Result depends on how best we understand the Situation and how fast we Respond to it.all organizations/associations have two kind of peopleordinary members who have the employee mindset and extraordinary leaders who work with enetrpreuneur mindset.i have committed myself to change not only mine but all of our employee behaviours into entrepreneurial behaviors. PRE - HOSPITAL TRAUMA CARE TRAINING My vision of building up better rapport with Police department was well conceived by our new State Secretary Dr.C.N.Raja communicated to all IMA District Head Quarter Branches in a jet speed.i should appreciate the pro active role of IMA State President Elect Dr.R.V.S.Surrendran, FOUR Sttate Vice Presidents-Dr.T.Senthamil Pari, Dr.P.R.prabu Elango,dr.S.Byravarathinam & Dr,S.Balagan Raja and all IMA Trauma Committee members.the hard work done at the shortest time with intense energy and immense enthuciasm by the IMA District Head Quarters Branches was literally amazing and has fetched us more than the desired results.our Director General of Policewas impressedwith the excellent reports received from all DSPs.There was palpable welcome response from all participants and laudable coverage in the both print and visual media.i profusely thank every one for making it a great success. Let us continue this useful image building exercise to all other First Responders to an accident site to help the trauma victims and bring down the mortality and disability numbers which is highest in Tamilnadu and India. IMA-GFATM-RNTCP-PPM PROJECT This project is back again. Our Tamilnadu is one of the 15 States and 1 Union Territory which will continue till 2015.It will have branch level CME and district wise Training progammes.ima will facilitate our members and their clinics/hospitals function as a Private Peripheral Health Institutions(PHI) and participate under RNTCP. Every one of us should be aware that TB has been declared as a fortifiable disease. Let us all assist the efforts of RNTCP in achieving its goal in bringing down the burden of TB in India which is highest in the world. NHB CENTINARY MEET 100th Quarterly Meeting of our IMA Nursing Home Board is scheduled on 9th March, 2014 at IMA State Building, Tambaram. NHB Office Bearers are putting every effort to make it a land mark event with participation of high level IAS Officers and leading Health Experts. Ever to be remembered 2 hour session on Patient Safety and ever to be retained Souvenir will be the highlights which is not to be missed by any NHB member. Dear Brothers and Sisters, Greetings and Best Wishes. The first project Pre-Hospital Trauma Care was a great success; nearly 3500 Police, Fire & Rescue Services and Home Guards Personals took part in the Project all over the State. We thank the Branches of Namakkal, Kanyakumari, Perambalur, Virudhunagar, Pudhukottai, Kancheepuram, Erode, Tirunelveli, Chennai, Vellore, Salem, Madurai and Theni. They have done the Project very well, in short notice. It is very well appreciated by Director General of Police, Mr.K.Ramanujam, IPS and Mr.K.Muthukarupan, IPS and all Districts' Superintendent of Police. I thank everyone of you for your support.. Attack on Hospitals It is becoming an on-going process; there was brutal attack on the Hospital at Theni. The members of Cumbum Valley Branch unitedly acted and booked the culprits under the Hospital Protection Act, Section 48. Similarly, there was an incident at Palani Branch. Crisis Management Committee along with other members of the Palani Branch protected the Doctor in the Clinic. FIR has been booked on the violators. I whole heartedly congratulate the members of these two Branches for their swift and bold action. Every branch should have Crisis Management Committee in order to protect our Members. Programs like Pre-Hospital Trauma Care along with Police Officials, help our members to have close rapport with the Police and Public. Family get together IMA-Madurai Meenakshi, IMA-Madurai, IMA-Pudukottai, IMA-Trichy & IMA-Coimbatore Branches have conducted Family Meet in an impressive manner. It really helps our member and their family to get to know each other and also have a good understand among colleagues. I wish every branch should carry out such activities. RNTCP The RNTCP Programme has come back again. We have three units and soon we will have workshops and seminars for our members. Membership Membership Fees Concession for Life Members is Rs 3000/- and for Couple Members is Rs.4500/-. This Concession is valid up to March, So, I wish all the Branch Members use this great opportunity to make all your Colleagues, Junior Friends and make them Members of our Great Association. We all know that 75% of our stress and burden gets eased if we have well trained quality paramedical team to support us. With this in mind IMA PARAMEDICAL WING is trying to come out with practical work shops in various bed side procedures like IV cannulation, catheterization, emergency intubation, CPR, basic computer handling, record keeping etc etc. Zone wise during Zonal meets. Our next zonal meet is at Chennai at Thambaram IMA Hall on 8th March. It will be a full day program with work shops and lectures. Nursing homes are requested