1 Licence Agreement This Licence Agreement is issued by London Mission (West London) Circuit of the Methodist Church and West London Mission Housing Association Limited both of 19 Thayer Street, London, W1U 2Q. West London Mission is the owner of the Haven, which is registered in respect of Regulated activity Accommodation for persons who require treatment for substance misuse and for Accommodation for persons who require nursing or personal care. The Home is subject to regular inspections by Care Quality Commission who are responsible for seeing that the Haven maintains those standards specified within the Health & Social Care Act The Home is aimed at providing a high standard of accommodation and support for people who are actively drinking. This Licence Agreement is between West London Mission in respect of the The Haven, Haven House, 280 Holly Park, London N4 4AQ and you the Licensee (Name) And begins on (Date) The accommodation to be occupied comprises use of a single ensuite bedroom, which is furnished in accordance with the inventory attached as Schedule 1 of this Agreement. In addition you, the Licencee will have use of communal areas comprising of WC, Dining are, smoking room, the lounges (x3) areas and the garden. With the exception of any changes in the Licence charge, this Agreement may only be altered by the agreement in writing of both the Licencee and the Home. The following sections outline the terms and conditions of this Licence Agreement in respect of: - Charge / payment for the Home The Home s obligations The obligations of the Licencee The Licencee s rights Those grounds on which termination of the Licence Agreement may occur 1
2 1. CHARGES FOR THE HOME a. The charge for occupation of the premises at the date of this agreement will be weekly. b. These charges may be subject to changes. If the Home is to alter the charge in any way, this will be done by giving the Licencee not less than one calendar month s notice in writing. c. The charge covers the total cost of the service provided for the Licencee at the Haven inclusive of meals, heating, lighting, water, and laundry facilities. The charge does not cover the use of a television in the residents own bedrooms and those Licencees who wish to have the use of a television in their rooms will have to purchase an individual Television Licence. d. The charge is to be paid direct to the Home by the relevant Local Authority. 2. THE HOME S OBLIGATIONS The Home agrees to: a. Licencee s Occupation To allow the Licencee to occupy the Premises and receive the service as outlined in Schedule II.( See Attached). For the duration of the Licence not to interfere with the Licencee s occupation of the premises other than when; Access is required for the purpose of providing the services which are detailed in Schedule II (See Attached). Access is required to inspect the condition of the premises or to carry out repairs or other works to the premises or adjoining property. The Licence is brought to an end under the terms of this agreement. b. Rates and Other Charges To pay to the respective authority and water authority any amounts due to them 2
3 c. Repairs and Maintenance With respect to Repairs and Maintenance the Home agrees to the following: (iii) (iv) (v) To keep in good repair the structure and exterior of the Premises. To keep the Home s common entrances, halls, stairways, passageways, and any other common parts in reasonable repair and fit for use. To keep in good repair and proper working order any installations provided by the Home for heating, water heating and sanitation and for the supply of water,gas and electricity. To keep in reasonable repair and fit for use all those items of furniture and fittings supplied by the Home. To keep the interior and exterior of the Home in a good state of decoration and normally to decorate these areas in accordance with the Home s Cyclical Maintenance procedures. 3. THE LICENCEE S OBLIGATIONS a. Charges To pay any charges monthly and to pay in arrears b. Use of the Premises To use the premises for residential purposes as the Licencee s only or principle home and not to operate a business at the Premises nor to use the Premises for any illegal purposes. Residents may vacate the Home on a temporary basis in relation to being admitted to a rehabilitation project, hospital, going on holiday and other agreed circumstances but this will be subject to funding arrangements. (iii) (iv) Not to cause undue nuisance, disturbance or physical harm to other residents or neighbours or staff. Residents are also responsible for the behaviour of their guests on this matter. Not to commit or allow invited visitors to commit any form of harassment on the grounds of race, colour, religion, sex, sexual orientation, age, disability which may interfere with the peace and comfort of the rest of the household, staff, visitors or neighbours. Not to commit or allow visitors to commit any act which results in serious disruption of another Licencee s right to peacefully occupy any part of the Home or to commit any act which results in physical harm to any other Licencee, staff, visitors or neighbours. 3
