RULES AND REGULATIONS Learning to live in a residence hall environment requires maturity, an examination of values, and assessing how one s behavior affects others. The specific rules and regulations that exist at ULH, Inc. can be found in this section and in the Rules and Regulations, which are an integral part of your license. We also enforce the University Of Louisville Code Of Student Conduct and the Housing policies. There are three basic principles, however, which we try to instill in all residents and which are the foundation for our policies: 1. Demonstrate care about yourself. 2. Demonstrate care about, and be considerate of, others. 3. Respect others and ULH, Inc. property. Take time to again review your license and familiarize yourself with the rules and regulations, as you and your guests are responsible for following them. Failure to do so may result in disciplinary action. RESIDENT ROOMS We realize the importance of personalizing your room; however, in order to comply with local fire codes (which are created ultimately for your own protection and safety) certain policies apply toward the condition of your room. In addition, decorating guidelines have been established in order to prevent damage to the rooms. 1) All rooms are to remain as furnished, with beds on their frames and furniture on the floor (i.e., no beds on top of desks or dressers, no desks or dressers stacked or turned on end, etc.). For safety reasons, no cinder blocks are permitted. Furniture may be rearranged in your room provided it is returned to its original position prior to check-out. 2) No bunk beds, lofts, waterbeds, etc. are permitted. We provide beds that can be bunked and/or raised or lowered to accommodate students. 3) No other construction, wall partitions, or any similar structures are permitted. No painting of student rooms is permitted. 4) Dartboards are not permitted since they cause excessive damage to walls. 5) Any alterations or modifications that pose a threat to safety, health, physical room damage, comfort of others, etc. are not permitted. 6) NO ITEMS ARE PERMITTED ON THE CEILINGS. This includes: nails, stickers (reflective stars), bottle caps, tape and poster putty. Damage to ceiling will result in a

charge. See chart below. 7) No additions to the original surface are permitted on the doors, windows, blinds or furniture. 8) No decorations are permitted on the windows. This includes; signs, posters, lights, flags, etc. 9) All decorations must be temporary so as not to permanently deface or damage your room furnishings. Posters and other wall decorations can be hung with thumb tacks, small picture hanging nails, or any other methods that will not damage painted or vinyl wall surfaces. 10) For fire safety reasons NO halogen lamps or candles are allowed in the rooms. 11) Please do not put tape OF ANY KIND on the carpet or vinyl. BATHROOMS In Community Park and Kurz Hall your room is connected to your suitemates room by the bathroom facilities. These rooms are designed with door locks that enable you to lock both rooms from the inside while you are using the bathroom facilities. Please remember to unlock your suitemate's door when you return to your room. Do not allow anyone to enter your suitemate s room through the bathroom. In addition, please be aware that if your toilet begins to overflow for any reason, you can stop the water flow by turning the valve located at the bottom left of the toilet to the right. Please be aware that toilets are not designed for the disposal of feminine hygiene products or paper towels. Residents will be responsible for any toilet damages/overflows that are the result of improperly disposed articles or overflows that are not reported. Residents are required to plunge their own toilet prior to calling maintenance. It is recommended that you have your own plunger on hand, as the plungers at the desk may be checked out. VACANT BEDROOMS Current residents cannot refuse a new roommate as long as there are empty beds/bedrooms in the apartment/suite. It is a violation of your license to tell a potential roommate that you do not want a roommate or that there is no vacant beds/bedrooms, when in fact, one exists. It is also a violation of your license to double occupy the space. Any of the above will result in a charge for the empty space being placed on your account. You may wish to rent out the space in order to avoid getting new roommates/apartment mates, please contact the Sales and Marketing Manager for more details. HEALTH AND HYGIENE Rooms, suites and apartments must be kept clean and sanitary at all times. This includes proper disposal of empty food and beverage containers. Residents are prohibited from violating any health code. Residents may not violate these regulations or interfere with the sage and clean environment of others. INSPECTIONS Apartment/suite inspections will occur for preventative maintenance and condition assessment. Residents will be notified in writing, in advance of these inspections. In the event that a resident had previously violated license agreement policies regarding proper cleanliness, guest privileges or the pet policy, this document serves as notice for management to re-inspect the apartment/suite as necessary to ensure there are no further violations. CHECK IN/CHECK OUT A Check in/check out Inventory and Condition forms will be provided by staff. Please take the

