1 Proceedings of the 112 nd SEIAA meeting held on 28 th January 2016 at Room No. 709, M.S Building, Bangalore Confirmation of the proceedings of 111 th SEIAA Meeting held on 11 th January Proceedings of 111 th SEIAA Meeting held on 11 th January 2016 was read and as there were no comments the same was accepted Action Taken reports on the proceedings of 111 th SEIAA meeting held on 11 th January The Authority noted that the action is being taken on the proceedings of 111 th SEIAA meeting held on 11 th January Deferred Project: For Invite: Construction Projects: Residential Apartment at Survey No. 21/1 and 12, Chikkanagamangala Village, Sarjapura Hobli, Anekal Taluk, Bangalore Urban District of M/s. M.J.Infrastructure, (SEIAA 37 CON 2015) It is a proposal seeking Environmental Clearance for construction of Residential Apartment of 225 Units with BF + GF + 4 UF on a plot area of 14, Sq.mts and with total built up area of 34, Sqm. Total water requirement of project is KLD. The subject was discussed in the SEAC meeting held on 5 th & 6 th June 2015 and 17 th & 18 th August The Committee has recommended to SEIAA for issue of Environmental Clearance, with a condition that the proponent shall maintain more greenery on the mother earth and with the following observations: 1. The proposal is a low rise building having B+G+4UF only and the conceptual plan have been approved by the competent authority.

The proponent clarified that sufficient ventilation and lighting has already been provided by providing open to sky spaces wherever required in order to maintain the good ventilation and light. 3. NOC dated from the Village Panchayat for water supply has been submitted by the proponent and the water balance also calculated fresh water demand at the rate of 55 LPCD as per the norms prescribed for rural water supply and the scheme for meeting the additional requirement has been given. 4. Since the ground coverage is only 50%, there is a scope for providing more than 30% of the greenery on the mother earth. The Authority during the meeting held on 29 th August 2015 had perused the proposal and took note of the recommendation of The Authority noted that the following observations were raised during the 99 th SEIAA meeting held on 29 th June 2015: The Authority observed that the residential units are compactly arranged without adequate space for ventilation. The project does not have required recreational area and the greenbelt. The internal circulation roads are narrow and having varying width. The proposal do not have any proof assured source of water supply. The picturesque view of the drawing gives an indication of possible high level of indoor pollution in the proposed residential units. The Authority after discussion decided to get the following information for further considerations: 1. Modification in the conceptual plan keeping the observations of the Authority made on 29 th June Details of Recreation Ground Area. 3. Details of greenbelt with provision for at least 33% of the plot area. 4. Details of the internal circulation roads of at least 6m width and drive way of 8 m width. 5. Possibility of high level indoor pollution and the proposed modified plan for preventing indoor pollution. The Authority also decided to invite the proponent. The Authority during the meeting held on had perused the reply submitted by the proponent on The proponent appeared before the Authority and explained the proposal in brief. The Authority opined that the reply submitted vide letter dated is incomplete and do not address the issues raised by SEIAA completely. The proponent 2
3 sought for some time for submission of revised reply as directed by the Authority. The Authority after discussion decided to consider after the receipt of revised reply. The Authority also decided to invite the proponent. The Authority perused the reply submitted by the proponent on The proponent appeared before the Authority and explained the proposal in brief. The Authority after discussion decided to clear the proposal for issue of Environmental Clearance subject to submission of the following information: 1. Revised scaled layout plan clearly indicating entry/exit, STP/MSW treatment facility location and all other infrastructural facility including RG area. 2. Enhance RG Area to the required 15% and converting one flat area for recreational purpose, as committed. 3. Relocate STP. 4. Increase in the green belt area to at least 33% and if there is a space constraint, alternate provision for compensating the greenery. 