3 CPS Energy has inked a 50-year deal with Joint Base San Antonio to operate and own the electric grid and natural gas facilities on JBSA's premises. The contract with the Defense Logistics Agency, which was put out for bids about three years ago, is worth $248 million. The privatization of the power grid on that military property enables the city-owned utility company to invest in infrastructure to upgrade the lines. Over the next year, CPS expects to spend around $4.5 million during the initial transition to survey the existing electrical and gas infrastructure, which is to be reimbursed by the federal government as part of the contract. With the rates that CPS charges the military, which collectively is their largest customer, it's a net positive financial impact," Rudy Garza, vice president of government and regulatory affairs at CPS, told the Business Journal before the contract was awarded. 3
4 Annexation Military Provision S.B. No. 6 Sec.A Authority Of Municipality To Annex Area Near Military Base. a. In this section, "military base" means a presently functioning federally owned or operated military installation or facility. b. Notwithstanding any other law, a municipality may not annex for full or limited purposes any part of the area located within one-quarter mile of the boundaries of a military base in which an active training program is conducted unless the municipality and the base authorities have entered into a comprehensive written agreement that establishes provisions to maintain the compatibility of the municipality s regulation of land in the area with the military base operations following the annexation. Bill took effect December 1, 2017 A municipality may annex for full or limited purposes, under the annexation provisions applicable to that municipality under this chapter, any part of the area located within five miles of the boundary of a military base in which an active training program is conducted but must adhere to the JLUS recommendations. The annexation proposition shall be stated to allow the voters of the area to be annexed to choose between either annexation or providing the municipality with the authority to adopt and enforce an ordinance regulating the land use in the area in the manner recommended by the most recent joint land use study. 4

6 Tree Ordinance Camp Bullis Tree Ordinance Benefits The trees help Camp Bullis from becoming the "lone island of refuge" for the endangered GCWA. The trees help buffer light from development around our installations, which helps protect the night training missions and the use of Night Vision Goggles (NVGs). Trees assist as a buffer to the noise coming from the installation training missions. Thus reducing noise complaints arising from the firing ranges and aviation activities. Trees assist the City of San Antonio maintain their ozone attainment standard set by the Environmental Protection Agency (EPA). This biggest factor in ozone creation begins with the reaction with man-made emissions and high temperatures. The overall shade produced by trees reduces the greenhouse gas, ozone, by reducing the urban heat island effect. Air Quality nonattainment status would impact the Armed Force s ability to propose any new projects on their installations because of the required federal Clean Air Act General Conformity regulations. 6
7 Tree Ordinance Camp Bullis Tree Ordinance Benefits Air Quality Non-attainment status would negatively impact the military's ability to propose any new missions on JBSA installations. Established under the Clean Air Act (section 176(c)(4)), the General Conformity rule plays an important role in helping the state improve air quality in the areas that do not meet the National Ambient Air Quality Standards (NAAQS). Under the General Conformity rule, all federal agencies must work with state, and local governments in a maintenance area to ensure that federal actions conform to the air quality plans established by the state implementation plan (S) Currently, the national standard is the 2015 NAAQS, which is 70 parts per billion (ppb). Our region has reported an average of ppb over the last 2-3 years. So, technically, we are in violation, but we have not received an official designation. Field training capability is a critical asset for military training and was the primary reason Fort Sam Houston gained 12,000 personnel in Base Realignment and Closure (BRAC) In 2009, a Joint Land Use Study (JLUS) was completed for JBSA-Camp Bullis. The City of San Antonio stepped forward and has implemented most of the JLUS recommendations, which includes strengthening the tree ordinance. The State of Texas should consider not reversing the progress that has been made in protecting missions in Military City USA. 7