time to read the comments concerning your apartment/suite. Please return this form to your RA upon completion and notify them if you find additional issues or have a concern. Please make sure this form is an accurate listing on your apartment/suite, as it will protect you from being charged for any damages which may have occurred before you moved in. Prior to check out at the end of the year, a letter will be sent o you notifying you of all the steps involved in checking out, including options for having your apartment/suite inspected, turning your keys and completing a mail forwarding address card. If you do not check out on time there is a $100 late check out charge for even 1 minute past the checkout time. Then an additional charge of $25 per day. 11 PUBLIC FURNITURE ULH, Inc. has provided high quality furniture to all floor lounges and other public areas for your comfort while studying or watching TV. The furniture is meant to stay in the designated areas so that all members of the floor can enjoy its use. Please do not take the public area furniture into your room as others cannot enjoy it there. There will be a $50.00 moving charge for removing furniture from any public area. All missing furniture is reported immediately to the authorities to assist in recovering the missing property, thus protecting your privilege of fully furnished floor lounges. NOISE You have the right to expect that you will be able to study or sleep without undue disturbance from noise. Keeping the volume on your stereo and TV at a level where it can only be heard in your room and lowering your voice when you are talking in the hallways are two things you can do to maintain a quiet environment. In the event that the noise level becomes too high for you, there are several steps that you can take. Explaining your reasons, (I'm trying to sleep, study, etc.) often leads to a more positive outcome than trying to order someone to be quiet. In any event, a compromise is usually the best answer to a dispute. If you do not get the desired results, contact the RA on call or the front desk. QUIET HOURS In order to provide an environment in which every resident can sleep or study when and where they want, some basic times and guidelines have been established. Quiet hours are a time that no audible noise should be heard in the hallways or lounges. All other floors will decide on quiet hours at the first floor meeting. Minimum standard of quiet hours on all floors have been set for everyday, 10:00 pm - 8:00 am. A 24-hour quiet policy is in place during mid-terms and finals. MUSICAL INSTRUMENTS With such dense living conditions, it is impossible to allow residents to have electrical instruments or drums on the premises. Remember, your neighbors need to be able to sleep, study, or relax without the excessive noise these instruments create. ALCOHOL The decision to drink and how much is a personal one. Alcohol related conduct which infringes upon the rights of others to a quiet, orderly living environment is not acceptable under any circumstances. The possession and/or consumption of alcoholic beverages in student rooms must comply with local, state, and federal laws and regulations. ALCOHOL CONSUMPTION IS PROHIBITED IN ALL PUBLIC AREAS IN AND AROUND THE BUILDING (i.e., lobby, study lounges, pool area, etc.) The possession of kegs, beer bongs, party balls, etc. are prohibited at any location on the premises. Discipline action will be taken for those violating the Alcohol policy. Residents found violating the Alcohol policy may be reported to the Dean of Students office and repeat offenses could result in being removed from housing. BALL PLAYING, SKATEBOARDS Ball playing (including, but not limited to, baseball, soccer, or football), skateboarding, rollerblading, bicycle riding, or use of any equipment with wheels are prohibited in the buildings/apartments/suites. These activities have the potential to create excessive noise, inflict damage, and can cause physical injury.

BBQs, FIRE PITS, OPEN FLAMES and FIREWORKS BBQs and contained fires in property designated fire containers are allowed under the following conditions: -Someone must stay with or be able to see the fire or charcoal at all times (charcoal and lighter fluid cannot be stored in apartments/suites). -Be mindful of wind and placement of the fire so that smoke doesn t bother neighbors -Dry brush or weeds must be cleared for five feet from the heat source in all directions -Coals and embers must be completely extinguished with water when finished -Fire pits, BBQs dug in the ground, or any type of fireworks are not permitted at any time. -Charcoal must be properly cooled and disposed of when cooking is completed. It should never be dumped on the ground. CANCELLATIONS Students may cancel at anytime. Fees may apply. When you signed your license you agreed to the cancellation policy. For the detailed cancellation policy DRUGS It is explicitly illegal to use or possess drugs or other controlled substances in both public and private spaces. Residents using, possessing or selling drugs will be subjected to disciplinary and / or criminal actions. ELECTRICAL SAFETY No modifications to, or changes in, electrical wiring are permitted. No splices, octopuses or modification devices of any kind may be used to add plugs in your room, suite or apartment. UL approved, grounded power strips with circuit breakers may be used only for the computer and computer related hardware. A maximum of two power strips may be used per room. Extension cords are not permitted. ENERGY CONSERVATION Efficiency of your HVAC unit is dependent upon complete air circulation. IT is important to keep all vents in every room open. In addition, please ensure that return air vents are left unobstructed. If you wish to request a new filter, please submit a maintenance request at the front desk. We are continually looking for ways to conserve energy and to contribute to this area of national consciousness. Please help us by taking the following steps: 1. Turn off lights when not in use. 2. Turn off appliances when not in use (i.e. irons, televisions, etc.) 3. Turn off stereos when leaving the room. 4. Set controls at a normal level in your refrigerators. 