2 Page 2 of 20 I.H. Rifle-Pistol Range SOP Chapter 1 Preamble The I.H. Lewis B. Whiting Rifle and Pistol Range has been a part of the Indian Hammock Hunt and Riding Club since the founding of the community. Over the years and still today, the range is enjoyed by the club membership and guests. May 11, 2006, the I.H. Board of Directors voted and approved modifications, expansion, and the range safety officer program to improve safety at the facility. The new improved range facility became operational in September of Chapter 2 Range Organization, Range Committee, Range Standard Operating Procedures 2.1 Organizational Table Indian Hammock Hunt & Riding Club, Inc. Board of Directors I.H. Manager (Range Mgr) Rifle-Pistol Range Committee On-Duty Range Safety Officers Member/Owner Users Member/Owner User Family & Guests 2.2 The I.H Board of Directors establishes the I.H. Rifle and Pistol Range Committee to advise the I.H. Manager. The I.H. Manager is the Range Manager. The President of the Board appoints the Committee Chair. All members holding a currently valid RSO from NRA; and who have successfully completed an orientation as provided for in section 2.4 of this document, are deemed to be committee members. The Committee members present at any meeting shall satisfy the requirement for a quorum. Range availability is at the discretion of the Manager. It is imperative that any member observing an unsafe condition, unsafe firearm handling, or range procedure violation immediately correct the member or guest and notify the onduty RSO, or the Manager. 2.3 Chief Range Safety Officer (CRSO) A NRA-certified Chief Range Safety Officer(s) will advise the Manager whenever reviewing range standard operating procedures and for training NRA range safety officers. The Manager will solicit input from a currently valid NRA-certified CRSO for any changes to the range SOP. In the event that the I.H. hosts a NRA Range Safety Officer class, the Manager will only use currently valid NRA-certified CRSOs as the instructors. 2.4 Range Safety Officers (RSO) eligibility Members in good standing of Indian Hammock and family members, 21 years old or older, are eligible to become an Indian Hammock designated Range Safety Officer. To qualify as an Indian Hammock RSO, he

3 Page 3 of 20 I.H. Rifle-Pistol Range SOP or she must present proof of National Rifle Association (NRA) certification as a RSO, complete an orientation with an I.H. CSRO selected by the Manager, and obtain approval from the Manager. 2.5 At all times that the range facility is open for firearm use, at least one Indian Hammock designated Range Safety Officer must be on-site at the range. I.H. Range Safety Officers serve under the direction of the Manager and Board. 2.6 Indian Hammock members who are not approved as I. H. Range Safety Officers must arrange to have an I.H. RSO accompany them to shoot. 2.7 The I.H. Manager maintains a roster of current authorized I.H. RSOs. The list will also be posted at the I.H. front gate. 2.8 The Rifle-Pistol Range Standard Operating Procedure (SOP), inclusive of the appendices, applies to all persons within the range facility (fenced area) regardless of status as a member, owner, lessee, family, guest, employee, rank as a board member, or other status. 2.9 It is understood that this SOP cannot anticipate every eventuality. All persons within the range facility (fenced area) will comply at all times with this SOP and will promptly obey the direction and orders from the RSO. The RSO has the authority to order any member or other person off of the range (to outside the gate) and to cease all shooting so as to, in his/her judgment, preserve order and the safety of all persons, regardless if the specific circumstance or condition is addressed in the current SOP The range Standard Operating Procedure is subject to change and revision by the Manager in cooperation with a Chief Range Safety Officer selected by the Manager. Changes are expected and will be made on an as-needed basis. In the interest of safety, it may not be practical to delay implementation of a specific procedure pending Board approval. In such cases, the procedure will be immediately established at the direction of the Manager and an I.H. CSRO selected by the Manager, and approval of SOP changes, if warranted, will be submitted to the I.H. Board of Directors for after-the-fact approval. Chapter 3 Authorized Firearms, Shooting Styles, and Targets 3.1 The Indian Hammock Rifle and Pistol Range offers the following target shooting activities: Muzzle loading: rifle, pistol, and shotgun. Shotgun use requires approval of on-duty RSO. Small bore: Both pistol and rifle. Includes.17,.22, and.22 M rim fire. Pistol: Bulls-eye pistol or other paper targets. Special Event Day. The Rifle-Pistol Range Committee is authorized to schedule Special Event Days at the rifle and pistol ranges, in accordance with Appendix I. When a special event is scheduled, the range may be dedicated to the special event and be closed to general use and shooting. On special event days, special event rules may apply. Any rule deviation from the I. H. Range SOP must be in accordance with Appendix I and be approved prior by the Manager and an I.H. CRSO selected by the Manager. High Power Rifle: Includes all rifles that can safely use the range. The range plans will not allow automatic or rapid semi-automatic firing. The range will be limited to single-shot rifle fire. LOAD ONE, SHOOT ONE unless conditions are such that the Manager and an I.H. Chief Range Safety Officer or the Duty Range Safety Officer (RSO) can safely authorize rapid semi-automatic fire. All rifle shooting is to be done from the bench unless the on-duty Range Safety Officer can safely authorize shooting from other positions. All shooters are responsible for their guns and ammunition while on the range facility. All shooters are responsible for understanding the safe operation of their firearm, performing the proper maintenance on their firearm, and proper selection and use of the ammunition they load. Member shooters are also responsible for the guns and ammunition of any guest they bring. All shooters are responsible for the proper specifications and selection of their eye protection and hearing protection.

