1 The BB&T Create a Caption Challenge Official Rules NO PURCHASE NECESSARY TO ENTER, PLAY, OR WIN. A PURCHASE WILL NOT IMPROVE YOUR ODDS OF WINNING. The BB&T Create a Caption Challenge (the Challenge ) is sponsored by Branch Banking and Trust Company, ( Sponsor ). By participating in the Challenge you agree to be bound by applicable laws and these Official Rules. The Challenge is not sponsored, endorsed or administered by, or associated with Facebook. By entering, you understand that you are providing your Challenge-related information to the Sponsor and not to Facebook and all inquiries related to the Challenge should be directed to the Sponsor, not Facebook. Eligibility: The Challenge is open only to legal residents of Alabama, Florida, Georgia, Indiana, Kentucky, Maryland, North Carolina, South Carolina, Tennessee, Texas, Virginia, West Virginia, and Washington, D.C., who are 18 years of age or older at time of entry, are Facebook users, and connected to ( Like ) the BB&T page on Facebook at time of entry and throughout the Challenge period. Void where taxed, restricted, or prohibited by law. Employees of Sponsor,Votigo Inc. ( Votigo) and their affiliates, sales representatives, retailers, distributors, and other vendor agencies involved in this promotion, and the households and immediate family members (parent, spouse, child, sibling) of such employees, are not eligible to enter or win. The Challenge is subject to all federal, state, and local laws and regulations. Challenge Entry & Timing: During the Challenge fans will be asked fans to submit a caption for a football-related image. The image will be revealed on the date noted in the Challenge Start column below. All captions will be eligible for fan vote from the time Sponsor approves them until close of submission period, 11:59 pm on the closing date (noted in the Challenge End column). One Grand Prize Winner, one Runner Up Winners and three Honorable Mention Winners will be announced the day after voting closes (dates noted in the Winner Notification column). If an entrant does not already Like the Page, the entrant must Like the Page and allow Facebook permission to gain access to the Challenge. Following the on-screen instructions, the entrant must provide all required information requested on the Official Entry Form, including a valid address, complete name (first and last name, no initials), state of residence and telephone number. To be considered eligible for prizes, completed entries must be entered electronically (with all information required for Challenge eligibility and administration purposes), submitted through the Challenge app on Facebook and received by 11:59 pm ET on the date noted in the Challenge End column in the chart above. No other methods of entry will be accepted.
2 Regardless of the number of entries submitted, each entrant is only eligible to win one (1) prize in this Challenge. All entries become the sole property of the Sponsor. Entries generated by automated means are void. If it is discovered that an entrant has registered or attempted to register or enter using multiple addresses, Facebook accounts or multiple identities, all of that entrant s entries will be declared null and void and any prize he/she might have been entitled to will not be awarded. Entry Guidelines: All Entries must conform to the Entry Guidelines below, be in good taste and in keeping with Sponsor s image as determined by Sponsor in their sole discretion. By submitting, uploading, posting, disclosing or otherwise making an entry available in this Challenge, each entrant warrants and represents he/she has the legal right and necessary permission(s) to do so; he/she is the sole and exclusive owner and rights holder of his/her entry; and his/her Entry conforms to the following guidelines: Must have been prepared for this Challenge and must not have been previously submitted in any competition and/or won an award or prize. Must not contain any material or any element that is unlawful or otherwise in violation of any law, rule or regulation. Must not contain any element or material that (except as expressly permitted in these rules), violates any other rights of a third party, including but not limited to patents, trade secrets, licensing rights, rights of publicity or privacy or any other intellectual property rights. Must demonstrate Challenge-appropriate content by supplying a caption relevant to the image provided. Must be family-friendly. Must not contain references to alcohol or illegal substances. Must not contain material or language that in the Sponsor s sole discretion is inappropriate, indecent, profane, obscene, tortuous, defamatory, harassing, harmful, slanderous, libelous, disparaging, or that is ethnically objectionable, or promotes bigotry, racism, hatred, harm or discrimination against any group, individual, or entity. Must adhere to Facebook Terms of Service. By participating in the Challenge, each entrant irrevocably grants to Sponsor and its affiliates, promotional partners, developers, and third party marketing entities a non-exclusive, perpetual, worldwide, royalty-free license to use, modify, rearrange, copy, reproduce the content for product web pages and marketing materials or for other purposes, and to publish and use the content, including any names, locations, and likenesses, in any and all media throughout the world and in any manner without further review, notice, approval, consideration or compensation. By participating in the Challenge, each entrant accepts and agrees that Sponsor in its sole discretion, may refuse an entry, remove an entry from the public viewing/voting gallery on the site, adapt or otherwise make changes to an entry and disqualify an entrant from the Challenge if they believe an entry fails to conform to the Entry Guidelines or is otherwise not in compliance with these Official Rules. Entrant agrees to indemnify and hold Sponsor and its affiliates, promotional partners, developers, and third party marketing entities from and against any and all liability, loss, damage, or judgments that any of the foregoing may suffer by reason of any failure of entrant to conform to these Challenge rules and guidelines, including but not limited to the infringement of any third party s intellectual property rights or the failure to obtain any required license, waiver, consent, or permission. 2