5. Specific social commitment plan with budget, activity and timeframe Modification of High Rise commercial Building (Multiplex and Shopping Mall), Residential Apartments Project at Sy.No.2699/1, (old no.42 to 47, 10, 11, 12, 32), PID No of Hosakere Road, Binnypet, Ward No.121, Bangalore Urban District of M/s. Relationship Properties Pvt. Ltd., (SEIAA 134 CON 2015) This is a proposal seeking Environmental clearance for proposed modification for High-rise commercial building (Mall & Amenities) and residential Apartment on a total plot area of Sq.mts and with total Built up area of 7,56, Sq.mts. The proposed building under expansion and modification consists of residential apartment of 3484 units consisting 11 blocks, Mall with 2 Basement+ Ground Floor+ 5 Upper Floor + Terrace Floor and Amenity Centre with Basement+ Ground Floor+ 1 Upper Floor + Terrace Floor. Total water requirement is 3316 KLD. It is noted that the proposal had earlier obtained Environmental Clearance vide Environmental Clearance letter No. SEIAA 201 CON 2012 dated 19 th July 2013 for the expansion and modification of Mixed Use Development consisting residential apartments with 5 Towers & a premium tower having 2B + G + 19 UF + Terrace. Commercial building consists of club house, hotel in 2B + G + 8 UF + Terrace and mall in 2B + G + 5 UF + Terrace. The subject was discussed in the SEAC meeting held on 30 th September 2015 and 2 nd November The Committee has recommended to SEIAA for issue of Environmental Clearance. 3
4 The Authority during the meeting held on had perused the proposal and took note of the recommendation of The Authority noted that construction of block number 1, 2 and 3 have been undertaken and the rest are proposed to be modified. Even though there is a reduction in built up area from the earlier E.C., there is an increase in the height of the buildings in the proposed plan upto 41 m. Justification in this regard is required. The Authority after discussion decided to get the following information for further consideration: (1) Layout plan of the proposed project super imposed on the project already issued with Environmental Clearance. (2) Revised calculation for the water requirement and corresponding water balance chart along with design of the STP and equalization tank taking the peak flow into consideration. (3) Explore the possibility of providing block-wise STP for decentralized sewage treatment and utilization of the treated water. (4) Revised layout plan to the scale clearly indicating all the infrastructure facilities and the proposed construction activity. (5) Real time traffic study report. (6) Details of the developments in the neighbourhood such as other developmental projects, infrastructural facilities, commercial establishments, road, railway line, etc in a radius of 3 Kms along with the sloping pattern. (7) Revised parking calculations based on the requirement as per MoEF, BHK norms and BBMP norms providing for the maximum of the above requirements and parking plan for corresponding number of vehicles. (8) Proposal to enhance energy savings to at least 25%. (9) Details of Recreational Ground Area with total percentage to the plot area. (10) Compliance on the earlier E.C. The Authority also decided to invite the proponent. The Authority during the meeting held on 17 th December 2015 had perused the reply submitted by the proponent. The proponent appeared before the Authority and explained the proposal in brief. The Authority noted that the proponent have already undertaken construction activity in violation of the provisions of EIA Notification, The construction activity that have been undertaken is not in accordance with the proposal approved vide the Environmental Clearance letter No. SEIAA 201 CON 2012 dated 19 th July The Authority therefore directed the proponent to stop the construction activity with immediate effect. 4
5 The Authority after discussion took the following decisions: (1) Issue the following directions under section 5 of the Environment (Protection) Act, 1986 to the proponent: (a) To suspend the construction activity of the above said project with immediate effect at the existing level till the Environmental Clearance is obtained. (b) To submit details regarding present level of construction along with latest dated photographs. (c) To show cause why action should not be initiated against you for the violation (2) Get the mahazar of the project site done to establish the violation. (3) Filing a complaint before the jurisdictional court for the violation under section 19 of the Environment (Protection) Act, The Scientific Officer, SEIAA is authorized for filing complaint on behalf of the Authority. (4) To consider the proposal after filing of the complaint and receipt of the information sought. Accordingly, the direction has been issued on The Authority perused the reply dated and the report of the mahazar conducted on The proponent was invited as per the request made in their letter dated The proponent appeared before the Authority and explained the proposal in brief. The proponent informed the Authority that out of 11 towers proposed as per the modified plan, construction of only three floors have been undertaken as per the approved plan. The Authority further noted that total plinth area of Tower 1, Tower 2 and Tower 3 as per the plan produced for Environmental Clearance issued on 19 th July 2013, whereas the plinth area of