4 Page 4 of 20 I.H. Rifle-Pistol Range SOP 3.2 Shooting activities not allowed at the improved range. A. Fully automatic firearms are not permitted. Rapid semi-automatic rifle firing is prohibited, unless conditions are such that the Manager and an I.H. Chief Range Safety Officer selected by the Manager, or the on-duty Range Safety Officer, can safely authorize rapid semi-automatic fire. B. Extra-long range rifles are not accommodated. (Example: 50 Cal. Browning) C. Shotguns are prohibited, except for sighting-in of slug guns from the bench. Patterning of buckshot may be allowed if the Range Safety Officer determines that firing can be safely accomplished from a position where persons and range equipment are safe from injury or damage. D. All shots are to be fired from the bench rest position. No prone, sitting, kneeling, or offhand shooting is allowed without the prior approval of the on-duty Range Safety Officer. E. Tracer or armor piercing ammunitions are prohibited. F. Quick-draw of a pistol from the holster is strictly prohibited. Slow-draw is allowed when approved by the on-duty range safety officer. 3.3 Authorized Targets, Target installation A. All shots will be fired at paper targets only that are mounted on the range wooden target frames. B. Target is to be taped to a cardboard or plastic backer. Plastic clamps or tape is to be used to hang the cardboard or plastic target backers between the two horizontal wood rails. C. Nails or staples into wood are prohibited. [Notice that the rails are now mounted on the backside of the posts so that no metal nail or screw head faces the shooter.] D. Do not post targets on the vertical target posts. E. Metal clamps are prohibited. F. Metal targets, portable frames, or ground-level targets are prohibited, except when authorized by the Manager and an I.H. CRSO selected by the Manager for a specific activity and a specific shooter. (These targets carry unique hazards that must be mitigated before use.) G. Do not post targets at shorter than established distances. To shoot shorter distance, the shooter moves downrange. Targets never move up-range. H. Exploding targets are prohibited. I. Member shooters are responsible to bring their own plastic target clamps, plastic or cardboard target backers, and targets to the range for themselves and their guests. Chapter 4 Eligibility of Range Users 4.1 Eligible Shooters and Visitors: Shooters and observers at the I.H. Lewis B. Whiting Rifle-Pistol Range must meet the following requirements. Eligible Member/Owner and Family: Persons must be a member/owner, or be a member s family member, and in good standing with Indian Hammock. Family member is as defined by the I.H. Bylaws, Restrictions, and Rules. Guests: Eligible adult member/owner, or eligible adult family member, may bring adult guest shooters and/or observers to the range. Adult guest shooters/observers must sign in on the member s applicable release form(s). The eligible member/owner or eligible adult family member must accompany their guest shooters/observers within the range facility. Minors 17 years of age or under: Each minor shooter and/or observer must be accompanied by the member/owner and a parent or legal guardian. The minor s parent or legal guardian must have signed the release form (Appendix F) prior to any minor being allowed on the range facility (inside the gate). A parent or legal guardian must accompany all minor shooters and the hold harmless waiver for minors must be signed. If a person other than a parent or legal guardian brings a minor shooter to the range, the original of a release signed by both parents or legal guardian and notarized must be on file in the Indian Hammock Office, in which case, the parent would not need to be present.

