2 1.0 SHORT TITLE:- 2 THE ODISHA MINING CORPORATION LTD. RECRUITMENT AND PROMOTION RULES FOR NON-EXECUTIVES, These Rules may be called the Odisha Mining Corporation Limited and Promotion Rules for Non-Executives COMMENCEMENT:- 2.1 These Rules shall come into force with immediate effect. 3.0 SCOPE AND APPLICATION:- 3.1 These Rules shall be applicable in the matters of and Promotion of all Non-Executives to be recruited in accordance with these Rules under the administrative control of Odisha Mining Corporation Ltd. excluding; i.) ii.) iii.) 4.0 DEFINITION:- Non-Executives of Odisha Mining Corporation Ltd. appointed /promoted in accordance with R&P Rules,1976 & R&P Rules for Non-Executives,1997 (These Employees shall be governed in accordance with R&P Rules for Non-Executives,1997). Employees on deputation from the State Govt. or Central Govt. or other Corporations. Employees appointed on contract basis, Non-Executives belonging to non permanent category, DRMP, Adhoc, Trainees, PR Miners, Weekly, Casual or similar category of employees. 4.1 In these Rules, unless the context otherwise requires; i.) Corporation means The Odisha Mining Corporation Limited.. ii.) Board means the Board of ors of the Odisha Mining Corporation Ltd. iii.) or means a or of the Board of ors of the Odisha Mining Corporation Limited. iv.) Chairman means the Chairman of the Odisha Mining Corporation Limited. v.) Managing or means the Managing or of the Odisha Mining Corporation Ltd. vi.) Government means the Govt. of India or Govt. of Odisha with reference to the context. vii.) Appointing Authority means the Managing or/chairman or any authority / Executive of the Corporation to whom the Board of ors has delegated powers to make appointment in respect of specified posts. viii) Non-Executive means the employees below E-1 grade under the administrative control of the Corporation. ix) Competent Authority means the Board or Chairman or Managing or or any other authority to whom such powers are delegated in writing under these Rules. 5.0 CLASSIFICATION:- 5.1 For the purpose of recruitment, promotion and career progression, the Non-Executive posts coming under these Rules are classified into following categories: Categories of Non- SCALE OF PAY GRADE PAY Pay Band Executives Un-Skilled Rs. 5,200-20,200/- Rs. 1800/- 1 Semi-Skilled Rs. 5,200-20,200/- Rs. 1900/- 1 Skilled-2 Rs. 5,200-20,200/- Rs. 2000/- 1 Skilled-1 Rs. 5,200-20,200/- Rs. 2200/- 1 High-Skilled-2 Rs. 5,200-20,200/- Rs. 2800/- 1 High-Skilled-1 Rs. 9,300-34,800/- Rs. 4200/- 2

3 6.0 CLASSIFICATION OF CADRES, SUB-CADRES & POSTS The Non-Executive posts coming under these Rules are grouped into various Service Cadres, Sub-cadres & posts. The Grade-wise posts of these cadres & sub-cadres, mode of filling-up of these posts, requisite qualification, eligibility criteria & experience etc. of these posts are mentioned in Annexure-1 to 14. the the Sub-cadres Details No Cadres 1. Each sub-cadre has a sanctioned strength combining all s coming under that sub-cadre. The posts of a sub-cadre are interchangeable, i.e the sanctioned strength will be notified as a total of the concerned sub-cadre. There shall be no post-specific sanctioned strength within a sub-cadre. The non- Executive of the concerned sub-cadre will be allowed to draw salary of the next higher post of that subcadre after completion of 4 years of service & will be designated accordingly. After this change of salary, there will be no vacancy in the lower posts. However, if the incumbent gets promotion to a post beyond the sub-cadre or leaves the sub-cadre or the Corporation, then the vacancy will be at entry level of that sub-cadre & will be filled up accordingly. This change of salary shall be treated as promotion & shall be effected through a Departmental Promotion Committee. For this promotion, creation of post or existence of vacancy in the higher posts shall not be necessary. While considering such promotion, the General Principles of Promotion prescribed in this rules shall be followed. 7.0 RECRUITMENT:- 7.1, either at entry level posts or higher level posts through Lateral Entry, shall be made by the Competent Appointing Authority based on the recommendation of the Selection Committee. 7.2 ENTRY LEVEL QUALIFICATION FOR RECRUITMENT. In such case, upper age limit may be relaxed upto 10 years. 7.4 The Non-Executives recruited prior to implementation of these Rules and possessing qualification & experience for any post under these Rules, may also attend the direct recruitment process whenever recruitment to any post as per these Rules is undertaken. In such case, upper age limit may be relaxed upto 10 years and after appointment they will be governed under these Rules. 7.5 LATERAL ENTRY Notwithstanding anything contained in these Rules, for reasons to be recorded in writing, the Corporation shall have the right to take up to any post (for which there is no provision for ) whenever it is felt expedient by the Competent Authority and when suitable candidates are not available for promotion. In such cases, the Managing or shall have the power to prescribe qualification, age, experience & other criteria for such direct recruitment keeping in view the specific job requirement. 