4 (v) (vi) (vii) Not to play or allow to be played any radio, television, record, or tape recording or musical instrument so loudly that it causes a nuisance or annoyance to neighbours or other Licencees. Those residents who own a pet prior to admission will be allowed to bring them to the Home on the condition that everyone else in the Home is in agreement. However, for those individuals already in residence who may wish to acquire a pet, this will be subject to the discretion of the Home Manager. To keep the interior of the Premises in good and in a clean condition. (viii) To pay for any damages to the Premises or any of the fixtures, fittings and furniture including those in the communal areas caused by the Licencee or any invited visitor, wear and tear excepted, and to pay any costs incurred by the Home carrying out such works in default. Also to pay for the replacement of loss of keys i.e. Bedroom / Main door. (ix) (x) Not to remove or make any alterations to the Premises or fixtures, fittings or furniture provided by the Home. To report to the staff promptly any disrepair or defect for which the Home is responsible in the structure, exterior or interior of the Premises or in any installation therein or in the common parts of the Home, or any disrepair or defects in the fixture, fittings or furniture. (xi) To allow access to the staff to provide the services as detailed in Schedule II. To allow access to staff or contractors acting on behalf of the Company at all reasonable hours of the daytime to inspect the condition of the Premises or to carry out repairs or other works to the Premises or adjoining property. (xii) To give the Home at least one weeks notice in writing when the Licencee wishes to end the Licence (xiii) To give the Home vacant possession and return the keys of the Premises at the end of the Licence and to remove all personal possessions and rubbish and leave the premises and the Home fixtures and fittings in good lettable condition and repair. The Home accepts no responsibility for anything left at the Premises by the Licencee once the Licence has been terminated. (xiv) To comply with any health and safety instructions including those relating to fire procedures and not to engage in conduct which is likely to endanger the health and safety of any residents. (xv) In respect to fire safety, not to use any form of heating in the Home other than that supplied by the Home. (xvi) Not to use the Home for business of any kind or any illegal activity. 4
5 (xvii) To take responsibility for any personal belongings that residents bring with them to the Home. The Home s insurance policy will not cover residents individual rooms. However, if residents wish to take out individual insurance cover for their personal belongings, help will be given by staff to arrange this. There will be provision for residents valuables to be kept in the Home s safe. A record of all valuables will be kept. The resident and a staff member will be required to sign the record kept when depositing or withdrawing any valuables. 4. LICENCEE S RIGHTS The Licencee has the following rights: (iii) (iv) The Licencee has permission to occupy the Premises for the duration of the Licence so long as the Licencee complies with the terms of this Agreement. The Company and the staff of the Home will consult the Licencee in matters of the running and management of the home and /or maintenance which are likely to effect the Licencee. Licencees have the right to complain about the service either informally or formally. Westminster Health Care have a formal complaints procedure of which all Licencees should be made aware by the staff and a written copy of the procedure given to them. If the complainant is not satisfied with how their complaint is being dealt with, they can refer their complaint to the Home s Registering Authority that is CSCI Camden Office: The Licencee has a right to any information about the terms of this Licence and about any policies and procedures which may affect them living in the Home. 5. ENDING THE LICENCE The Home can end the Licence by issuing a written notice on one or more of the grounds listed below: (iii) (iv) The Licencee has failed to pay charges that are due. The Licencee has failed to comply with or breached any of the conditions of this Agreement. The Licencee has caused damage to the property, fixtures or fittings of the Home to which this Agreement refers. The Licencee has caused serious and/or persistent nuisance to other residents, staff or neighbours or acts of harassment on the grounds of race, colour, religion, gender, sexuality, age or disability. 5
6 (v) Suitable alternative accommodation has been offered. The Home agrees it will not normally give less than 28 days notice terminating the Licence. The period of notice will be detailed in the written notice which will also give details of why it has been issued. In cases where the Licencee fails to comply with a notice the Home may take legal proceedings to address the situation. In cases of seriously disruptive violent behaviour the notice given by the Home may specify a shorter period than 28 days provided that the period is reasonable in the circumstances. 8 Schedule II The Haven offers long term care and accommodation to men and women, usually aged 40 and above, who have chronic alcohol problems and who are unable or unwilling to stop drinking. A philosophy of Harm Minimisation informs the practice of the Home. Those services provided by The Haven are as follows; To provide a home for life which is maintained to those standards as required by the Home s Registering Authority, the Care Quality Commission under the Health & Social Care Act, Health and Safety Act 1974 and the Food Hygiene Act Access to healthcare services, GPs and other primary healthcare services such as opticians, dentists, chiropodists, and District Nurses. Access to other appropriate support services such as day centres and drop-in services to enable residents to establish links with the community and develop their own individual social networks. Access to laundry facilities To be provided 3 meals per day: breakfast, lunch, and supper To provide a keyworker for each resident who will aim to develop a care plan which reflects each resident s individual care and support needs. To have their own room and access to all the communal living areas of the Home To have their rooms and the Home cleaned and maintained on a regular basis. To pursue any leisure activities and general interests. To ensure resident rights are respected in relation to - privacy - dignity - independence - choice - fulfillment 8