to avail this opportunity and send their para medical staffs in good no and train them to have quality people. Certificates will be given to the participants. Concept of IMA Regional Paramedical Institute formation is also thought of and hope it will take. Shape in future. Many Nursing Homes have IMA Reg Para Med Institutes but all are not functioning. We are planning to have Tie up with Agents who can get students for the courses.already along with IMA NHB corporate we have fixed norms for Nursing Trainees from various private institutes who come for training to our Hospitals. They have to stick on to one hospital for minimum 2years and stipend structure for them with refundable deposits has been already mailed to all NHB Members. NHB will have tie up with such Institutes and will be able to provide such Trainees to NHB Corporate Members. Secretary, FSS of IMA TNSB Dr. L. Chitti Babu Hony. Finance Secretary, FSS of IMA TNSB We thank all the members who have settled the pending dues for the FSS. Nearly 75 lacks were collected after we took over the FSS Scheme. It is unfortunate that the number of deaths for the year 2012, 2013 have gone up more than 40 deaths and hence the question of reducing the fraternity amount is not possible. In the last State Council Meeting itself, it was discussed any new member enrolled in IMA also should enroll in FSS Scheme, unless we attract the young members and increase the membership, it is very difficult to run the scheme. I request all the Branch Secretaries to give 10 minutes for the Management Committee Member to talk about FSS. We have already announced attractive prizes for the branch who have enrolled more members. I feel that State Branch will announce a membership enroll month for every scheme. Almost most of the computersation work is over with the hard work of the Secretary, Dr. T.N. Ravishankar. I wish each and every one of you a superb performance in all your endeavours in this month of February IMA CGP has scaled up all its activities with greater magnitude. It is all because of the help, assistance, and guidance from the State Office. We have completed the modules for almost all the Courses except Diabetology and Oncology with one module each to be completed in the month of February. MEDICO LEGAL CASE: Medical case with legal consequences or a legal case that requires medical advice is medico-legal case. A doctor can come across a medico legal case in any of the following ways During a Regular Practice:- 1. A case is brought by the Police for examination. 2. A person is referred for expert advice after having been attended by a doctor and after registering a medico legal case in the previous hospital. 3.After investigation the doctor is of the openion that the case must be registered as a medico legal case and he immediately takes the consent of the patient to convert the case into a medico legal case. Points to be remembered: Consent taken from patient for converting a case into a medico legal case must be an unpressurised consent. In case where consent is not received from the patient, the doctor must write down all the findings and inform the nearest police station about such MLC. A doctor must use his skill and judgment in case of MLC where, the patient has come on his own and has not revealed his history completely to the doctor On referral of a patient from previous hospital where the case has been registered as an MLC, the doctor must inform the nearest police station about the same. If such a case need to be further referred, then it must be accompanied by complete details and a letter of referral Any request by the patient or friends or relatives of the patient, for not registering a case as MLC should not be accepted under any circumstances by the attending doctor. 17 then Honorable Chief Justice of Supreme Court, R.C.Lagothi, (LP Mathur and P.K.Balakrishnan) gave a favorable and beautiful judgment regarding criminal cases of medical negligence against doctors. That particularjudgment only saves many of our doctors from criminal inedieul negligence since Honorable Chief Justice and his colleagues declared in the judgment in Para 5 I - 52 and 53 as follows. Para 51 :- The investigating officer and the private complainant cannot always be supposed to have knowledge of medical science so as to determine whether the act ofthe accused medical professional amounts to rash or negligent act within the domain of criminal law under section 304-A of IPC. Para 52:- The medical profession renders to human beings is probably the noblest of all. Many a complainant prefers recourse to criminal process as a tool for pressurizing the medical professional for extracting uncalled for or unjust compensation. Para 53:- Government of India and/or the State Governments in consultation with the Medical Council of India should form certain guidelines to safeguard the doctors from frivolous and false allegations. Until then, the court and police should follow the following guidelines given by this court. a) A private complaint may not be entertained unless the complainant has produced prima facie evidence before the court in the form of a credible opinion given by the competent doctor. b) Whenever