk-based auditing approach is required per Standard #2010 of the Institute of Internal Auditors International Standards for the Professional Practice of Internal Auditing. The annual risk assessment process involves understanding the entity and its environment (including internal controls), performing analytical procedures, observation and inspection, consideration of staff and management input and the 37

39 establishment of a formal rating system, which is used to demonstrate risk level of major activities of the District. The annual audit plan includes an assessment of cash collection sites (on a rotating basis), monitoring the results of a prior year audit project, examination of concessionaires and review of major revenue and expenditure categories are endeavored to be audited each year. As a result of the risk assessment process, a sample of several District activities will be audited during the course of the coming year. The 2013 plan is to examine Ardenwood and Roberts cash handling, monitor the results of the 2004 employee expense report audit, examine concession agreement compliance at the Tilden Merry-go-round, and review major capital project expenditures for Tidewater project and the Vogt et. al. (Barron) Black Diamond property acquisition. The internal audit plan has been presented to the Board Finance Committee and is unanimously recommended for full Board of Directors approval. Organizational Independence IIA Standard #1110 requires that organizational independence of the internal audit activity is confirmed annually to the Board. The District s internal audit function s independence conformity is confirmed with qualification. The Interpretation of IIA Standard defines independence as follows: Independence is the freedom from conditions that threaten the ability of the internal audit activity to carry out internal audit responsibilities in an unbiased manner. Due to the current District reporting structure, the internal audit function is assigned within the Finance Department. Per the IIA Standard, independence can be achieved through a dual-reporting relationship. The District does comply with IIA Standard #1110 Interpretation, which states, Organization independence is effectively achieved when the (internal audit function) reports functionally report to the Board. In compliance with the District s Internal Audit Charter, the Audit Manager reports administratively to the CFO/Controller and functionally to the Board. Consequently, the organizational independence of the internal audit activity is confirmed with qualification. ALTERNATIVES None are recommended. 38

Authorization to Retire and Write-off Certain Fixed Assets from District Financial Records (Spaulding/Rubaloff) The General Manager and the Board Finance Committee (by unanimous vote at their January 22, 2013 meeting) recommend that the Board of Directors authorize staff to retire and writeoff certain fixed asset equipment and infrastructure items from District financial records. REVENUE / COST There is no cost associated with this item. BACKGROUND Annually, the District performs an inventory of assets and records an accounting adjustment to write-off the remaining net book value (original cost less accumulated depreciation) of any equipment or capital outlay no longer in the District s possession. Items with a net book value of over $25,000 are subject to Board review and action to remove them from the District s financial records. Three items (all capital outlay items) with a net book value of over $25,000 were disposed of during 2012, all of which were replaced through new construction. Authorization to Accept a Donation of Landscape Material from Orinda Gateway, LLC (Victor/Ragatz) The General Manager recommends approval of a resolution authorizing acceptance of a donation of landscape material from Orinda Gateway, LLC ( Orinda Gateway ). REVENUE/COST The Park District will receive landscape boulders and rocks with an estimated value of $87,000. BACKGROUND Orinda Gateway has surplus landscape material, predominately rocks and boulders, from its Wilder housing development project along Highway 24 near the Caldecott Tunnel. Orinda Gateway has offered to donate the material to the Park District. Park District staff inspected the material and found it suitable for Park District purposes. Staff estimates that there are 2,900 tons of landscape boulders and rocks available with a market value of approximately $87,000 (Orinda Gateway will be solely responsible for determining the value of the donation for tax purposes). Orinda Gateway is willing to assist Park District staff in loading the rock for transport. The material will be stockpiled at various Park District locations for later use. The project is currently out to bid and project funding includes federal funds from the Transportation Investment Generating Economic Recovery (TIGER II) grant, State Environmental Enhancement and Mitigation funds and Measure WW Development funds. Federal TIGER II funds are administered by Caltrans Local Assistance on behalf of the Federal Highway Administration and 47