5 Page 5 of 20 I.H. Rifle-Pistol Range SOP Chapter 5 Range Safety Rules 5.1 NRA General Firearm Handling Rules listed below are incorporated into the I.H. Range SOP. A. Always keep the firearm pointed in a safe direction. B. Always keep your finger off the trigger until ready to shoot. Keep finger outside the trigger guard until ready to fire or until the command, Commence Firing has been given. C. Always keep the action open and the firearm unloaded until ready to use. This means keep the action open and firearm unloaded until the shooter is in position on the firing line, and the line has been cleared for live fire by the RSO. D. Know your target and what is beyond it. E. Be sure the firearm is safe to operate. F. Know how to use the firearm safely. G. Use only the correct ammunition for your firearm. H. Wear eye and ear protection. I. Never use alcohol or drugs before or during shooting. J. Store firearms so that they are not accessible to unauthorized persons. 5.2 Indian Hammock General Range Safety Rules: A. It is imperative that any member observing an unsafe condition, unsafe firearm handling, or range rule violation immediately correct the member or guest. B. All firearms transported into the Range facility are to be unloaded and safe, and will be loaded on the firing line only. Firearms will not be loaded until the shooter is in position on the firing line and the RSO gives the command to load or gives the command that the range is ready for live fire. C. Firearms that are out of the case and not in use must be benched. (Actions open and facing up, chambers empty, muzzles pointing down range, and safeties on.) Firearms not benched shall be racked with the actions open and, chambers empty, and safeties on. Where possible bolts shall be removed. Semi-automatic firearms, when not on the firing line, must display a readily visible flag (zip-tie or similar device, preferably orange colored) inserted within the action to provide a visual indictor that the action is clear. D. Open pistol carry and/or concealed firearm carry of a loaded firearm are prohibited on the range until instructed to load by the RSO. E. The on-duty RSO is directed to prohibit any person from shooting who appears to be physically impaired and/or who may contribute to an unsafe condition on the range. F. Know and obey all range commands (see Appendix A). G. Whenever live firing is being conducted, The RSO will conduct a range safety briefing, in accordance with Appendix D, for every person who comes into the range facility (inside the fence). The briefing can be shorter for repeat range users who are experienced, safe shooters. H. All shooters and non-shooters who enter the facility must sign the applicable hold-harmless and release form(s) and check-in with the on-duty RSO immediately upon arrival. I. Know where other persons are at all times. J. Shoot only with authorized firearm, with only authorized ammo, at authorized targets. K. All persons in the range facility during live fire activities are required to wear hearing protection. L. All persons in the range building, or near a forward firing line, are also required to wear eye protection. M. When the Cease Fire command is given: Immediately stop shooting, point muzzle in safe direction, await instructions. Do not perform any action with firearm or ammo unless specifically directed to do so. N. Do not handle any firearm or stand at the firing line where firearms are present while others are down range. O. Always keep the muzzle pointed at the downrange backstop. Never allow the muzzle to point in any direction whereby a discharge would allow the escape of the bullet to an outer area. P. The general rule for the range is, Load One, Shoot One. Live fire, both slow and rapid fire, are allowed subject to prior RSO authorization.