8 Golden-Cheeked Warbler (GCWA) Camp Bullis Supporting Case Facts Camp Bullis, is the home of the Department of Defense Medic training and Officer Basic Training Course, Air Force Security Forces providing essential training for ongoing operations in Afghanistan, Iraq, Africa and military humanitarian missions world-wide. It is the only large field training area for 85,000 personnel stationed on JBSA (Lackland and Randolph AFBs and Fort Sam Houston). Camp Bullis is faced with increasing endangered species pressures, such as an increase of occupied habitat for Golden-cheeked Warbler (GCWA) due to developers off post displacing GCWA onto 10,000 acres at Camp Bullis. There are over 28,000 total acres, of which about 10,000 are habited. The most significant restriction is the ability to thin vegetation in habitat areas. After nearly 27 years under warbler restrictions, much of Camp Bullis contains extremely dense canopy, making it very difficult to use for field training. There are also seasonal restrictions for occupied habitat including 100-meter buffers during the March-August timeframe when the warbler is in Texas for its migratory nesting season. These restrictions prohibit light, pyrotechnics and gunfire noise, and vehicles. Multi-million dollar efforts are in place to enact a mitigation program in order to exchange conservation easements for equivalent land off post through programs of the Army Environmental Command (AEC), REPI (Readiness and Environmental Protection Initiative), the Army Compatibility Use Buffer (ACUB), The Nature Conservancy and Texas Parks & Wildlife Dept. In six transactions over 6,000 acres of off-post property were placed under permanent conservation as an authorized mitigation exchange by the US Fish and Wildlife Service. The most important ongoing factor keeping the GCWA pressure in check is the San Antonio tree ordinance. It requires developers to maintain 80% of the trees should they develop the 26,000 acres of steep slope to the west across I-10 of Camp Bullis. Much of those areas appear to be GCWA habitat and the camps would be flooded with a large influx of GCWA if these areas were densely developed. Currently the local tree ordinance does not apply to homeowners or agricultural holders, only to subdivision developers. Local tree ordinance protects Camp Bullis from becoming the "lone island of refuge" for the endangered GCWA. The GCWA prompts many federal restrictions for the base due to the Endangered Species Act. -Maj. Gen. Russell J. 9 City of San Antonio Dark Skies Ordinance Development Services and Office of Sustainability are working with a stakeholder group to study and consider whether to update San Antonio s Dark Skies Ordinance. An update could expand the reach and leverage newer technology to promote energy savings in addition to the other environmental and health benefits associated with dark skies. Current Dark Sky Ordinance December 2008 Military Lighting Overlay District (MLOD) enabling ordinance was established. Currently applies to 5-mile buffer around JBSA Camp Bullis. Applies to residential and commercial uses, as well as outdoor signs and street lights. MLOD Requires Downward light fixtures for outdoor lighting. Regulation of lighting intensity. Restricts outdoor lighting after 11:00PM with some exceptions. CoSA Staff Proposal Update current Camp Bullis MLOD and apply through rezoning. Apply updated MLOD to JBSA Lackland and JBSA Lackland Training Annex (LTA)/Medina Annex (MA). Military Overlay District: Dark Skies Update 9

11 Feral Hog Study Program JBSA proposed a study to manage the growing population on Camp Bullis The hogs are considered a destructive non-native species. Responsible for the destruction of flora, soils, hydrology, floodplains, wetlands, sensitive karst topography and pose a threat to humans. JBSA-Camp Bullis is coordinating a control study with the United States Department of Agriculture (USDA) Animal and Plant Health Inspection Service (APHIS). Objective Identify the proportion of a population likely to consume the bait. Understand the influence of social structure on the bate consumption. Estimate initial abundance of feral hog in the areas indicated on the map. 11
12 Feral Hog Study Program Study consists of baiting activities, population control measures and statistical analyses Camp Bullis conducted a Helicopter Feral Hog population control event in September. Baiting activities will use a non-toxic placebo version of Hog-Gone. The process will take 2-3 weeks to complete. Population control measures include trapping, ground shooting and potential use of aerial gunning after the non-toxic Hog-Gone is administered. This process will take place during the hours of hours for up to 3 days total, over a two week period following the bate consumption. The statistical data will analyze the information gained from the baiting and population control measures. Their findings will include analyzing individual sightings, kill locations, and whisker and tissue samples. 16 Geographic Information System (GIS) Geographic Information System (GIS) Lets us visualize, question, analyze, and interpret data to understand relationships, patterns, and trends in our area. GIS is becoming essential to understanding what is happening and what will happen in geographic space. Once we understand, we can prescribe action 16