49 requirements for project implementation and documentation are stringent. The use of a construction management firm would provide project specific support to Design and Construction staff in the fulfillment of these requirements. Entering into a consultant contract with a construction management firm in advance of construction contract award would insure that the consultant team is prepared and ready to go when construction starts. Services provided by Harris & Associates would include contract administration and inspection, submittal review, preparation of change orders, evaluation of payment requests, materials testing and project closeout, including all required documentation and as-constructed information. The construction management team would also coordinate with stakeholders, resource and regulatory agencies, utility companies, District staff, adjacent property owners and the public. The request for proposals was posted on the Park District website. Seven (7) firms submitted proposals on or before the due date of January 22, After careful review and consideration of these proposals, four (4) of these firms were invited to proceed to the interview phase as listed below: 1. Swinerton Management and Consulting San Francisco, CA The interview panel was comprised of District staff from the Planning/Stewardship & Development Division. Authorization to Reimburse Grazing Tenant Ned Wood for Fencing Construction: Briones Regional Park (Radosevich/Collins) The General Manager recommends that the Board of Directors authorize the reimbursement of up to $60,000 to grazing tenant Ned Wood for costs associated with building a fence on the Williamson and Remington properties at Briones Regional Park, consistent with the District s Resource Improvement Authorization (RIA) process for work performed by grazing licensees. REVENUE/COST This fencing project will be funded from funds previously appropriated by the Board of Directors as part of acquisitions at Briones Regional Park. BACKGROUND District staff identified a need for significant fencing at both the Remington and Williamson properties at Briones Regional Park at the time of acquisition. Funding for this fencing was budgeted into the Safety and Security project account for Remington and Williamson, CIP and respectively, by Board Resolution # on September 7, The estimated cost for the fencing and associated roadwork is $60,000. The grazing tenant for the property, Ned Wood, has agreed to complete this project on behalf of the District. Pursuant to standard District grazing license terms, District tenants may undertake resource improvement projects on lands they manage for grazing, habitat and public use benefits. Projects are subject to review and approval by the Park Supervisor, Unit Manager, Wildland Vegetation Program Manager and District Counsel, who have all approved this project and recommend this disbursement. The funding for RIA projects is reimbursed upon successful completion of the project. Due to the size of the disbursement being over $25,000; this matter is being brought to the Board for approval. 51

Actions Taken By Other Jurisdictions Affecting the Park District (Doyle) California Coastal Conservancy Albany Beach Phase I Restoration and Public Access Implementation On Thursday, February 7, 2013, the California Coastal Conservancy voted to authorize the disbursement of $1,461,173 to the East Bay Regional Park District for the Albany Beach Phase I Restoration and Public Access Implementation Project. The funds will be used to complete the reconstruction, stabilization, and enhancement of approximately 1,850 feet of trail, enhancement of the intertidal and sub-tidal zone, and upland habitat improvements at Albany Beach in McLaughlin Eastshore State Park. Funding from the Coastal Conservancy for the project comes from mitigation funds required by San Francisco Bay Conservation and Development Commission (BCDC) permits for work completed by the California Department of Transportation (CalTrans) for work on the Bay Bridge and Interstate 80. The project helps implement the Eastshore State Park General Plan, adopted in 2002, and will protect water quality in the San Francisco Bay by creating sub-tidal habitat, arresting eroding soil, and will improve public access and recreation in McLaughlin Eastshore State Park and along the San Francisco Bay Trail. East Bay Regional Park District Board of Directors certified an Environmental Impact Report for the project on November 20, Additional funding for the Phase I improvements will be provided by the District. 55