6 Page 6 of 20 I.H. Rifle-Pistol Range SOP Q. All shots fired must hit the target or the shooter will be required to move to a shorter range or more stable shooting position. No exceptions. R. Long-range pistol shooting will be permitted only with the prior approval of on-duty RSO. S. Minors (17 years of age and under) must be under the direct on-site supervision of an adult member in good standing any time they are handling or shooting a firearm. T. Smoking, or using tobacco products, is prohibited at the Range Facility (inside the fence). U. Shooters and non-shooters will not consume alcoholic beverages or drugs, including prescription and over-the-counter medications, which may inhibit the shooter s judgment or actions before or during any live firing activity. The RSO is instructed to deny range access to anyone believed to be in violation. V. Eating food is prohibited at the range facility. Exception: at I.H. planned special events where sufficient RSOs are present to maintain order, maintain focus on safety, and maintain sufficient distance from shooters. W. No alcoholic beverages are allowed at any time. Drinking non-alcoholic beverages is prohibited unless the container is re-sealable. Exception: see V above. X. Semi-automatic rifles are to be loaded fired single shot only. Semi-auto slow or rapid fire may be conducted if approved by the on-duty RSO but still will only fire one round per trigger pull. Y. Only RSOs, shooters, coaches, and spotters are allowed up on the firing line when the line is hot. Z. Everyone present is responsible to promptly correct any unsafe condition, unsafe firearm handling, or range rule violation observed and notify RSO so that appropriate instruction or enforcement can occur to limit reoccurrences. 5.3 Indian Hammock Range Administrative Rules: A. At least one I.H. Range Safety Officer must be present to observe shooters and other persons, sign applicable forms, and call in to the front gate. At times, based on activity and persons present, there may be one or more RSO(s) for the rifle range and one or more RSO(s) for the pistol range. The onduty RSO will determine when the range activities are at the point that he cannot safely manage the range. At such time, the RSO will either instruct some shooters to delay activity until additional RSO(s) arrive, or take other action he deems appropriate to control the activities within his capabilities to maintain a safe range. B. On entry to the Range, all persons (shooters and non-shooters) are to report to the RSO for completion of applicable forms and the range safety briefing. The RSO is responsible for reporting the names of all persons to the I.H. front gate. The on-duty RSO is required to sign the hold harmless agreement (Appendix I) when opening the range for other shooters and he/she is not recreationally shooting. NOTE: This does not apply to the release for minors form (Appendix G) that a parent/guardian must still sign. C. RSO will conduct an inspection of the range and complete the inspection checklist (Appendix C). D. The Rifle and Pistol range facility is a restricted limited access area. Access is limited to Eligible Range Safety Officers, Eligible Shooters, and guests who are accompanied by Eligible Shooters. For administrative and maintenance purposes, only Range Committee members and IH maintenance staff may access the range outside of normal operating hours. Trespass into the Range facility is a crime under Florida Law. Trespass with a firearm is a Felony. Trespass laws will be enforced. E. Pets are not allowed in the Range facility (inside gate). F. All vehicles are to be parked outside the fence unless authorized by the on-duty RSO. G. Users will remove their targets and all other debris, including brass, when finished shooting. Said debris, including brass, all targets, and target backers are to be removed from the range entirely or placed in the appropriate recycle/refuge containers. H. The Rifle and Pistol ranges are available for use seven days a week from 7:30 am to ½-hour before sunset but not later than 6:30 pm. I. All persons will conduct themselves in an orderly manner at all times and Member/Owners will be responsible for the conduct of any family members and guests.

7 Page 7 of 20 I.H. Rifle-Pistol Range SOP Chapter 6 Enforcement of SOP and Related Safety Standards 6.1 Enforcement of the I.H. Rifle and Pistol Range Standard Operating Procedure for the range facility are necessary to improve the safety for the range. Standard Operating Procedures are almost worthless without a means of enforcing compliance by all users. 6.2 All Indian Hammock Range Safety Officers are certified eligible for range duty in accordance with this SOP. The Indian Hammock Range Safety Officers serve under the direction of the Manager. The Manager is authorized to suspend or terminate the eligibility of any RSO at any time for any reason he deems fit. In the event that the Manager suspends or terminates the eligibility of an RSO, the matter will be referred to the I.H. Board of Directors for review. If appropriate, the Manager may recommend additional sanctions in accordance with the Club Rules. 6.3 The initial control for safe range operation is the responsibility of the on-duty Range Safety Officer. A RSO is required to be present for any and all activity involving a firearm. The RSO is responsible to report all incidents that may affect the safe operation of the range. 6.4 In the event of a problem or a violation, the RSO is responsible to take action immediately. Minor issues are to be resolved by the RSO providing guidance and direction. For serious problems or procedure violations, the RSO is instructed to ask or order the member, (and guest) to leave the range facility. (A letter/ of the facts is to be promptly sent to the Manager). The on-duty RSO is directed to prohibit any person from shooting who appears to be physically or mentally impaired and/or who creates an unsafe condition on the range. 6.5 In the event of a serious problem or violation where the RSO has requested or ordered a member or guest to leave and that member or guest does not leave, the RSO is directed to call the Indian Hammock Duty Manager to request assistance from local law enforcement. 6.6 All violations reported will be evaluated by the Manager. If appropriate, the Manager will forward the matter to the Board for additional actions as may be necessary. 6.7 Safety demands that firearm-sporting activities have strict rules. Eligible shooters who violate the Rifle and Pistol Range SOP are subject to being banned from use of the facility by the Manager. Violators are also subject to penalties imposed by the Board. Chapter 7 Emergency Actions 7.1 In the event of any emergency: Immediately call a, CEASE FIRE. If a person receives a bullet wound, place the firearm involved in the incident on the bench or ground at the location where the discharge occurred, pointed in a safe direction. Verify that all other firearms are unloaded and clear. The RSO s first responsibility is to prevent any further injuries. Initiate first aid. Call 911. If a person receives a bullet wound, regardless if paramedic needed, Florida law requires that the sheriff s office be notified immediately. If the sheriff or fire-rescue is responding, have all shooters store the uninvolved firearms unloaded, securely, and safely in closed cases and/or vehicles.

