4 WETLANDS BOARD VIRGINIA BEACH, VIRGINIA PUBLIC HEARING MINUTES The November 2013 PUBLIC HEARING for the Virginia Beach WETLANDS BOARD was called to order by the Chair, Patrick Shuler, in the City Council Chamber, Virginia Beach, Virginia, at 10:00AM, November 18, Chairman Shuler welcomed all present, stated the responsible charge of the Wetlands Board, as delineated in the Virginia State Code, and announced appeals are available through the Virginia Marine Resources Commission within ten (10) days of this Board's decision. Approval expires one (1) year from the date it is granted. A permit is normally extended, but not an approval. Applicants are advised to obtain their permit within no more than thirty (30) days of their Hearing. Extensions must be requested before the expiration date. The Chair acknowledged each applicant and/or agent for the applicant and administered the oath of truth and honor. The slide presentation for each application site was rendered by Mr.McKenna. Mr. Marks read the Planning Department comments. 4

VB VW PROJECT: PROJECT LOCATION: SPEAKER: Construct riprap, fill and plant wetlands vegetation to create a living shoreline involving wetlands 1433 North Bay Shore Drive contiguous to Rainey s Gut Jason Barney, Barney Environmental Agent for the Applicant Upon motion by Mr. Jobe, seconded by Mrs. Brown, the application of RAYMOND BREEDEN was APPROVED, AS MODIFIED, subject to: 1. the Wetlands Board commends the applicant for attempting to restore the vegetated wetland resources due to the project s potential for moderate impact to marine resources 2. the retaining structure (coir logs or marsh sill revetment) be installed along the eastern terminus of the backfilled portion of the project 3. revising the plans and resubmitting to include one (1) or possibly two (2) cross sections in that area 4. the planting units installed 12 inches (12 ) on center VOTE: 7-0 Members Voting Aye: Nils S. SNIDER was APPROVED, AS MODIFIED, subject to: 1. the limits of construction identified on the Site Plan.