GM COMMENTS GENERAL MANAGER Thanks to efforts by the Public Affairs Department, specifically Isa Polt-Jones, the Park District received an extraordinary social media industry distinction recently as having the fourth largest number of followers on Twitter from a survey of the top 50 park and recreation agencies in the nation. The rankings are as follows: 1. NYC Parks and Recreation: 35,560 followers 2. Chicago Parks District: 9,401 followers 3. Seattle Park: 7,421 followers 4. EBRPD: 5,602 followers 5. Philadelphia Park and Recreation 4,296 followers 6. Louisville Metro Parks: 4,050 followers 7. Raleigh Parks and Recreation: 3,822 followers 8. DC Parks and Recreation: 3,538 followers 9. San Francisco Recreation and Parks: 3,223 followers PUBLIC SAFETY From January 16 February 14, 2013 the Public Safety Division handled 538 service calls and 417 total incidents. Highlights are included below. Police There were 21 arrests made throughout the District for a variety of felony and misdemeanor offenses, including DUI, weapons possession, drug possession, violation of court restraining orders, disorderly conduct, public intoxication, and indecent exposure. Officers also issued

61 citations for Ordinance 38 violations, vehicle code violations, and parking violations. Officers handled 176 field interviews (contacts without citations or arrests) and contacted four persons on probation or parole, to conduct compliance checks. Alameda Creek Trail: On February 4, an officer responded to a report of a knife being brandished at a victim, his dog and the victim s dog became aggressive towards each another. The suspect verbally threatened the victim and then left. Suspect information was obtained and the investigation is ongoing. On February 7, an officer contacted a subject who is known to the department from past contacts and arrests. The subject was out of compliance for registering as a sex offender (a felony offense) and as a transient. The subject, also on probation, was arrested. Carquinez: On January 28, several officers responded to the report of a suicide. The subject was pronounced dead on scene from a self-inflicted gunshot wound. East Shore State Park: On February 4, an officer and medical personnel responded to the report of a nude subject with self-inflicted stab wounds. The subject was transported to the hospital for psychiatric evaluation. Garin/Dry Creek: On January 17, several officers responded to the report of shots being fired. The suspect was located and determined to be carrying a pellet rifle and admitted to firing several rounds in a canyon. The subject had previously been cited for this offense at the beginning of the month, and was arrested for possession of a dangerous weapon on Park District land. Iron Horse Trail in Danville: On January 17, an officer responded to the report of an illegal encampment. The subject was determined to be under the influence of alcohol, was on probation for public intoxication, and had been contacted several times by District officers for the same offense. The subject was arrested for public intoxication and the probation violation. Iron Horse Trail in Walnut Creek: On February 5, an officer responded to the report of robbery on the trail. The victim was walking when a suspect on a bicycle ran into her, forced her to the ground, and stole her cell phone. The victim refused medical attention for her injuries and was able to provide suspect information to the officer. Lake Chabot: On January 21, a sergeant contacted two subjects, parked in a vehicle on a service road, for a curfew violation. One subject lied about her age and was cited for the park curfew violation. She was released to her parents. Martin Luther King Jr. Shoreline: On January 25, officers witnessed a subject run from a vehicle saying she had been assaulted. The suspect was in violation of felony child endangerment, provided false information to officers, and was possibly engaging in 58

62 prostitution. The suspect was arrested and the child, who had been left alone in the car, was released to the custody of his grandmother. On February 11, a sergeant contacted a motorcyclist for riding on the trail. motorcycle was impounded for expired registration. The Martinez Shoreline: On February 6, an officer was dispatched for a welfare check on a subject sleeping on a bench. The subject was intoxicated and had been arrested several times in the past for public intoxication. He was unable to care for himself and was arrested for public intoxication. Point Isabel: On February 10, an officer contacted a subject parked in the lot after curfew. The subject had false registration tags on his vehicle license plate, and drug paraphernalia was located inside the vehicle. He was arrested for fraudulent registration and possession of drug paraphernalia. Redwood: On January 22, an officer responded to the report of an animal problem. A park user s large dog had attacked a small dog two times. The owner of the large dog would not respond to requests from the small dog s owner to leash the aggressive dog. The officer took a report. Tilden: On January 26, an officer responded to the report of an assault. The suspect was seen by the officer and pulled over. It was determined no assault had occurred, but the driver was arrested for DUI. Vasco: On February 1, an officer met with park staff regarding forty windmills that had recently been burglarized. After leaving the meeting the officer located two suspects driving near Vasco. The two suspects were interviewed and one admitted to stealing copper wire over the past few years. Firearms and drug paraphernalia were also located in the suspect s vehicle and he was arrested for several charges, including possession of burglary tools and firearms offenses. Fire Operations Fire Response On February 9, firefighters responded to a vegetation fire at Wildcat Canyon Park. Firefighters arrived to find a structure fire, which was not on District property, being handled by Richmond Fire. On February 10, firefighters responded to Tilden Park for an elderly woman suffering from a medical condition. Firefighters responded with the Rescue Wheel and transported the patient from the trail to a waiting ambulance. The patient was then transported to the hospital by ambulance. 59