the said Towers as per the modified plan submitted for the Environmental Clearance is Sqm only which is less than the approved area. The proponent further informed that in Tower 1, out of 2 Basement, Ground and 18 Upper Floors approved, presently 2 Basement, Ground and 5 Upper Floors are completed and the 6 th Floor is in progress. In Tower 2, out of 2 Basement, Ground and 18 Upper Floors approved, presently 2 Basement, Ground and 5 Upper Floors are completed and the 6 th Floor is in progress and in Tower 3, 2 Basement, Ground and 18 Upper Floors approved, presently 2 Basement, Ground and 3 Upper Floors are completed and the 4 th Floor is in progress. The proponent therefore asserted that they have not exceeded the construction approved in the Environmental Clearance letter dated 19 th July 2013 and therefore it should not be treated as a case of violation. The 5
6 proponent while responding to a query with regard to change in the location of the said towers informed the Authority that two Towers (Tower1 and Tower 3) are started in the same location as approved and only location of Tower-2 is slightly shifted towards eastern side to accommodate parks and open spaces as per BDA norms at the western end of the project site. The Authority after discussion opined that the construction undertaken is not in violation of the provisions of EIA Notification, 2006 as the proponent hold a valid Environmental Clearance. The Authority therefore decided not to treat this as a case of violation and to drop the proposed action under E (P) Act. The Authority further decided to issue Environmental Clearance as per the recommendation made by the SEAC, subject to submission of the following information: 1) Ways and means of utilization of excess treated water proposed to be let into the sewer line including exploring the possibility of providing a detention pond. 2) Revised parking calculations based on the requirement as per MoEF, BHK norms and BBMP norms providing for the maximum of the above requirements. 3) Neighbourhood details of the proposed project site. 4) Details of Recreational Ground area with at least 15% of the plot area. 5) Specific social commitment plan with budget, activity and timeframe For further consideration: Residential Development, Sy. Nos. 80, 2/1, 2/2, 2/3, 54/1B, 54/1A, 79/4, Rachenahalli Village, K.R.Puram Hobli, Bangalore East Taluk, Bangalore Urban District of M/s. Mantri Technology Constellations Pvt. Ltd (SEIAA 50 CON 2013) It is a proposal seeking Environmental Clearance for proposed residential development Mantri Sun3 project of 1273 flats on a Plot Area of 47, Sqm and with the total Built Up Area of 1,96, Sqm. The Authority noted that the SEAC during the 102 nd SEAC meeting held on 26 th & 27 th April 2013 have decided to issue model ToRs along with the additional TORs for the preparation of EIA by the project proponent. Accordingly the ToR was issued on The proponents have submitted the EIA report on The subject was discussed in the SEAC meeting held on 11 th & 12 th August 2014, 30 th & 31 st March 2015, 13 th July 2015, 23 rd September 2015 and 7 th October The Committee has recommended for issue of environmental clearance, after appraising the proposal along with the EIA report. 6
7 The Authority during the meeting held on had perused the proposal and took note of the recommendation of The Authority after discussion decided to get the following information for further consideration: (1) Clarification as to why action should not be taken for the discrepancies in the EIA report as observed by (2) Revised scaled layout plan duly indicating entry, exit, STP/MSW treatment facility location and all other infrastructural facility. (3) Project configuration with drawing. (4) Water audit for the project along with water balance chart for the monsoon and non-monsoon season. (5) Details of excavated Earth and plan for safe disposal of excess excavated earth with details of site proposed for disposal. (6) Justification for utilization of entire organic waste generated in the project with due calculations. (7) Details of green belt development with at least 33% of the plot area. The Authority also decided to invite the proponent. The Authority during the meeting held on 11 th January 2016 had perused the reply submitted by the proponent vide letter dated The proponent appeared before the Authority and explained the proposal in brief. The Authority opined that the clarification furnished by the proponent with regard to discrepancies in the EIA report is not convincing. The Authority therefore decided to reconsider the proposal during the next meeting with a detailed scrutiny of EIA report submitted by the proponent earlier and the present EIA report in the office. The proponent was advised by the Authority to submit the lab reports pertaining to the baseline data collection undertaken for preparation of the latest EIA report. The Authority perused the reply submitted by the proponent vide letter dated The Authority after discussion decided to get explanation for the discrepancies such as building configuration, baseline data, projected impact on the environmental parameters, etc in the EIA report submitted. The Authority also decided to invite the proponent for furnishing clarification. 7