Indian Hammock Rifle and Pistol Range is 500 yards south of the I.H. Office/Stables Complex. 911-Emergency personnel will require the following information when you call. Exact location of injured. Is the location safe for EMS to enter? Telephone number from which you are calling. Your name. What Happened? How many people are injured or ill? Describe symptoms. First aid actions taken. Raulerson Hospital, Okeechobee Lawnwood Hospital, Ft Pierce & Chapter 8 Range Safety Officer Training and Certification 8.1 Eligible Range Safety Officer, (RSO). To qualify as an Indian Hammock RSO he or she must: Receive certification as a RSO from the NRA by completing a NRA Range Safety Officer training class and passing the NRA RSO exam. Present proof of NRA certification as a RSO to the Manager and schedule I.H. RSO orientation. Complete an on-range orientation class and pass a written test conducted by an I.H. CRSO selected by the Manager. Be approved by the Manager.

9 Page 9 of 20 I.H. Rifle-Pistol Range SOP 8.2 Receiving the NRA RSO certification card from the NRA typically takes six weeks or longer. Members who have attended and passed a NRA RSO training classes offered in Indian Hammock may attend an I.H. RSO orientation by a CRSO selected by the Manager, pass the I.H. written test, and be approved by the Manager in advance of the receipt of the NRA certificate card. 8.3 RSOs are responsible for maintaining their NRA-RSO certification by periodic renewal and completion of any qualifications required by the NRA. 8.4 RSOs are responsible for maintaining their I.H. RSO qualifications by frequent review of the RSO training manual, review of current range SOPs, and by participation in committee meetings and other range activities. 8.5 RSOs are responsible for forwarding changes and renewals of their NRA certification to the I.H. manager s office for incorporation onto the list of RSOs authorized to open the range. 8.6 I. H. RSO re-certification is required. In addition to any re-certification requirements of the NRA, the Manager and a selected CRSO will, periodically at their discretion, require that RSOs demonstrate their knowledge of the current I.H. Range procedures by passing an examination, either written, practical, or both. Those who fail to pass the exam will have their I.H. RSO status suspended or revoked.

Cease firing Notifies shooters to stop firing immediately and await further instructions. This order can be given by anyone on the range. Cold Range or Range is Cold Unload all firearms. Rifles are to be benched. Open all actions. Remove bolts from rifles. When the range is cold do not touch any firearm on the range. Commence firing or Firing Line is Hot Signals shooter to begin shooting. Go forward and check targets Range is safe to go down range. Rifles are to be benched. Confirm that all actions are empty and open. Do not touch any firearm on the range. Is the line ready? Shooter not ready raise hand and speak out. Is the range clear Range office command to check the range clear for cold range condition. Load Shooters given permission to load. Misfire! Called by shooter, usually muzzleloader shooter, to inform others that firearm did not fire and a hazardous condition may exist. In case of a misfire, keep the firearm pointed at safe downrange target for at least 2 minutes. A hang fire is likely. RSO will assist shooter with problem. Ready on the right Ready on the left Ready to Fire Sequence of commands that gives shooter last chance to signal Not ready Ready to Fire means the range will go hot in five seconds.

12 Page 12 of 20 I.H. Rifle-Pistol Range SOP Appendix B RSO s Range Opening/Closing Procedure On arrival at the range, call the I.H. Gate, reporting that range is open and the following information. Update information to Gate as needed. RSO s name and cell phone number. Names of all persons (shooters and non-shooters) within the range facility (inside the fence). Confirm the following items are present at the range: release agreements, safety briefing forms, range inspection forms, copy of range SOP, and first-aid kit. Confirm that range rules are posted. Conduct range inspection using checklist (Appendix C). Conduct range safety briefing for all persons at the range facility, using the briefing outline (Appendix D). Confirm that all persons (shooters and non-shooters) within the range facility (inside the fence) sign the safety briefing form and the applicable hold harmless agreement(s). All persons includes the on-duty RSO. Conduct activity in accordance with range SOP. Failure of persons to abide by the range SOP may result in immediate eviction from the range and possible suspension of future shooting privileges. The on-duty RSO will report all incidents to the Manager. Notify gate when activity is finished, all persons have departed, and range is closed. All signed range documents are to be placed in the rifle range desk inside the metal clipboard.