63 The Fire Department is currently preparing Fire Training for forty-one firefighters. The training will begin March 11 and will include live vehicle extrication, live structure fire, hazardous materials, and EMT training. Fire Management District-wide Contractors continued the eucalyptus thinning project at the Sibley Triangle, and the annual herbicide treatment to re-treat eucalyptus stumps in several fuels management sites throughout the East Bay Hills. A contractor completed the eucalyptus removal project at Anthony Chabot. The Prop 84 Civicorps crew started ladder fuel reduction at Anthony Chabot near Cottontail Trail. Medical/Accident/Injury Firefighters responded to 16 medical/accident related emergencies throughout the District. The incidents included health related problems, bicycle accidents, and personal injuries. Lifeguard Service Highlights from the past month s activities include: The lifeguard recruitment period for the 2013 season has begun. Lifeguard Service has developed a recruitment poster, posted roadside banners, conducted blasts, and planned swim team visits. The lifeguard in-service recertification program is being revamped in order to meet changes in the American Red Cross lifeguard training certification. On January 17, Pete DeQuincy gave a presentation at the Northern California Aquatic Management Association workshop. 60

Public Comment: None 2. Healthy Parks Healthy People Kids Challenge EBRPD AGM of Public Affairs Carol Johnson reported about the Healthy Parks, Healthy People (HPHP) initiative. Pending the approval of a Community Transformation Grant offered through the U.S. Centers for Disease Control (CDC) in 2012, EBRPD proposes to lead a multi-sector collaborative the Get Outdoors! (GO!) Network for Kids Health that will work to increase 74

79 outdoor and physical activity, particularly outdoors in the park system, among children and their families in Oakland and Richmond California. The GO! Network aligns with the CDC s long-term objective to reduce the rate of obesity through nutrition and physical activity interventions by 5%. The GO! Network is innovative in linking three often-disconnected sectors that should work together to improve public health: the healthcare system, the school system, and park system. Selected partners in this innovative initiative are Children s Hospital and Research Center, Oakland; West Contra Costa County Unified School District; Oakland Unified School District (OUSD); Eco Village, a project of Earth Island Institute, Richmond; Alameda County Office of Education; and EBRPD. This program has a strong link to State Superintendent of Public Instruction Tom Torlakson s Healthy Kids campaign. Final notification of grant recipients is scheduled for the end of September In 2011, EBRPD launched a Healthy Parks Regional Collaborative effort with the National Park Service, Golden Gate National Recreational Area, and the Institute at the Golden Gate. Together, the agencies developed a founding advisory council to steer the HPHP Bay Area effort. By working with leaders of open space, schools and higher education, community planning and health care, this collective impact approach is identifying Parks Prescriptions strategies to reduce barriers and foster increased physical activity levels using the outdoors in parks, open spaces, and on trails. This collaborative approach is focused on impacting residents of the entire San Francisco Bay Area. Kids Challenge program will pilot in select 3 rd grade classroom for the first year beginning in September. Ms. Johnson provided a list of schools which applied to participate in the pilot program and a matrix showing ethnicity and economic indicators. Ms. Johnson asked the supervisors if there are other schools they would like considered for the pilot program. Supervisor Mitchoff said she hopes this pilot will generate interest from other schools which did not apply. 3. Impact of dissolution of County Redevelopment Agency on EBRPD activities/projects Contra Costa County Deputy Director of Conservation & Transportation Steve Goetz described how the dissolution of the Contra Costa County redevelopment agency affects EBRPD activities and facilities in two of the former redevelopment project areas, Rodeo and North Richmond. In Rodeo, the redevelopment agency and EBRPD have a written agreement which obligates the agency to provide up to $500,000 to EBRPD to offset the cost of developing and operating recreational facilities. All financial obligations of former redevelopment agencies must now be approved by the state. The County Redevelopment Successor Agency is proposing to the state to make this payment to the EBRPD within the January to June 2013 time period. The agreement calls for both parties to identify the activities/facilities to receive these funds. County and EBRPD staff will be meeting later this month to develop a recommendation of activities or projects to fund, and submit the recommendation to the Successor Agency (Board of Supervisors) and EBRPD for approval. This funding must also be approved by the Oversight Board established to review the activities of the Successor Agency. 75

