Ansley!f12 f/' Captain Rick Stalder RE Annual Summary (2016) DATE: March 23, 2017 As set forth in Clarksville Police Department General Order C-9, this document serves as the annual summary of citizen complaints made against Clarksville Police Department personnel for the year During the year 2016, Eleven (11) incidents resulted in citizen complaints being lodged against department personnel. The 11 incidents involved 24 different department employees. The incidents were classified in the following categories: Racial Bias 0 Traffic Violations 0 Rudeness 1 Criminal The following findings were concluded after investigation of the 11 incidents: All allegations sustained 2 All allegations not sustained 1 All allegations unfounded 4 Administratively closed 1 All allegations exonerated 3 The following is a breakdown of findings by the allegation category: Rudeness : This incident stemmed from a police applicant that wrote the Chief of Police a letter stating that everybody she had talked to was less than helpful and rude to her. t was determined that she had
2 talked to 4 members of the Professional ntegrity Unit in reference to her application and her failure to appear at the physical agility test. t was determined that an error by Tennessee Job Services did confuse the situation but no member of the department had been rude or unhelpful to the complaint. The complaint was unfounded. : n one incident an officer conducted an inappropriate search and made inappropriate statements to a female. The Officer also spent on duty time at the complainant's residence. All allegations were sustained and the officer's employment was terminated. A second incident involved an officer handcuffing then releasing the complainant who had pulled onto department property to confront the officer for allegedly running a stop sign on his police motorcycle. The officer had written the complainant a citation a few days early. t was found that the officer's conduct was inappropriate. The officer received a written reprimand. 1 complaint in this classification was not sustained, 1 was exonerated, 2 were unfounded, and 1 was administratively closed by the Chief of Police because it had no substance or merit. : n one incident a juvenile complainant told her mother that she had been "choke slammed" by an officer who was breaking up a fight. Through the use of in car video/audio and witness interviews it was determined that the officer had not done anything inappropriate or outside of policy. The officer was exonerated. A second complaint was made by a suspect's mother alleging excessive force on four officer's during the arrest of her adult son. The officers were attempting to take the suspect into custody for an active warrant. The suspect continually resisted and even kicked at the officers. The suspect was taken to the ground and handcuffed. When the suspect resisted getting into the police vehicle one officer used his shoulder to force the suspect into the car. Through the use of video of the incident itwas determined that the officer's did not do anything inappropriate or outside of policy. This incident was unfounded. A third incident involved the allegation of excessive force made against 3 officers. The complainant reported that he couldn't remember exactly what happened but he had sustained injuries to his head and it could only be the result of police brutality. The investigation revealed that the suspect ran from an officer during the search of his person. The suspect was tased during the foot pursuit causing him to hit his head on a concrete driveway. The suspect was knocked unconscious from the fall and did sustain injuries to his head. t was determined that the officer's action
3 were within the policy that was in effect at the time of the incident. Audio from the incident was captured by the officer's in car video system. The complaint of excessive force was unfounded. t is my opinion that the complaint reporting and tracking procedures of the Clarksville Police Department are thorough and transparent. s are investigated in a timely manner and the citizens are kept abreast of developments. The department uses these incidents to thoroughly review and reassess our policies and procedures. do not recommend any changes to the procedure at this time.