5. Make sure all faucets are properly turned off. 6. Please notify maintenance of any problems concerning your thermostat, lights, and/or faucets. GUESTS We encourage you to invite guests to your home but please keep in mind that your guests must abide by ULH, Inc. rules and regulations. As the host, you are held accountable and responsible for the conduct of your guests' at all times. If you feel that your guests won t be able to control themselves properly while visiting ULH, Inc. do not place yourself in a position of responsibility for your guest s behavior. We do have a sign in policy and an escort policy. Your guests must be escorted by you at all times while in the building (this means you cannot leave them in your room while you run down the hall or to class). Never agree to escort a person(s) you do not know personally because you will be responsible for them. This includes opening lobby doors to allow visitors to enter. See the front desk to sign in your guests. Do NOT give your keys to anyone. You are responsible for your keys and anyone you allow to have access to them. Immediately report lost or stolen keys to the front desk. There are charges associated with lost or stolen keys that will be the resident s responsibility. Visitation Policy Visitation is defined as those times during which residents may have guests in their rooms, suites, or apartments, or in the public areas of residential floors. In addition to the set HRL/ULH, Inc. guidelines for guests, specific visitation plans should be outlined by residents in the side by side agreements stating the maximum hours during which visitors or guests may visit. With these plans, the shared concerns and wishes of the roommates are of paramount importance and determine what are acceptable or unacceptable visitation privileges within a specific room. Visitation is a privilege that is subordinate to a resident s right to privacy within her or his room. Residents may not exercise their visitation privileges if doing so interferes with the rights of the roommate or of other residents. Suspension of visitation privileges for an individual, a floor or an entire residence hall may be issued by the Office of Housing and Residence Life and ULH, Inc. with just cause.

The University of Louisville provides several different visitation options for students depending on where they live. The visitation policy strives to recognize and balance the following priorities: The need to provide options to students and parents who have different desires regarding visitation arrangements. The need to maintain a safe environment in the halls. The need to respect students desire for privacy. The need to recognize the value of visitors in a vibrant, educational community. Residence Halls and Apartments for Upperclassmen Mixed Buildings: Twenty-four hour visitation, seven days a week is permitted in Louisville, Stevenson, Threlkeld, West, Center, UTA, Med-Dent, Community Park, Billy Minardi Hall, Herman and Heddy Kurz Hall, and Bettie Johnson Hall. Guests are allowed to stay overnight. Overnight guests are defined as any person not assigned to that bedroom/suite/apartment, staying more than six (6) hours in a day and/or sleeping in the bedroom/suite/apartment. However, all roommates/apartment mates must be in agreement about whom, when and hours visitors are allowed. Regardless of prior agreements, guests cannot stay more than six nights in month with no more than two nights consecutive. Minors can visit but in order to spend the night must be approved by the Residence Life Coordinator, Assistant Director for Residence Education, Assistant Community Manager or Community Manager prior to arrival. Those who violate these will be subject to disciplinary action. Visitation Hours for Hall Opening, Closing, and Break Periods During the weekend that halls open and finals week (hall closing), family and friends may sign in beginning at 8:00 am until the conclusion of the applicable visitation hours to help residents move in and out of the halls. Twenty-four hour quiet hours are still in effect while other students are having finals. During Fall, Thanksgiving, Winter Break and Spring Breaks visitation hours will stay in effect as normal. Illegal occupancy and cohabitation policy Illegal occupancy may include but is not limited to: staying more than 6 nights in a month and/or more than 2 nights consecutive being restricted from entering a building for disciplinary or other reasons not being enrolled in good standing with the University not having a signed license on file with Housing or ULH, Inc. Cohabitation may include but is not limited to: having overnight guests staying more than the allowable nights either by the visitation policy or the side by side agreement