17 Regional JLUS Implementation Strategy (RJIS) RJIS # RJIS Actions Next Step *C / 1 Identify critical areas/priority properties for acquisition that support preservation of military readiness for all Joint Base San Antonio (JBSA) installations through the use of Readiness and Environmental Protection Integration (REPI) funding or other Public-Public or Public-Private funding mechanisms. Bexar County secured $5 Million in Defense Economic Adjustment Assistance Grant Program (DEAAG) funding for the encroachment/land acquisition around Randolph Air Installations Compatible Use Zones (AICUZ) safety areas. Project received extension through Feb REPI has been approved for Randolph and there is one in the process for consideration/approval for Lackland Continually partnering with the JBSA encroachment team and P4. Update in Utilize capital improvement and infrastructure systems planning for stronger interagency communication/coordination on regional growth and management. Funding for Haul Route: Provides access for construction of Airman Training Complex (ATC) City of San Antonio (CoSA) provided $450k in funding for route construction. The funding Includes: Negotiation with landowner at Springvale Drive and Eagle Rock Drive for access to CPS Energy easement ($81k, estimated 10-year construction), road construction on CPS Energy easement ($69k), and a deceleration lane on Highway 90 Frontage Road west of Springvale Drive for construction traffic ($300k). Growdon Road traffic conflict JBSA-Lackland. CoSA will revisit in the summer of 2018 for possible funding. 3 Pursue legislation to authorize Texas counties limited land use authority to protect and preserve the military readiness around the state s installations. Senate Bill (S.B) 6 authorizes a municipality to annex for full or limited purposes, under the annexation provisions applicable to that municipality, any part of the area located within 5 miles of the boundary of a military base in which an active training program is conducted. 18 Regional JLUS Implementation Strategy (RJIS) RJIS # 4 Develop a Memorandum of Understanding (MOU) for a formal development notification process between the jurisdictions/ agencies and the JBSA installations. Dark Sky ordinance proposals in progress in City of San Antonio and Converse. Continue to track progress. 5 Develop a Regional JLUS Implementation coordinating board/task force. Executive Task Force Meetings (TFM) rounds 1 st and 2 nd are completed. September 2017 the Executive TFM was held, and will be followed by individual installations meetings. The 3 rd round of TFM will begin in Projected TFM dates: JBSA Randolph 10/30/17 JBSA Lackland 11/29/17 JBSA Camp Bullis 12/18/17 6 Pursue Mandatory real estate disclosure of Military Influence Areas (MIA) to ensure the safety and quality of life for homebuyers in the MIA s. This can be done through modifications to the Texas Association Of Realtors (TAR) Forms 1406 And 1506 For TAR members and amendment of Property Code seller s disclosure of property condition for all realtors in the State Of Texas. House Bill (H.B) 890 became effective Sept 1, Legislation only pertains to resale of existing homes. Work with all interested parties, including San Antonio Board of Realtors (SABOR). RJIS Actions Next Step The last meeting for Dark Skies was November 13, Proposal of changes discussed in meetings may be implemented in the future ordinance development. The Planning & Zoning Commission for the City of Converse is also drafting a Dark Skies Ordinance. Continue following progress on City of San Antonio and Converse Dark Sky Ordinance proposals. Will continually receive updates pertaining to density limits in Schertz. *C/ 8 Monitor the incorporation of Air Installation compatible Use Zone (AICUZ) guidelines for safety and noise in impacted jurisdictions zoning ordinances/unified development codes to protect military mission readiness and the public. City of Schertz is developing an Memorandum of Understanding (MOU) on density limits on east side of JBSA Randolph. AACOG is helping to distribute the Drone brochures to municipalities and the school districts surrounding military installations. Continue following Schertz density limits strategy and proposal. JBSA Lackland and Randolph are currently in the process of updating their Air Installations Compatible Use Zones (AICUZ). 9 Monitor the incorporation of Bird/Wildlife Air Strike Hazard (BASH) guidelines for safety in impacted jurisdictions zoning ordinances/unified development codes to protect military mission readiness and the public. AACOG contracted with Sustainable Organizations, Natural Resources, and Infrastructure (SONRI)-Meurer Municipal Consulting Services to assess the viability of municipalities around all JBSA installations to provide municipal services through contract service agreements. This is an ongoing project with expected closing date February This RJIS is still in progress, and updates will be provided through Developing BASH outreach material. *C Complete * In Progress 19

