4 4 REGULATORY & COMPLIANCE PROGRAMS Preparing for OCR Audits February 14, 2012; 10:00 am 10:45 am Pilot audits have now been completed and OCR s contracted audit firm (KPMG) is charged with conducting 150 audits during OCR previously announced that audits would not just target large organizations or organizations that had complaints filed against them. This training is designed to help practices prepare for an OCR audit and what to expect when an auditor walks through the door. Overview of the OCR Audit Program & Contractor Requirements Consequences of Non-compliance Documentation: The first thing auditors ask for How to Prepare for an Audit Managing physicians, practice managers/administrators, legal counsel, privacy and security officers, risk managers, compliance officers, other relevant or key staff Be Prepared: Identity Theft & the Medical Practice February 29, 2012; 10:00 am 10:45 am Congress passed legislation at the end of 2010 that, for now, exempts medical practices (but not hospitals) from Red Flags Rule requirements. The legislation did leave the door open, however, to allow the Federal Trade Commission to require practices to comply with the Red Flags Rule in the future. Red Flags Rule aside, practices still need to take steps to reasonably ensure breaches do not happen in order to prevent identity and medical identity theft. This webinar will review the requirements of an identity theft protection program, and outline the implementation steps and Red Flags Rule requirements. Identity Theft Protection Requirements HIPAA Security Rule & Incident Response: How current requirements relate Risk Analysis Expanded Requirements Staff Training Steps to Implement an Identity Theft Protection Program What If the Red Flags Rule Applied to Medical Practices? Practice managers/administrators, legal counsel, privacy and security officers, risk managers, compliance officers Patient Rights & Gaps in the Medical Practice March 8, 2012; 10:00 am 10:45 am Have you ever made an appointment with a new provider, been asked to sign the Notice of Privacy Practices acknowledgement of receipt, but then not been given a copy? This is not as uncommon as practices may think. This webinar will review the HIPAA Privacy Rule and Oregon privacy statute-designated patient rights, and provide practices with the tools they need to reasonably ensure patients rights are honored. Overview of HIPAA Granted Patient Rights Overview of Oregon Statutory Patient Privacy Rights Common Gaps in Honoring Patient Rights Notice of Privacy Practices requirements Informed Consent, Consent & Authorization: What is required and what you can t ask of patients Right to View Patient Records (versus request a copy) Amendment Request Rights & Practice Responsibilities Templates: Patient Related Rights Documentation Physicians, practice managers/administrators, reception staff management, HIM managers and directors, legal counsel, privacy and security officers, risk managers, compliance officers, other relevant or key staff Risk Analysis & How to Conduct One March 14, 2012; 10:00 am 11:30 am A risk analysis is more than an examination of risks to your EHR, practice management system and forms of technology you use on a day-to-day basis. A risk analysis must cover risks that may impact your organization at all levels, including administrative, physical and technical risks to all PHI, critical business processes, etc. While the HIPAA Security Rule only focuses on electronic PHI, the HIPAA Privacy Rule includes language requiring you to protect PHI in any form. This webinar will review the HIPAA Security Rule and the Meaningful Use Rule risk analysis requirements. You will learn how to develop a plan to conduct your risk analysis on a periodic basis, inventory your assets, determine what can harm you and your patients, what controls you have implemented to protect you and your patients and what remaining risks need to be addressed. This includes prioritizing risks, developing mitigation plans and documenting risks that are acceptable to your organization.

5 5 REGULATORY & COMPLIANCE PROGRAMS Meaningful Use Rule Overview: Why a Risk Analysis? HIPAA Privacy and Security Rule Requirements Other Considerations Outside the Regulations Conducting a Risk Analysis 101 Mitigation Planning 101 Managing physicians, practice managers/administrators, legal counsel, privacy and security officers, risk managers, compliance officers, other relevant or key staff Patient Portals and Personal Health March 21, 2012; 10:00 am 10:45 am More and more medical practices offer their patients access to their personal health records (PHRs) through online patient portals. Doing this comes with legal and technical considerations. This webinar will review the technical and legal requirements related to offering patients access to EMRs and PHRs. Certain legal statements can deter patients from taking advantage of practice-offered patient portals and PHRs. PHRs & HITECH Requirements Technical Requirements: Protecting patient data The Line between Patient & Practice Responsibility related to Data Protection Legal Disclaimers: How to drive patients away Tips for Implementing or Managing Patient Portals & PHRs Social Media and the Medical Practice: Uses and Risks March 28, 2012; 10:00 am 11:30 am More and more practices are taking advantage of social media, like Facebook, Twitter and YouTube, to reach out to patients. Many practices are also using social media to inform the public of the types of services they offer. Often the risks associated with social media are not fully considered and can lead to significant breaches of patient health information, potential regulatory fines, damage to reputation and potential law suits. This webinar will review the social media tools available to practices, outline the risks associated with using social media, and provide participants with tools that will help them reduce those risks. What is Social Media? Review commonly used social media vehicles Social Media Risks: review the legal, technical and regulatory risks associated with social media Overview of key shortfalls associated with practices social media use Overview of effective social media programs Social media policy & procedure templates Social media program management & reducing risks Managing physicians, practice managers/administrators, legal counsel, privacy and security officers, risk managers, compliance officers, communication officers, prevention/outreach program management, other relevant or key staff Managing physicians, practice managers/administrators, legal counsel, privacy and security officers, risk managers, compliance officers, other relevant or key staff Take Advantage of the OMA s Education to Go Resources OMA offers recorded versions of some of our most popular educational programs, created specifically with busy physicians and their staff in mind.
