2 July 25, 2011 To: From: Subject: Members of the Board of Directors Will Kempton, Chief Executive Officer Agreement for Construction of the Placentia Avenue Railroad Overview On February 28, 2011, the Orange County Transportation Authority Board of Directors authorized the issuance of an invitation for bids for the construction of the Placentia Avenue Railroad. Bids were received in accordance with the Orange County Transportation Authority s public works procurement procedures. Board of Directors approval is requested to execute the agreement. Recommendation Authorize the Chief Executive Officer to execute Agreement No. C between the Orange County Transportation Authority and Flatiron West, Inc., the lowest responsive, responsible bidder, in an amount not to exceed $23,769,540, for construction of the Placentia Avenue Railroad Grade Separation Project. Discussion The Placentia Avenue Railroad (Project) is located between Crowther Avenue and Fender Avenue, in the cities of Fullerton and Placentia. The tracks, which are being separated from the roadway, are used daily for Burlington Northern Santa Fe (BNSF) Railway freight transportation and by Metrolink and Amtrak passenger rail services. This is the first of seven grade separation projects along the BNSF/Orangethorpe Corridor being constructed in the OC Bridges program. The proposed Project consists of lowering the Placentia Avenue roadway under the BNSF tracks to provide a grade separated crossing. Construction of bypass tracks and a temporary detour road are necessary to construct the Project. The Project scope also includes work at adjoining streets and commercial driveways, and a storm drain pump station. 3 Page 2 two lanes of traffic operating in both directions on a temporary roadway to the east of the current street. The Orange County Transportation Authority (OCTA) will be responsible for the construction and construction management of this project. Upon completion, the Project will be turned over to the cities of Fullerton and Placentia for maintenance under Cooperative Agreement Nos. C and C , respectively. Procurement Approach This procurement was handled in accordance with OCTA s procedures for public works and construction projects which conform to state requirements. Public works projects are handled as sealed bids and award is made to the lowest responsive, responsible bidder. Invitation for Bids (IFB) was released on March 17, 2011, and posted on CAMM NET with electronic notification being sent to 2,633 firms. The Project was advertised on March 30 and April 25, 2011, in a newspaper of general circulation. A pre-bid conference was held on April 26, 2011, and was attended by 17 firms. Five addenda were issued to update drawings, replace exhibits, provide the list of attendees at the pre-bid conference, and to respond to questions related to the IFB. On May 24, 2011, ten bids were received and publicly opened. All bids were reviewed by staff from OCTA s Contracts Administration and Materials Management and Highway Programs departments to ensure compliance with the terms and conditions, specifications, and drawings. The recommended firm s bid is 30.5 percent below the engineer s estimate and is considered by staff to be fair and reasonable. State law requires award to the lowest responsive, responsible bidder. As such, staff recommends award of the contract for construction of the Project to Flatiron West, Inc., the lowest responsive, responsible bidder, in an amount not to exceed $23,769,540. Fiscal Impact The project was approved in OCTA s Fiscal Year Budget, Capital Programs Division, Account SO203-PPJ, and is funded with a combination of Proposition 1B Trade Corridors Improvement Fund and Measure M2 (Project O) Funds.