80 In North Richmond, the redevelopment agency funded preparation of a Specific Plan whose boundaries included the Wildcat Creek Regional Trail. The Specific Plan provided an opportunity to amend County policies affecting EBRPD facilities, including whether or not to support a trail overcrossing at Richmond Parkway. Implementation of the Specific Plan became infeasible when redevelopment ended, so the planning process was terminated and County policies for the area will not be changing for the foreseeable future. Earlier this year, however, the County approved the Signature/Nove residential development project within the Specific Plan boundaries, but it did not require redevelopment assistance. The project includes a new road connection to Richmond Parkway (Wildcat Creek Drive), about 150 feet north of where Wildcat Regional Trail crosses under Richmond Parkway. This project, if constructed, will accommodate pedestrians and provide an alternative route for trail users who wish to cross Richmond Parkway. 4. Update on County actions related to trail projects, including Bailey Road and the Delta De Anza Trail, the Delta Trail, and the Lafayette/Moraga Iron Horse Trail Connector Study Contra Costa County Senior Transportation Planner John Cunningham provided information about the Olympic Corridor Connector study which, under Measure J, funded a consultant to develop a class one facility to connect these trails as a joint project between the County and the City of Lafayette. The project will be completed in 12 months. The City of Walnut Creek is motivated to include the Broadway Plaza area into the trail. The Bailey Road and Delta DeAnza portion will take 13 months. The consultant will implement enhancements along Bailey Road in Bay Point near BART. Mr. Cunningham stated the Park District requested funds for development of the Delta Trial. EBRPD Trails Manager Jim Townsend added the project will enhance safety and will formalize an informal trail to Delta Shoreline. In addition, the Tross family will donate an easement to EBRPD. The preliminary engineering and CEQA are the first phase of this project. The challenge on the Delta Trail is getting to the shoreline. The contract for the consultant is on the August 14, 2012, EBRPD board agenda. 5. Status of US Army Corps of Engineers Lower Walnut Creek Channel process and how this may effect EBRPD and proposed extension of the Iron Horse Trail to Waterfront Road Contra Costa County Public Works Deputy Director Mitch Avalon described the lower Walnut Creek Channel project north. The channel was built in 1960 and silted in. In 1990, the County tried to get permits because the silt from the watershed and tidal action was filling the channel to flood capacity. The cost for the permits is $1 million. The Army Corps of Engineers has a reevaluation review. The County is required by the Corps to maintain levees. In 2002, a 9-step feasibility study was required prior to receiving federal funding. It has taken ten years to get through 2 steps of the study. The federal funding is getting more difficult to secure. In 2007, the levee was put on the list of deficient levees. The County needs the Corps approval in order to receive additional federal funding. The Corps regulatory branch states the sediment cannot be removed. The County is trying to develop a project to have flowage easements which will allow water to overtop the levee and trails. 76