Police Officer before proceeding against the doctor accused should obtain an independent and competent medical opinion preferably from a doctor in Government Service qualified in that branch of medical practice. c) Unless the arrest is necessary the doctor accused should not be arrested in routine manner. Judgment given by Hony. Justice R.C Lagdthi and others on 5/8/2005 at Supreme Court is a milestone and landmark Judgment in Medical Profession. Many of our colleagues escaped from the 304 A cases because of the above judgement. We doctors should not forget Hon. R.C.Lagothi in our lifetime. Subsequent to R.C.Lagothi s judgement justice Markandeya Kadju and R.M Lodha have given a judgment in civil appeal number 3541 of 2002 between Martin F.D Souza Versus Mohd.Ishfaq on (Toxicity following minakin injection) In that judgment Para 117, Markandeya Kdju stressed that in CPA cases also Justice Lagothi s guidelines should be followed. Paral l7:- We, therefore, direct that whenever a complaint is received against a doctor or hospital by the consumer fora or by the criminal court than before issuing notice to the doctor or hospital against whom the complaint was made the consumer forum or criminal court should first refer the matter to a competent doctor or committee of doctors, specialized in the field relating to which the medical negligence is attributed, and only after that doctor or committee reports that there is a prima facie case of medical negligence should notice be then issued to the concemed doctor/hospital. This is necessary to avoid harassment to doctors who may not be ultimately found to be negligent. We further warn the police officials not to arrest or harass doctors unless the facts clearly come within the parameters laid down in Jacob Mathew s case (Supra), otherwise the policemen will themselves have to face legal actions. Para ll3&l l4 He emphasized that aiter 1995 judgement, doctors afraid to give Morphia or Pethidine to Myocardial infraction cases and afraid to treat head injury cases because ofcpa. In Para 13 while this court has no sympathy for doctors who are negligent, it must also be said that frivolous complaints against doctors have increased, by leaps and bounds in our Country particularly after the Medical Profession was placed within the preview of the Consumer Protection Act. For example, earlier when a patient who had a symptom of having a heart attack would come to a doctor, the doctor would immediately inject him with Morphia or Pethidine injection before sending him to the cardiac care unit because in cases of heart attack time is the essence of the matter. However, in some cases the patient died before he reached the hospital. After the medical profession was brought under the consumer protection act vide Indian Medical Association Vs V.P. 18 Pethidine injection are often blamed and cases of medical negligence are filled against them. The result is that many doctors have stopped giving (even as family physicians) Morphia or Pethidine injection even in emergencies despite the fact that from the symptoms the doctor honestly thought that the patient was having a heart attack. This was out of fear that if the patient died the doctor would have to face legal proceedings. In para 114-Similarly, in cases of head injuries (which are very common in road side accidents in delhi and other cities.) Earlier, the doctor who was first approached would starred giving first aid apply stiches to stop the bleeding. However, now what is often seen is that doctors out of fear of facing legal proceeding do not give first aid to the patient, and instead tell him to proceed to the hospital by which time the patient may develop other complications. Para 115-He cautions the court and consumer Fora as below: ln para 115 Hence courts/consumer Fora should keep the above factors in mind when deciding cases related to medical negligence, and not to take a view which would be in fact a disservice to the public. Subsequent to Hony. Markandeya Kadju s judgement, Justice Ganguly Appeal No 2641 of in case between Kishan Rao and Nikhil Super Speciality Hospital, he criticized and Condemned the judgement given by Hony. Markandeya Kadju in Para 53 as follows: Para 53: The two judge Bench D souza has taken note of the decisions in Indian Medical Association and Mathew, but even after taking note of those two decisions, D souze (Supra) gaee those general directions in Para 106 which are contrary to the provision of the governing statute. That is why this court cannot accept those directions as constituting a binding President in cases of medical negligence before Consumer Forum. Those directions are also inconsistent with the avowed purpose of the said act. Because of the above said ganguly s Statement many of our doctors lost their opportunity of getting 99% of reli@fit1 CPA cases. If Mmkandeyu Katgms judg ixient is accepted by the upper count definitely more than 90% of the doctor s burden regarding CPA will come down. The integrity of justice Ganguly"fis*now questionable because of the sex scandle case in the Supreme Court. This is a time for us to go upper forum against the judgement given by Ganguly against Marlcandeya Kadju