Future & Recently Promulgated Rules 1. Stage 2 DBPR Monitoring Lead Ban Cross Connection Control Revisions Radionuclide Monitoring for NTNCs Revised Total Coliform Rule
4 D.1. Stage 2 DBPR Monitoring A. USEPA was responsible for the initial IDSE phase of this rule, but DEP will implement the compliance monitoring phase of this rule (DEP rule adopted December 30, 2012) B. Rule impacts roughly 2,500 systems, all CWSs & NTNCWSs that produce or deliver water treated with disinfectant C. Major provisions include: 1) One-time IDSE for some systems. Completed 2) Replacing system wide RAA with a sampling point or Locational RAA 3) Operational evaluation levels (OELs) & OE reports for systems monitoring quarterly for TTHM & HAA5 10 D.2. Lead Ban US Congress passed the Reduction of Lead in Drinking Water Act of 2011 Act changed the definition of lead-free New definition requires all materials that come into contact with the water to be <.25% lead in the wetted surface (was 8% of weighted average) 11 D.2. Lead Ban (continued) Manufacturers are responsible for making this change in their products Potable water fixtures and pipes installed after January 4, 2014 should meet new NSF Standard 372 Water systems cannot install or use replacement products after January 4, 2014, as well 12 4
5 D.3. Cross Connection Control A. Revisions of the Cross Connection Control Rule primarily address residential customer requirements B. The CCC revisions became effective May 5, 2014 C. This rulemaking began in 2008, faced numerous challenges (including a citizen rule challenge), but enjoys the support of most water utilities 13 D.3. Cross Connection Control D. Goal/Purpose of Revisions i. Increased flexibility/potential cost savings for CWSs & residential customers a. Allows Dual Check at residential premises with auxiliary/reclaimed water b. Allows biennial testing of Double Checks & RPs at residential service connections ii. Clarify CCC requirements for CWSs (with Tables) a. Table listing of minimum required elements of a CCC Plan b. Table of categories of customers with corresponding minimum type of backflow protection needed iii. Require Large CWSs to submit annual reports a. CWS greater than 10,000 required to submit two-page report (form) b. First report covers CY due March 31, D.4. Radiological Monitoring & NTNCs A. History 1. USEPA s Radionuclides Rule does not apply to NTNC systems. DEP dropped the monitoring requirement for NTNCs in Today there are 801 NTNC water systems in Florida. 3. NTNCs serve schools, daycares, clinics, factories, labor camps and small businesses. 4. A 2008 Rad study indicated no exceedances among 94 new systems; however, six of the pre-2000 systems continued to exceed the Radium-226 or Gross Alpha MCL. 5. In February 2010, DOH issued instructions to work with the DEP and the six systems to correct the existing NTNC problems. 15 5
6 D.4. Radiological Monitoring & NTNCs A. History (CONTINUED) 6. In 2010, Florida s State Surgeon General submitted to DEP a threetier strategy to address the radionuclide risk potential to customers of NTNC systems 7. This strategy addressed: (1) existing systems, (2) new systems, and (3) revision to the DEP Radionuclides Rule by In 2013, DEP issued a Notice of Proposed Rule 9. In 2014, the Final Rule was adopted and the effective date for NTNC compliance is January 1, USEPA currently developing a standard for Strontium (3-5 years) 16 D.4. NTNC Radiological Monitoring B. Radionuclides Rule Requirements 1. NTNCs must meet the same standards (MCLs) as community systems, but offer both waivers and reduced frequencies of monitoring 2. It is anticipated that over 60% of NTNCs will be eligible for a total waiver from monitoring of the Radionuclides 3. New or existing NTNCs without historical data are to begin monitoring for Radionuclides in 2016 DECEMBER 31, 2015 LAST DAY TO COLLECT HISTORICAL DATA! 17 D.5. Revisions to the Total Coliform Rule Key Provisions of the RTCR USEPA issued the final rule in February 2013 Implementation scheduled for April 1, 2016 Proposed rule includes establishment of an "acute" MCL that is based on E. coli and elimination of the existing "non-acute" MCL that is based on multiple total coliform detections, replacing it with a treatment technique for total coliform that requires assessments and corrective action 18 6