81 EBRPD Board Member Beverly Lane stated the District s goal is to get the Iron Horse Trail to this area. Mr. Townsend indicated bridges would be too costly, but an alternate route could avoid the wet section. An alternative route will be investigated once the 2013 deadline is reached. 6. Update on East Contra Costa Habitat Conservation Plan (HCP) Contra Costa County Principal Planner John Kopchik reported the HCP has streamlined species permitting. Land use agencies may now extend permit coverage to project applicants within their jurisdictions. Instead of seeking endangered species permits from the state and federal agencies, project proponents will now acquire their endangered species approvals from their local land use planning agency. The regional permits will also be used for public infrastructure projects throughout eastern Contra Costa County. Mr. Kopchik informed the committee updating developer fees merits serious consideration. Discovery Builders will challenge any fee updates. Discovery Builders would prefer not to go through the HCP. The Park District should be concerned fees stay adequate to provide for maintenance. Mr. Kopchik provided a handout of the East Contra Costa County Habitat Conservancy 2011 Year in Review public outreach brochure. The HCP has acquired nearly ten thousand acres which have become preserved lands. All acquisitions have been with the Park District. Currently, all acquisitions are grant funded. Funding is still available to purchase lands if willing sellers can be identified. Mr. Townsend noted the Round Valley Bridge has been covered by HCP, as well as Black Diamond Mines to Round Valley Regional Trail which goes through habitats that would be difficult and time consuming for the Park District to acquire. 7. Contra Costa County Supervisor Federal Glover recommended the next meeting be held in 2013 and Monday s are good for the County. No specific date was chosen at this time. 87 1 Pleasanton Weekly News Uploaded: Monday, February 25, 2013, 4:58 PM No more waterslides for Shadow Cliffs Park District could not find right vendor for popular summer facility by Dolores Fox Ciardelli Pleasanton Weekly Staff What a ride it has been but the popular waterslides opened in 1981 at Shadow Cliffs Regional Recreation Area will not be refurbished or rebuilt. One vendor, Harvest Family Entertainment LLC, based in Texas, made two proposals, said Jim O'Connor, assistant general manager of the East Bay Regional Park District, but they did not meet the terms set by the district. "They wanted the district to fund 80%," O'Connor said. This would have equated to the district paying $2.4 million to replace the current facility on 3.5 acres, plus $9.6 million for another water feature proposed for an adjacent 8- to 11- acres. "The staff recommendation was to reject the proposals," O'Connor said. "They didn't meet the terms, which was full funding and future operations and maintenance." At the Park District operations committee meeting Feb. 21, its members voted 3-0 to support the staff recommendation, he added. A long-range land use plan for Shadow Cliffs Regional Recreation Area, approved by the Park District board of directors in May 2011, said the waterslides were expected to remain open for another 10 years. However, the facility was not reopened for the 2012 summer season after 82

88 2 inspections last winter determined they needed extensive repairs. The land use plan calls for removing the waterslide structures, then adding picnic sites with tables, benches, barbeques, shade shelter, wind screening and trees. It also calls for developing a "splash pad" playground or other water-play area geared to families with young children. "The committee is asking us to expedite the land use plan," O'Connor said, "but we currently have no funding to remove the existing waterslides and no funding to implement the plan." Supporters of the waterslides attended previous Park District meetings to speak on their value as a recreational facility during the hot summer months and as a place for teen employment, but O'Connor said no one from the public attended last Thursday's meeting. The Rapids Waterslide was opened in 1981 by Glenn Kierstad under a 25-year contract. After its expiration, the operation continued with year-to-year agreements, which Kierstad has said prevented him from making improvements. Water Ventures, a water park developer based in Lake Forest, conducted a study of the facility last summer and concluded the "site is an excellent venue for such a water park," and a request for proposals went out with a deadline of Dec. 20. But only Harvest Family Entertainment responded. The Rapids Waterslide area covers about 3.5 acres, which includes four waterslides, a maintenance building, office, storage, separate men's and women's restrooms with dressing areas and lockers, and a picnic area with a shade structure, picnic tables and barbeques. 83

89 3 Water Ventures reported that in order to be successful, the waterslides facility should offer more opportunities for water play, such as wave pools, leisure pools and lazy rivers. But it said improvements needed before reopening the current facility would total $885,100. "The cost estimate for the renovation work would be $1.4 million when you add up all the engineering costs, permitting, inspection," O'Connor said in September. 84