not having a signed license on file with Housing or ULH, Inc. accessing the room or apartment while the assigned occupants are not present utilizing a key to enter a room or apartment to which one is not assigned using the bathroom and shower facilities as if one lived in that room/suite/apartment keeping belongings, such as clothes and books, in the room as if one lived in that room/suite/apartment A visitor is any person who has signed into the hall (if required) with a resident anytime during the day or night. All visitor(s) should be escorted by a resident when he/she leaves the room/suite. He/she should leave with the resident when leaving the building, abide by Housing Herald and ULH, Inc. policies while in the hall, should not use the floor restroom if he/she is of the opposite sex, may sleep over if not in violation of the illegal occupancy/cohabitation/visitation policies, and has the permission of room/suitemates to be there and is in accordance with the side by side agreement. Visitors to family licensed apartments are allowed to remain in the apartment even if the resident leaves the building. Visitors to Bettie Johnson Hall and Non-Family licensed apartments in UTA are not allowed to remain in the apartment when the resident leaves the building. Illegal sleeping over or cohabitation is when a resident shares a room/suite/apartment with someone of the opposite sex whom he/she is not married to or someone of the same sex sleeps in the room/suite/apartment and violates any part of the illegal occupancy/cohabitation/visitation policies. Guest Sign-in Policy Residents and their guests (including parents and family members) are required to conform to the visitation hours established in the building in which they live or are visiting. Residents are responsible for and can be held accountable for the behavior of their guests. Residents must inform their guests of Housing and ULH, Inc. policies. Residents of a room may be held accountable for the guest s behavior that takes place inside the room and in the common areas of the building whether or not the residents are present. Guests that fail to comply with any University policy or staff member, will be asked to leave the residence hall. A guest can be denied permission to remain in the building or may be prohibited from future visits if he or she creates a disturbance or violates any rule or regulation. Enforced in West, Wellness, Miller, Threlkeld, Louisville Hall, Unitas Tower, and University Tower Apartments 24 hours a day, seven days a week. In Bettie Johnson Hall, Herman and Heddy Kurz Hall and Community Park 10p-8a seven days a week. No sign-in is required in Medical-Dental Apartments. All persons who would normally require an escort in the hall (residents and nonresidents) must sign in at the front desk by completing a sign-in card. The host and the guest may be required to present ID for verification. Guest(s) must be escorted at all times in the building and upon entering and leaving. Additionally, host and guest must sign out.

Even if no staff is present when you need to sign in or out, cards will be available. Please complete and deposit in the appropriate box. If no cards are available, any piece of paper with your name, your guest s name, the date and time you signed out is acceptable. Note: Over the years, we have determined that two guests per resident present is a comfortable limit for guest, noise, and general community issues. In some situations, fire codes related to occupancy may also be a factor. INTERNET USE There is a growing trend of students stealing movies and music from the Internet due to highspeed connections. The ULH, Inc. and the University of Louisville does not condone these actions and if you are caught downloading or sharing copyrighted files from the Internet, your Internet port will be shut down. Your port can be deactivated for as long as a week or to the rest of the year depending on the severity of the issue and how quickly you respond when you are made aware of the problem. In addition, the Dean of Students may take disciplinary action, which could result in forfeiture of your housing license. The signature on your housing license indicates you agree to the computer usage policy for U of L. All students receive information outlining the consequences for violating copyright laws. This information is available on the U of L web page. A first offense will result in the resident s port being shut down for one week. PETS Although it may be difficult to leave your pet at home, the sanitation and health risk to residents, as well as the potential harm to the animal itself, make it impossible to have pets on the premises. No pets or animals except for small fish aquariums (10 gallons or less, containing fish only) are permitted. Failure to comply could result in a fine up to $ and possible eviction. POSTING All signs and posters must be pre-approved by the Community Manager before they may be posted. Posters, signs, etc. can only be placed in designated areas. SMOKE DETECTORS The smoke detectors in your apartment/suite are very sensitive. When taking a shower, close the bathroom door to ensure the steam does not affect the detector. When cooking, be sure to use the fan above the stove. This could help prevent a grease fire. If your detector makes a beeping sound, the battery is low. Complete a maintenance request at the front desk as soon as possible to have the battery replaced. Any time a smoke detector sounds an alarm, you should respond to it as an emergency and proceed in a safe manner. Never disconnect the smoke detectors. Sometimes you may experience a false alarm. The smoke detectors can be set off by dust, an insect, or just may need routine cleaning. Open all windows to allow fresh air into the apartment/suite. It is better to err on the side of caution. Tampering with a smoke detector will result in disciplinary action.