8 Proposed Residential Project Sumadhura Soham at Khata No. 1791, Sy. No. 147/2, 148/1, Pattandur Agrahara Village, Bangalore East Taluk, Bangalore of Sri. Milind S. Thakker, No. 43, CKB Plaza, 2nd Floor, Varthur Main Road, Marathahalli, Bangalore. (SEIAA 169 CON 2015) This is a proposal seeking Environmental clearance for Development of Residential apartment of 299 units with B + GF +4UF+Terrace, on a total Plot area of 16, Sq.mts and with total Built up area of 49, Sq.mts. Total water requirement is 174 KLD. The subject was discussed in the SEAC meeting held on 17 th November The Committee has recommended to SEIAA for issue of Environmental Clearance, subject to submission of the following information: 1. Requisition letter given to BWSSB 2. Corrected FAR after considering TDR. The Authority during the meeting held on had perused the proposal and took note of the recommendation of SEAC along with the reply submitted by the proponent vide letter dated The Authority after discussion decided to get the following information for further consideration: 1) Revised scaled layout plan in metric units clearly indicating entry, exit, location of municipal solid waste management facility, STP, internal circulation, etc. 2) Details of Recreational Ground area. 3) Details of green belt with at least 33% of the plot area. 4) Revised water calculation and corresponding water balance chart. 5) Revised quantification of MSW as per standards and the corresponding management plan. 6) Rain water harvesting as per CGWA norms. The Authority perused the reply submitted by the proponent vide letter dated The Authority opined that the point-wise information furnished are incorrect and not satisfactory. The Authority therefore decided to direct the proponent to submit the following information for further consideration: 1) Layout plan on the scaled drawing with all the details such as entry/exit, internal road and other infrastructural facilities. 2) Width of the internal circulation road. 8
9 3) Details of Recreational Ground area with at least 15% of the plot area "Bren Edge Water", Residential apartments at Sy. No.33/1 and 33/2, Haralur Village and Sy.No.30/8B, Kasavanahalli village, Varthur Hobli, Bangalore East, Bangalore of M/s. Bren Corporation, (SEIAA 11 CON 2015) It is a proposal seeking Environmental Clearance for Construction of "Bren Edge Water", Residential Apartments of 308 Flats with Basement + GF + 13 UF + TF on a plot area of Sq.mts and with total built up area of Sq.mts. Total water requirement of project is 208 KLD. The subject was discussed in the SEAC meeting held on 19 th and 20 th March The Committee has recommended for issue of environmental clearance, subject to submission of the following information. 1. Revised hydrological study of the area influencing the surface water flow duly marking the ridges. 2. Lake water quality analysis report. The Authority during the meeting held on had perused the proposal and took note of the recommendation of The Authority further noted that the project authorities are alleged to have undertaken earth work and have caused inconvenience to the local people due to unscientific way of handling the excavated earth. The Authority therefore decided to consider the proposal after getting details on the said allegation. The Authority perused the reply submitted by the proponent vide letter dated The Authority noted that the proponent have informed that the earthwork referred to above is because of the works undertaken for construction of compound wall and site leveling/soil testing. The proponent have submitted an undertaking that the earthwork will be done in scientific way and ensure that it will not cause any inconvenience to the surrounding people. The Authority after discussion decided to clear the proposal for issue of Environmental Clearance subject to submission of the following information: 1) Revised parking calculations based on the requirement as per MoEF, BHK norms and BBMP norms providing for the maximum of the above requirements. 2) Specific social commitment plan with budget, activity and timeframe. 9