7.5 (a) (*) Eligible applicants of un-skilled, Semi-skilled & Skilled categories shall be considered for appointment under RA Scheme in the entry level post of appropriate cadres/sub-cadres as per R&P Rules for Non- Executives,2012. However, eligible applicants of High Skilled category shall be considered for appointment in a special post in the scale of pay of Rs. 5,200-20,200/- with G.P of Rs. 2200/-, ( i.e below of the entry level posts of appropriate cadres/sub-cadres) as given in Annexure-16, which is hereby added as a new Annexure to these Rules. These special posts created for the purpose of RA Sceme appointments shall be within the total sanctioned strength of the concerned cadre/sub- cadre as given at Annexure APPOINTING AUTHORITY The Managing or shall be the Appointing Authority in respect of all Non-Executive posts. 7.7 SELECTION COMMITTEE The Managing or shall, from time to time, constitute one or more Selection Committee (s) for the purpose of recruitment to various Non-Executive posts. 7.8 MANNER OF RECRUITMENT & SELECTION: The Managing or will decide the manner of / Selection for filling-up of various posts in Non-Executive Cadres/Grades basing on the recommendation of Selection Committee with necessary modifications, if any While filling-up the vacant posts in Non-Executives Cadres/Grades, the provisions of CNV Act shall be adhered to In the matter of recruitment in the Corporation, domiciles of the state of Odisha shall only be considered for appointment The posts which do not require much of technical knowledge/expertise/ competence/ qualification etc. shall be filled up by local candidates and/ or preference shall be given to the local candidates at the time of recruitment against such posts The number of candidates in the Selection list shall ordinarily be double the number of notified vacancies available in a particular grade. The Selection list shall be valid for a period of one year from the date of its approval by the Managing or.

8 8 7.9 AGE FOR RECRUITMENT: The candidate to be selected for Non-Executive posts should not be below 18 years & above 32 years of age on the date the vacancy is notified or advertised or otherwise specifically provided elsewhere in these Rules. The upper age limit can be relaxed incase of SC/ST/SEBC candidates as per the norms of State Govt. The upper age limit for Departmental candidates having requisite qualification may be relaxed upto 10 years (as provided in Para -7.3 & 7.4 above.) The Managing or shall have the power to prescribe lower & upper age limit for lateral entry as provided in Para-7.5 above Documents required at the time of joining:- At the time of joining in Corporation Service, a selected candidate shall produce the following documents in the prescribed format. Bio-data form duly filled-in alongwith attested copies of relevant Certificates / Testimonials. Medical Fitness Certificate from any Medical Officer of the State Govt. or Central Govt. or OMC. Property Statement (movable & immovable). Affidavit declaring that he / she is not involved in any Criminal misconduct. Declaration that he/she does not have more than one spouse living PROBATION: Candidates appointed through either at entry level or higher levels through lateral entry shall be kept under probation for a period of one year. This period will be counted towards normal increment, leave & seniority. On successful completion of probation, the candidates shall be confirmed in. The probation period can be extended for a further period of one year, if necessary. During the period of probation, their services can be terminated by the Appointing Authority with one month s Notice. 8. GENERAL PRINCIPLES OF PROMOTION. Promotion from one post to next higher post in Non-Executive cadres and sub-cadres shall be considered by the Departmental Promotion Committee subject to fulfilling requisite experience & qualification criteria as has been indicated in Annexure-1 to 14.. Promotion in various Non-Executive cadres and sub-cadres shall be made on the basis of seniority-cumfitness. While considering promotion, the DPC shall assess the performance of the Employee for at least a period of 03 years falling within the preceding 05 years. At the time of consideration of promotion, Internal Vigilance and Departmental Proceeding Clearance of eligible candidates shall be obtained. Departmental Promotion Committee The Managing or shall, from time to time, constitute Departmental Promotion Committee consisting of Senior Executives of OMC for considering promotion of non-executives. 8.6 DEBARMENT/DISQUALIFICATION: a) When a Non-Executive has been charge sheeted in a Vigilance Case or a charge sheet has been issued by any Court in a Criminal Case or cognizance has been taken by the Court in a Criminal Case or charges have been framed & communicated to the Non-Executive concerned in a Departmental Proceedings or placed under Suspension, the DPC shall consider his/her case but record its recommendation separately which shall be placed in a sealed cover. b) If the Non-Executive is completely exonerated from the charges, he/she will be promoted retrospectively from the due date, if recommended by the DPC and will also be entitled to arrears of salaries and allowances. Where the Non-Executive is not completely exonerated, the promotion, even if recommended by the DPC, shall not be given effect to and his/her case for promotion will be considered by the next DPC in normal course and having regard to the penalty imposed on him/her.