14 Page 14 of 20 I.H. Rifle-Pistol Range SOP Appendix D Range Safety Briefing Outline A range safety briefing is required for every person who comes into the range facility. The briefing can be shorter for repeat range users who are experienced safe shooter. All persons entering the range facility must have a range safety briefing and must sign the applicable hold harmless agreement if firearm activities are being conducted. Conduct briefing on the range immediately prior to range use. Follow this outline when conducting range safety briefings. Issue copy(s) of the abbreviated range shooting rules to each range user(s) (Appendix E). Involve the range users. Have them read the rules and handouts. Ask questions to reinforce their understanding. All persons (shooters and non-shooters in the range facility) are required to sign the Safety Briefing Acknowledgment Form (Appendix E). If requested, a copy may be issued to the person. If applicable, state purpose of the event; give an overview of ongoing or planned range activity for the day. Introduce range safety personnel. Explain RSO s role and introduce other shooters on the range. Explain range layout and limits of their movements. Review firing line and spectator issues, Load one-shoot one and slow fire. WHITING RIFLE AND PISTOL RANGE In consideration of being allowed to attend a course of instructions in firearms use or for the use of the range facilities at the I.H. Lewis B. 19 Page 19 of 20 I.H. Rifle-Pistol Range SOP APPENDIX H Special Event Days On Special Event days, special event rules may apply. These rules may deviate from the regular I. H. Range SOP with the prior approval of the I. H. Manager and a CRSO selected by the Manager. For Special Events, alternative targets (i.e., sporting clays, etc., but not foodstuffs may be permitted with the prior approval of the I. H. Manager and a CRSO selected by the Manager. All cowboy action shooting, single-action shooting with steel targets, will be conducted under the Single Action Shooting Society (SASS) rules. Shooters will draw their firearm only when standing on ground. To hold a Special Event Day, a written request ( preferred) for the event must be submitted to the Rifle and Pistol Range Committee in advance of the event. Allow sufficient time for the Manager, and CRSO selected by the Manager, to review and approve the request and plan. At a minimum, the request must include: Name of the event. Date and time period for the event. The event sponsor. (The event sponsor is required to be one or more Indian Hammock RSOs.) Details regarding the course of fire and the firearms to be used. Qualifications of the shooters expected to attend the event. (Age, skill, and experience level) Estimate of the number of shooters and the number of spectators expected to attend the event. Range rules for the event. Name of primary RSO and names and assignments of the assisting RSOs. Event plan and schedule with timelines. Estimated financial costs and participant fee, if any.

Whether the range safety officer ( RSO ) should be required to execute the Club s release and indemnification agreement when the RSO is simply serving as the RSO and not engaged in discharging any firearms or otherwise utilizing the range facilities; and 2. Whether any guardian of a minor child (such as an aunt, uncle, grandparents or babysitter) may execute the Club s release and indemnification agreement on behalf of the minor child. You have provided me with a copy of the Appendix E Hold Harmless Form titled Release, Waiver, Indemnification, Hold Harmless and Assumption of the Risk Agreement I.H. Lewis B. Whiting Rifle & Pistol Range together with a copy of Appendix F Release Form for Minor (17 years of age or less) titled Release, Waiver, Indemnification, Hold Harmless & Assumption of the Risk Agreement (Minor) I.H. Lewis B. Whiting Rifle & Pistol Range, each hereinafter referred to as the Release. As to question #1, it is my opinion that the RSO should be required to execute the Release even if the individual is merely serving as the RSO and is not otherwise engaged in utilizing the range facilities. There are a variety of scenarios that occur whereby the RSO could have a claim against the Club if the RSO did not execute the Release. If, for instance, the RSO was injured by a stray bullet, and did not execute the Release, the RSO could have a cause of action against the Club for items such as the failure to properly construct a backstop, the failure to have the appropriate safety procedures in place, and/or other negligence by the Club in failing to protect persons from being injured by a stray or ricocheting bullet. All persons present at the range facility should be required to execute the Release. As to question #2, the person executing the Release on behalf of a minor child must be the parent or legal guardian of the minor child. An aunt, uncle, grandparent, babysitter or any other third person does not have the legal authority or ability to release any rights that the minor child may have. Both parents are generally deemed to be the natural guardians of their minor child. See Fla. Stat as attached. The only person other than a parent who could execute a release would be a person actually appointed as the legal guardian for the minor child pursuant to a court order.