RJIS Actions Next Step Requires State Legislation. Could be addressed in the 86 th legislative session. *C/ 11 Monitor the amendments of Unified Development Code (UDC s) and zoning ordinances of local impacted jurisdictions to incorporate dark sky lighting controls and develop outreach program to educate Regional JLUS partners about sensitive lighting applications. The last meeting for Dark Skies was November 13, The next meeting shall reflect changes made during the drafting process. Modification of policy and direction may occur. The City of Converse has drafted a Dark Skies Ordinance and they intend to present it to the Planning and Zoning Commission in October. Continue following Dark Skies Ordinance progress for City of San Antonio and Converse as well as Schertz Density Limits progress. 12 Monitor the amendments of UDC s, zoning ordinances, and building codes of impacted jurisdictions to incorporate sound attenuation standards for noise sensitive land uses that are located in one of the regional noise MIA s. Research on flight path information for JBSA is ongoing. Flight path information will be mapped when acquired. Waiting on flight path study completion. Once the study is completed, the data will be requested. 14 Adopt FAA Part 77 and any amendments as state law to ensure FAA Part 77 compliance by developing a height restrictions zoning ordinance/order for each impacted jurisdiction. FAA Part 77 is currently being reviewed to address whether the document meets strategy requirement. 15 Coordinate utility, infrastructure, telecommunications and alternative energy development regionally. AACOG Defense Economic Adjustment Assistance Grant (DEAAG) program project for JBSA 98% complete. Received extension thru May 30, 2018 to resolve easement issue at JBSA-Lackland. All other milestones of project are complete. CPS was awarded a 50-year deal with Joint Base San Antonio to operate and own the electric grid and natural gas facilities on JBSA's premises. During the fiscal 2018, CPS has a projected gross revenue of $2.72 billion. Earlier this year, CPS installed a solar micro-grid on Fort Sam Houston that generates 78 kilowatts of power and enabled one of its buildings to operate off the grid in the event of an outage. Typically, the U.S. Army base would use diesel generators for power when outages occur *C Complete * In Progress 21

The AACOG JLUS department serves as a research & data support for Installation Encroachment Management Team (IEMT) concerns and impacts to JBSA in order to preserve its current missions and potentially extract new missions. New development with potential impact will go into executive and or task force presentations. Continually work with the JBSA Encroachment team on issues to continually address military concerns/impacts. 17 Ensure review of agency plans to address military water concerns. Defense Economic Adjustment Assistance Grant (DEAAG) project for JBSA 98% complete. Received extension thru May 30, 2018 to resolve easement issue at JBSA-Lackland. All other milestones of project are complete. 98% of project completed. Contract extended through May 30, 2018, when associated costs will be paid and reimbursements submitted to OOG. 18 Develop mission informational brochures and materials and conduct community briefings to educate the public about military mission-related impacts. The Military Influence Area map shapefiles obtained from the Matrix Design and a first draft is currently under review. As new data is received from various stakeholders the Military Influence Area map will be updated. In progress. Additional data is needed as it becomes available and updated. 20 Develop outreach materials and conduct joint outreach to developers on Low Impact Development (LID) storm water practices. CoSA DSD is following national planning trends and incorporating LID features into their capital infrastructure projects. Met with San Antonio River Authority (SARA) December 4, 2017 to discuss brochure material. Reaching out to San Antonio Water System (SAWS), San Antonio River Authority (SARA) and Edwards Aquifer Authority (EAA) on outreach material content. Brochure in progress. The time for action is now. Before, during, and after the next Base Realignment and Closure (BRAC). Significant changes will occur. Other states and military communities are taking action to improve their military value and support. Texas must move forward.