9 8.7 APPEALS: 9 A Non- Executive, who is aggrieved by an order of promotion, may appeal to the Managing or through proper channel within a month from the date of issue of the promotion order. However, appeal received after this period may be entertained upto a further period of two months subject to condonation of delay by the Managing or. 9.0 RESERVATION FOR SCHEDULED CASTES/SCHEDULED TRIBES/ SEBC/ EX-SERVICEMEN/PERSONS WITH DISABILITY & SPORTS PERSONS: All s and Promotions shall be subject to the provisions of ORV Act and Rules as well as subsequent amendments/guidelines made there under by Govt. from time to time. Reservation for Scheduled Castes, Scheduled Tribes, SEBC, Ex-Servicemen, Persons with Disability & Sports Persons shall be made as per Govt. instructions /guidelines GRADATION LIST Gradation list of Non-Executives (Seniority list) shall be suitably maintained for each cadre. Inter-se-seniority will be determined according to the comparative merit position in the panel, both in case of initial appointment as well as promotion. In case of doubts about the seniority of a Non- Executive or inter-se -seniority of two or more Non-Executives, the decision of the Managing or shall be final RETIREMENT: 11.1 Retirement on superannuation: (*) All Non-Executives in Class-III & Class-IV grades of the Corporation shall retire on superannuation on completion of 60 years of age. (*) The age of retirement on superannuation of Class-III employees enhanced from 58 yrs to 60 yrs as per the Board of ors in their 406 th meeting held on & 407 th meeting held on communicated vide Office Order dtd Pre-mature Retirement A Non-Executive may retire voluntarily with approval of Competent Authority under any Voluntary Retirement Scheme of the Corporation in vogue subject to the condition that the concerned Non- Executive is not placed under suspension nor any Vigilance/Criminal/ Departmental Inquiry is pending or being contemplated against him/her A Non-Executive may retire at any time after completing 30 years of service including probation or attaining 50 years of age by giving a notice in writing to the Competent Authority at least 3 months before the date on which he/she wishes to retire. However, the Competent Authority may allow the Non-Executive to submit the said notice before a shorter period. The Competent Authority can withhold permission to a Non-Executive who seeks to retire under this Rule if he/she is under Suspension or if any Vigilance/ Criminal /Departmental Inquiry is pending against him/her The Competent Authority may also require any Non-Executive to retire from the Service on grounds of inefficiency, ineffectiveness and lack of integrity at any time after he/she has completed 30 years of service including probation or he/she attends 50 years of age in accordance with procedures to be specifically laid down for this purpose A Non-Executive can be retired compulsorily from Corporation service by the Competent Authority if the concerned Non-Executive is found physically / mentally unfit by a Medical Board duly constituted for this purpose A Non-Executive can be compulsorily retired from the Corporation service if he/she is found guilty in a Departmental Proceedings in accordance with provisions of OMC Service (Classification, Control & Appeal) Rules INTERPRETATION: On all questions of interpretation, the decision of the Managing or shall be final. He will have the power to clarify these Rules by administrative instruction subject to stipulation that such clarification shall be brought to the notice of the Board REPEALS & SAVINGS: 13.1 The OMC & Promotion Rules for Non-Executives-1997 shall remain in force for those Employees appointed & promoted under the said Rules.

10 Notwithstanding anything contained in these Rules, any guidelines/ directives / instructions issued from time to time by the State Government to the Public Sector Undertakings in general or to the Corporation, in particular, in the matter of and Promotion of Non-Executives, shall be adhered to The Board reserves the right to amend, modify, alter, cancel, withdraw, suspend or keep in abeyance any or all the provisions contained in these Rules at anytime as deemed necessary for the larger interest of the Corporation