s Judgement. My request is our IMA should file an appeal against AK Ganguly s Judgement Appeal No 2641 of 2010 in case between Krishna Rao and Nikhil Super Specialty Hospital. ln spite of Hon. Chief Justice, R.C.Laghothi s request the Central, State and Medical Council to frame a rules and regulations to safeguard the doctors from frivolous and false complaints so far they didn t take any action. ' When I was a legal chairman of PPISSS of TN, l sent several registered letters to Central, State and Medical Councils requesting them to form guide lines as per Supreme Court's instruction to prevent false allegations against the doctors, They didn t do anything upto December ' ln December 2012 only, Medical Council of India requested Tamilnadu Medical Council to look into my grievances. Then Tamilnadu Medical Council formed one Legal Ethics Committee on January 2013 under the leadership of President of Tamilnadu Medical Council Dr.Prakasam. Myself, Dr.Muthura]an, Dr.Ravlsankar were nominated as Members. After going through several CPA cases and Judgements, l came to conclusion that all CPA cases must be referred to respective State Medical Councils. lf the State Medical Councils find any Prima Facie evidence against the doctor, then only CPA cases must be framed by the courts and police. INDIAN PHARMACOPOEIA COMMISSION organizes CME on Pharmacovigilance in Technical Collaboration with IMA TNSB Dear Friends, We are glad to share with all of you and invite you to be part of yet another novel initiative of IMA TNSB, namely organizing a CME on Pharmacovigilance and the role of practising doctors in it, in association with the Indian Pharmacopoeia Commission, which is the National Coordination Centre for the Pharmacovigilance Programme of India under the aegis of the Ministry of Health and Family Welfare, Government of India, at Chennai on Saturday 22-Feb-2014 between 1 PM and 5 PM. The World Health Organization defines Pharmacovigilance as the science and activities relating to the detection, assessment, understanding and prevention of adverse effects or any other drug-related problem (pertaining to the usage of medications and/or medical devices during clinical trials as well as after the drug or device has been approved for marketing). The aims of pharmacovigilance are to enhance patient care and patient safety in relation to the use of medicines throughout the world; and to support public health programmes by providing reliable, balanced information for the effective assessment of the risk-benefit profile of medicines. The primary objective of pharmacovigilance is to ensure that any therapy renders more benefit than risk to the consumer. The Indian Pharmacopoeia Commission has been organizing nationwide CMEs to create awareness about the Pharmacovigilance Programme of India (PvPI) as well as the roles and responsibilities of medical practitioners in reporting suspected adverse drug reactions to PvPI. With the IMA Headquarters already recognizing the importance of pharmacovigilance and having established the IMA Pharmacovigilance Education Cell almost a decade ago, it is evident that achieving excellence in Pharmacovigilance in India is a shared goal for PvPI and IMA. I am very thankful to the members who had taken efforts to convey their agreement to the last month's message that common people and the media should be made to understand what Medical Science is. This matter was very well discussed in JUSTICE R.C.LAHOTI JUDGMENT on appeal 144 &145 of 2004, dated Para 31, 32, 51, 52 Human body and medical science both are too complex to be easily understood. To hold in favour of existence of negligence, associated with the action or inaction of a medical professional, requires an in-depth understanding of the working of a professional as also the nature of the job and of errors committed by chance, which do not necessarily involve the element of culpability. Para 32 For a Medical Accident or failure, the responsibility may lie with the medical practitioner and equally may not. The inadequacies of the system, the specific circumstances of the case, the nature of human psychology itself and sheer chance may have combined to produce a result in which the doctor's contribution is either relatively or completely blameless. Human body and its working is nothing less than a highly complex machine. Coupled with complexities of medical science, the scope for misimpressions, misgivings and misplaced allegations against the operator i.e. the doctor, cannot be ruled out. One may have notions of best or ideal practice which are different from the reality of how medical practice is carried on or how in real life the doctor functions. The factors of pressing need and limited resources can not be ruled out from consideration. Dealing with a case of medical negligence needs a deeper understanding of the practical side of medicine. Para 51- There is no chance for the complainant to have adequate knowledge in medicine Para Many a complainant prefers recourse to criminal process as a tool for pressurizing the medical professional for extracting uncalled for or unjust compensation. Such malicious proceedings have to be guarded against. We must be really