1 Undertakings bank rivate () Notes Case examiners are referred to the case to answer guidance. Case examiners must always make sure that undertakings are suitable for the particular circumstances of a case. These undertakings are split into four separate sections A to D to help case examiners in choosing the most appropriate undertakings. Normally a set of undertakings will address each of the four sections and follow the format set out in this document. However, where necessary case examiners should tailor undertakings to meet specific situations. Further explanation and help is provided in this column. age 1 of 8

Sharing information with the right people at the right time Undertakings 1-4 should always be part of a set of undertakings. 1. Keeping us informed about where you are working by: a. telling us within seven days of accepting any nursing or midwifery appointments and providing us with contact details of the employer. b. telling us within seven days when you leave or stop working for an employer. c. giving us the name and contact details of the individual or organisation offering the post, employment or course of study within seven days of accepting any post or employment requiring registration with us, or any course of study connected with nursing or midwifery. d. giving us the name and contact details of the individual or organisation within seven days of entering into any arrangements required by these undertakings. 2. Immediately telling the following parties that you have agreed to these undertakings under the NMC fitness to practise procedures, and disclosing the undertakings to them: a. any organisation or person employing, contracting with, or using you to undertake nursing or midwifery work. b. any agency you are registered with or apply to be registered with (at the time of application) to provide nursing or midwifery services. c. any prospective employer (at the time of application) where you are applying for any nursing or midwifery appointment. d. any educational establishment where you are undertaking a course of study connected with nursing or midwifery, or any such establishment to which you apply to take such a course (at the time of application). Seven calendar days is the expected timeframe however the case examiners may vary this depending upon circumstances. The arrangements referred to in 1b will include arrangements for clinical or health supervision. This undertaking is connected to nursing and midwifery employment or educational study. If case examiners consider disclosure of the undertakings to other employers or organisations is required (such as posts in a healthcare setting) then they can impose a separate tailored undertaking to address this. Any tailored undertaking must be relevant, proportionate, workable and measurable. age 2 of 8

Telling us about any clinical incidents you are involved in, any investigations started against you and/or any disciplinary proceedings taken against you within seven days of you being made aware of them. Seven days is the expected timeframe however the case examiners may vary this depending upon circumstances. 4. Allowing us to share, as necessary, information about the standard of your performance, your compliance with and progress towards completing these undertakings with [X] and any employer, prospective employer, any educational establishment and any other person who is or will be involved in your retraining and supervision. 5. (rivate) Informing: [delete as applicable] a. your general practitioner b. your consultant psychiatrist c. your occupational health practitioner(s) d. any other registered medical practitioner or therapist responsible for your care that you have agreed to these undertakings under our fitness to practise procedures, and disclosing the undertakings to them. 6. (rivate) Allowing: [delete as applicable] a. your general practitioner b. your consultant psychiatrist c. your occupational health practitioner(s) d. any other registered medical practitioner or therapist responsible for your care to share information about your health, treatment, and compliance with these undertakings with us and with each other. age 3 of 8
4 B. Stopping or restricting something while things are put right 7. Confining your [nursing/midwifery] practice to [X]. Case examiners to specify a particular employer, hospital or ward within the hospital or more generally such as setting, nonacute areas, day duties, research posts, NHS posts. 8. lacing yourself and remaining under the supervision of [X] any time you are employed or otherwise providing nursing or midwifery services and making sure that such supervision consists of [List] Case examiners to define level and nature of supervision, for example: Working at all times under the direct observation of a registered nurse of band 6 or above. Working at all times on the same shift as, but not necessarily under the direct observation of, a registered nurse of band 6 or above who is physically present in or on the same ward, unit, floor or home that you are working in or on. Weekly meetings to discuss your clinical caseload. This list is not exhaustive. 9. Not to [X] unless supervised by [Y] (except in life threatening emergencies). Such supervision will consist of particular procedure, the age 4 of 8
5 [List] name/rank of the person who can supervise (for example your line manager, mentor, supervisor, a registered nurse of band 6 or above, Sister Jane Smith etc.) and the extent of the supervision (for example being observed while carrying out the procedure). 10. (rivate) Keeping your nursing or midwifery commitments under review and immediately limiting your practice or stopping practising in line with advice from [delete as applicable] a. your general practitioner b. your consultant psychiatrist c. your occupational health practitioner(s) d. any other registered medical practitioner or therapist responsible for your care. 11. (rivate) Abstaining from the consumption of [X]. The course must be assessed, not simply completed through attendance. This should always be age 5 of 8
6 accompanied by an undertaking that demonstrates safe practice in the area of concern through the practical application of the learning. time periods. 13. Keeping and providing us with a copy of a personal development log [every/by] [X]. The log will record every time you have undertaken [Y] which must be witnessed and signed by [Z] and contain their comments on how you carried out the procedure(s) including dates. 14. Keeping and providing us with a copy of a reflective practice profile [every/by] [X]. The profile will detail every case where you have been involved in [Y], must be signed by [Z], will set out the nature of the care given and contain their comments on how you gave the care. If the case examiners consider it necessary for the nurse or midwife to submit these regularly, they should set out the frequency with which such reports are required, specify the relevant procedure(s) and name/rank of the person who can comment (for example your line manager, mentor, supervisor, a registered nurse of band 6 or above, Sister Jane Smith etc.).
