1 CITY COUNCIL AGENDA REPORT DEPARTMENT: Public Services MEETING DATE: November 21, 2017 PREPARED BY: Alex Tachiki, Management Analyst AGENDA LOCATION: CC-8 TITLE: Recordation of Memorandum of Unrecorded Grant Agreement (MOUGA) and Submittal of Project Closeout Package for the Transit Village Grant Project OBJECTIVE: To Authorize the recording of the MOUGA and to submit the final project closeout package to the State related to Proposition 84 Urban Greening Grant Funding for the Transit Village Grant Project BACKGROUND: On November 7, 2006, California voters passed Proposition 84 (Prop 84), the Safe Drinking Water, Water Quality and Supply, Flood Control, River and Coastal Protection Bond Act of 2006, which established $5.4 billion in grant funds for multi-beneficial open space projects. Under Prop 84, the Urban Greening for Sustainable Communities Program was established to provide $70 million in funds to preserve, enhance, increase or establish community green areas such as urban forests, open spaces, wetlands and community spaces (e.g., community gardens). In 2010, City staff applied for and were awarded funding for the Transit Village Multi-Benefit Park and Greenway Project. The project was a proposed partnership between the City, the Metro Gold Line Authority, and Amigos de los Rios. The Transit Village Multi-Benefit Park and Greenway Project created a new park and installed several environmental enhancements to the area adjacent to the Metro Gold Line, known as Station Square. In April, 2016, the City filed a Notice of Completion and accepted the final work for the Transit Village Multi-Benefit Park and Greenway Project by the Griffith Company. ANALYSIS: In 2010, the City Council approved the use of grant funding from this program for the Transit Village Multi-Benefit Park and Greenway Project. The project created the needed open space and developed a park in an area that was identified as open space deficient. Improvements completed through this project included several streets and right-of-ways in the area around Station Square, and the construction of Station Square. The multiple benefits of the project included: New native tree planting to reduce heat island effect and increase shade and water retention. On-site infiltration and storm water storage Additional native vegetation to decrease water usage and Installation of bio-swales, permeable paths and the use of decomposed granite to mimic natural rainwater capture, cleansing and infiltration. 2 These improvements were all components of the larger improvements done in and around the Station Square Area. In April 2016, the City Council accepted the final work and rendered all work complete for this project. In order to finalize the grant agreement, the City must file with the State its final payment request for final reimbursement costs. The City is anticipating final reimbursement from the State to total $132, Upon receipt of the final payment, the grant funds received for this project will total $915, As a component of finalizing the grant agreement, the City must record a Memorandum of Unrecorded Grant Agreement on all parcels involved within the project area (Attachment 1). Once the MOUGA has been recorded on all nine (9) parcels, the City has completed the requirements of the Grant and is eligible to receive final payment. The MOUGA is a legal document that binds all nine parcels and restricts the sale or transfer of the properties without written approval of the State. This document has been reviewed and approved for submittal by the City s Consulting City Engineer and Land Surveyor. ENVIRONMENTAL IMPACT: Authorization to record the MOUGA and apply for final project closeout reimbursement does not have an environmental impact. FISCAL IMPACT: The submittal of this agreement will finalize the total grant funding of $915, that was expended during the construction of the Station Square Transit Village Project. OPTIONS: The following options are presented for the City Council s consideration: 1) Authorize the City Manager to direct the recordation of the Memorandum of Unrecorded Grant Agreement (MOUGA) and submittal of all necessary grant documents to the State. 2) Reject staff s recommendation and provide further direction. RECOMMENDATION: Staff recommends that the City Council authorize the City Manager to direct the recordation of the Memorandum of Unrecorded Grant Agreement (MOUGA) and submittal of all necessary grant documents to the State. COUNCIL ACTION REQUIRED: If the City Council concurs, the appropriate action would be a motion to authorize the City Manager to direct the recordation of the Memorandum of Unrecorded Grant Agreement (MOUGA) and submittal of all necessary grant documents to the State..

RECITALS On or about May 8, 2013, Agency and Grantee entered into a certain Grant Agreement, Grant No. U ( Grant ), pursuant to which Agency granted to Grantee certain funds for the acquisition or development of certain real property, more particularly described in attached Exhibit A and incorporated by reference (the Real Property ). Under the terms of the Grant, Agency reserved certain rights with respect to the Real Property. Grantee desires to execute this Memorandum to provide constructive notice to all third parties of certain Agency reserved rights under the Grant. NOTICE The Real Property (including any portion of it or any interest in it) may not be sold or transferred without the written approval of the State of California, acting through the Natural Resources Agency, or its successor, provided that such approval shall not be unreasonably withheld as long as the purposes for which the Grant was awarded are maintained. The Grantee shall not use or allow the use of any portion of the real property for mitigation without the written permission of the State. The Grantee shall not use or allow the use of any portion of the real property as security for any debt.