10 Residential Apartment at Sy. No. 103/1, Khatha No.216, Doddatogur Village, Begur Hobli, Bengaluru South Taluk, Bengaluru Urban District of M/s Sree & Sree Builders & Promoters (SEIAA 94 CON 2015) It is a proposal seeking Environmental Clearance for construction of Residential Apartment of 351 units with Basement+Ground Floor+11 Upper Floor on a plot area of 17, Sq.mts (karab area = Sq.m) and with total built up area of 54, Sqm. Total water requirement of project is 237 KLD. The subject was discussed in the SEAC meeting held on 4 th September The Committee has recommended to SEIAA for issue of Environmental Clearance, subject to submission of the following information. 1. Scientific assessment of the availability of the water from the bore well in the project site 2. Revised water balance calculating fresh water demand at the rate of 55 LPCD as per the norms prescribed for rural water supply and the scheme for meeting the additional requirement 3. Revised rain water harvesting calculations 4. Proposal to provide an underpass to connect the other side of the project site. The Authority during the meeting held on 26 th September 2015 had perused the proposal and took note of the recommendation of The Authority observed that the parcel of land in Part-2 is not of any practical use or beneficial to the project activities, as it is bifurcated by a public road and the entire activity is concentrated on the land in Part-1 The Authority after discussion decided to get the following information, in addition to information sought by SEAC for further consideration: 1. Revised layout plan exclusively for the land in Part-1 without considering the land in Part Details of Kharab land duly marking it on layout plan. 3. Revised land-use plan such as ground coverage, park & open spaces, greenbelt, parking area, etc. with respect to Part-1 only. 4. Source of water and NOC from the competent authority. 5. Enhance energy savings to at least 25%. 6. Revised quantification of MSW as per the standards. 7. Revised water balance with due emphasis for utilization of the treated water. 8. Design of rainwater harvesting pit as per CGWA norms. The Authority also decided to invite the proponent. 10
11 [ 112 th SEIAA Meeting Proceedings Dated 28 th January 2016 The Authority during the meeting held on had perused the reply submitted by the proponent vide letter dated The proponent appeared before the Authority and explained the proposal in brief. The Authority observed that the drawing submitted is not to the scale, the land in the Part -2 of the project site is deducted, but the activities in the land in Part-1 remains unchanged. In view of this, the activities proposed are disproportionate to the available area and therefore required lung space and other amenities cannot be accommodated as per norms. The Authority therefore advised the proponent to submit revised plan designed as per norms. The proponent requested for an opportunity to submit the revised plan and other required information. The Authority therefore decided to reconsider the proposal after the receipt of revised drawing and other relevant information from the proponent. The Authority perused the reply submitted by the proponent vide letter dated The Authority after discussion decided to clear the proposal for issue of Environmental Clearance subject to submission of the following information: 1) Justification for the higher density of occupancy in the proposed built up area. 2) Specific social commitment plan with budget, activity and timeframe Expansion of Residential building Project at Survey Nos.22, 23 & 24 of Chandrashekarpura Village & Sy. No. 50/2(P) of Yellenahalli Village, Begur Hobli, Bangalore South Taluk, Bangalore Urban District of M/s. Nandi Housing Pvt. Ltd., # 48, 36 th Main Road, BTM Dollars Scheme, Bangalore (SEIAA 147 CON 2015) It is a proposal seeking Environmental clearance for expansion of Residential Building Project from 672 units with BF+GF+4UF to 851 units with BF+GF+4 UF on a plot area of Sq.mtr and with the total Built up area of 1,19, Sq.mtr (additional Sq.mtr). Total water requirement is 574 KLD. The proponent obtained EC from MoEF vide No: /2006-IA.III dated The subject was discussed in the SEAC meeting held on 20 th October The Committee has recommended to SEIAA for issue of Environmental Clearance, after the submission of the following information. 1. Detailed Hydrological study of the influencing the area 2. Details of the adjoining lake. The Authority during the meeting held on had perused the proposal and took note of the recommendation of 11
12 The Authority noted that Environmental Clearance for the ongoing project has been issued on by the Ministry of Environment and Forests, Government of India. Validity of the Environmental Clearance as specified by the MoEF is only 7 years. The proponent have submitted the application for the modification of the Environmental Clearance on i.e., after the expiry of validity period of the Environmental Clearance. The Authority after discussion decided to get the following information in addition to the information sought by SEAC for further consideration: (1) Present level of construction undertaken as per the earlier Environmental Clearance issued by the Ministry of Environment and Forests, Government of India. (2) Details of constructions that has already been completed and the proposed with a comparative statement. (3) Justification with regard to addition of 179 units with 48,176.1 Sqm built up area, when the plot area and the configuration of the building