39 Flexibility for Co-Mingled Meals FNS allows a single menu flexibility when Pre-K and K-5 students are in the same service area at the same time (co-mingled) Co-mingled schools may: Choose to follow the gradeappropriate meals patterns for each grade group, OR Serve the K-5 meal pattern to both grade groups

41 What is a Waiver Request? A request for temporary regulatory relief from one or more Program requirement(s) Approvals are granted for a limited time period
42 Legislative Authority The NSLA gives the Secretary authority to waive Program requirements under certain conditions: Must support the purpose and intent of the Program Must not increase the overall cost of the Program If cost does increase, the additional cost must be paid from non-federal funds
43 Public Notice Requirement State or Program operator must provide notice and information to the public regarding the waiver Acceptable methods include: Posting notice on the State or Program operator s website Through an announcement in the local/state newspaper
44 Waiver Authority Limitations Waivers may not be granted for: Nutritional content of meals served Federal reimbursement rates Provision of free and reduced price meals Price charged for a reduced priced meal Sale of competitive foods and a variety of other topics.
45 Submitting a Waiver Request Program operators must submit waiver requests to the State agency States must submit waiver requests to the FNS Regional Office Should occur at least 60 calendar days prior to waiver implementation

September 30, SAs are to submit applications to the FNS Regional Office. December 31, USDA will announce the final set of awards.