3 Submission and Voting: Entries must be uploaded via the Challenge app and will be reviewed by the Sponsor prior to being made public. Entries that comply with the Entry Guidelines will be pushed live within 24 hours of submission. Entries that do not comply with the Entry Guidelines will be denied. All Entries approved and published during the submission period will be eligible for public vote. Voting begins as soon as the first entry is approved after the question for each new Entry Period is announced and concludes at 11:59 pm ET on the dates noted in the Challenge End column in the chart above. Registered fans have the ability to cast one vote per caption per day of the Challenge period. The entry receiving the most fan votes at the close of the Challenge period for each round will be named the Grand Prize Winner. The entries receiving the second number of fan votes will be named the Runner Up Prize Winners. The entries receiving the third, fourth and fifth-highest number of fan votes will be named the Honorable Mention Prize Winners. The entries receiving the highest and second highest number of fan votes will appear on-field at the ACC Football Championship Game, in Charlotte, N.C., December 7, 2013, to compete in a corn hole game. The winner of the on-field game will be named the Corn Hole Winner. All prize winners are final and binding and subject to these Official Rules. In the event a winning Challenge entry is discovered to be invalid for any reason whatsoever or the person who submitted the winning Challenge entry fails to comply with these Official Rules prior to delivery of the prize, the prize may be forfeited and awarded to an alternate winner. Winner Selection and Notification: All winners will be notified within 24 hours of the close of the Challenge period by phone or an sent to the address specified at the time of entry. The prizes are not transferable; no prize substitutions are allowed except as may be determined by Sponsor in its sole discretion. The potential prize winners (parent or legal guardian if potential prize winner is a minor in his/her state of residence) must complete, sign and return an Affidavit of Eligibility, Publicity Release, Mutually Acceptable Liability Release, and any other necessary documents. If the Affidavit of Eligibility, Publicity Release, Mutually Acceptable Liability Release and any other necessary documents are not returned within seven (7) calendar days after the event, the prize will be forfeited in its entirety and the prize will not be awarded. Prizes: A total of six (6) prizes will be awarded in this Challenge. Total aggregate approximate retail value (ARV) of all prizes in this Challenge up to $1,002 USD. One (1) Grand Prize One (1) Grand Prize Winner will receive six (6) tickets to the ACC Football Championship in Charlotte, N.C., December 7, 2013 and an opportunity to compete in an on-field corn hole game. 4 Three (3) Honorable Mention Prize Packages Three (3) Honorable Mention Winners will receive two (2) tickets to the ACC Football Championship in Charlotte, N.C., December 7, ARV: $90.00 USD each. One (1) Corn Hole Prize Package One (1) Corn Hole Winner will receive $250 and an ACC football signed by the ACC coaches. ARV: $ USD Odds of Winning: The odds of winning depend upon the number of eligible entries received during each Entry Period. Online Registration: If for any reason the Challenge is not capable of running as planned, including disruptions caused by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other cause that corrupts, affects or compromises the administration, security, fairness, integrity, proper conduct or intended play of the Challenge, Sponsor reserves the right at its sole discretion to disqualify any individual it deems responsible and further reserves the right to cancel, terminate, modify or suspend the Challenge, with appropriate alternate method of prize award selected. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications failure, theft, destruction or unauthorized access to, or alteration of, entries, including any erroneous appearance of qualification for a prize. Sponsor is not responsible for any problem or technical malfunction of any telephone network or lines, computer online systems, servers or provider, computer equipment, software, failure of any or entry to be received by Sponsor due to technical problem or traffic, congestion on the Internet or at any website, or any combination thereof, including any injury or damage to Entrant s or any other person's computer related to or resulting from participation or downloading any materials in this Challenge. Sponsor is not responsible for incorrect or inaccurate entry information whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Challenge or by any technical or human error that may occur in the processing of the entries. WARNING: ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS CHALLENGE IS A VIOLATION OF LAW AND SHOULD SUCH ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED. Challenge entries generated by a script, macro or other mechanical or automated means are ineligible and will be disqualified. All entries must include a valid address for the entrant. In the event of dispute as to the identity or eligibility of a winner based on an address, the winning entry will be declared made by the Authorized Account Holder of the address submitted at the time of the entry. The Authorized Account Holder is the person to whom the applicable Internet service provider or other organization (such as business or educational institution) has assigned the addresses for the domain associated with the submitted address. Not an Offer or Contract of Employment: Under no circumstances shall participation in this Challenge, the submission of an entry, awarding of a prize or anything in these Official Rules be construed as an offer or contract of employment with either the Sponsor. Additional Terms: By entering, entrant agrees to accept and abide by the rules of the Challenge and agrees that any dispute with regard to the conduct of this Challenge, rule interpretation or award of prize, shall be resolved by Sponsor, whose decision shall be binding and final.