SMOKING Non-smokers are often offended or physically irritated by the presence of smoke in their habitat. Smoking in the building (including the hallways, lounges, student rooms, dining room and stairwells) and outside the main entrance is prohibited. In additional U of L is a smoke free environment. The Health Promotion office at U of L offers smoking cessation classes and support groups. UNIVERSITY OF LOUISVILLE PROPERTIES ARE SMOKE-FREE FACILITIES! SOLICITATION In order to keep strangers off the floors and to protect your interests, ULH, Inc. does not permit any solicitation to occur. If at any time you find soliciting occurring on your floor, contact your RA or the front desk immediately. We ask that you meet pizza and other deliveries at front door where you can pick them up rather than have strangers on the floors. VANDALISM Willful destruction of property by a resident or guest is a violation and may result in disciplinary action, prosecution and immediate eviction. ACCOUNTABILITY DISCIPLINE We have a set of rules and guidelines at ULH, Inc. which must be adhered to if you wish to continue to live here. It is very important that you familiarize yourself with all rules and regulations and the material contained in this handbook, the student code of conduct and in your license. Since every resident will have received these rules, this is considered your warning. Part of the RAs, Residence Life Coordinator and Assistant Community Manager jobs involves making sure that the rules of the property are followed. At times it is not a pleasant job; however, it must be done to insure the safety of all residents and to help insure that we all get along well in such close quarters. ULH, Inc. operates in an adult atmosphere, thus, most residents will never find themselves involved with disciplinary action. The largest part of those who do require disciplinary action will simply need a verbal clarification or warning. For those persons whose behavior is such that it requires more attention, any or all of the following may occur: A private meeting with a staff member, a written warning (with copies to your file and possible the Dean of Students office) restriction from areas or events, relocation within the building, the community or to non-ulh, Inc. managed building, referral to the Community Manager, and/or Dean of Students office, eviction, and/or criminal prosecution. DISRUPTIVE BEHAVIOR Residents are expected to act in a manner that will not disturb the academic pursuits or infringe upon the privacy rights, health or safety of other persons. Understand that any activity that has a negative impact on a roommate/apartment mate, neighbors or others will not be tolerated. FAILURE TO COMPLY Each resident is required to follow all directives of the Property and/or University Staff and act in an appropriate and civil manner. Failure to accurately identify oneself to staff or comply with staff requests and directives will result in disciplinary action.

ASSAULT, PHYSICAL ABUSE AND HARASSMENT Physical, verbal and other abusive behavior or threats toward residents, staff and other is forbidden. Threats of any kind, racial or sexual harassment, malicious pranks or abusive namecalling are not permitted and will not be tolerated. Such conduct may be grounds for immediate disciplinary action, removal from the property, and criminal prosecution. GAMBLING Gambling is prohibited on the property, including all apartments/suites, common areas and grounds. GUESTS You are welcome to have guests visit you at ULH, Inc. Your visitors must abide by the rules and regulations of ULH, Inc., just as you would. You are directly responsible for communicating these policies to your guests and are responsible for their actions (whether you are with them or not). Guests not complying with ULH, Inc. policies will be asked to leave. Guests can be denied permission to remain in the building or may be prohibited from future visits if he or she creates a disturbance or violates any rule or regulation. The underlying assumption in ULH, Inc. is that residents have the capacity and desire to be selfdirecting and responsible members of their community. Residents enter the community as young adults who are responsible to, and in search of, opportunities for development and learning. Your floor is yours to use but not abuse. You have the freedom to make it work for you, coupled with the responsibility to keep it working for others. We hope the above guidelines enable you to enjoy your community in a safe environment. INTERIM RESTRICTIONS OR REMOVAL The Community Manager or a designee may remove students from their residences and deny access to the residence for an interim period pending ULH, Inc./University disciplinary proceedings or medical evaluation. Interim restriction or removal occurs when the Community Manager determines, in consultation (when possible) with the Dean of Students Office, that there is evidence that the continued presence of the person(s) in his/her residence poses a substantial threat to the person, to others or to the safety, stability and continuance of normal residence hall functions or University property. Interim restriction or removal is effective upon informing the person. Resident(s) removed or restricted on an interim basis will be given an opportunity to appear personally before the Assistant Community Manager or a designee within five (5) business days from the notice of the effective date of the interim removal or restriction, in order to discuss only the following: -Reliability of the information concerning the resident s conduct, including the matter of students identity and/or -Whether the conduct and the surrounding circumstances reasonably indicate that the continued presence of the resident(s) poses a substantial threat to the student, to others, or to the stability of normal University or residence hall functions. Unless otherwise determined by the Community Manager or designee, such interim restriction or removal shall remain in effect until a disciplinary hearing is held and an outcome is determined. If a student is not found responsible for any violation of a policy infraction and is readmitted to housing, he/she may be entitled for a refund for the time period they were removed from the hall. Any refunds for the time period are not automatic, and will be determined on a case by case basis by the Community Manager.