thankful to him for going into the depths of medical science, how a doctor works and the difficulties he meets in his practice. He has clearly defined what is medical negligence based on understanding medical science, earlier Judgments and books on medical law. This is the shield which protects us from wild, ambitious, greedy, vengeful allegations of medically illiterate and ungrateful patients. So medical faculties should always be thankful for the efforts the Judge Lahoti has taken to define what is medical negligence. In the recently held PPLSS management committee meeting, one District Co-ordinator raised this matter. Our IMA TNSB - President Dr. M. Balasubramaniam outlined the efforts being taken in this regard. A Programme in TV media is being worked out. Anyway, we must make the people understand that we are not God, but a privileged hand of God in lifting at least a part of burden of our suffering fellowmen and to alleviate those who are burning in the fire of pain and sorrow. 37 WINTER SKIN CARE FOR INDIAN SKIN Chakravarthi Mailer Ravindran, MD DVL Introduction Winter is always a challenge to the skin by various factors. The skin being the protective organ of the body, the change of season always affects our skin. As winter sets in, with it's low ambient humidity, water is lost from the skin to the atmosphere leading to dryness. A low skin temperature causes blood vessels to contract and less fluid reaches the skin. In addition, the elderly have reduced number of sweat and sebaceous glands, which prevents the skin from being properly hydrated by the sweat and protected from water loss by the sebum. Hence dry skin problems worsen with age. Winter is always a challenge to the skin by various factors Physio Pathology Dry skin in the winter has been reported to involve defects in water holding and barrier functions, and decreased ceramide (CER) levels in the stratum corneum. This loss of lipid content in the skin allows the trans epidermal water loss and provokes dryness and subsequent pathological changes like asteostatic eczema, etc. Factors Influencing Dryness Sudden drop in tempreture Frequent baths Hot water bath Certain medication like corticosteroids, diuretics, cimetidine etc Increase in age Zinc deficiency Internal disease like myxoedema, thyroid HIV etc Environmental pollutent Clinical Features Dry skin is first perceived as a sense of tightness on the facial skin, especially on the cheeks and around the mouth. In other areas of the body, itching or a fine grey scaling may be the first sign of dryness. On the palms and soles, it begins as a parchment like hardening of the skin and cracks at the edges of the palms and soles as well as itching, irritation and redness around the fingers and toe nails. If due care is not exerted at this point, the itching leads to scratching which leads to fine erosions on the skin in which dust particles settle leading to aggravation of itching. This cycle continues tills such time as the skin breaks down completely leading to eczema. This is called asteatotic eczema. The areas that are most prone to this are those in which the number of sweat glands per unit area is low, such as shins, [front of legs], front and sides of thighs and hips, flanks and back. While winter causes skin dryness it also causes people to dry warmly. However, come February the temperature rises without an associated rise in humidity. Warm clothing is given up. The skin is faced with a warm dry challenge as opposed to a skin is inflamed with winter itch or very early invisible inflammation of the skin and this skin is exposed to sunlight, it turns dark, hence moisturizing kåj if«khw»il F«ïl âš k Lnk m ò fh L»wh. všyhçlk«m ò fh Ltnj KiwahdJ. 38 sunscreens are recommended rather than plain moisturizers on sun exposed areas. To add insult to injury, ambient dust settles on the skin and promotes increased moisture loss by increasing the surface area of the skin. Environmental pollutants such as vehicular and industrial fumes with their burden of particulate matter can easily penetrate dry and chapped skin and damage it. Management One should change over to fatted soaps in winter and soap the body only once a day. Non-soap cleanser should be preferred than soap, generally available as a liquid or gel. Repeated wetting and drying of the skin leads to overall dryness of the skin. A face or body wash should be followed by dabbing and not rubbing the skin. This should be followed by application of a moisturizer within 3 minutes. Moisturizers are preferred to vanishing creams. Moisturizers should be minimally perfumed or unperfumed. Men, who use shave gels, shave foams, after shave and astringents, should precede the have with application of oil or heavy moisturizers. Face and body talc increase drying, hence avoidance advise should be done. The traditional castor oil bath has much to recommend it. People who work in air-conditioned should be advised to stay away from the AC vent or deflect the output. Advise them to apply moisturizers to the face and neck, elbow to hand and knee to ankle once in 3 hours Women must wear shoe sand socks as open footwear gives rise to chapped, cracked tanned, aged looking feet in winter.
