The recommendation is that there is enough information within the papers to decide the application without an oral hearing. Regulation 31 The proposed pharmacy is not on the same site or adjacent to any other pharmacy, therefore this regulation is not engaged. Consider the impact of decision on those with protected characteristics under the Equalities Act 2010 and is this in accordance with NHS England s Public Sector Equality Duty. Consider impact of decision on NHS England s duty on health inequality. Regulation 24(1) criteria a) for the patient groups that are accustomed to accessing pharmaceutical services at the existing premises, the location of the new premises is not significantly less accessible; There is no information within the application or comments regarding any impact on this group. The recommendation is that there would be no impact. Applicant Patient groups that use the pharmacy are: Patients registered with local surgeries: the three largest patient groups comprise those patients registered with Leytonstone MC, 157 Leytonstone Rd, Thatched House MC, 136 High Road and Stratford HC, The Grove. Local Residents Patients registered with local surgeries but access pharmaceutical services independent from general medical services. Elderly & Disabled patients Overlap between the above groups. For all of the above groups the location of the new premises is not 3

4 significantly less accessible for the following reasons: Both premises are located on Leytonstone Rd, it takes 2 minutes by foot to walk between the two sites. There are no barriers to movement between the two sites nor are there any geographical barriers which will impede access to the new site. For those walking between the two sites, the pavements are flat, welllit and well maintained. The pavements also have dropped curbs and there is a designated pedestrian crossing point. This is beneficial for the elderly and disabled. For those accessing the site by car there will be no difference as they will be able to use the same car park. The majority of prescriptions dispensed originate from the practices detailed above. The proposed site is close to the existing site. Therefore the patient group who are registered patients of these surgeries and who have visited their GP and need to have a prescription dispensed, access to pharmaceutical services should be the same. NHS England comments/observations None of the parties notified have made any comments with the exception of Boots who have asked to be kept informed of the outcome of the application, but have no objections to the relocation as patient groups have been defined and the distance is short. The distance between the two sites is approx. 110 metres, and whilst the proposed site is on the opposite side of the road to the current site, there is a pedestrian crossing nearby. The walking distance between these two sites is only a few minutes and should not be an issue for patients. (b) in the opinion of the NHSCB, granting the application would not result in a significant change to the arrangements that are in place for the provision of local pharmaceutical services or of pharmaceutical services other than those provided by a person on a dispensing doctor list (i) in any part of the area of HWB1, or (ii) in a controlled locality in the area of a neighbouring HWB, where that controlled The PSRC have determined that the patients would not find this new site significantly less accessible. NHS England comments/observations The distance is short between these two premises. There is no evidence that the relocation would cause any changes to the arrangements in place for the provision of pharmaceutical services. The PSRC have determined that the move would not result in a change to the arrangements that are in place for the provision of local pharmaceutical services or pharmaceutical services. 4

5 locality is within 1.6 kilometres of the premises to which the applicant is seeking to relocate; (c) the NHSCB is satisfied that granting the application would not cause significant detriment to proper planning in respect of the provision of pharmaceutical services in the area of HWB1; (d) the services the applicant undertakes to provide at the new premises are the same as the services the applicant has been providing at the existing premises (whether or not, in the case of enhanced services, the NHSCB chooses to commission them); and (e) the provision of pharmaceutical services will not be interrupted (except for such period as the NHSCB may for good cause allow). Decision The PSRC have determined that granting this application would not cause detriment to proper planning. The applicant will provide the same services at the new location as at the existing location. The hours of the pharmacy will also be the same for the new premises as for the current one. There will be no interruption of services except for any period that NHS England Agrees. The PSRC have determined that there is enough information within the papers to decide the application without an oral hearing. There are no pharmacies within close proximity of the proposed site, therefore regulation 31 does not apply. Regulation 24(1)a the new premises are not significantly less accessible for patients. Regulation 24(1)b this move would not result in a change to the arrangements that are in place for the provision of local pharmaceutical services or pharmaceutical services Regulation 24(1)c - this application would not cause detriment to proper planning. Regulation 24(1)d the same services and hours are planned for the new premises. Regulation 24(1)e there will be no interruption of services The PSRC have determined that the application fits the criteria for regulation 24 and is therefore approved. 5