remains the same. (4) Details of Recreational Ground Area with total percentage to the plot area. (5) Revised parking calculations based on the requirement as per MoEF, BHK norms and BBMP norms providing for the maximum of the above requirements. (6) Revised greenbelt development plan with at least 33% of the plot area. (7) Rain water harvesting plan as per the CGWA norms. (8) Location of STP, solid waste management facility and other infrastructure facilities duly indicating on layout plan. (9) Revised scaled layout plan super imposing the proposed activity on the earlier plan. (10) Revised design of the equalization tank taking peak hour flow into consideration. The Authority also decided to invite the proponent. The Authority during the meeting held on 11 th January 2016 had perused the reply submitted by the proponent vide letter dated The proponent appeared before the Authority and explained the proposal in brief. The Authority noted that Environmental Clearance has been issued for this project by the Ministry of Environment and Forests, Government of India on 21 st February Therefore the validity of the E.C. which is now revised to seven years is lapsed and the proponent have not got it extended following the due procedure of law. The proponent informed that the said Environmental Clearance has been issued in accordance with the provisions of EIA Notification, 1994 and no validity period is mentioned in the E.C. letter. Therefore, seeking extension of validity was not felt 12
13 necessary. Now the proponent is before the Authority for expansion of the project by undertaking additional construction in the vacant land reserved for future expansion. The Authority after discussion decided to take up the proposal for further consideration after ascertaining the statutory position with regard to validity of E.C. issued under EIA Notification, It is ascertained from the available records that the Environmental Clearance letter No /2006-IA.III dated issued by the erstwhile Ministry of Environment and Forests in favour of M/s Nandi Housing Pvt. Ltd. has been issued under EIA Notification, As per Notification No. S.O. 356 dated 4/5/1994 read with Notification No. S.O.2555(E) dated 21 st August 2013, validity of the Environmental Clearance is for a period of five years for commencement of the construction or operation. The Authority while examining the proposal sought to know whether the construction activity has been started well within the validity period or not. The Authority therefore decided to get authentic documents if any to convince the Authority that the construction activity has been started as per the provisions of the EIA Notification, 1994 and the amendments made thereon. The Authority therefore decided to consider the proposal after the receipt of the aforesaid document. Mining Projects: Building Stone Quarry Project, Sy.No.179/1A of Pajeer Village, Bantwal Taluk, Dakshina Kannada Dist. (1-0 Acre) (QL No.63) of Sri Dinakar Ullal (SEIAA 1108 MIN 2015) This is a Renewal proposal seeking Environmental clearance for quarrying of Building Stone in 1-00 Acres, Government Land. The subject was discussed in the SEAC meeting held on 19 th October The committee observed that based on the elevation of the quarry site above ground level (Difference in level m), depth proposed is 9 m, area of quarrying (as per land use plan), and with the available area, it is not possible to go that depth, because lifting of quarrying material from that depth & movement of vehicles will be very difficult. Also the committee observed that already mining has been done in the proposed quarry area. Though it is a patta land, without obtaining EC, doing mining is violation of EIA Notification The Committee after discussion decided to limit the production to 70%(Restricting the depth of mining to 10m) of the total estimated production keeping the minable area quantity and the sustainability of the mine in the mind and decided to recommend the proposal to SEIAA for issue of Environmental Clearance. 13
14 The Authority during the meeting held on had perused the proposal and took note of the recommendation of The Authority after discussion decided to get a clarification from the proponent with regard to the violation noted for further consideration. The Authority perused the reply submitted by the proponent vide letter dated The Authority noted that it is a renewal quarry with a validity of 5 years as per the Notification dated extraction of building stone limiting the production to 70%(Restricting the depth of mining to 10m) of the proposed production, as recommended by Fresh Projects: Mining Projects: Building Stone Quarry Project of Sy.No.122/3K/2 of Ainapur Village, Bijapur Taluk & Dist. (2-0 Acres) of Sri Vivekananda Virappa Gunari, Neelaganagai, Plot No.77, Aishwarya Nagar, Bijapur District. (SEIAA 385 MIN 2015) This is a renewal proposal seeking Environmental clearance for quarrying of Building stone in 2-00 Acres, Patta Land.
